I. INTRODUCTION

A. Background 1. Government of Madhya Pradesh (GOMP) with a sector project loan funding from Asian Development Bank (ADB) has proposed to implement Madhya Pradesh Urban Services Improvement Project (MPUSIP), herein after referred as ‘the Project’. Madhya Pradesh Urban Development Company Limited (MPUDC) shall be the Implementing Agency and the State Urban Development and Environment Department (UDED) shall be the executing agency for the Project. A project management unit (PMU) created under MPUDC is implementing MPUSIP.

2. The Resettlement Framework for MPUSIP outlines the objectives, policy principles and procedures for land acquisition, if any, compensation and other assistance measures for Displaced Persons1 /Affected Persons, if any. This framework reflects the borrower’s law on the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013, state government policies, ADB’s Safeguard Policy Statement (SPS), 2009 and other social safeguard guidelines. A detailed description of compensation measures and assistance is provided in the entitlement matrix.

3. An entitlement matrix, consistent with the existing norms and guidelines of the country and the state government, and ADB’s Safeguard Policy Statement has been prepared to cover losses identified in this Project. The matrix recognizes that the lack of title/customary rights recognized under law will not be a bar to entitlement and has special provisions for non-titled persons. The eligibility for compensation will be determined through a cut-off date. People moving into the sub- project area after the cut-off date will not be entitled to compensation or other assistance.

4. Madhya Pradesh Urban Services Improvement Program (MPUSIP) proposed to be funded by Asian Development Bank (ADB) envisages provision of sustainable water services to 128 towns in the State out of which some of the towns will also be provided with sewerage management services. The State Urban Development and Environment Department (UDED) is the Executing Agency while the Madhya Pradesh Urban Development Company (MPUDC) Limited is the implementing agency for the Project.

B. Project Description 5. Selected towns under MPUSIP are further divided into two phases. As per revised procurement plan, MPUSIP’s physical components include (a) improvements to water supply scheme in 69 subproject towns, and (b) sewage collection and treatment services proposed in four (4) identified towns namely Saikheda, Sanawad, Anjad and Barwaha under Phase 1 while in Phase 2 – water supply scheme in 59 subproject towns and sewage collection and treatment services proposed in eight towns namely , Dhamnod, Mandsaur, Nagda, Jabalpur (part- II), Maihar, Khajuraho and Rajnagar. The project also includes an institutional strengthening component and a project management and administrative support component. The objective of the proposed improvements in subproject town is to achieve safe and sustainable water services both in terms of services to customers, cost recovery and conservation of precious water resources. The project proposals envisage providing 100% coverage of population with

• Supplying pure drinking water. • Promote sustainable measures to increase potable water supply to the population. • Water supply through future sustainable source developments. • Water supply through improvements of safe yield of existing water sources. • Water supply through improvements to water treatment works. • Drinking water supply contributes towards a sustainable regional development. • To improve the current state of the water cycle of subproject through improvements in the separate components of the water supply system in investment program

C. Scope of the Report 7. This draft land acquisition and involuntary resettlement due diligence report (DDR) is prepared for the proposed water supply augmentation scheme for the town Pachore located in . This subproject town comes under Phase 2. This subproject water supply scheme (WSS) for town Pachore includes following (i) construction of new weir; (ii) utilization of existing intake well cum pump house at Newaj River; (iii) laying of raw water rising main of length 450m from intake well to WTP; (iv) construction of water treatment plant (WTP) of capacity 7.5 MLD; (v) utilization of existing three overhead tanks (OHTs) and proposal of two number of OHTs of capacity 800 KL and 200 KL; (vi) laying of clear water feeder mains of length 5210 m; (vii) distribution lines of 38558 m. The proposed subproject will provide metered water supply for domestic, institutional and commercial users including metered connections to each household in the town. All municipal wards of the town will be covered under the project. The total population of subproject town Pachore as per census 2011 is 27396 and estimated design population for the year 2048 is 56,600.

8. A due diligence process was conducted to examine the land acquisition and resettlement issues in detail, in line with ADB SPS 2009. This report describes the findings and provides copies of relevant documents, resolutions, minutes of meetings and photographs. This land acquisition

2 and resettlement due diligence report needs to be read along with the Resettlement Framework prepared for MPUSIP.

