Main results of the Council

Home Affairs ministers adopted a European pact to combat international drug trafficking as well as a set of conclusions on:

– facilitating entry for citizens of the member states of the EU at external borders ;

– the follow-up to the European Pact on Immigration and Asylum ;

– an action plan concerning unaccompanied minors from third countries.

On issues related to , ministers adopted an EU-US declaration on the fight against terrorism and a discussion paper by the EU counter-terrorism coordinator on the implementation of the EU strategy and action plan to combat terrorism .

The Council also discussed the outcome of the recent EU-Russia Justice and Home Affairs Permanent Partnership Council and held a general debate on internal security .

Justice ministers took the next steps on authorising the first in the history of the EU . It concerns the law applicable to divorce and legal separation . Ministers agreed on key elements of the content of the legislation. Still in public, the delegations confirmed their agreement on the rights of interpretation and translation in criminal procedures.

The Council will also continue discussions with the on a compromise text regarding an European protection order with the goal to reach agreement between the two co- legislators as soon as possible. Ministers then agreed on a general approach on a directive on combating trafficking of human beings.

The Council agreed on a negotiating mandate for the EU's accession to the Council of Europe's Convention for the Protection of Human Rights and Fundamental Freedoms. On European rules concerning matters of succession ministers adopted political guidelines for future work and examined the state of play in matters of eJustice.

In the margins of the Council session on Thursday, the Mixed Committee (the EU plus , , and ) examined the state of play concerning the development of the Schengen Information System II (SIS II) , including a draft global schedule as presented by the Commission. The committee also discussed the issue of visa liberalisation for Western Balkan states .

Under "other business", the Council examined:

– a directive on the fight against sexual exploitation of children ;

– the issue of visa reciprocity and Canada in connection with the sixth Commission report regarding visa reciprocity as set out in regulation 539/2001;

– a study on burden-sharing systems ;

– recent developments in the fight against corruption ;

– the progress made on an EU-Turkey readmission agreement ;

– the issue of police cooperation in South-Eastern Europe ;

– the outcome of the meeting of interior ministers of the G6 in Varese, ; and

– the priorities in Justice and Home Affairs matters as presented by the incoming Belgian presidency .

A-items adopted by the Council without discussion include conclusions on the Commission's action plan implementing the Stockholm Programme , on the Eurojust Annual Report for 2009, on psychosocial support in the event of emergencies and disasters and on the European Arrest Warrant . On the subject of security in connection with football matches , the Council approved an evaluation report on the degree of implementation of a related Council decision of 2007 as well as a resolution concerning an updated handbook with recommendations for international police cooperation and measures to prevent and control violence and disturbances in connection with football matches.

EUROPEAN PACT TO COMBAT INTERNATIONAL DRUG TRAFFICKING

Afterapublicdebate,ministersadoptedaEuropeanpacttocombatinternationaldrugtrafficking (8821/10 ).Itfocuses,atthisstage,oncocaineandheroinandshouldserveinthefutureasamodel forthefightagainstothercategoriesofdrugs,primarilycannabisandsynthetics.

Thepactenumeratesanumberofcommonprinciplesforthefightagainstthissortofcrimeand elaboratesonthreemaincommitments:

– disruptingcocaineroutes,

– disruptingheroinroutes,and

– counteringtheproceedsofcrime.

Foreachofthesethreecommitmentsthepactoutlinesspecificactionsaswellastargetdeadlinesby whentheseactionsshouldbeimplemented.

ThepactisanintegralpartofthelawenforcementaspectoftheEU’santidrugstrategy(established in2005)andtheEUactionplanfor20092012,whichadvocateaglobalbalancedapproachbased onsimultaneousreductionofsupplyanddemand.ItisapracticalapplicationoftheStockholm ProgrammeandoftheEuropeanInternalSecurityStrategyendorsedbytheEuropeanCouncilin December2009andMarch2010,respectively.

FACILITATING ENTRY FOR CITIZENS OF THE EU AT EXTERNAL BORDERS - Council conclusions

TheCounciladoptedthefollowingconclusionsonfacilitatingentryforcitizensoftheEUat externalborders( 9873/10 ).Theyfocusontheneedtoimprovefasttracksystemsforexternal bordercrossingsforthebenefitofEUcitizenswhileatthesametimesafeguardingtherightbalance betweentherighttofreemovementandguaranteeingthehighestlevelofsecurity.

