1.1 DCO Application

1.1.1 Wheelabrator Technologies Inc. (WTI) has made an application to the Secretary of State (SoS) for Business, Energy and Industrial Strategy for a Development Consent Order for the construction and operation of a 75MW waste-to-energy facility, ‘the Wheelabrator Kemsley Generating Station’ ("K3") and for the construction and operation of a 42MW waste-to-energy facility, ‘Wheelabrator Kemsley North’ ("WKN").

1.1.1 K3 is a waste-to-energy facility located adjacent to and east of the DS Smith , to the north of , . Planning permission was granted for K3 in 2012 by Kent County Council with a generating capacity of 49.9MW and a waste processing capacity of 550,000 tonnes per annum. The facility is now substantially constructed and is expected to be operational in late 2019.

1.1.2 The applicant has identified that K3 would be capable of processing an additional 107,000 tonnes of waste per annum and, without any change to the external design, generating an additional 25.1MW of electricity. However, in order for the K3 project to be properly categorised and consented under the Planning Act 2008 the applicant is seeking consent for the construction of K3 at its total generating capacity of 75MW (i.e. 49.9MW consented + 25.1MW upgrade), together with the separate proposed total tonnage throughput of 657,000 tonnes per annum (550,000 consented + 107,000 tonnage increase).

1.1.3 The proposed new Waste-to-Energy plant, Wheelabrator Kemsley North (WKN), would be a single 125Mwth line facility capable of processing 390,000 tonnes of waste per annum, with a generating capacity of 42MW. WKN is not therefore a Nationally Significant Infrastructure Project (NSIP) by virtue of its generating capacity.

1.1.4 WTI made a formal application on the 1st June 2018 to the Secretary of State (SoS) for Business, Energy and Industrial Strategy under Section 35 of the Planning Act 2008 for a direction as to whether the project is nationally significant. The SoS issued their direction on the 27th June 2018 confirming that WKN is to be considered and treated as a development which requires development consent.

1.1.5 A single Development Consent Order is being sought for K3 and WKN through a single application to the Planning Inspectorate (PINS), prior to being determined by the Secretary of State (SoS) for Business, Energy and Industrial Strategy.

1.2 Legislative Context

1.2.1 S42 of the Planning Act 2008 requires the applicant to consult various bodies on the proposed application, including:

(a) such persons as may be prescribed;

(b) each local authority that is within section 43;

(d) each person who is within one or more of the categories set out in section 44.

1.2.2 Regulation 13 of the Infrastructure Planning (Environmental Impact Assessment) Regulations 2017 [The 2017 EIA Regulations] requires the applicant, at the same time as publishing notice of the proposed application under S48(1), to send a copy of that notice to the consultation bodies and to any person notified to the applicant in accordance with regulation 11(1)(c) of the EIA Regulations.

1.2.3 S47(1) of the Planning Act 2008 requires the applicant to prepare a statement setting out how the application proposes to consult, about the proposed application, people living in the vicinity of the land. Section 47(6) (as amended by the Localism Act 2011) states that the applicant must make the statement available for inspection by the public, in a way that is reasonably convenient for people living in the vicinity of the land and must publish in a newspaper circulating in the vicinity of the land a notice stating where and when the statement can be inspected.

1.2.4 S48 of the Planning Act 2008 requires the application to publicise the application in the prescribed manner.

1.3 Purpose of this Document

1.3.1 This Document, 1.4, forms part of the DCO application and provides copies of the notices placed in newspapers prior to the application being submitted. Details relating to all the pre-application consultation is available in Document 5.1 – Consultation Report.

1.4 Newspaper Notices

1.4.1 The following notices have been published in accordance with S47 and S48 of the Planning Act 2008. In accordance with Regulation 13 of the 2017 EIA Regulations, the notice published under S48 was sent to those parties notified under S42.

1.4.2 Appendix A contains examples of the S47 and S48 notices from the 2017 consultation which only sought to increase the electrical generating output of K3 to up to 75MW.

1.4.3 Appendix B contains the notices published under S47 in 2018, at which time the proposal comprised the upgrading of K3, an increased tonnage throughput to K3 and the proposed WKN facility.

1.4.4 Appendix C contains the S48 notices published in 2018, at which time the proposal comprised the upgrading of K3, an increased tonnage throughput to K3 and the proposed WKN facility.

1.4.5 Appendix D contains the S48 notices published in 2019, following a change to the description of the K3 development, to seek consent for the construction and operation of K3 to its proposed generating capacity of up to 75MW and its
