Wheeling Firefighters Association has submitted their application to conduct a Tag Day in Wheeling pursuant to our Chapter 4.64 of the Wheeling Municipal Code, which allows an organization to conduct a Tag Day for no more than two days within Wheeling.

The above organization has joined together with the Muscular Dystrophy Association and has participated in a Tag Day event for several years within our community. The Village last approved their request to tag in our community on July 21, 2014.

WHEREAS, the Wheeling Municipal Code, Chapter 4.66, “Tag Day" requires that organizations secure a permit to conduct such Tag for no more than two days within one calendar year within the Village of Wheeling; and

WHEREAS, Wheeling Firefighters Association, a not-for-profit organization, has made proper application for a permit to conduct a Tag Day Event on September 4, 2015 with a rain date of September 11, 2015.

EXECUTIVE SUMMARY

Staff recommends approval of the attached Raffle License Application from Addolorata Villa. This license requires Board approval because they are seeking a waiver of the fidelity bond requirement.

Addolorata Villa has submitted their application to conduct a Raffle in Wheeling, pursuant to Municipal Code Chapter 4.66 which allows an organization to conduct the sales of raffle tickets and to conduct the raffle within Wheeling. This raffle is taking place in conjunction with Addolorata’s annual Fall Villa Fest, a simple event which takes place on the grounds of Addolorata and benefits the residents and their families.

The above organization has been in existence for over 60 years within our community. The Village last approved their raffle and amusement event on August 4, 2014; they are also requesting a waiver of the fidelity bond requirement.

WHEREAS, Ordinance No. 1825 allows for a qualified organization to request a waiver of requirements to acquire a fidelity bond to conduct a raffle; and

WHEREAS, Addolorata Villa has requested a waiver of the fidelity bond and made proper application for a permit to conduct a raffle on September 13, 2015; and

WHEREAS, it has been determined that the waiver of the fidelity bond to conduct a raffle is within the guidelines set forth in Ordinance No. 1825.

EXECUTIVE SUMMARY The Resolution approves a Fourth Amendment to the Village’s police tow contract with Gene’s Village Towing with increases in the tow rate from $85 to $95 per tow and the daily storage rate from $30 to $35 per day. All fees are charged to the vehicle owner and not to the Village. The Village has the ability to terminate the agreement if it is dissatisfied with the service upon 45 days’ written notice to Gene’s.

Attached to this Memorandum is a request from Gene’s Village Towing to increase the daily towing and storage rates as stated above. Gene’s has attached supporting evidence for the rate increases which establish that even after the increase, Gene’s provides the lowest tow rate when compared to the suburbs surrounding Wheeling. Further, the Police Department remains pleased with the service that Gene’s provides and recommends the increase.

RESOLUTION WAIVING COMPETITIVE BIDDING AND APPROVING A FOURTH AMENDMENT TO THE VILLAGE OF WHEELING CONTRACT WITH GENE’S VILLAGE TOWING

WHEREAS, the Village of Wheeling, Lake and Cook Counties, Illinois, is a home rule unit of government pursuant to Article 7, Section 6 of the Illinois Constitution of 1970; and

WHEREAS, on June 13, 2005, the Village of Wheeling entered into a contract for towing services with Gene’s Village Towing after a competitive bidding process (the

“Contract”); and

WHEREAS, on May 8, 2006, the Village Board approved a First Amendment to

Village of Wheeling Contract with Gene’s Village Towing which amendment extended the term of the contract to 6 years up to and including May 7, 2012; and

WHEREAS, in 2011, on January 18, 2011, the Village Board approved a Second

Amendment increasing the towing fees to $85 per tow and the daily storage fees to $30 per day; and

WHEREAS, on May 7, 2012 the Village Board approved a Third Amendment to the contract for a six year period through May of 2018 based upon the written recommendation of the Police Department and the approval of the Village Manager; and

WHEREAS, Gene’s has requested an increase in the towing rates from $85 to $95 per tow and an increase in the daily storage rate from $30 to $35 per day; and

WHEREAS, all fees are charged to the owner of the vehicle and not to the Village.