EUROPEAN PACT ON IMMIGRATION AND ASYLUM - Council conclusions

TheCounciladoptedconclusionsonthefollowuptotheEuropeanPactonImmigrationand Asylum( 10302/10 ).

Theseconclusionswelcometheprogressalreadymadeinmanyoftheareasforactionsetoutinthe pact,asidentifiedinthefirstannualreportsubmittedbytheCommissionon6May2010.They identifyseveraltrendsandadvancesmadesincetheadoptionofthepactinOctober2008thatareof particularimportanceincludingthoseinthefollowingareas:

– labourmigration;

– combatingillegalmigration;

– asylum;and

– cooperationwithcountriesoftransitandorigin.

Theconclusionsalsohighlightanumberofareasinwhichmoreeffortsareneededandsetsoutkey policygoalsforthenexttwelvemonths.Theyinclude:

– furtherworkonthepolicyplanonlegalmigrationcomplementedbyanambitious integrationagenda;

– improvingattentiongiventounaccompaniedminors;

TheimplementationofthepactandrelevantaspectsoftheStockholmProgrammewillcontinueto bekeptunderreview.

Asafurtherstep,theEuropeanCouncilwillbeinvitedtoendorsetheconclusions,atitsmeetingon 17June2010.

UNACCOMPANIED MINORS - Council conclusions

Afterapublicdebate,theCounciladoptedconclusionsonthesubjectofunaccompaniedminors comingtotheEUregardlessofwhethertheyareasylumseekers,illegalmigrantsorvictimsof traffickinginhumanbeings( 9824/10 ).

Theconclusionsaddressparticularlythefollowingfiveissues:

– knowledgeofthephenomenon(e.g.improvingdatacollection);

– preventionofunsafemigrationandtraffickinginhumanbeings(e.g.financingof preventiveactionsatlocallevel;trainingforborderguards);

– receptionandproceduralguarantees(e.g.assessingwhetherthecurrentEUlegislation offersunaccompaniedminorssufficientprotectiontoguaranteethatminorsaretreatedas such;quickdecisionsinthebestinterestofthechild;exchangeofbestpracticeguidelines; combatingthephenomenonofdisappearance);

InSeptember2009,theCouncilagreedthatallmemberstateswouldbenefitfromthedevelopment ofcommonapproachesandincreasedcooperationwithcountriesoforigin,includingcooperationto facilitateminors'return.TheStockholmProgramme,adoptedinDecember2009,welcomedthe Commission’sinitiativetodevelopanactionplanonthisissuewhichsupplementstherelevant legislativeandfinancialinstrumentsandcombinesmeasuresdirectedatprevention,protectionand assistedreturn.TheCommissionadoptedthecommunicationontheactionplanon6May2010 (IP/10/534 ).

EU-US 2010 DECLARATION ON COUNTER-TERRORISM

TheCouncilagreedonanEUUSDeclarationonthefightagainstterrorism( 10591/10 ).

ThisdeclarationbuildsontheEUUSJointStatementontheclosureoftheGuantanamoDetention Center(10967/09 )andtheCouncilconclusionsofJune2009( 10523/2/09 ).

CTC DISCUSSION PAPER

AfterapresentationbytheEUcounterterrorismcoordinator,theCouncilexaminedthemostrecent discussionpaperontheimplementationoftheEUstrategyandactionplantocombatterrorism (9685/10 ).

Inhisreport,theEUcounterterrorismcoordinatorfocusesonfourmainchallenges:

– creatingaclearerpictureofthethreatEuropeisfacing,

– securingbetterpublictransport,especiallyinthefieldoflandtransport,

– ensuringthemonitoringofterroristtravel,and

– connectinginternalandexternalsecurity.

Foreachofthesechallenges,theEUcounterterrorismcoordinatorsuggestsanumberofconcrete actions.Otherareasinwhichprogressshouldbemadeincludecybersecurityandthesolidarity clause.Article222TFEUaskstheEUandthememberstatestoactjointlyinaspiritofsolidarityif amemberstateistheobjectofaterroristattackorvictimofanaturalormanmadedisaster.

EU-RUSSIA PERMANENT PARTNERSHIP COUNCIL

TheCouncilwasinformedabouttheoutcomeoftheEURussiaPermanentPartnershipCouncilon JusticeandHomeAffairsissues,heldinKazanon2526May2010.

