  • Trump and Trade Updates – April 2017
Trump and Trade Updates – April 2017 Commerce Moves to Review China’s “Nonmarket Economy” Status 4/3/17 – The Trump administration on April 3, 2017 issued a notice of initiation and request for public comment and information pertaining to whether the People’s Republic of China (PRC) should continue to be treated as a nonmarket economy (NME) country under the antidumping and countervailing duty laws. The notice in the Federal Register indicates that this inquiry is part of the Department of Commerce’s less-than-fair-value investigation of certain aluminum foil from the PRC. The notice states that the Department of Commerce has treated the PRC as an NME country in all past antidumping duty investigations and administrative reviews. Yet, under the agreement with the PRC regarding its accession to the World Trade Organization (WTO), the PRC believes that WTO members were required to begin treating it as a market economy in December 2016. The department is conducting this inquiry in order to obtain the most recent data and information available from U.S. industry, and the notice states that U.S. law allows it to review the PRC's nonmarket economy status "at any time." The timing of this notice is interesting, given that Chinese President Xi Jinping is traveling to the United States for talks later this week. Draft Notice to Congress Indicates Intent to Begin Renegotiating NAFTA 4/3/17 – In a draft letter to the Senate and House of Representatives, the Trump administration appeared closer to formally announcing and notifying Congress of its intent to begin renegotiating the North American Free Trade Agreement (NAFTA).

JACOB WOHL, JACK BURKMAN, J.M. BURKMAN & ASSOCIATES, LLC, PROJECT 1599, MESSAGE COMMUNICATIONS, INC., and ROBERT MAHANIAN Defendants. PRELIMINARY STATEMENT 1. All eligible voters have the right to vote unimpeded by deception or intimidation. The right to vote “in a free and unimpaired manner is preservative of other basic civil and political rights” and “any alleged infringement of the right of citizens to vote must be carefully and meticulously scrutinized.” Reynolds v. Sims, 377 U.S. 533, 562 (1964). 1 Case 1:20-cv-08668-VM Document 102 Filed 05/19/21 Page 2 of 28 2. This case is about a targeted, discriminatory effort to infringe on the fundamental rights of New Yorkers—and others across the country—to vote in a safe, lawful manner. Jacob Wohl and Jack Burkman, through Burkman’s lobbying firm, J.M. Burkman & Associates, and the purported organization Project 1599 (collectively “Wohl and Burkman”), concocted a racist campaign that trafficked in stereotypes and spread lies and deception all for their shared goal of intimidating voters and depressing voter turnout to disrupt a presidential election.

It has been accepted for inclusion in University of Chicago Legal Forum by an authorized editor of Chicago Unbound. For more information, please contact unbound@law.uchicago.edu. The Rules of #MeToo Jessica A. Clarke† ABSTRACT Two revelations are central to the meaning of the #MeToo movement. First, sexual harassment and assault are ubiquitous. And second, traditional legal procedures have failed to redress these problems. In the absence of effective formal legal pro- cedures, a set of ad hoc processes have emerged for managing claims of sexual har- assment and assault against persons in high-level positions in business, media, and government. This Article sketches out the features of this informal process, in which journalists expose misconduct and employers, voters, audiences, consumers, or professional organizations are called upon to remove the accused from a position of power. Although this process exists largely in the shadow of the law, it has at- tracted criticisms in a legal register. President Trump tapped into a vein of popular backlash against the #MeToo movement in arguing that it is “a very scary time for young men in America” because “somebody could accuse you of something and you’re automatically guilty.” Yet this is not an apt characterization of #MeToo’s paradigm cases.

  • The People Shaping the Trump Administration
The People Shaping the Trump Administration Despite Running on a Pledge to ‘Drain the Swamp’ and Crack Down on Special Interests, Donald Trump Has Filled His Transition Team With Lobbyists and Others With Potential Conflicts November 16, 2016 – Donald Trump rode to the White House by raging about alleged rampant corruption in Washington and pledging to “drain the swamp.” Each of the five points in the ethics platform he issued in October focused on diminishing the influence of lobbyists.1 These included a promise to impose a five-year ban on former executive branch officials lobbying the federal government. Trump further promised to crack down on special interest-influence by expanding the definition of lobbyist to include consultants and others who trade on inside government information and expertise.2 But Trump’s nascent transition team, which will shape his administration, is swarming with lobbyists and other special interests. Many of the lobbyists are working for the transition on areas for which they currently are lobbying the federal government. Meanwhile, many of those who aren’t lobbyists appear to have potential conflicts of interest. Vice president-elect Mike Pence reportedly said on November 15 that the transition team would be purged of lobbyists, but the transition team has not made the point official.3 Even if true, that remedy would not address cases such as a defense contractor working on defense interests, or a lawyer for health care interests working on health care reform. Here are brief summaries of individuals who have been reported in the media as overseeing agencies or policies for Trump’s transition team.

Abstract Between 2017 and 2019, California experienced a series of devastating wildfires that together led over one million people to be ordered to evacuate. Due to the speed of many of these wildfires, residents across California found themselves in challenging evacuation situations, often at night and with little time to escape. These evacuations placed considerable stress on public resources and infrastructure for both transportation and sheltering.

  • Screendollars
Monday, May 24, 2021 | No. 169 When Star Wars opened May 25, 1977 no one but Steven Spielberg thought it would be a hit. George Lucas had been turned down by Universal, United Artists and Disney before pitching 20th Century Fox his sci-fi epic inspired by 1930's serials like Flash Gordon and Buck Rogers, the 1966 TV series Star Trek and Frank Herbert's 1965 novel Dune. Fox creative affairs chief Alan Ladd, Jr. greenlighted SW, but Fox's distribution arm never considered it a likely hit. Fox marketers wanted to change the title because moviegoers might think Star Wars was about the Vietnam War or, perhaps, superstars Elizabeth Taylor and Richard Burton's divorce. When Lucas screened a rough cut for some director pals, they weren't impressed. Brian De Palma reportedly called it the "worst movie" ever made. Spielberg, however, predicted SW would be "the biggest movie of all time." Lucas thought SW was doomed and skipped its premiere to vacation with Spielberg in Hawaii where they heard SW was a boxoffice phenomenon and then came up with a new project to do together -- Raiders of the Lost Ark (1981), the first Indiana Jones blockbuster. Exhibitors were reluctant to book SW, thinking only kids and sci-fi buffs would buy tickets, so it opened at just 32 theatres. Two days later, it was in 43 theatres and a week later in 157. It peaked in mid-August at 1,096, a very wide run then. Produced for $11 million, its original release did $461 million domestically and $196 million abroad – huge numbers at Theatrical Poster for Star Wars, the time.

The NYAG’s proposed Complaint in Intervention is attached as Exhibit A along with a proposed Order attached hereto as Exhibit B. The NYAG brings this motion now to ensure that the Court has sufficient time to consider this request, while Defendants’ interlocutory appeal to the Second Circuit is still pending.1 ECF No. 81. Moreover, discovery is in a very preliminary stage and there has been no substantive motion practice seeking summary judgment on the merits of plaintiffs’ case. Accordingly, the parties would not be burdened by the addition of NYAG to enforce and represent the rights of New York, in addition to the individual claims raised herein.