NOW THEREFORE, be it resolved by the President and Board of Trustees of the

Village of Wheeling, Lake and Cook Counties, Illinois as follows: 1

Competitive bidding is hereby waived and the Village President and Clerk are hereby authorized to execute the Fourth Amendment for the Village of Wheeling’s Towing Contract with Gene’s Village Towing, attached hereto as Exhibit A.

FOURTH AMENDMENT TO VILLAGE OF WHEELING’S CONTRACT WITH GENE’S VILLAGE TOWING

WHEREAS, this Agreement is made this ______day of August , 2015, by and between the

Village of Wheeling, an Illinois Municipal Corporation, and Gene’s Village Towing; and

WHEREAS, the Village of Wheeling, Lake and Cook Counties, Illinois, is a home rule unit

of government pursuant to Article 7, Section 6 of the Illinois Constitution of 1970; and

WHEREAS, on June 13, 2005, the Village of Wheeling entered into a Contract for towing services with Gene’s Village Towing (the “Contract”); and

WHEREAS, the Contract is attached hereto as Exhibit A; and

WHEREAS, on May 8, 2006, the Village approved a First Amendment to the Contract which

extended the term through May 7, 2012 which First Amendment is attached hereto as Exhibit B; and

WHEREAS, in 2011, the Village approved Second Amendment which allowed for a rate

increase to $85 per tow and $30 per day for storage attached hereto as Exhibit C; and

WHEREAS, on May 17, 2012 the Village approved a Third Amendment to the Contract

extending the term through May 31, 2018 attached hereto as Exhibit D; and

WHEREAS, the Contract and this Amendment incorporate by reference all documents set

forth in Paragraph 1(a) of the Contract (hereinafter the “Contract Documents”); and

WHEREAS, pursuant to the Contract, Gene’s has requested a rate increase from $85 to $95 per tow and from $30 to $35 for the daily storage rate; and

WHEREAS, the Board of Trustees finds that the rate increases are warranted.

NOW THEREFORE, it is agreed as follows:

1. The towing and storage fees in the Contract are hereby amended as follows: 1

Tow Charges: $95 per tow/day;

Daily Storage Charge: $35 per day.

The new rates will go into effect August 15, 2015.

2. During the remaining period of the Contract as amended, any rate increases requested by

Gene’s Village Towing must be approved by the Board of Trustees of the Village of

Wheeling. If the Board of Trustees does not approve such a request, the rates shall remain

as stated in the original contract documents.

3. All terms and conditions of the original Contract Documents and Amendments thereto not

specifically amended herein shall remain in full force and effect.

SUBJECT: Water Conservation Ordinance Change

EXECUTIVE SUMMARY In order to comply with regulations set forth by the Illinois Department of Natural Resources, the Village is required to adopt two amendments to its Municipal Code: one requiring the use of certain products bearing a WaterSense label, and one requiring that individual properties cannot engage in lawn sprinkling on consecutive days.

The Illinois Department of Natural Resources (IDNR) recently amended its Lake Michigan Water Allocation Rules and Regulations to further the effort of water conservation. As part of the initiative, all Lake Michigan Water Allocation permittees are required to adopt ordinances that include amendments to their municipal code that pertain to water conservation. These amendments must be adopted and submitted to the IDNR by September 1, 2015, in order to demonstrate compliance with the new state law.

The first amendment requires that all new and replacement plumbing fixtures and irrigation controllers specific to sprinkler systems bear a WaterSense label, as determined by the United States Environmental Protection Agency’s WaterSense Program; the WaterSense label identifies products that use less water than conventional models. The attached ordinance adds this requirement to Title 16 (“Plumbing Code”) of the Village’s Municipal Code. The second amendment requires that no lawn sprinkling of individual properties take place on consecutive days; the attached ordinance adds this requirement to Title 13, Section 130.04.280 (“Nonessential Use Restrictions”) of the Village’s Municipal Code. Adoption of this second amendment will necessitate implementation of an even/odd day water sprinkler system using property addresses, a system implemented by numerous other municipalities in ongoing attempts to reduce water usage.

