BACKGROUND:

The North Koel Reservoir project is situated in the most backward tribal area in Palamau/Garhwa districts of Jharkhand State. The project was originally accepted by the Advisory Committee of MoWR in its 13th meeting held on 19.03.1980 for Rs. 113.17 crore subject to forest clearance by Ministry of Environment & Forests (MoEF). Later on 11.89 km long Left Bank Canal (LBC) was added to the scope of the project. The modified proposal costing Rs. 439.03 Crore was considered and accepted by the Advisory Committee of MoWR, RD&GR in September, 1989 in its 44th meeting subject to compliance of the stipulations of the Ministry of Environment and Forests. The construction works had started in the year 1972.The work continued till 1993 and was stopped in that year by the Forest Department, Govt. of Bihar. Since then, the work on dam is at a standstill. An expenditure amounting to Rs. 769.09 crore is reported to have been incurred on the project till date. The MoEF had objected during 1993 to the installation of gates with the apprehension that water accumulated in the dam would threaten the and . The clearance from MoEF in respect of submergence of forest land of 1007 hectare of buffer area of Palamau Tiger Reserve could not be obtained.

The matter was discussed in a meeting held on 30-06-2016 at New wherein in order to operationalize the project without much delay and realize value from the investments already made, it was decided that the ponding level in the dam be such that there is no submergence of additional land. It was decided that the Full Reservoir Level (FRL) of the reservoir may be restricted to Elevation (EL) 341.0 m for saving of core area of Palamau Tiger Reserve. As a result of reduction of FRL by 26.28 m, at the new FRL of EL 341.0 m (instead of originally envisaged EL 367.28m), 1,11,521 hectare land under drought prone area of Palamau and Garhwa districts of Jharkhand and Aurangabad and Gaya districts of Bihar will be irrigated annually.

MoWR, RD & GR had constituted an Empowered Committee (EC) under the Chairmanship of Secretary, MoWR, RD & GR to monitor the implementation of the balance works of North Koel Project vide Memorandums dated 21.02.2017 & 24.03.2017. CE (IMO), CWC is the Member Secretary of the said EC. 1stmeeting of the EC was held on 01.06.2017.

MoWR, RD & GR had also constituted a Technical Evaluation Committee (TEC) under the Chairmanship of Member (WP&P), CWC for completing the balance works of North Koel Project in May, 2017. CE (IMO), CWC is the Member Secretary of the said TEC. Irrigation Planning(South) DirectorateofCWC is entrusted with work of Secretariat of the TEC.

The approval of Cabinet received vide Cabinet Secretariat’s No. 28/CM/2017(i) dated 18th August 2017 for completion of the North Koel Reservoir Project for estimated cost of Rs. 1622.27 croresto be incurred during three financial years (2017-18, 2018-19 & 2019- 2020) for the following was conveyed by MoWR, RD & GR vide Office Memorandum F.No. Z-16012/92/2016-FM/3781-3798 dated 15.09.2017.

 Restricting water level behind the dam at an elevation of EL 341.0 m.  Meeting the cost of common components of Rs. 1013.11 crores of balance works as a grant from Long Term Irrigation Fund (LTIF) under Prime Minister KrishiSinchaiYojna (PMKSY).  Meeting the 60% cost of the remaining cost of balance works amounting to Rs. 365.6 crores from LTIF as a grant to the State of Bihar and Jharkhand for an amount of Rs. 212.43 crores and Rs. 31.23 crores respectively.  Arranging the 40% of the remaining cost of balance works amounting to Rs. 243.66 crore by the State Governments of Bihar and Jharkhand as loan from LTIF through NABARD at the rate which is not subsidized and is related to the market borrowing cost with no interest subvention. Cost increase, if any, over land above the present estimated cost of balance works of the project, would be shared by the two State Governments.  For execution of balance works of the project by M/s WAPCOS Ltd., a CPSU under MoWR, RD & GR as the Project Management Consultant (PMC) with a centage of 5% of the work components of balance project cost on a turnkey basis, within a period of 30 months from the award of work.  For monitoring of execution of the balance works of the project by an Empowered Committee of Government of headed by CEO, NITI Aayog.  State Governments of Bihar & Jharkhand to immediately complete land acquisition, settle R&R issues and handle related litigation(s) and provide the necessary protection including law and order support during the execution/completion of the balance works of the project to the CPSU.

