ART. 2º - A arrematação far-se á pelo maior lance. ART. 3º - Os produtos a serem licitados estarão à disposição dos interessados, no dia do Leilão, quando poderão ser revisados. Antes disso poderão ser examinados nas cocheiras do vendedor. ART. 4º - É facultado aos interessados fazer examinar por técnicos de sua confiança os produ- tos a serem licitados, antes do Leilão. Portanto serão INACEITÁVEIS quaisquer recla- mações posteriores. Os animais serão vendidos no estado em que se en- contram no momento da arrematação, portanto, não serão aceitas quaisquer reclamações ou possível cancelamento. Após a batida do martelo, a venda é definitiva e considerada como boa e perfeita. Exa- minem antes de comprar. ART. 5º - Os vendedores e a APPS (Agência Paulista de Puro Sangue) não se responsabilizarão por quaisquer alterações ocorridas no estado dos animais, após a arrematação, tampouco acidente de transporte. Paragráfo 1º - Lembramos aos interessados que procedam com antecedênca a devida revisão dos animais, pois uma vez na pista, a distância impede muitas vezes a verificação de detalhes somente visíveis de perto, e reclamações desta natureza não serão aceitas. ART. 6º - Os animais, após o leilão, retornarão aos locais de origem, e deverão ser retirados no prazo de 3 (tres) dias a contar da data da arrematação. ART. 7º - Os lances correspondem ao valor da parcela mensal, que serão multiplicados por 15 (quinze), e resultará no valor total da arrematação. ART. 8º - Foram dispensados os necessários cuidados para que o catálogo esteja correto, mas a APPS (Agência Paulista de Puro Sangue), os vendedores e o leiloeiro não respondem por erros ou omissões do mesmo. Eventuais correções feitas durante o leilão prevale- cerão sobre o catálogo. II - DOS COMPRADORES ART. 9º - Os compradores poderão optar por uma das seguintes condições de pagamento: - 12 parcelas mensais, iguais e sucessivas, sem juros e sem correção. - à vista com 8% (oito por cento) de desconto. - Os animais arrematados por valor de parcela inferior ou igual a R$ 400,00 (quatrocentos reais), deverão ser pagos à vista. ART.10º - Os interessados em obter financiamento deverão apresentar a APPS cadastro para apreciação até 10 dias antes do leilão. Parágrafo 1º - Os compradores que não estiverem cadastrados ou aqueles cujos cadastros não forem aprovados terão que efetuar o pagamento à vista, gozando do desconto estipulado. ART.11º - Os compradores deverão pagar as seguintes taxas: a) 8% (oito por cento) sobre o valor do arremate, para qualquer opção de pagamento. b) Transferência de propriedade conforme tabela de emolumentos do Stud Book Brasi- leiro. ART.12º - Aos compradores compete ainda: a) Assinar no ato da compra nota promissória no valor correspondente ao preço da aquisição, mais as taxas devidas, com vencimento contra apresentação e que deverá ser paga ou substituida quando da regularização da compra. b) Assinar, a transferência de propriedade. c) Assinar o contrato de financiamento. d) Os acertos das compras deverão ser efetuados junto à APPS, no local do leilão, ou no escritório localizado na Vila Hípica 4, Hipódromo da Gávea. ART.13º - O ICMS é de responsabilidade do vendedor na forma do decreto 34.449. Os produtos com idade inferior a 36 meses estão isentos de ICMS, entretanto para as vendas interestaduais o imposto é devido e seu recolhimento será de responsabilidade do comprador. III - DOS VENDEDORES Compete ao vendedor: ART. 14º - Pagar a importãncia de R$700,00 (setecentos reais) por animal, referente a inscrição no leilão. ART. 15º - No caso de não apresentação do animal inscrito, seu responsável também deverá pagar a importância mencionada acima. ART. 16º - Apresentar o animal inscrito, no dia e local designados, devidamente encabrestados, acompanhado de seu respectivo cavalariço, carteira de identidade e exame negativo de AIE e MORMO, dentro do prazo de validade do mesmo, exigido pelo serviço de Veterinária do Jockey Club. ART. 17º - No caso de defesa ou forfait, o vendedor terá 5 (cinco) dias úteis para efetuar o pagamento, após este prazo, incidirão juros sobre o débito. a) na defesa , o vendedor ficará responsável pelo pagamento das taxas de comprador, além das despesas previstas no artigo 14º. IV - CONDIÇÕES FINAIS ART.18º - O animal arrematado será entregue pelo vendedor mediante autorização por escrito da APPS (Agência Paulista de Puro Sangue), a qual será dada imediatamente após a regularização total