Once the new ordinance is adopted, staff will notify all residential, commercial, and industrial water customers of the changes. The Village newsletter, website, and cable channels are all media through which staff can inform the public of these changes.

An Ordinance Amending Title 16, “Plumbing Code,” Chapter 16.1 “Plumbing Code,” to Add a New Section 16.1-2 “WaterSense Products” and Amending Title 13 “Water and Sewers,” Chapter 13.04 “Water Connection and Use,” Section 13.04.280 “Nonessential Use Restrictions” of the Wheeling Municipal Code Relating to Water Conservation Issues

WHEREAS, Village of Wheeling receives a permit from the Illinois Department of Natural Resources relating to the allocation of Lake Michigan water; and

WHEREAS, the Illinois Department of Natural Resources has recently updated and amended its Lake Michigan Water Allocation Regulations (“Regulations”); and

WHEREAS, the amended Regulations require domestic permitees to adopt an ordinance that requires all new and replacement plumbing fixtures and irrigation controllers on sprinkler systems that bear a WaterSense label, as designated by the United States Environmental Protection Agency WaterSense Program; and

WHEREAS, the amended Regulations also requires domestic permitees to adopt an ordinance that restricts non-essential outside water uses to prevent excessive, wasteful use; and

WHEREAS, the President and Board of Trustees of the Village of Wheeling find that it is in the best interest of the Village and its residents to amend the Wheeling Municipal Code to comply with these Regulations;

NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Wheeling, Counties of Cook and Lake, State of Illinois, as follows:

Section A: Title 13 “Water and Sewers,” Chapter 13.04 “Water Connection and Use,” Section 13.04.280 “Nonessential Use Restrictions” of the Wheeling Municipal Code is hereby amended and shall read in its entirety as follows:

13.047.280 Nonessential uses restricted

(a) The nonessential use of water from the village water system is prohibited every day from May 15th to September 15th between the hours of 12:00 noon and 6:00 p.m. and lawn sprinkling shall not occur on consecutive days.

(b) The village manager or his designee is authorized and empowered to permit the watering of newly laid sod or seed at any time and on any day upon issuance of an appropriate permit and for a time period not to exceed two consecutive weeks.

347634_1 (c) The village manager is authorized and empowered to restrict nonessential use of water from the village water system for such additional period of time and in such manner as he may deem necessary in order to conserve the supply of water in the village of Wheeling. The village manager shall announce the additional restrictions, and the restrictions are effective upon the announcement.

(d) In the event additional restrictions become necessary, every effort shall be made to allow the sprinkling of newly laid sod or newly seeded lawns for a reasonable length of time after the sod or seed has been placed. The sprinkling, however, shall be allowed only with the permission of the village manager.

Section B: Title 16, “Plumbing Code,” Chapter 16.1 “Plumbing Code,” of the Wheeling Municipal Code is hereby amended to add a new Section 16.1-2 “WaterSense Products” which shall read in its entirety as follows:

16.1-2 WaterSense Products

Pursuant to 17 Ill. Admin. Code 3730.307(c) (4) and subject to the Illinois Plumbing Code (77 Ill. Admin. Code 890) and the Lawn Irrigation Contractor and Lawn Sprinkler System Registration Code (77 Ill. Admin. Code 892), all new plumbing fixtures and irrigation controllers installed after the effective date of this Ordinance shall bear the WaterSense label (as designated by the U.S. Environmental Protection Agency WaterSense Program), when such labeled fixtures are available.

Section C: This Ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law.

Section D: Those chapters, sections or subsections of the Wheeling Municipal Code not expressly amended or repealed by this Ordinance are hereby re-enacted and it is expressly declared to be the intention of this Ordinance not to repeal or amend any portions of the Wheeling Municipal Code other than as expressly set out in Section A of this Ordinance.

