House File 575 - Introduced HOUSE FILE 575 BY SORENSEN A BILL FOR 1 An Act providing for training and other procedures relating 2 to student seizures for public and accredited nonpublic 3 schools. 4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 2665YH (4) 88 je/jh H.F. 575 1 Section 1. NEW SECTION. 280.16B Student seizure training 2 and response —— administration of medication. 3 1. For purposes of this section: 4 a. “Licensed health care professional” means the same as 5 provided in section 280.16. 6 b. “Seizure action plan” means a written, individualized 7 health plan designed to acknowledge and prepare for the health 8 care needs of a student diagnosed with a seizure disorder. 9 c. “Seizure medication” means medication approved by the 10 United States food and drug administration or any successor 11 agency and prescribed to a student by a licensed health care 12 professional to treat seizure disorder symptoms, including 13 medication to be administered on an emergency basis. 14 2. The board of directors of a school district and the 15 authorities in charge of an accredited nonpublic school shall 16 have at least one employee at each attendance center who has 17 received instruction on administering or assisting with the 18 self-administration of seizure medication. 19 3. Instruction pursuant to subsection 2 shall include 20 instruction on administering seizure medication and recognizing 21 the signs and symptoms of seizures and the appropriate steps 22 to be taken to respond to such signs and symptoms. Such 23 instruction shall be fully consistent with training programs 24 developed by the epilepsy foundation of America or any 25 successor organization. 26 4. The parent or guardian of a student prescribed seizure 27 medication shall do all of the following to enable a school 28 employee to administer seizure medication to or assist with the 29 self-administration of seizure medication by the student: 30 a. Provides the school district or school each school 31 year with a written authorization in a form prescribed by the 32 school district or school to administer the medication at an 33 attendance center or other school function. 34 b. Provides the school district or school each school 35 year with a written statement from a licensed health care LSB 2665YH (4) 88 -1- je/jh 1/5 H.F. 575 1 professional that contains all of the following information: 2 (1) The student’s name. 3 (2) The name and purpose of the medication. 4 (3) The prescribed dosage of the medication. 5 (4) The route of administration of the medication. 6 (5) The frequency that the medication may be administered. 7 (6) The circumstances under which the medication may be 8 administered. 9 c. Provides the seizure medication to the school district or 10 school in its unopened, sealed package with the label affixed 11 by the dispensing pharmacy intact and replaces the seizure 12 medication upon depletion or expiration. 13 d. Collaborates with school district or school personnel to 14 create a seizure action plan for the student. 15 5. The school district or school shall keep the written 16 statements and seizure action plan pursuant to subsection 17 4, paragraphs “a” and “b”, on file. The school district or 18 school shall distribute the seizure action plan to any school 19 personnel or volunteers responsible for the supervision or care 20 of the student. 21 6. Every school district or school shall provide an 22 age-appropriate seizure education program to all students 23 on seizures and seizure disorders. The program shall be 24 consistent with guidelines published by the epilepsy foundation 25 of America or any successor organization. 26 7. The board of directors of a school district and the 27 authorities in charge of an accredited nonpublic school shall 28 require a minimum of one hour of self-study review of training 29 materials on recognition of and appropriate response to seizure 30 disorders by each principal, guidance counselor, and teacher 31 each school year. 32 8. The department of education, in consultation with the 33 board of medicine, the board of nursing, and the board of 34 physician assistants, shall adopt rules pursuant to chapter 35 17A to administer this section, including but not limited to LSB 2665YH (4) 88 -2- je/jh 2/5 H.F. 575 1 rules establishing standards for the development and content of 2 seizure action plans, content for instruction required pursuant 3 to subsection 2, and content for self-study review pursuant to 4 subsection 7. 5 Sec. 2. STATE MANDATE FUNDING SPECIFIED. In accordance 6 with section 25B.2, subsection 3, the state cost of requiring 7 compliance with any state mandate included in this Act shall 8 be paid by a school district from state school foundation aid 9 received by the school district under section 257.16. This 10 specification of the payment of the state cost shall be deemed 11 to meet all of the state funding-related requirements of 12 section 25B.2, subsection 3, and no additional state funding 13 shall be necessary for the full implementation of this Act 14 by and enforcement of this Act against all affected school 15 districts. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill requires school boards and authorities in charge 20 of accredited nonpublic schools to have at least one employee 21 at each attendance center who has received instruction on 22 administering or assisting with the self-administration of 23 seizure medication. 24 Such instruction shall include instruction on administering 25 seizure medication and recognizing the signs and symptoms of 26 seizures and the appropriate steps to be taken to respond to 27 such signs and symptoms and shall be fully consistent with 28 training programs developed by the epilepsy foundation of 29 America or any successor organization. 30 The bill defines “seizure medication” as medication approved 31 by the United States food and drug administration or any 32 successor agency and prescribed to a student by a licensed 33 health care professional to treat seizure disorder symptoms, 34 including medication to be administered on an emergency basis. 35 The bill requires the parent or guardian of a student LSB 2665YH (4) 88 -3- je/jh 3/5 H.F. 575 1 prescribed seizure medication to take actions specified in 2 the bill to enable a school employee to administer seizure 3 medication to or assist with the self-administration of seizure 4 medication by the student. 5 The parent or guardian must provide the school district 6 or school each school year with a written authorization to 7 administer the medication at an attendance center or other 8 school function. The parent or guardian must provide the 9 school district or school each school year with a written 10 statement from a licensed health care professional that 11 contains specified information about the student’s seizure 12 medication. The parent or guardian must provide the seizure 13 medication to the school district or school in its unopened, 14 sealed package with the label affixed by the dispensing 15 pharmacy intact and replace the seizure medication upon 16 depletion or expiration. The parent or guardian must 17 collaborate with school district or school personnel to create 18 a seizure action plan for the student. The school 22 district or school is required to distribute the seizure action 23 plan to any school personnel or volunteers responsible for the 24 supervision or care of the student. 25 The bill requires every school district and accredited 26 nonpublic school to provide an age-appropriate seizure 27 education program to all students on seizures and seizure 28 disorders. The program shall be consistent with guidelines 29 published by the epilepsy foundation of America or any 30 successor organization. 31 The bill requires school boards and authorities in charge 32 of accredited nonpublic schools to require a minimum of one 33 hour of self-study review of training materials on recognition 34 of and appropriate response to seizure disorders by each 35 principal, guidance counselor, and teacher each school year. LSB 2665YH (4) 88 -4- je/jh 4/5 H.F. 575 1 The bill requires the department of education, in 2 consultation with the board of medicine, the board of nursing, 3 and the board of physician assistants, to adopt rules to 4 administer the bill. 5 The bill may include a state mandate as defined in Code 6 section 25B.3. The bill requires that the state cost of 7 any state mandate included in the bill be paid by a school 8 district from state school foundation aid received by the 9 school district under Code section 257.16. The specification 10 is deemed to constitute state compliance with any state mandate 11 funding-related requirements of Code section 25B.2. The 12 inclusion of this specification is intended to reinstate the 13 requirement of political subdivisions to comply with any state 14 mandates included in the bill. LSB 2665YH (4) 88 -5- je/jh 5/5.
