LEMBRAMOS, AINDA, QUE AS VENDAS REALIZADAS NO LEILÃO SÃO IRREVOGÁVEIS E IRRETRATÁVEIS, NÃO PODENDO O COMPRADOR RECUSAR O(S) ANIMAL(AIS) ADQUIRIDO(S). “ 203 Anos de Seleção e Tradição “ REGULAMENTO & NORMAS ESPECÍFICAS Regulamento, Normas Específicas e Condições Gerais I – CONDIÇÕES GERAIS 1º - O Leilão 4 ASES & 1 CORINGA será realizado no dia 03 de maio de 2011 (terça-feira), a partir das 20:00 horas, no Castelo do Batel, em Curitiba/Paraná, situado na Avenida do Batel 1323. 2º - O leilão terá como empresa leiloeira devidamente autorizada pelos vendedores a Agência TBS Ltda, a qual será a responsável pela organização e pelo marketing do certame. 3º - A arrematação far-se-á pelo maior lance, sendo que: “as vendas realizadas em leilão são irrevogáveis e irretratáveis, não podendo o comprador recusar o animal adquirido ou solicitar redução de preço”, conforme o disposto no Art. 1.106 do Código Civil. 4º - Todos os participantes - compradores, vendedores, licitantes e presentes e mesmo os que efetuarem lance pelo telefone - obrigam- se a acatar de forma definitiva e irrecorrível as disposições do presente regulamento, o qual é considerado como conhecido por todos, não podendo ninguém se recusar a aceitá-lo e cumpri-lo, alegando desconhecê-lo, conforme disposto no Artigo 3 da Lei de Introdução ao Código Civil. 5º - O comprador concede ao vendedor, em penhor pecuniário, a mercadoria adquirida, até a liquidação total da divida, ficando o comprador de posse da mercadoria, na qualidade de fiel depositário. 6º - Assiste ao vendedor o direito de solicitar avalista de seu conhecimento, desde que manifeste esta exigência por escrito à Agência TBS Ltda, antes do acerto financeiro do comprador. 7º - O não pagamento de qualquer das prestações, em seu exato vencimento, implicará na cobrança antecipada de todo o saldo devedor. 8º - Antes do Leilão os animais a serem licitados estarão à disposição dos interessados nos respectivos haras ou nas cocheiras do JOCKEY CLUB DO PARANÁ. Os animais também poderão ser examinados no dia do leilão, a partir das 15:00 no Castelo do Batel. Os mesmos deverão ser examinados pelos interessados e/ou seus treinadores, veterinários ou prepostos, antes da realização do leilão, ficando, portanto, INACEITÁVEIS quaisquer reclamações posteriores. PARÁGRAFO PRIMEIRO - Reiteramos aos interessados que procedam a devida revisão dos animais com antece- dência, pois reclamações pós-leilão não procedem e não serão aceitas. 09º - Os vendedores e a Agência TBS Ltda. não se responsabilizarão por quaisquer alterações ocorridas no estado dos animais após a arrematação. Batido o martelo, o animal estará por conta e risco de seu adquirente, cessando toda e qualquer responsabilidade por parte do vendedor e da Agência TBS Ltda. 10º - Após a arrematação, os animaisdeverão ser retirados de suas cocheiras do Jockey Club no prazo máximo de 4 (QUATRO) dias, a partir do dia do Leilão (inclusive este). Findo este prazo o trato passará a correr por conta do comprador, e por ele deverá ser pago diretamente ao vendedor no dia da retirada do animal. Fica estipulado que o valor diário do trato será de R$ 35,00 (trinta e cinco reais) por dia. II - DOS COMPRADORES 11º - O comprador deverá efetuar seu acerto no máximo até o 1º dia útil no escritório da Agência TBS Ltda, situado na Vila Hípica do Jockey Club do Paraná - Grupo 44, em horário comercial, ou através de acerto via Correio e Depósito Bancário para compradores de fora da praça de Curitiba. PARÁGRAFO ÚNICO - Vencido este prazo, o comprador estará sujeito à multa de 10% (dez por cento) do valor total da arrematação, além de correção monetária de acordo com a inflação e juros de 4% (quatro por cento) ao mês. 12º - Os compradores que não estiverem cadastrados, ou aqueles cujos cadastros não sejam aprovados, terão de efetuar seus pagamentos à vista, gozando dos descontos estipulados a seguir: 13º - CONDIÇÕES DE PAGAMENTO: O valor do lance multiplicado por 1 5 (q u i n z e), (1+14), resultará no valor total da arrematação A) - Em 15 (quinze) parcelas, iguais, mensais, sucessivas e sem juros, sendo que a primeira vence no ato da arrematação, juntamente com as taxas do leilão, e as outras 14 parcelas vencem sucessivamente a cada 30 dias contados a partir da data do leilão. B) A vista com desconto de 10% (dez por cento) sobre o valor total do arremate. PARÁGRAFO ÚNICO: O valor das taxas devidas será sempre calculado e pago sobre o montante total a prazo da arrematação, independentemente do desconto para pagamento a vista, e sobre estas taxas não incidirá desconto algum. 