BAY POINT COMMUNITY ASSOCIATION EMERGENCY MEETING OF THE BOARD FRIDAY, OCTOBER 19, 2018 AT 3:30 PM BPCA CONFERENCE ROOM APPROVED MEETING MINUTES

CALL TO ORDER: Ed Helms called to order at 3:30 p.m.

QUORUM: A quorum was established.

PLEDGE OF ALLEGIANCE: Ed Helms led the Board and all in attendance to stand and recite the Pledge of Allegiance.

Hurricane Committee Update: Ed Helms reported that the hurricane committee has been meeting every day at 10:30 AM and 3:30 PM to discuss plans, handle emergencies and provide a path to get the community back together. The committee members are Ed Helms, Carl Selph, Bill Wanner, Lynn Briley, Jack Kennedy and a new member John Warren due to his extensive knowledge and recent experience with Hurricane Erma clean- up.

Mr. Helms commended the staff, Lynn, Tom, Trisha, Debra, Jack, Jim, and all of our security staff for working extremely long hours and doing a stellar job. 1

Volunteers Jo Ann Day and Linda Corcoran have helped in . Lee Lilly is our contractor with SE Dirtworks and has been working closely with Jack Kennedy fixing issues as they arise. Mr. Lilly cleaned Baytown’s parking lot and took down a tree that was blocking the Post Office back door to allow the mail truck access to the building and allow the Post Office to remain open.

As mentioned at the Monday meeting, FEMA will not enter private roads and communities to remove storm debris. On Tuesday the county commissioners had an emergency meeting and they voted unanimously to enter private communities to remove debris. The County is going to do this and then file a claim with FEMA and will fight the battle with FEMA to receive reimbursement. If they do not collect anything from FEMA they will not come back to Bay Point for payment. They are in the process of signing a contract with GAC. GAC is the company that just completed BPCA road work. It couldn’t be a better situation. After removing debris from 911 routs GAC will come into our community and start removing debris. This should commence approximately a week from today.

The day after the storm a large number of tree guys flooded the community. We are now requiring contractors to provide their business license and proof of liability and workman’s compensation insurance to be allowed access to the community. Today the Florida Department of Business and Professional Regulation (DBPR) are on property enforcing license requirements. Unlicensed workers will be asked to leave and they will be fined by the DBPR.

A letter addressed to owners and residents was distributed containing information relevant to the community and how we will move forward with debris removal. These letters will be handed out at all gates to all residents entering the community and by volunteers in the community. They will also be available at the Post Office. Tom Worrel contacted WOW and Comcast regarding when they will be able to restore cable services. WOW said they should have service returned in two weeks, Comcast does not know when they can restore service.

Halloween is 12 days away. The community will not be ready to safely have trick-or- treating. An event is being planned to take place in the park on Halloween evening. Details are being worked out and will be released soon.

Motion to Fund Clean-up: Ed Helms reiterated that Bay County is going to come in to the community and remove storm debris that residents put on by the side of the road in the right-of- ways. That does not include what we have to do to clean up all BPCA’s common areas. All the islands, areas that are in the right-of-way, areas that owners have not done or are not responsible for taking care of. BPCA will have to contract to have these common areas cleaned. The committee has met with four large contractors from Naples, and other experienced large companies who have done this type of clean up before. Prior to learning that the County would come into Bay Point the first estimate received for clean-up was $2,850,000. With the County coming in to help it will drastically reduce the cost to clean-up what remains.

MOTION: by Carl Selph: The BPCA board of directors does hereby authorize the following actions: 1.) The Hurricane Restoration Committee is authorized to select, negotiate, and contract with a qualified disaster recovery contractor to fulfill the scope of the bid specifications (attached). 2.) The sum of $400,000 is appropriated for use by the Hurricane Restoration Committee to meet the requirements of the aforementioned contract and any necessary contingencies, second by Bill Wanner, and approved by five yea votes: Jo Ann Day, Carl Selph, Lisa Snow, Bill Wanner and Ed Helms. One nay vote: Walt Rankin.

Owners Concerns: Open discussion regarding the following topics took place:  Golf Villas water leak  Sink hole on Wahoo turned out to be erosion that is temporally fixed  Contractors receiving speeding citations must pay them immediately or they will lose their BPCA permit  Within the next week all security staff should be able to return to work  Thomas Dr. gate will close at sundown until the further notice due to security coverage and gate damage  Water boil warning is currently in effect  Road at Marina is blocked. A complaint of kids racing along the Marina road and causing disturbance. It was reported that the Marina road is now blocked

ADJORNMENT: There being no further business Ed Helms adjourned the meeting at 4:15 PM.