In pursuance to the approval of the Cabinet for completion of the North Koel Reservoir Project, MoWR, RD & GR vide Office Memorandum dated 18.09.2017 and dated 25.09.2017 has re-constituted the Empowered Committee (EC) to monitor the implementation of the balance works of North Koel Reservoir Project with CEO, NITI Aayog as its Chairman. The first meeting of the re-constituted Empowered Committee (EC) to monitor the implementation of the balance works of North Koel Project was held on 08.11.2017 at under the Chairmanship of CEO, NITI Aayog.

2. SALIENT FEATURES OF BALANCE WORKS

The details of the financial implications for incurring Rs. 1622.27 crore for completion of balance works between Centre and States are as under:

Both the State Government have agreed to engage M/s WAPCOS Ltd, a CPSU under MoWR, RD & GR for project management consultancy and execution of the balance works component of the project for estimated cost of Rs. 585.98 Cr. The detailed scope of work / assignment is as under.

3. AGREEMENT AND MEMORANDUM OF UNDERSTANDING (MoU)

A Contract Agreementamongst CWC, Water Resources Departments of State Govts.of Bihar and Jharkhand and WAPCOS was signed in 26th September 2017 for execution/completion of balance works of North Koel Project.TEC recommended the 4 nos. of amendments in contract agreement amongst various amendments proposed by WAPCOS for acceptance of parties. The approval of Secretary, WR, RD & GR to the proposed Amendment No. 1 (four amendments) on the contract agreement amongst CWC; Water Resources Department, Govt. of Bihar; Water Resources Department, Govt. of Jharkhand and M/s WAPCOS Ltd. for “Execution / Completion of Balance Works of North Koel Reservoir Project, Jharkhand & Bihar” signed on 26th September 2017 was conveyed by the FM Wing of MoWR, RD &GR vide letter dated 11.03.2019. Thus, the Amendment No. 1 (four amendments) approved by MoWR, RD & GR has become the part of the contract agreement signed on 26th September 2019 amongst the parties mentioned above.

MoU amongst Centre and both the State Govts and Supplementary MoAs for funding arrangements through Long Term Irrigation Fund (LTIF) for State’s share in respect of Govts. of Bihar and Jharkhand was signed in 12th January, 2018

4. FUNDS RELEASED TO THE PROJECT

An amount of Rs. 572.38 crore has been remitted by MoWR, RD & GR to WRD, Jharkhand towards Central Assistance (CA) from LTIF through NABARD for the forest related components. As part of compliance of the conditions of Stage –I clearance, the State Government has deposited the requisite amount in Adhoc CAMPA account. Central Assistance (CA) for the project works, amounting to Rs 8.05 crore was released by MoWR, RD & GR to WAPCOS in FY 2017-2018 and Rs. 78.75 crore (Rs. 10. 32 cr. + Rs. 2.77 cr. + Rs. 2.82 cr. + Rs. 57.36 cr. + Rs. 5.48 cr.) in the FY 2018-2019. Total CA released to M/s WAPCOS Ltd. till date: Rs. 86.8 crore.

5. Latest meeting of Technical Evaluation Committee (TEC) for completing the balance works of North Koel Project

Till date, total 20 meetings of TEC were held and the last being held on 14.05.2019. The list of participants of 20th TEC meeting is placed at Annex-I. During this meeting, the issues regarding the tender of RMC work for Jharkhand portion up to Bihar border (RD 0.00 km to 31.40 km); the status of Revised Cost Estimates (RCE) of North Koel Reservoir Project; the matter regarding readiness by WAPCOS to start the work at dam site immediately once the NOC from the State Forest Department is obtained; the process for handing over of all the required land by both the State Govts. of Jharkhand and Bihar to WAPCOS for execution of works within stipulated time; Work Plan and Status of balance works being executed by WAPCOS etc. were discussed.