9. Involuntary resettlement impacts will be reconfirmed after completion of detailed design and detailed measurement surveys (DMS) which will be jointly conducted by Design Build and Operate (DBO) Contractor with PIU and project consultants before initiation of civil works during implementation.2 Executing Agency will be responsible for submission of the updated social safeguard document to ADB for No Objection. The final Involuntary Resettlement report will be reviewed and disclosed on website of urban local body (ULB), Implementing Agency and ADB. The Implementing Agency is responsible to hand over the project land/site to the contractor which should be free from all encumbrances.

II. POLICY FRAMEWORK, AND ENTITLEMENTS

10. The Resettlement Framework prepared for MPUSIP sets out the objectives, principles, eligibility criteria and entitlements for APs, based on ADB SPS, 2009 and LARR 2013 as well as national and state laws for protection of street vendors. Until recently, all activities related to rehabilitation and resettlement in the State of MP had been based on the Madhya Pradesh Resettlement and Rehabilitation Policy, 2002 (MPRR) and National Rehabilitation and Resettlement Policy, 2007 (NRRP-2007). Government of Madhya Pradesh (GoMP) adopted LARR 2013 on 3rd October 2014 with some specifications for operationalizing its implementation in the state. Details of policies are in the Resettlement Framework for MPUSIP.

III. SUBPROJECT DESCRIPTION

A. Description about subproject town

11. Pachore is a Nagar Parishad in district of Rajgarh, Madhya Pradesh. It is located on 23.7135° N, 76.7308° E and 106 kms away from of Bhopal in the central part of the state of Madhya Pradesh. This subproject town is divided into 15 wards. Subproject town Pachore has population of 27396 of which 14077 are males while 13319 are females as per Census of India 2011. Population of children with age of 0-6 is 4029 which is 14.71% of total population of Pachore Nagar Parishad. In Pachore Nagar Parishad, Female sex ratio is 946 against state average of 931. Child sex ratio in Pachore is around 931 compared to Madhya Pradesh state average of 918. Literacy rate of Pachore town is 76.00% which is higher than the state average of 69.32%. In Pachore, male literacy is around 84.32% while female literacy rate is 67.22s%.

B. Existing Water Supply

12. Presently water supply system in Pachore is based on both surface water source and ground water source. Weir having length of 150m and 3m height was constructed on Newaj River. Intake well cum pump house for existing water supply scheme for town Pachore is already constructed on Newaj River which is located on the upstream of river and about 470m away from existing weir. It is located on 23° 43’ 13.28°N, and 76° 43’ 18.74 E. Water is being pumped to

3 existing water treatment plant (WTP) (3.50 MLD) which is located around 450m away from intake location. The existing WTP of Nagar Parishad Pachore is not in good condition and is not proposed to be used in the proposed system. Some part of the town is dependent on 20 tube wells and 25 hand pumps. Two numbers of OHTs having capacity 450KL each are available in the town, while a third OHT having capacity 450 KL is constructed but not yet handed over to Nagar Parishad Pachore. Water supply distribution system of 15km of GI and ACP was laid down in year 2000. Presently, only 52LPCD water is being supplied to the town which is very less as per the norms of CPHEEO manual. The water supply distribution system is laid in parts and in a haphazard manner and causes water supply losses at the rate more than 45%. Only about 60% population of town is covered by water supply and therefore needs water supply augmentation and improvement scheme to be executed on priority. As per the Service Level Benchmarking (2008) of Government of India (GoI), it is mandatory to supply 135LPCD of treated (quality) water to 100% population of the town.

13. Present water supply arrangements are not adequate and ground water source level is depleting day by day, therefore water scarcity conditions are arising. Water supply losses during transmission are also very high that leads to high energy consumption and loss to ULB.

14. Details of present water supply infrastructure available in the Pachore town are mentioned in the below table:

C. Components of Proposed Water Supply Scheme 15. The primary objectives of the proposed water supply subproject include:

(i) service improvements to achieve safe and sustainable water services both in terms of services to residents and cost recovery (ii) conservation of precious water resources. The project envisages providing 100 percent coverage of population with continuous, pressurized and safe drinking water services and achieving progressively increase cost recovery by expanding the coverage and increasing operating efficiency. (iii) per capita supply at135 LPCD has been considered.