DiscussionsfocusedontheimplementationoftheroadmapforaCommonSpaceofFreedom, SecurityandJustice.Awiderangeofsubjectswasexamined,rangingfromvisafacilitationand readmissionagreements,migrationissuesandthefightagainsttransnationalcrimeandterrorismto judicialcooperationincriminal,civilandcommercialmatters.

INTERNAL SECURITY

TheCouncilheldageneraldebateoninternalsecurity.ThesocalledM.A.D.R.I.Dreport (10203/10 )andtheInternalSecurityStrategyfortheEuropeanUnion( 5842/2/10 )providedthe mainelementsforthediscussion.

Ministersemphasisedthatoperationalcooperationamongmemberstatesmustbestrengthenedand highlightedanumberofpolicyareaswhereactionshouldbefocusedon.Theseincludeorganised crimeanditsvastfinancialresources,moneylaundering,cybercrime/security,terrorism, traffickinginhumanbeings,armstrafficking,illegalmigrationandcooperationwiththirdcountries.

TheCouncil'srecentlyestablishedinternalsecuritycommittee(COSI)wasalsochargedtoreport annuallyonthestateofinternalsecurityintheEU.

AtitsmeetinginFebruary2010,theCouncilapprovedtheInternalSecurityStrategyforthe EuropeanUnionwhichtheEuropeanCouncilendorsedonemonthlater.TheCommissionis expectedtoadoptacommunicationonconcreteactionsinautumn2010

Thestrategy'smainobjectivesare:

– topresenttothepublictheexistingEUinstrumentswhichalreadyhelptoguaranteethe securityandfreedomofEUcitizensandtheaddedvaluethatEUactionprovidesinthis area;

– tofurtherdevelopcommontoolsandpoliciesusingamoreintegratedapproachwhich addressesthecausesofinsecurityandnotjusttheeffects;

– tostrengthenlawenforcementandjudicialcooperation,bordermanagement,civil protectionanddisastermanagement.

ThestrategysetsoutaEuropeansecuritymodel,whichintegratesamongothersactiononlaw enforcementandjudicialcooperation,bordermanagementandcivilprotection,withduerespectfor sharedEuropeanvaluessuchasfundamentalrights.Itidentifiesthemainthreatsandchallengesthe EUisfacing,includingterrorism,organisedcrime,cybercrime,drugandarmstrafficking, traffickinginhumanbeings,sexualexploitationofminorsandchildpornography,economiccrime andcorruptionandyouthviolence.Naturalandmanmadedisasterssuchasforestfiresandenergy shortages,alsorequirecrossborderpreparednessandresponse.Anotherchallengeistoaddress commonphenomenathatposethreatstocitizensacrossEurope,forexampleroadaccidents.

TheM.A.D.R.I.DreportisadocumentfromtheTrioPresidencythatdescribesthecurrentthreats andchallengestointernalsecurityintheEU,basedonthreestrategicdocuments:Europol's OrganisedCrimeThreatAssessment(OCTA),theTerrorismSituationandTrendReport(TESAT) andFrontex'sAnnualRiskAnalysis.

DIVORCE AND LEGAL SEPARATION - A PIONEER GROUP OF MEMBER STATES SEEKS COMMON RULES

TheCouncilreachedacomfortablequalifiedmajorityagreementonauthorisingthefirstenhanced cooperation 1inthehistoryoftheEU.Itconcernsthelawapplicabletodivorceandlegalseparation (RomeIII)( 9898/2/10 ).MinistersalsodecidedtotransmitthetexttotheEuropeanParliamentin ordertoobtainitsconsenttotheenhancedcooperation.

Onthecontentofthelegislation,aregulationimplementingtheenhancedcooperation,ministers agreedonageneralapproachonkeyelements( 10153/10 )andrequestedfurtherexaminationof outstandingissues.

Bothfiles,thedecisiontoauthorizetheenhancedcooperationandtheregulationimplementingit, weredebatedinpublic.

14memberstateswillparticipateintheenhancedcooperation.Oncetheyreachunanimous agreement,theregulationwillsetclearrulesonhowinternationalcouplescanseekdivorceorlegal separationinthesecountries.OtherEUmemberstateswhoarenotyetreadybutwishtojointhis pioneergroupatalaterstagewillbeabletodoso.

