The Senate and the Fight Against the 1885 Chinese Immigration Act The Senate and the Fight against the 1885 Chinese Immigration Act by Christopher G. Anderson On June 22, 2006, the Prime Minister rose in the House of Commons to “offer a full apology to Chinese Canadians for the head tax and express our deepest sorrow for the 2007 CanLIIDocs 309 subsequent exclusion of Chinese immigrants.” After recalling the fundamental role that Chinese Canadians had played in the nation-building construction of the Cana- dian Pacific Railway (CPR), the Prime Minister observed how – once the line was completed – “Canada turned its back on these men” as it imposed a $50 Head Tax on Chinese migrants in 1885, increased this to $100 in 1900 and then to $500 in 1905, and finally expanded the scope of its exclusionary measures in 1923 to make it all but impossible for Chinese immigrants to resettle legally in Canada through into the post-Second World War period. Although the various race-based measures insti- tuted to exclude Chinese migrants were deemed to be legal at the time, they were, ac- cording to the Prime Minister, “inconsistent with the values that Canadians hold today.” This article argues that at the time of the 1885 legislation, and for some time after, there were voices that spoke out against these discriminatory policies. Most specifically, this sentiment dominated debates on the question in the Canadian Sen- ate between 1885 and 1887, and it did so to such an extent that government support- ers had to resort to some clever procedural maneuvers to see the law passed and amended against the will of the majority of Senators. In an important sense, then, these restrictive measures are not only “inconsistent with the values that Canadians hold today,” but also conflict with values held by Canadians in the late 19th century, values that can be traced to a set of liberal beliefs on the rights of non-citizens inher- ited from Britain. The debates that took place in the Senate are, therefore, both inter- esting and important because they provide greater depth to our understanding of the historical record of race relations in Canada. Benedict, Ph.D. ABSTRACT This dissertation is the first study to examine the Irish and Chinese interethnic and interracial dynamic in the United States and the British Empire in Australia and Canada during the nineteenth and early twentieth centuries. Utilizing comparative and transnational perspectives and drawing on multinational and multilingual archival research including Chinese language sources, “The Global Irish and Chinese” argues that Irish immigrants were at the forefront of anti-Chinese movements in Australia, Canada, and the United States during the second half of the nineteenth century. Their rhetoric and actions gave rise to Chinese immigration restriction legislation and caused major friction in the Qing Empire’s foreign relations with the United States and the British Empire. Moreover, Irish immigrants east and west of the Rocky Mountains and on both sides of the Canada-United States border were central to the formation of a transnational white working-class alliance aimed at restricting the flow of Chinese labor into North America. Looking at the intersections of race, class, ethnicity, and gender, this project reveals a complicated history of relations between the Irish and Chinese in Australia, Canada, and the United States, which began in earnest with the mid-nineteenth century gold rushes in California, New South Wales, Victoria, and British Columbia.

    “The Present of California May Prove … the Future of British Columbia”: Local, State, and Provincial Immigration Policies Prior to the American Chinese Exclusion Act and Canadian Chinese Immigration Act Jay M. Perry* n August 2017, American presidential advisor Stephen Miller announced a proposal to reduce immigration to the United States. Under the proposal, new immigrants would receive priority under Ia system awarding points based on a variety of criteria, including but not limited to proficiency in English and high-demand skills. Miller explained the inspiration of the proposed policy, claiming, “we looked at … the Canadian system. We took things we liked. We added things that made sense for America and where we are as a country right now.”1 This was not the first time an American or Canadian government official took an immigration policy from the other and adapted it to meet new circumstances. Miller’s comments reflect a history dating to nineteenth-century debates over Chinese migration to California and British Columbia. This study emphasizes British Columbia’s and California’s efforts to curb Chinese immigration through shared, borrowed, and adapted rhetoric, policy initiatives, and lobbying efforts between 1850 and 1885. British Columbia and California shared economies and settlement patterns in the second half of the nineteenth century, including Chinese migration disproportionate to the rest of their respective countries. People and policies moved along the Pacific Coast with little regard to international borders. Empire manifested itself most prominently in urban settings, Tespecially in Victoria, British Columbia’s capital city. Nineteenth-century Victoria – like Melbourne, Auckland, and Cape Town – was an entrepôt in a settler-colony linked to the larger networks of global commerce and racialized hierarchies. In such outpost cities, as the Australian geographer Jane Jacobs observed, and Renisa Mawani and Penelope Edmonds have demonstrated, “the spatial order of imperial imaginings 1 was rapidly … realised” in distinctive racial patterns and morphologies. Nothing symbolizes racialized spatial order and race relations as much as Victoria’s Chinatown. This, Canada’s oldest Chinatown, was established in the colonial era and, according to prevailing opinion, provided a haven for Chinese immigrants who were disliked by white residents in the host community.

MARSHALL* Historians have generally believed that the provincial legislature in post-Confedera- tion British Columbia divided along “Island vs. Mainland” lines prior to the introduction of political parties. This myth is challenged in a study using political voting records and the computer-based methods of legislative roll-call analysis. A systematic re-examination of a traditional source, nineteenth-century newspapers, further supports a new interpretation: that in the inaugural period of Confederation an “Island vs. Mainland” schism did not exist in the B.C. legislature, but a “Rural vs. Urban” split was evident. The underlying divisive issue was adoption of the Canadian tariff. This study looks at some of the ways in which the creation of a new Canadian state in 1867 influenced ways of thinking about the nature of political association and civic identity. Based on a thorough analysis of English-Canadian magazines published between 1867 and 1900, as well as major books and pamphlets written about the constitution in Canada, many by the same authors, it focuses on the English-Canadian intellectuals and public writers who tended to write most systemically about such issues. This study assesses changing ideas of political association in these sources through an analysis of the key political concepts of constitution, nationality, citizenship, and loyalty, each of which form the basis of separate chapters. It argues that ideas of “modern” political association developed by these concepts often led to concerted efforts to describe the Canadian state as a legitimate and natural container of civic affiliation. While many described these concepts as increasingly defined by the relationship between the individual and the territorial, constitutional state, they continued to be guided by assumptions about racial identity and lines of exclusion.

Some families emigrated with their British servants in tow. There were repeated efforts to import English girls and women en masse. And many employers were obliged to tolerate ‘strangers’ (Aboriginal and Chinese servants) in their homes. ' A Thesis submitted in Partial Fulfilment of The Requirements for the Degree of MASTER OF ARTS in the Department of HISTORY. The University of British Columbia. September, 1950. An abstract of the the3is DOMINION POLICY on Immigration and Colonization. 1867-1939. This dissertation gives a brief background of the development of Canada in the period preceding Confederation. In this is included a short account of the plans for acquiring]and the acquisition of the North-^est Territories. Then follows an account of the development of dominion policy regarding the disposition of the Crown lands and the attempts to attract settlers to farm those lands. The building of the first transcontinental railroad is also briefly treated. Some attention is given to the early settlements, both for• eign and British, and the reasons for the failure of much of the government effort in that field. The study of the great priod of development in the years following 1896, the work of Sifton in bringing about the expansion of settlement, increasing immigration, building additional railroads, stimulating the colonization companies, and the resulting increase in all branches of industry, is them made, in more detail. The decline of immigration as a result of depression and the disappearance of the free homestead is then s studied, and finally the effect of World War I on immigration. The following section treats of the post-war period and its curtailed immigration and of the efforts of the governments to stimulate immigration through the British Empire Settlement Scheme, especially in the application of this scheme to Canada.