da compra (pagamento e assinatura dos documentos necessári- os), correspondendo ao vendedor a responsabilidade de manutenção do animal até no máximo 3 (treis) dias subsequentes à arrematação. A partir do 4º dia, as despesas de manutenção ficarão por conta do comprador, pagas as diretamente ao vendedor, no dia da retirada do animal no valor de R$ 60,00 (sessen- ta reais) a diária. Parágrafo Único - Eventuais problemas decorrentes da não retirada do animal são de exclusiva responsabilidade do comprador. ART.19º - A palavra do leiloeiro, no decorrer do leilão está credenciada a alterar ou complementar estas normas, bem como as informações no catálogo. O leiloeiro reserva-se o direito de não aceitar lances de pessoas que a seu critério julgar não responsáveis sendo seu julgamento soberano. ART.20º - Fica estabelecido o foro da capital do Rio de Janeiro, para a eventualidade de qualquer pendência judicial. ART.21º - No caso de acerto direto entre as partes, as taxas deverão ser pagas à Agência. Após o prazo de 2 (dois) dias, se o comprador não tiver efetuado o pagamento, o débito será efetuado contra o vendedor. ART.22º - As taxas do leilão são irrestituíveis, mesmo para os casos de anulação. ART.23º - Os casos omissos serão julgados pelos vendedores e pela APPS (Agência Paulista de Puro Sangue), a seu exclusivo critério, sendo finais e definitivas as suas decisões, não podendo ser encaminhado nenhum tipo de reclamação, sem primeiro ocorrer o acerto inicial. ART.24º - É facultado ao vendedor a exigência de avalista. No caso de não aprovação do avalista indicado, o comprador deverá efetuar o pagamento à vista. ART. 25º - Dos animais inscritos para correr após o Leilão: De acordo com a nova norma da Comissão de Corridas do JCB, para animais de leilão, inscritos para correr no final de semana imediato, deverão obedecer as seguintes regras: 1) Os animais correrão em nome do vendedor, podendo desde que autorizado, utilizar a farda do comprador, para tanto o adquirente deverá regularizar a compra antes da realização do páreo, junto ao escritório da APPS. 2) Os animais correrão sob a responsabilidade dos treinadores inscritores; 3) Os premios liquidos a que fizerem juz, serão dos novos compradores, mas serão creditados aos vendedores que deverão em acerto direto, repassar aos compradores; 4) Se houver interesse do arrematante em fazer forfait, as despesas serão de respon- sabilidade do mesmo. ART.26º - O não pagamento de uma das notas promissórias implica no vencimento automático de todas as demais ainda para vencer. ART.27º - As vendas realizadas no leilão são irrevogáveis, não podendo o comprador recusar o animal ou solicitar redução de preço (art. 1106 do Código Civil). Todos os participantes obrigam-se a acatar as disposições do regulamento, não podendo se escusarem de aceitá-las, alegando que não as conheciam (art. 3º da Lei de Introdução Civil). ART.28º - A APPS, não é responsável por eventuais problemas nas aquisições feitas através do sitema telefônico implantado no leilão. ART.29º - Os compradores terão o direito de examinar os animais por veterinários e treinadores, inclusive pedindo exames de endoscopia e radiografias por carta, não sendo aceitas devoluções posteriores à arrematação, conforme regulamento dos leilões. ART.30º - Os participantes deste leilão, especialmente inscritos e arrematadores, obrigam-se a acatarem as disposições destas Normas Específicas, instituidas pelos Jockeys Club de São Paulo, Jockey Club Brasileiro, Jockey Club do Rio Grande do Sul, Jockey Club do Paraná. ART.31º - O Compromissário Comprador, depois de notificado por via postal, com prazo de CINCO DIAS, outorga desde já poderes especiais e irrevogáveis ao Jockey Club, para debitar em conta corrente do PROPRIETÁRIO E/OU CRIADOR, todas as parcelas devidas e referentes ao presente compromisso de compra vencidas e não pagas nas épocas convencionadas, inclusive juros de mora e/ou multa contratual dando como bons e corretos os débitos eventualmente feitos, sem direito a qualquer reclamação ou contestação. Os valores debitados em conta corrente do Compromissário Comprador serão levados à crédito em conta corrente do Promitente Vendedor, caso não haja contranotificação fundamentada. Para todos os fins de direito o endereçamento da notificação postal será o constante no contrato firmado pelo Compromissário Compra- dor, cabendo a ele no caso de mudança comunicar por escrito ao Promitente Vendedor.
