Printed Schedule of Rates applicable for execution of the work :- CurrentBidhannagar Circle, P.W.D. s Schedule of Rates for Buildings Works, S & P Works The willing agencies are requested to submit their application in their printed pad containing full mailing address with Mobile no. & Land Line number (if any) along with required documents (Self Attested) as mentioned herein below. A)Intending tenderers are required to produce current Professional Tax Deposit Challan / Professional Tax Clearance Certificate, PAN Card issued by the IT Deptt., Govt. of India, valid 15-digit Goods and Services Taxpayer Identification Number (GSTIN) under GST act, 2017 as per Notification vide memo no.-4374-F(Y) dated. 13th. July, 2017 of the Finance Department, Trade License from the respective Municipality /Corporation or Panchayet, plumbing license in case of (S & P), valid partnership deed (in case of partnership firm) etc. all in original along with one set of self- attested photocopies to the Assistant Engineer at the time of application for being entitled to participate in the tender. It may be emphasized that WITHOUT THE ABOVE DOCUMENTS IN ORIGINAL THE APPLICATION MAY NOT BE ENTERTAINED. B) Tender documents, specific priced schedule of items for the works and other relevant particulars maybe seen by the intending tenderers in the office of the Assistant Engineer, P.W.Dte., Kolkata East Sub Division-IV, Aliah University Campus (Park Circus), 17, Gorachand Road, Kolkata-700 014 on all working daysbetween 12.00 Noon to 4.00 P.M. C) Earnest Money in the form of Demand Draft / Pay Order payable to the “Executive Engineer, P.W.Dte., Kolkata East Division” mustbedeposited alongwith the tender.VIII th Issueof NSC cannotbe pledged as Earnest Money as per postal rule. Unpledged instruments will not be entertained. In case of partnership firm(s), the pledged instrument(s) must reflect the name(s) of the firm as well as the name(s) and address(es) of the partner / partners who is/are authorized to pledge the same as per valid partnershipdeed(s). D) In case of Registered Unemployed Engineers Co-operative Societies and Registered Labour Co- operative Societies, documents of credentials showing satisfactorycompletion of a single work in P.W.D. /PW(Roads) Dte. / Housing Dte. of Government of West Bengal commencing on or after 01.04.2006 of value not less than 40% of the Estimated Cost of the work applied for, Certificate of Registration from the respective Assistant Registrar of Co-operative Societies, Professional Tax Deposit Challan / Professional Tax ClearanceCertificate, PAN Card, must be produced in original along with one set of attested / self-attested photocopies at the time of application for issuance of tender papers. WITHOUT THE ABOVE DOCUMENTS IN ORIGINAL THE APPLICATION MAY NOT BE ENTERTAINED. Payment Certificates in lieu of credentials will not be accepted. E) Ifthedatesfallon holidaysor on days of bandh ornaturalcalamity, the dates defer to next working days. TheAssistant Engineer, P.W.Dte., Kolkata East Sub Division-IV reserves the right to refuse permission to any applicant without assigning any reason whatsoever and no challenge against such refusal will be entertained. F) All tenderers are requested to be present personally during opening of tenders positively. If considered necessary, instant bid maybe conducted immediately after openingof tenders to lowerdown rates and in no casehis /her absence will stand against holding the same. G) In case of inadvertent typographical mistake found in the specific priced schedule of rates, the same will be treated to be so corrected as to conform with the prevailing relevant schedule of rates and / or technically sanctioned estimate. H) The intending tenderer is required to quote the rate in figures as well as in words in hisown handwriting and same ink as percentage above / below than or at par with the relevant priced schedule of rates. The intending tenderer is required to sign in English, Bengali or Hindi. Signature of tenderer in all locations must be identical. I) Signature, name, address and occupation of witness to contractor s signature should be properlyfilled up. A participating tenderer in the same work must not be a witness. J) Issuanceof work order as well as payment willdepend on availabilityof fund and no claim whatsoever will be entertained for delay of Issuance of work order as well as payment, if any. Intending tenderers may consider these criteria while applying for permission and while quoting their rates. K) The accepting authority reserves the right to reject anyor all the tenders without assigning anyreason whatsoever and he will not be bound to accept either the lowest tender or any of the tenders. L) If an agency who isallowed to participate in thetender does not drop thetender along with required earnest money he will not be allowed to participate in the next 3 (Three) nos. consecutive tenders of this Sub- Division and no correspondence will be made in this regard. M) If any tenderer withdraws his offer before acceptance or refuse within a reasonable time without giving anysatisfactory explanation for such withdrawals, he shallbe disqualified for submitting tender to this Sub-Division for minimum period of 1 (one) year. N) The contractor shallhave to take photographyof the work just before commencement and after completion of different stages which shall have to be submitted with the billin duplicate and no extra payment willbe made on this account. All the agencies shall have to fillup their mobile number and email address otherwise the tenders may treated as informal.