Thereareapproximately122millionmarriagesintheEU,about16million(13%)areassumedto beinternational.Theregulation,onceadopted,willhavethefollowingadvantages:

– itallowsinternationalcouplesintheparticipatingmemberstatestoknowinadvancewhich lawwillapplytotheirdivorce;

– itincreasesflexibilityandautonomybygivingthespousesthepossibilitytochoosethe applicablelaw;and

– wherenoapplicablelawischosen,itintroducesharmonisedconflictoflawrulesonthe basisofascaleofsuccessiveconnectingfactors.

Therebyenhancedcooperationinthisfield:

– improveslegalcertainty,predictabilityandflexibilityforcitizens;

– protectsweakerpartnersduringdivorcedisputesandpreventsthesocalled"rushtocourt", i.e.situationswhereoneofthespousesappliesfordivorcebeforetheotheronedoesin ordertoensurethattheproceedingisgovernedbyagivenlawwhichheorsheconsiders morefavourabletohisorherowninterests;and

– lessenstheburdenonchildrenininternationaldivorcedisputes.

InJuly2006,theCommissionadoptedaproposalforaregulationamendingregulation2201/2003 asregardsjurisdictionandintroducingrulesconcerningapplicablelawinmatrimonialmatters (‘RomeIII’)( 11818/06 ).Itsaimwastodevelopjudicialcooperationincivilmattershavingcross borderimplications,basedontheprincipleofmutualrecognitionofjudgments.Thetextwas discussedduringseveralpresidenciesbutatitsmeetinginJune2008,theCouncilconcludedthatit wasnotpossibleboththenandinthenearfuturetoreachunanimousagreementontheproposal asrequiredbytheNiceTreaty.

Giventhesecircumstances,Greece,Spain,Italy,,Luxembourg,Austria,Romaniaand SloveniaaddressedinJuly2008arequesttotheCommissionindicatingthattheywishedto establishenhancedcooperationbetweenthemintheareaofapplicablelawinmatrimonialmatters andthattheyexpectedtheCommissiontosubmitaproposaltotheCounciltothatend.Sincethen Greecehaswithdrawnfromthisrequest,andafurthersixmemberstateshavejoinedit:Bulgariain August2008,FranceinJanuary2009,GermanyandinApril2010,LatviaandMaltain May2010,PortugalinJune2010.

PROCEDURAL RIGHTS - INTERPRETATION AND TRANSLATION

Regardingadirectiveontherightstointerpretationandtranslationincriminalproceedings,the Councilconfirmedtheagreementreachedon27May2010bythePermanentRepresentatives Committeeonacompromisetextwhichwasnegotiatedinrecentweeksbetweenrepresentativesof theCouncil,theEuropeanParliamentandtheCommission( 10420/10 ).

Ministersalsowelcomedthattheagreementonthisfilewasreachedsoquicklyandthattalkswith theEuropeanParliamentpointtoafirstreadingagreementinthecomingweeks.

Thedirectiveisbasedonaninitiativeby13memberstates(Belgium,Germany,Estonia,Spain, France,Italy,Luxembourg,Hungary,Austria,Portugal,Romania,FinlandandSweden)following anagreementthatwasreachedunanimouslybytheCouncilinOctober2009inrespectofa CommissionproposalfromJuly2009.Thetextalsotakesaccountofaproposalthatwassubmitted bytheCommissioninMarch2010.

Thedirectivewillsubstantiallyenhancetherightsforsuspectedandaccusedpersons,inparticular asregards:

– therighttointerpretation

– Asuspectedoraccusedpersonwhodoesnotunderstandorspeakthelanguageofthe criminalproceedingsconcernedwillbeprovidedwithoutdelaywithinterpretation duringcriminalproceedingsbeforeinvestigativeandjudicialauthorities,including duringpolicequestioning,duringallcourthearingsandduringanynecessaryinterim hearings.

– Wherenecessaryforthepurposeofensuringthefairnessoftheproceedings, interpretationwillalsobeavailableforcommunicationbetweenthesuspectedor accusedpersonandhislegalcounselindirectconnectionwithanyquestioningor hearingduringtheproceedingsorwiththelodgingofanappealorotherprocedural applications,suchasforbail.

– Asanexceptiontothegeneralrules,anoraltranslationoranoralsummaryof essentialdocumentsmaybeprovidedinsteadofawrittentranslation,oncondition thatsuchoraltranslationororalsummarydoesnotaffectthefairnessofthe proceedings.