Section E: If any section, clause or provision of this Ordinance, or any application thereof to any person, property or circumstance, shall be held to be invalid or unenforceable by a court of competent jurisdiction, such invalidity or unenforceable provision or application, and to this end the provisions of this Ordinance are declared to be severable.

SUBJECT: Cross Connection and Backflow Program

EXECUTIVE SUMMARY: The Village is required by the state plumbing code to regulate backflow prevention devices. To meet the current Illinois Environmental Protection Agency (IEPA) and EPA requirements, additional amendments to Title 13 “Water and Sewers,” Chapter 13.04 “Water Connection and Use” are required. Below is a summary of the proposed changes to the Title 13.

Cross connection and backflow programs are designed to ensure that the water supplied by municipalities maintains its integrity and remains free from the dangers of backflow. Backflow is the reversal of water flow against its normal direction, which can cause contaminants or hazardous materials to enter the public water supply. Statewide mandates governed by the EPA exist across the country, which require every municipality to operate and maintain an effective backflow program and perform regular cross-connection surveys of the water distribution system. The Village’s responsibility of this program is management and enforcement as non-compliance issues arise.

In order to clarify the responsibilities of the property owners relative to cross connection and backflow devices, as outlined in the state and federal regulations, the following requirements that have been incorporated into the amendment to Title 13:  Annual testing of the backflow prevention devices, at the property owner’s expense; and  Property owner completion of the cross-connection survey, which will be provided by the Village.

Title 13 is also being amended to allow for proper management and enforcement during non- compliance. As it stands now, if a resident or business owner refuses to allow a Village employee access to their water meter for the purpose of testing, repairing or replacing it when it is believed to be malfunctioning, the Village has no recourse and is unable to address the problem. The proposed ordinance amendment would give the Village the right to discontinue water service (as a last resort) to protect the water supply system. ORDINANCE NO. 15-____

AN ORDINANCE AMENDING VARIOUS SECTIONS OF TITLE 13 “WATER AND SEWERS,” CHAPTER 13.04 “WATER CONNECTIONS AND USE” OF THE WHEELING VILLAGE CODE RELATING TO BACKFLOW PREVENTION DEVICES, CROSS CONNECTIONS AND INSPECTION OF METERS

WHEREAS, the Village of Wheeling (“Village”) is an Illinois Municipal Corporation pursuant to the Illinois Constitution of 1970 and the Statutes of the State of Illinois; and

WHEREAS, the Village has determined that it is essential that the Wheeling of Village

Code (“Code”) be amended to clarify the responsibilities of property owners relative to cross- connection and back flow devices inspections and surveys and that imposing such a requirement will protect and promote the public health, safety, and welfare of its citizens.

NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF WHEELING, COUNTIES OF COOK AND LAKE, STATE OF ILLINOIS, AS FOLLOWS:

Section 1: Title 13 “Water and Sewers,” Chapter 13.04 “Water Connection and Use,” of the Wheeling Village Code is hereby amended to add a new Section 13.04.310 “Cross- connection devices and survey” which shall read in its entirety as follows:

13.04.310 - Cross-connection devices and survey

a) Every installed backflow prevention device shall be tested annually by a State Certified Cross Connection Device Inspector (CCCDI), at the property owner’s expense, to ensure proper function. The property owner is responsible for the proper completion of the annual testing and is responsible for submitting a copy of the inspection report to the Village by the anniversary date of the testing, which is anniversary of the installation date. If the Village has not received the report by the anniversary date for such testing, the Village shall send a notice to the current water user and property owner via U.S. first class mail, which shall include notice that the possible penalty is disconnection. If the Village does not receive the test report within thirty (30) calendar days after sending the first notice, the Village shall send the second notice via U.S. certified mail, which shall include notice that the possible penalty is disconnection. Failure to provide the Village with a properly completed test report within thirty (30) calendar days after sending out the second notice shall result in such property owner being served with a disconnection notice and the Village shall follow the procedures for

