1 GOVERNMENT OF NATIONAL CAPITAL TERRITORY OF DELHI DIRECTORATE OF EDUCATION (PRIVATE SCHOOL BRANCH) OLD SECRETARIATE, DELHI-54 No F/DE (15)/PSI3/4607/13/2015/,RS 5 6 5 LI\ Dated: c 0 R 1) E R That I lon'ble High Court of Delhi vide judgment dated 24.11.2014 in WPC No 4607 of 2013 titled Justice for All Vs Govt. of NCT of Delhi and Anr, directed that "Though we are of the view that the orders in the earlier writ petition i.e Social Jurist (supra) were with respect to all schools without carving out any distinction of primary, middle or secondary schools but to avoid any ambiguity, we direct the Directorate of Education, GNCTD to on yearly basis ensure that all schools including nursery schools which have seen allotted land on the condition of admitting 25% of the students in schools established thereon from weaker sections of the society and on _free ship basis, abide thereby and iffinds any such schools to he in breach, immediate send intimation they eolto the DDA. We also direct the DDA to immediately on receipt of such intimation, imitate the process of cancellation of the leases." That as per general terms and conditions of allotment of land, laid down by the Government Land owning Agency/Delhi Development Authority while allotting the land to the societies for schools, it is mandatory for the Nursery Schools to give 25% admissions of the total strength of the classes to the children belonging to Economically Weaker Sections (EWS) of the Society and provide free ship to them. That in order to conduct the admissions of EWS category children smoothly in such schools, the basic instructions/guidelines for the academic year 2018-19 are as under:- a. Every Nursery School shall notify the total number of its seats of the school viz-a-viz number of seats reserved for Economically Weaker Sections of the society on the Notice Board/Website of the school. The notice board shall be placed at the prominent place in the school which can easily be accessed by the general public. b. No registration fee or any cost of prospectus shall be charged from the parents/children applying against EWS seats. The school shall provide registration/admission form to the EWS parents/guardians free of cost. c. The school shall acknowledge the application for admission against EWS seats through a receipt and shall assign each application a registration number. d. In case, the application of any child is found not in order and is thus rejected, the reason/s for its rejection shall be recorded and communicated to the parents. 2 c. Income Certificate issued by a Revenue Officer not below the rank of Tehsildar or BPI_, Ration Card/AAY Ration Card/Antodaya Ration Card/Food Security Card issued by Food Supplies & Consumer Affairs Department. Govt. of 'ACT of Delhi shall he considered as a proof' for claiming the benefit of Economically Weaker Sections by the school. (Child belonging to Economically Weaker Section means that child whose parents total annual income is less than one lakh rupees from all sources). The genuineness of EWS certificate issued by Revenue Department may he verified by the school authorities online at <www.esla.delhi.gov.in > Revenue Magistrates of Revenue Department and Ration Cards mentioned above may he verified from respective offices of Food Supplies & Consumer Affairs Department, GNCT of Delhi. before extending the benefits to the applicants on the basis of certificate produced. f. The distance criteria adopted for admission of EWS/DG candidates at Entry Level Classes under the provisions of Right to Education Act, 09 shall applicable to the admission of I:WS in Nursery School also and preference of admission shall he given in order of distance of residence from the school i.c first 0-1 km radius, second 1 kms. third 3-6 kms and beyond 6 kms in case of vacancies still exist. g. If the number of applications exceeds the number of seats available in the EWS category, the admission shall he decided through 'Draw of Lots' which shall he conducted in the presence of parents. The school shall inform all the parents about the date of conducting of draw in such cases. h. These institutions shall finalize the list of selected EWS children on the date of' Lirt\v of lots and get it signed by the least five parents present during the draw of lots. The school shall remain all the records properly for future references and the admission process shall be completed immediately after the draws if any. i. The seats meant for EWS category shall he filled with children belonging to the said category only. j. No screening procedure i.e. interview, counseling, written or oral test of any type of parents or child shall be conducted for the purpose of those admissions. k. The Head of these institutions shall be responsible for compliance of these orders and verification of' aforesaid documents related to EWS admissions. Therefore, Chairpersons/Presidents of all the societies, having allotted land by the Government Agencies for Nursery School and running Nursery (pre-school)/Pre-primary only, are hereby reiterated our earlier instructions dated 27.08.2015 & 01.04.2016 to ensure that the said institutions shall admit at least 25% children of the total strength of the Nursery /KG class belonging to Economically Weaker Sections (EWS) of society, wherever any fresh admissions r\, 3 ire made, and grant free-ship to them following the above instructions/guidelines strictly. The classes running beyond pre-primary classes are not permissible and if found so the action u/s 18(5) of RTE shall be initiated. Further, Chairpersons/Presidents of the societies are directed to submit the compliance report for admission of EWS category for the last three years in the enclosed proforma after the admission process is over .i.e up to first week of April 2018. The list of 176 Societies as provided by DDA with complete details to whom land has been allotted by DDA for running Nursery school is enclosed. These schools shall ensure admission of 25% EWS students in their schools. I lowever the said list of 176 is only indicative. all the societies which have been allotted land by DDA to run nursery schools shall ensure the compliance of 25% EWS admission in the schools run by them. Non-compliance of the orders shall be viewed seriously and the same may he brought to the notice of DDAll..and Owing Agencies for cancellation of lease deed of the land of the society/trust.