Thedirectivealsocontainsprovisionsonthequalityofinterpretationandtranslationand onthetrainingofjudges,prosecutorsandjudicialstaff.

Thedirectiveispartofawiderpackageoflegislativeandnonlegislativeinitiativesthataimat strengtheningproceduralrightsofsuspectedoraccusedpersonsincriminalproceedings.The Councilunanimouslyagreedonthiswiderpackage,orroadmap,inOctober2009( 14552/1/09 ).

Theroadmapidentifiessixmainareasonwhichlegislativeorotherinitiativesaredesirableoverthe comingmonthsoryears:

EUROPEAN PROTECTION ORDER

TheCouncildiscussedpubliclythememberstateinitiativeforaEuropeanprotectionorder( PE- CONS 2/10 ).Theaimofthedirectiveistofacilitateandenhancetheprotectiongrantedtovictims ofcrime,orpossiblevictimsofcrime,whomovebetweenEUmemberstates.

Afteralongdiscussion,thepresidencyconcludedthatthereissufficientgroundfortheCouncilto continuediscussionswiththeEuropeanParliamentwithaviewtoreachinganagreementonthetext ofthedraftdirective.ThepresidencynotedthatatthenextsessionoftheCouncilinOctober2010, theCouncilshouldassessthepositionoftheUnitedKingdom,followingareasonableperiodof timeasreferredtoinarticle3,paragraph2ofprotocol21totheLisbonTreaty.

Theparagraphreads:"Ifafterareasonableperiodoftimeameasurereferredtoinparagraph1 cannotbeadoptedwiththeUnitedKingdomorIrelandtakingpart,theCouncilmayadoptsuch measureinaccordancewithArticle1withouttheparticipationoftheUnitedKingdomorIreland."

NegotiationswillnowfollowwiththeEuropeanParliamentandtheCouncilwillassessprogress madeatitsnextmeetinginOctober2010.CouncilandParliamenthavetoagreeonafinaltextof thedirectiveundertheordinarylegislativeprocedure.Eachmemberstatewillthenneedto transposethenewrulesintonationallaw.

TheproposalforaEuropeanprotectionorderisbasedonajointinitiativeoftwelveEUmember states 1,presentedinJanuary2010.Thefocusoftheinitiativeisoncrimeswhichmayendangerthe victims'life,physical,psychologicalandsexualintegrityortheirpersonalliberty.Theultimategoal istoavoidnewactsofcrimeandtomitigatetheconsequencesofpreviousactsofcrime.

Onceadopted,thedirectivewillallowacompetentauthorityinonememberstatetoissuea Europeanprotectionorderonthebasisofwhichacompetentauthorityinanothermemberstate takesmeasureswithaviewtocontinuingtheprotectionofthatperson.Thesemeasureswould includeobligationsorprohibitionsimposedonthepersoncausingdanger,suchas:

– anobligationnottoentercertainplacesordefinedareaswheretheprotectedpersonresides orwhichhe/shevisits;

Intheeventofabreachofoneormoreofthemeasurestakenbythememberstateexecutingthe Europeanprotectionorder,thecompetentauthorityofthatstatewouldhavethepowerstoimpose criminalsanctionsandtakeanyothercriminalornoncriminalmeasures.

ThetextasitstandsconsidersthatitisnecessarytoallowEuropeanprotectionorderstobeissued andexecutedinallmemberstates,inaccordancewiththeirnationallaw.Europeanprotection ordersshouldbeissuedbyanyjudicialorequivalentauthority,irrespectiveofthelegalnatureof suchauthority(criminal,civiloradministrative).Itproposesathreestepapproach:theissuingstate makesarequestforanEuropeanprotectionorder,thereceivingstaterecognisestheEuropean protectionorderandexecutestheorderbytakingadecisionunderitsnationallawinorderto continuetheprotectionofthepersonconcerned.

EU ACCESSION TO THE ECHR

Afterapublicdebate,theCounciladoptedanegotiatingmandatefortheEU'saccessiontothe CouncilofEurope'sConventionfortheProtectionofHumanRightsandFundamentalFreedoms (ECHR).

On17March2010,theCommissiontableditsrecommendationforanegotiatingmandate.Different Councilworkinggroupshavediscussedtheproposalsincethen.