348088_1 1 nonpayment set forth in Section 13.04.230, including a right to a hearing set forth in Section 13.04.240. b) All property owners shall comply with all recommendations made by the CCCDI, including, but not limited to, the correction of deficiencies, replacement of failed device(s), or the removal of cross-connection device(s), or the installation of backflow prevention devices. The property owner is responsible for the proper completion of the corrections recommended by the CCCDI. In case of a disagreement between the property owner and the CCCDI regarding the CCCDI’s recommendations, the property owner shall report the disagreement in writing to the water supervisor or his or her designee together with the report by the CCCDI. The water supervisor or his or her designee shall order an independent CCCDI to conduct an independent inspection, at the owner’s expense. After a review of all reports, the water supervisor or his or her designee shall make a decision based on the report by the independent inspector. Failure to comply with the recommendations of the CCCDI or the decision by the water supervisor or his or her designee shall constitute a violation of this Chapter and shall result in a notice of disconnection being sent and the Village shall follow the procedures for nonpayment set forth in Section 13.04.230, including a right to a hearing set forth in Section 13.04.240. c) A property owner must complete and submit the cross-connection survey required by the federal and state government, as provided by the Village within thirty (30) calendar days from the date of the U.S. postmark. The property owner is responsible for the proper completion of the survey. If the Village has not received the completed survey within thirty (30) calendar days from the date of the U.S. postmark, the Village shall send a notice to the current water user and property owner via U.S. first class mail, which shall include notice that the possible penalty is disconnection. If the Village does not receive the completed survey within thirty (30) calendar days after sending the first notice, the Village shall send the second notice via U.S. certified mail, which shall include notice that the possible penalty is disconnection. Failure to provide the Village with the completed survey within thirty (30) calendar days after sending out the second notice shall result in such property owner being served with a disconnection notice, which shall follow the procedures for nonpayment set forth in Section 13.04.230, including a right to a hearing set forth in Section 13.04.240.

Section 2: Title 13 “Water and Sewers,” Chapter 13.04 “Water Connection and Use,” Section 13.04.180 “Meter location and inspection” of the Wheeling Village Code is hereby amended to read as follows:

13.04.180 Meter location and inspection.

(a) Meters shall be installed in a location that will be easily accessible and protected from frost, and other dangers and damage and the owner or person in charge shall at all times permit any duly authorized village employee free entry

348088_1 2 for the purpose of examining, testing, reading or repairing such meter and appurtenant installations. Failure to permit a duly authorized Village employee entry to the premises for the purpose of installing, examining, testing, reading or repairing such meter and appurtenant installations shall result in disconnection and a notice of disconnection will be sent and shall follow the procedures for nonpayment set forth in Section 13.04.230, including a right to a hearing set forth in Section 13.04.240. Meters heretofore installed in inaccessible locations shall be moved at the expense of the owner of the premises. All owners and occupants shall, at their own expense, keep all water meters in good repair and properly protected from frost and other dangers and shall be responsible for the cost of replacing or repairing water meters that are damaged due to the failure of the owner and occupant to keep said meter in good repair or to protect said meter.

(b) Each building or other structure owned, rented or occupied independently of other buildings located on the same lot or subdivided area shall be served by a separate service line and shall be equipped with an individual water meter; except that private garages used for normal storage purposes and served from the water supply of one of the major buildings on the property need not be equipped with such meter.

Section 3: Any and all ordinances, sections or subsections of ordinances in conflict herewith are hereby repealed.

Section 4: In the event any part or parts of this Ordinance shall be found to be unconstitutional by a court of competent jurisdiction, such unconstitutionality shall not affect the validity of the remaining parts of this Ordinance.

Section 5: This Ordinance shall be in full force and effect from and after its passage, approval and publication as required by law.

SUBJECT: Dundee Road Intersection Improvements: Elmhurst Road/Dundee Road

EXECUTIVE SUMMARY The Village staff has been discussing and reviewing plans concerning the intersection of Dundee Road/Elmhurst Road with IDOT representatives for approximately three (3) years. The improvements include intersection expansion and turn lane additions. Village Staff recommends acceptance of the attached Agreement and associated costs to the Village for the new signal EVP.