16. Proposed components: Presently, water supply sources are tube wells and surface water. Tube wells become dry in summer season and are insufficient to cater to the demand at the rate of 135lpcd for present and projected population of Pachore Nagar Parishad. Hence, these are not dependable sources, nor are the people of the town getting treated water as per CPHEEO minimum norms of 70lpcd. Hence, there is a need for new construction of weir at Newaj river, rehabilitation of the existing structure of intake well cum pump house at Newaj river, raw water pumping main, clear water feeder main, construction of new WTP and two OHTs, providing new distribution system with metering, District Metering Area (DMA), Supervisory Controller and Data Acquisition (SCADA) system and house service connections etc. Proposed components are as follows:

(i) Water Source: River Newaj is proposed for WSS town Pachore. (ii) Weir: A new weir is proposed with length of150m long and height 4.5m (iii) Intake Well cum Pump-house: Existing (Dia 5.5 m, Height – 12.90 m) (iv) Raw water pumping main: Ductile Iron K-9 Pipe dia-350mm and length-450m (v) Water Treatment Plant: A new WTP (7.5 MLD) with Rapid Sand Filter Type is proposed (vi) Clear Water Rising Main/Feeder Main: (i) 50M with dia 150mm + (ii) 5160 M with

IV. FIELD WORK AND PUBLIC CONSULTATION

18. This involuntary resettlement document is prepared in consultation with stakeholders including local residents, beneficiaries/consumer, and Urban Local Body (ULB)

7 officials/representatives. Informal consultations and focus group discussions (FGDs) were conducted to seek feedback from local people and other important stakeholders on the proposed development interventions, perceived impacts and mitigation measures and their participation.

A. Outline of Fieldwork

19. During the visit, a field inspection of proposed subproject facility locations and pipeline alignments that had been identified was undertaken. These included field visit to the identified sites and alignments and stakeholder consultations. The entire land requirement for the proposed subproject component will be fulfilled by government lands. The details of selected lands for subproject components are given in the Appendix 1 and Appendix 4.

B. Field work Report

20. Meetings were held with the concerned ULB Officials, Public Representatives, Stakeholder and prominent resident of both subproject town to collect data / information for proposed subproject during various discussions/meetings (refer to Appendix 2).

• During the meeting and discussion, information on the existing status of water supply in the town and the requirement of the stakeholders, was gathered. The gaps were arrived at in consultation with the stakeholders and are well documented. • With the ULB authorities, all the possible water supply sources and identified locations for all other the components of water supply scheme. • All the options of possible water supply source, its dependability, quality assurance of source available and the distance from the town, were studied and discussed with the stakeholders. • Water from the selected source was collected and tested from the Laboratory of Bhopal Municipal Corporation Laboratory, Bhopal. Also test report is obtained for designing purpose. • Water security is ensured in consultation with the concerned department WRD, such that best-chosen water source is made available to ULB for the purpose of water supply scheme. • Revenue authorities were contacted to ensure that the land required for facilities in the town is secured and in the ownership of ULB or Revenue Department, Government of Madhya Pradesh for WTP and Service Reservoirs.

C. Public Consultation

21. Extensive consultations were undertaken with key stakeholders in line with ADB's requirements pertaining to environment and social considerations. Focus group discussion (FGD) conducted at nearby of proposed locations of Intake Well, WTP and OHT etc. The outcome of focused group discussion with stakeholders in the town and the line departments (persons involved in Infrastructure like water, waste water and allied services - Engineers and workers of Local Body, water resource department (WRD), public works department (PWD), National Highways Authority of India (NHAI), district administration and others. Thus, representatively various problems ahead may encounter to public during pre and post execution of work considers and after discussion with concern authorities' necessary mitigation measures are well considered (refer to Appendix 2). Tools used for consultation were stakeholder meetings. The following were the outcomes of consultations:

(i) The consultations helped to identify the felt needs /concerns and apprehensions of the communities related to the project and priorities of concerned stakeholders. (ii) Consultations revealed that people are aware of the problems of the existing water supply system in the town and are willing to cooperate in the proposed project. (iii) Consultations with the key stakeholders revealed that existing water supply system is in a pathetic condition, so improvement is required and local inhabitant will definitely and fully accept the project. (iv) The ULB Officials had apprehensions regarding the project whether it will be a financial burden to the Nagar Parishad. The Nagar Parishad does not have capacity or resource to be party in sharing the loan repayment.

22. The major stakeholders targeted during consultations are:

(i) The municipality, its elected members and staff who will be required to oversee the construction of the distribution networks and WTP as well as be directly responsible for the maintenance of the installations. (ii) Local residents who will take initiative to connect their houses with the water distribution line. (iii) Local business people and traders. (iv) The opinion makers, who are intimately acquainted with and well regarded by the community. They need to be enlisted in spreading environmental awareness within the community as well as in conveying the benefits of the project.