TheTreatyofLisbonprovidesthelegalbasisfortheaccessionoftheEUtotheECHR.Art.6(2) TEUstipulates:"TheUnionshallaccedetotheEuropeanConventionfortheProtectionofHuman RightsandFundamentalFreedoms".

Furthertothis,theStockholmProgrammecallsfora"rapid"accessiontotheECHRandinvitesthe CommissiontosubmitarecommendationtotheCouncil"asamatterofurgency".

SUCCESSION

Afterapublicdebate,theCounciladoptedpoliticalguidelinesforfutureworkonproposed EuropeanrulesconcerningmattersofsuccessionaswellasaEuropeancertificateofsuccession (14722/09 + 14722/09 ADD 2 ).

Ministersunderlinedtheimportanceoftheproposedregulationsinceithasthepotentialtomake lifeeasierforheirs,legateesandotherinterestedparties.Notleast,theproposedruleswouldtake someofthestressoutofsuccessionplanningbyenablingpeopletochoosethelawthatwillgovern thetransmissionofalltheirassets.

On14October2009,theCommissionadoptedaproposalthataimsatsimplifyingtheruleson successionswithaninternationaldimensionintheEU.Theproposalprovidesfortheapplicationof asinglecriterionfordeterminingboththejurisdictionoftheauthoritiesandthelawapplicabletoa crossbordersuccession:thedeceased'shabitualplaceofresidence.Peoplelivingabroadwill, however,beabletoopttohavethelawoftheircountryofnationalityapplytotheentiretyoftheir succession.

Allassetsmakingupasuccessionwillthusbegovernedbyoneandthesamelaw,therebyreducing theriskthatdifferentmemberstateswillissuecontradictorydecisions.Likewise,asingleauthority willbecompetentforsettlingthesuccession.Lastly,therewillbefullmutualrecognitionof decisionsandauthenticactsinsuccessionmatters.

Undertheproposedregulation,aEuropeanCertificateofSuccessionwouldalsobecreatedto enableapersontoprovetheirstatusasheirortheirpowersasadministratororexecutorofa successionwithoutfurtherformalities.Atpresent,peoplesometimeshavegreatdifficulty exercisingtheirrights.Theresultwillbefasterandcheaperprocedures.

ItistobenotedthatDenmark,theUnitedKingdomandIrelandwillnottakepartintheadoption andapplicationoftheproposedregulation.

TRAFFICKING IN HUMAN BEINGS

TheCouncilagreedonageneralapproachregardingadirectiveaimedatstrengtheningthefight againsttraffickinginhumanbeingsandtheprotectionofvictims.

InMarch2010,theCommissionadopteditsproposalonthefile( 8157/10 ).Onceadopted,thenew ruleswillreplaceframeworkdecision2002/629/JHA.Thegoalistofurtherapproximatenational legislationandtoimproveinternationallawenforcementandjudicialcooperation.Theprovisions ofthefuturedirectiveinclude:

– adefinitionofthecrime,aggravatingcircumstancesandstifferpenalties;

– extraterritorialjurisdictionmakingitpossibletoprosecuteEUnationalsforcrimes committedabroadandtouseinvestigativetoolssuchasphonelisteningandaccessto financialdata;

– specialtreatmentofthevictimsincriminalproceedingsincludingnonpunishmentof victimswhosuffertheconsequencesofthecriminalactivities;

– ahigherstandardofprotectionandassistanceforvictims,andinparticularspecial protectivemeasuresforchildren;

– preventivemeasuresaimedatdiscouragingthedemandsideofthephenomenon.

E-JUSTICE

TheCounciladoptedareportandendorsedaroadmaponeJusticereflectingthestateofplayand futureplans.Ministersalsoagreedonanoteontheassessmentoftheactivitiesofthestructureas foreseenintheEuropeaneJusticeactionplan.

ConcerningtheEuropeaneJusticeportal,theCouncilexpresseditsdisappointmentandregretted thattheportalwouldnotbelaunchedinthefirsthalfof2010asrequestedbytheJHACouncilin November2009andinApril2010.TheCouncilrecalledthatthiswouldbetheseconddelayinthis worksincetheinitialdeadline(end2009).

Inthiscontext,theCouncilrequestedtheCommissiontotakeallpossiblemeasurestoensurethe promptdeliveryofthefirstreleaseoftheportalandtocontinueworkonfuturereleases.