IDOT has produced preliminary plans for the addition of two (2) new turn lanes at the subject intersection on Dundee Road in the Village. Cost to the Village of the construction work is estimated at $11,500, with substantial improvement to traffic flow at each intersection expected. In order to proceed with final design, IDOT has requested formal approval by the Village Board in order to proceed further with design drawings. This memorandum serves as a summary of various facets of the project.

Turn Lane Proposal Elmhurst/Dundee Intersection: 1. Dundee Road will receive a right turn lane for traffic turning southbound onto Elmhurst from eastbound Dundee Road. The turn lane will begin at the east shopping center driveway and extend to the intersection, but not south on Elmhurst. The roadway radius at the southwest corner will be increased to accommodate this change. The east Dundee Road driveway serving the currently vacant corner lot is expected to be removed.

2. Elmhurst Road will receive a right turn lane for traffic turning westbound onto Dundee Road from southbound Elmhurst Road. The turn lane will begin at the north restaurant (old Arby’s) driveway on Elmhurst Road and extend to the intersection, but not west on Dundee Road. The roadway radius at the northwest corner will be increased to accommodate this change. The south Phillips 66 gas station driveway on Elmhurst is expected to be removed.

Timing: IDOT intends to complete design drawings and the property acquisition process for right of way. Intersection construction improvements could begin as early as the Spring of 2016.

Jurisdictional Transfer: There is no jurisdictional transfer associated with this construction proposal.

Traffic signals: The signal at Elmhurst/Dundee will require an upgrade, which will cost the Village approximately $11,500.

Roadway lighting: No roadway lighting is proposed as part of these improvements. The Village is currently under contract with a consultant for the design of roadway lighting along the entire length of Dundee Road, including these intersections. IDOT has informed us that any requested lighting would be the full fiscal responsibility of the Village. The lighting design has been completed, and installation of the lighting is planned to take place in 2016 in conjunction with this intersection improvement. Currently the Village has secured funding for 80% of the cost of the new lighting.

Sidewalks: IDOT will be replacing any existing sidewalk that is currently located within the construction areas.

Utility relocations/adjustments: All utility work is the responsibility of IDOT.

Proposed Typical Roadway Pavement Section: Pavement will be asphalt in all locations.

Staff Comments: Given the limited but strategically important nature of these roadway improvements and the minimal proposed cost to the Village, Staff recommends approval of the attached Agreement.

A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF WHEELING AND THE STATE OF ILLINOIS FOR THE IMPROVEMENT OF ILLINOIS ROUTE 68 (DUNDEE ROAD)

WHEREAS, the Village of Wheeling (the “Village”), Cook and Lake Counties, Illinois is a home rule unit of local government pursuant to Article 7, Section 6 of the Constitution of the State of Illinois; and

WHEREAS, both the 1970 Illinois Constitution (Article VII, Section 10) and the Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.) authorize and encourage intergovernmental cooperation; and

WHEREAS, the Village and the State of Illinois (“State”), through the State’s Department of Transportation, desire to enter into an agreement for the improvement of Illinois Route 68 (Dundee Road), known as State Section: 3041N-3(12) in order to facilitate the free flow of traffic and ensure safety to the motoring public; and

WHEREAS, the Village and State have negotiated an agreement regarding the improvement of Illinois Route 68 (Dundee Road), known as State Section: 3041N-3(12) (the Agreement”); and

WHEREAS, the Agreement contemplates the widening of Illinois Route 68 (Dundee Road) and a traffic signalization project; and

WHEREAS, the Village believes that the Agreement will provide benefits to Village residents; and

WHEREAS, the Village President and the Board of Trustees have determined that the Village that it is in the best interests of the Village and the public health, safety and welfare of persons and property within the Village to enter into this Agreement.