V. LAND AVAILABILITY AND INVOLUNTARY RESETTLEMENT IMPACTS

23. No land acquisition or resettlement impacts are anticipated for any of the proposed civil works for Pachore water supply subproject as utilization of existing intake well, construction of new weir, WTP, raw water feeder mains, clear water feeder mains and overhead tanks (2 in numbers) are proposed on government lands (refer to Appendix 1 and 4).

24. For Pachore town, raw water abstraction will be done from Newaj river then treated and supplied to the town. The new weir is proposed on Newaj river. Land for proposed weir and existing intake well belongs to water resource department (WRD). Land is without any settlement/ squatter /cultivation. Low lying area is reported on the upstream of river Newaj on right hand side (RHS) of the river flow. Area namely Kumhar Mohalla, Bhatiara Moholla and Mandikini Nagar under ward number 12 near old highway road is reported low lying. These habitations are reported sufficiently away from the riverbed area. Still, to avoid the impact on these low lying areas, a retaining wall with length of 1200 m is proposed within the river bed on the RHS of the river.

25. A new WTP (7.5 MLD) is proposed within the campus of existing WTP. Vacant land is available in the campus. This identified land is located at Balbatpura under ward number 3. The identified land for WTP has been in the possession of Nagar Parishad Pachore from many years and was not acquired in anticipation of ADB funded MPUSIP. As per the land records, the land title mentions land under revenue department. A land transfer from revenue department to nagar parishad is required. This land is vacant land free from any encroachment/any type of cultivation or not used for other purposes, therefore, no involuntary resettlement impact is anticipated.

26. The proposed raw water pumping main of 450m long 350mm dia. DI K9 from existing intake well to proposed WTP (located within the campus of existing WTP) will be replaced and laid within the existing alignment. The existing alignment passes through private land (kutcha road within the agricultural land) and consent was obtained from the landowner while laying it. Informal discussion with the landowner indicates that he is willing to give consent for the rehabilitation work. However, a fresh written consent will be obtained before the start of civil works.

27. Two numbers of new OHTs of capacity 800 KL and 200 KL are proposed. Land identified for OHT 800 KL is in ward no. 15. (back side of food-grain market locally called Galla Mandi with Khasra no. 1333/1) while land identified for OHT 200 KL is in ward number 1 (Bilapura with Khasra number 331/1). The lands are vacant and belongs to revenue department, GoMP. Proposed identified site/locations are reported vacant and free from any encroachment/any type of cultivation or not used for other purposes, therefore, no involuntary resettlement impact is anticipated. Existing three OHTs are also considered under proposed WSS town Pachore and there are no resettlement impacts associated with existing sites.

28. New distribution network includes laying of 38558m pipeline. These pipelines are proposed to be laid underground within RoW of the existing public roads belonging to Pachore- Nagar Parishad. Proposed pipe diameters are between 75mm to 315mm depending on the width of the roads. Distribution lines are proposed on one sides/ centre of the road depending upon availability of space where road widths are small.

29. Pipe laying activity on roads in the most congested market areas and densely built-up areas has been carefully planned to avoid Involuntary Resettlement impacts including temporary economic impacts to hawkers, shops and businesses.

30. Measures will be taken to minimize excavation, disturbance to pedestrians and traffic and avoid income loss to businesses, while minimizing road reconstruction costs. Temporary impacts to traffic/access to shops and residences due to digging of pits for pipe laying are possible during construction; however, these will be mitigated by ensuring access to properties through provision of pedestrian planks, provision of adequate signage, and careful traffic management. Mobile hawkers will be assisted to move to places vacant nearby or to other side of the road, to ensure their earnings are not affected. No income loss is anticipated.

31. House Service connections: Provide house service connection tapping from a distribution main/sub-main including one tapping saddles, elbows, service pipe from tapping point to the chamber near property boundary or inside the property boundary. The work shall include excavation, road restoration, etc. Under the proposed subproject, about 6366 connections with water meter are proposed.

32. Civil works in the project include linear excavation for laying pipes within the roads, placing pipes in the trench and refilling with the excavated soil. The trenches will be of 0.4 m – 0.7 m wide and 0.8 to 1 m depth. Subsequent to completion of works, road reinstatement will be undertaken by the contractor as part of the civil works. Proposed distribution pipe-laying on roads in most part of the town will not have any permanent or temporary Involuntary Resettlement impact.