Theportalseekstopromotetheuseofinformationandcommunicationtechnologiesinthefieldof justice.Theuseofnewtechnologieswillrationaliseandsimplifyjudicialproceduresandreduce operatingcosts,forthebenefitofcitizens,undertakings,legalpractitionersandtheadministration ofjustice.Theportalwillprovideaccesstoinformationandservicesinthefieldofjustice, especiallyinthecrossbordercontext.Itisintendedtobeaonestopshopforjusticerelated informationandfunctionalitiesintheEU.

Theportalwillbedevelopedgradually.Inthelongterm,threeaspectswillbecovered:

– firstly,accesstolawandinformationatEUandnationallevel(NLex,EURLex, caselaw),includingpanEuropeandatabases(e.g.tofindalawyerornotaryinanother MemberState);

– secondly,electroniccommunicationbetweenajudicialauthorityandthecitizen (submissionofapplicationstocourt,exchangeofdocumentsincourtproceedings,suchas theEuropeanorderforpaymentprocedureetc.);and

– thirdly,securecommunicationbetweenjudicialauthoritiesinthecrossbordercontext (informationaboutvideoconferencing,itsavailabilityandpossibilities,secureexchangeof legalassistancerequestsetc.).

TheroadmaponeJusticereflectsthestateofplayinconcretetermsandaimstomakearealistic planningforthemonthsandyearstocome.Themainconclusionoftheassessmentofthe implementationstructureisthatnochangesshouldbemadetotheimplementationstructureuntil 2013andthatanotherreviewofthestructureshouldbecarriedoutinthefirsthalfof2012.

VisareciprocitywithCanada

FollowingtheEUCanadasummiton5May2010,theCouncilwasalsobriefedbytheCommission andtheCzechRepublicontheissueofthevisarequirementimposedbyCanadaonCzech nationals.TheCouncilrequestedtheCommissiontocontinuetopressfortheliftingofthevisa requirementinconsultationwiththeCzechRepublic

Canadaisamongthethirdcountrieswhosenationalsarenotsubjecttoavisarequirementunder regulation539/2001.Thisregulation,however,asamendedbyregulation851/2005,alsoprovides forpossiblereciprocitymeasuresincaseswhereacountryenjoyingvisafreetraveltotheEU introducesvisarequirementsforcitizensofoneorseveralEUmemberstates.

CanadaalsocontinuestomaintainavisarequirementforBulgarianandRomaniancitizens.

Belgianpresidencypriorities

Finally,theincomingBelgianpresidencyinformedboth,justiceandhomeaffairsministers,about itsprioritiesinjusticeandhomeaffairsmatters.

MIXED COMMITTEE: SIS II AND VISA LIBERALISATION IN THE WESTERN BALKANS

InthemarginsoftheCouncilsessiononThursday,theMixedCommittee(theEUplusNorway, Iceland,LiechtensteinandSwitzerland)examinedthestateofplayconcerningthedevelopmentof theSchengenInformationSystemII(SISII)andtheissueofvisaliberalisationfortheWestern Balkanstates.

SISII

ThecommitteetooknoteofareportbytheCommissiononthestateofplayoftheSISIIproject andanaccompanyingdraftglobalschedule.Thedraftglobalscheduleprovidesforentryinto operationoftheSISIIbythefirstquarterof2013.TheCouncilalsocalledontheCommissionto presentassoonaspossibleafinalglobalscheduleaswellasacomprehensivebudgetaryestimate forthedevelopmentofthesystem.BothshouldbeconfirmedbytheCouncilinOctober2010,atthe latest.

TheissueofvisaliberalisationfortheWesternBalkanswasdiscussedandtheCommissionreported ontheadoptionofaproposaltomodifyRegulation539/2001inordertoextendvisaliberalisation toAlbaniaandBosniaandHerzegovina.

Delegationswelcomedthepresentationoftheproposalandexpressedthehopethatitwouldbe possibletoadoptitquicklyoncethetwocountriesconcernedmeettheoutstandingbenchmarks underthevisaliberalisationdialogue.

TheCouncildecidedinNovember2009toamendthisregulationandtograntvisafreetraveltoand throughouttheSchengenareaforcitizensoftheformerYugoslavRepublicofMacedonia, MontenegroandSerbia( 15521/09 ).Thevisawaiverbecameeffectiveon19December2009to holdersofbiometricpassports.