14º - Os compradores deverão pagar as seguintes taxas no ato da arrematação (IRREVERSÍVEIS mesmo em caso de anulação da venda, devolução, desconto, cancelamento, etc.): A) - 8,0% (OITO por cento) sobre o valor total da compra a prazo. B) - Transferência de propriedade (valor fixado pela ABCPCC). PARÁGRAFO ÚNICO: A taxa de transferência de propriedade será paga diretamente à ABCCC / STUD BOOK BRASI- LEIRO, pelo comprador, após este receber em seu endereço, via correio, AR, os documentos pertinentes ao animal arrematado, enviados pela TBS após esta, por sua vez, haver recebido as notas promissórias e contrato de compra e venda assinados pelo comprador e avalista (quando solicitado). “ 203 Anos de Seleção e Tradição “ 15º - Aos compradores compete ainda: A) - Preencher formulário onde constará nome, identidade, CPF, telefone, endereço e destino do animal. B) - Assinar Nota Promissória no valor correspondente ao total da arrematação, acrescido da taxa de transferência, com vencimen- to contra apresentação, e que deverá ser trocada ou paga quando da regularização da compra. A não regularização da compra conforme o exposto nos Artigos 13º, 14º, e 15º autorizará o vendedor a cobrar o animal a vista, através desta Nota Promissória. C) - Assinar transferência de propriedade. D) - Assinar contrato de financiamento e de compra e venda. E) - Assinar Nota Promissória no valor das taxas devidas (vide Artigos anteriores), com vencimento contra apresentação e que deverá ser trocada ou paga quando da regularização da compra. A não regularização da compra autorizará a Agência organizadora do evento a cobrar estas taxas devidas em quaisquer casos através desta Nota Promissória. III - DISPOSIÇÕES FINAIS 16º - O animal arrematado será entregue pelo vendedor mediante autorização por escrito da Agência TBS Ltda. ou do próprio vendedor, a qual será dada imediatamente após a regularização da aquisição e o acerto final por parte do comprador. PARÁGRAFO ÚNICO - Eventuais problemas decorrentes da não retirada do animal são de exclusiva responsabilidade do comprador. 17º - A palavra do leiloeiro oficial, Sr. JOSÉ L. L. NETO, no decorrer do leilão, tem fé pública, e estará credenciada a alterar, completar ou retificar estas normas, bem como quaisquer informações constantes nos catálogos de venda, aos quais foram dispensados os necessários cuidados, o que não impede qualquer interessado de verificar a exatidão das informações neles contidas. 18º - Após o prazo de 4 (quatro) dias úteis, caso não tenha ocorrido o acerto final por parte do comprador, o vendedor poderá aceitar ou não, com a anuência da Agência TBS Ltda, a substituição do comprador. 19º - Os vendedores tem como obrigação apresentar a venda animais desalienados, em seu nome , e com seus documentos em ordem. Estas exigências são de total e exclusiva responsabilidade dos vendedores e o não cumprimento de qualquer delas poderá ocasionar o impedimento da apresentação do animal no leilão. Caso isto ocorra, o vendedor continuará obrigado a quitar seus compromissos junto a Agência leiloeira. Não podendo em caso algum deixar de honrar seus acertos financeiros, relativos as despesas do leilão ou de taxas. A responsabilidade da venda de animal sem documento ou alienado é exclusiva de cada vendedor. 20º -São sempre de exclusiva responsabilidade do vendedor a entrega do animal acompanhado de sua devida documentação e dos exames de praxe 21º - Os casos omissos serão julgados pela Agência leiloeira (TBS), não podendo ser encaminhado nenhum tipo de reclamação sem primeiro ocorrer o acerto final e a regularização da compra.