33. Laying of transmission mains and distribution network pipelines in the project area has been carefully planned to minimize disturbance to pedestrians and traffic and avoid income loss to businesses. Potential temporary impacts to traffic/access to shops and residences due to digging and excavation for pipe laying are possible during construction; however, these will be mitigated by ensuring access to properties through provision of pedestrian planks, provision of adequate signage, and careful traffic management.

34. Proposed component wise involuntary resettlement impact is depicted below in the table.

35. Mitigation: The sites or locations for the subproject components have been selected carefully to avoid and minimize involuntary resettlement impacts. The following mitigation measures are proposed to avoid and/or reduce the impacts during linear pipe works:

(i) Provide prior advanced notice (minimum one week) to community along the construction stretch. Distribute information on project and grievance redress mechanism, (ii) Maintain access to avoid disturbance to residents and businesses by providing planks and leaving spaces for businesses and residents to maintain access, (iii) Manage traffic flows as per traffic management plan prepared by the contractor in coordination with local authorities and communities, (iv) Limit the amount of time of open trenches, and complete works quickly where business activities are located, (v) Avoid full street closure to extent possible, (vi) Contractors shall provide employment opportunity to the local residents and particularly woman where possible, and (vii) Contractors shall assist vendors and hawkers in shifting to alternative locations, if required.

36. This sub-project does not have any Involuntary Resettlement impact as there will be no physical or economic displacement. The subproject will have no adverse land acquisition impacts as the subproject components are proposed at public land which is revenue land and does not belong to tribal community. Transmission and distribution pipeline carry raw and clear water will traverse only through right of way (RoW) of the government road. Keeping in view, no Involuntary Resettlement impacts are likely to be envisaged, an involuntary resettlement screening checklist is prepared and attached as Appendix 3. Accordingly, the subproject is classified under ‘Category C’ for involuntary resettlement under ADB’s SPS-2009.

VI. BUDGET

37. A budgetary provision is made for costs likely to be incurred during implementation of subproject.

VII. CONCLUSIONS AND RECOMMENDATIONS

38. No involuntary resettlement impacts are anticipated at identified sites for sub-project components, as adequate vacant land is available for the proposed facilities, within the compounds of government lands. The proposed sites for weir, intake well, WTP and OHTs belong to GoMP (WRD and revenue). Office of the Nagar Parishad - Pachore is in process to get no objection certificate (NoC) from WRD for water abstraction from the proposed source-Newaj river. Land records are collected from revenue department, refer to Appendix 4 and 5. While other details if any, shall be appended accordingly to the updated DDR. For linear components (pipe laying) or those proposed along government road RoWs belongs to NHAI, PWD and Nagar Parishad road, temporary disruption to road users, pedestrians and community members will be avoided in the most congested zones of both the town. Safety measures shall be ensured, and temporary disruptions mitigated during construction by the contractor through simple measures such as provision of planks for pedestrian access to shops and traffic management. Accordingly, the sub-project is classified as Category C for involuntary resettlement as per ADB SPS 2009.

39. Social Safeguards personnel at PMU, MPUSIP will be responsible to undertake a review of due diligence report during project implementation and if there is any change in alignment/site, concerned safeguard officials will carry out a due diligence investigation to document and study the social impact assessment of new alignment/site.

40. Next steps: The Draft DDR needs to be updated during detailed design with the following information, and ADB’s No Objection obtained, prior to start of construction:

(i) NoC is required from WRD to abstract water from Newaj river (in progress). (ii) NoC is required from NHAI, PWD to lay the transmission / distribution line. (iii) Existing raw water pumping main RWPM was laid in the private land with consent of the landowner, as per Chairman of Nagar Parishad Pachore but a fresh written consent is required from the landowner, if new RWPM is to be laid within the same alignment. Details of consultation with the landowner along with the written consent will be attached in the updated DDR. Currently the land is vacant, however, if found utilized for any purpose/activity before the start of civil works, resettlement impacts, and involuntary resettlement category will be further assessed in line with the MPUSIP’s Resettlement Framework. (iv) Transfer of proposed land of the WTP and OHTs in the name of ULB (in progress). (v) In addition to the above, in order to improve the quality of consultations, local community organizers will be appointed for Project under package; record of consultations held with local communities and other stakeholders to be included in updated/final DDR. (vi) Consultations with downstream users / villages will be conducted and included in the updated DDR. (vii) Reflection of design or site changes proposed, if any.