O) Deduction of Tax shall be as below as per provision :- i) Cess @ 1% (One Percent) of the cost of construction works will be deducted from the bills of the contractors on all contracts awarded on or after 01.11.2006 in pursuance with G.O. No. 599A/4M-28/06 dated 27.09.2006. ii) Successful Tenderers will be required to obtain valid Registration Certificate & Labour License from respective Regional Labour Offices where construction workbythemareproposedto becarriedoutas perClausesu/s7 of West Bengal Building & other Construction Works Act, 1996 and u/s 12 of Contract Labour Act. iii) Power of Attorney holders are not allowed to sign Tender Documents unless otherwise approved by Government. iv) Clause - 25 of the conditions of contractof the West Bengal Form No. 2911/2911(i)/2911(ii) may be treated to be omitted and there is no provision for arbitration for resolution of disputes that mayarise outof the contracts to be entered into by the Department with the contractors for the purpose of carrying out execution of public works as per G.O. No. 558/SPW dated 13-12-2011 of P.W.D. v) Clause - 17 of the conditions of contractof theWestBengalForm No. 2911/2911(i)/2911(ii) have been amended as per GazetteNotification No.5784-PW/L&A/2M-175/2017 dated 12-09-2017 of P.W.D. (Law & Arbitration Cell). vi) Successful tenderer will be required to observe the following conditions strictly as stated below.If there is any violation of any or all the relevant criteria, as stated below, during execution of the job, it will render the concerned agencies ineligible for the work then and there or at any subsequent stage as may be found convenient. (a) Employees ProvidentFund and Miscellaneous ProvisionsAct,1952 and Employees State Insurance Act, 1948 should be strictlyadhered to wherever such Acts become applicable. (b) Minimum wages to the workers shall bepaid according to the rates notified and /or revised bythe State Governmentfromtime to timeunder theMinimumWages Act,1948 in respect of scheduled employments,within the specified time as per law. Payment of bonus, wherever applicable, has to be made. (c) Adequate safety and welfare measures must be provided as per the provisions of the Building and other Construction Workers (Regulation of Employment & Conditions of Service) Act, 1996 read with WestBengalBuilding and Other Construction Workers (Regulation of Employment and Conditions of Service Rules, 2004). (d) All liabilities arising out of engagement of workers are duly met before submission of bills for payment. P) Each bidder may participate 1 (one) no of work only. If any bidder participate more than one work then his/her participation will be cancelled against all works. Q) Additional performance security @ 10% of the tendered amount , in the form of Bank Guarantee from any Scheduled Bank before issuance of the Work Order, shall be obtained from the successful bidder if the accepted bid value is 80% or less of the Estimate put to tender. If the bidder fails to submit the Additional Performance Security within seven working days from the date of issuance of Letter of Acceptance, his earnest money will be forfeited and other necessary actions will be taken as per No:-4608- F(Y ) dated:-18/07/2018 of the Finance Department, Audit Branch, Govt. of West Bengal. Special Terms and Conditions for Tarfelting works ::-- The Securitydeposit@10 %of the executed valueof the work shall be deducted from the bill and retained till completion of the Defect LiabilityPeriod which shall be for a period of 5 (Five) years fromthe date of Completion of the work. If anydefect is observed within the Defect Liability Period, the Firms shall have to rectify the defect at their own cost very promptly on receipt of report from the office.