NOW, THEREFORE BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF WHEELING, COUNTIES OF COOK AND LAKE, STATE OF ILLINOIS, AS FOLLOWS:

SECTION 1: Each Whereas paragraph above is incorporated by reference into this Section 1 and made a part hereof as material and operative provisions of this Resolution.

EXECUTIVE SUMMARY Requesting consideration for approval of Change Order No. 1, an increase of $30,000.00 to the contract with Mondi Construction concerning the 2015 Sidewalk Removal and Replacement Program. To avoid further disruption to residents in the future and to take advantage of favorable concrete installation pricing, we are requesting authorization to replace the sidewalk now while construction is taking place. Approval of this request will allow completion of sidewalk replacement in areas affected by the 2015 Water Main Replacement Program.

On April 6, 2015, the Village Board approved Resolution No. 15-48 awarding a contract to Mondi Construction in the amount of $38,449.75 for removal and replacement of approximately 1,820 lineal feet of deteriorated sidewalk slabs and 30 lineal feet of deteriorated curb and gutter in various locations. The contract was bid out and awarded through the Municipal Partnering Initiative (MPI).

During construction inspection of the 2015 Water Main Replacement Program by Public Works staff, approximately 1,200 linear feet of sidewalk were identified for future replacement on Sherwood Drive, 6th Street, 7th Street, and Glendale Avenue. While these sections of sidewalk are not in immediate need of replacement, Public Works and CIP staff personnel anticipate replacement within the next couple of years. To avoid further disruption to residents in the future and to take advantage of favorable concrete installation pricing, we are requesting authorization to replace the sidewalk now while construction is taking place. Allowing the additional sidewalk construction would permit completion of all water main installation, street resurfacing, curb, gutter, and sidewalk installation in one construction season.

The requested Change Order is in the amount of $30,000.00; the net effect of this Change Order is an increase in the approved contract amount from $38,449.75 to $68,449.75. Full funding is available in the Capital Improvement fund.

WHEREAS, additional sidewalks were identified for replacement on Sherwood Drive, 6th Street, 7th Street, and Glendale Avenue , resulting in an increase of $30,000 to the original contract, thereby creating a total contract amount of $68,449.75; and

WHEREAS, it is determined to be in the best interest of the Village of Wheeling to accept Change Order No. 1 for the above-referenced increase in contract price;

Per the Wheeling Historical Society’s request, this Ordinance authorizes the donation to the Society of certain items not being used by the Village.

AN ORDINANCE DECLARING AS SURPLUS AND AUTHORIZING THE DISPOSITION OF PERSONAL PROPERTY OWNED BY THE VILLAGE OF WHEELING CURRENTLY BEING STORED AT 77 WEST HINTZ ROAD

WHEREAS, the Village of Wheeling has received a request that certain unused items in the Public Works facility located at 77 West Hintz Road be donated to the Wheeling Historical Society; and

WHEREAS, in the opinion of the corporate authorities of the Village of Wheeling, it is no longer necessary or useful or in the best interests of the Village to retain ownership of the personal property hereinafter described; and

WHEREAS, it has been determined by the President and Board of Trustees of the Village of Wheeling that said property is of minimal market value and should be donated to the Wheeling Historical Society;

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF WHEELING, COUNTIES OF COOK AND LAKE, STATE OF ILLINOIS:

SECTION ONE: Pursuant to Section 5/11-76-4 of the Illinois Municipal Code, Illinois Compiled Statutes, Ch. 65, the Board finds that the following described personal property:

 One (1) ladder used by the Fire Department over 20 years ago  Paintings, photographs of past Village Boards, a collage, and numerous plaques concerning financial and other Village department accomplishments now owned by said Village, is no longer necessary or useful to the Village, and the best interests of the Village would be best served by its disposition.

SECTION TWO: Pursuant to said Section 5/11-76-4, the Village Manager or his designee is hereby authorized and directed to dispose of by transferring it to the Wheeling Historical Society.

SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, by a vote of at least three-fourths of the corporate authorities, and approval in the manner provided by law.
