The Philippine budget is identified as a source of corruption as it directly involves the allocation of public money. This study traced the Philippine budget process and identified the various actors that intervened therein. Through process tracing and content analysis, various risks of corruption were identified in each of the four phases of the budget process. These risks include the following: (1) the abuse of discretion by government officials; (2) the failure to make the process transparent; (3) the abuse of discretion in the use of lump sum funds; and (4) the abuse of the authority to reallocate savings in the budget. With the identification of these risks of corruption, appropriate policies were designed to control corruption in the Philippine budget.

Ochave Ateneo de Davao University [email protected] Abstract This paper is an attempt to localize Herman and Chomsky’s analysis of the commercial media and use this concept to fit in the Philippine media climate. Through the propaganda model, they introduced the five interrelated media filters which made possible the “manufacture of consent.” By consent, Herman and Chomsky meant that the mass communication media can be a powerful tool to manufacture ideology and to influence a wider public to believe in a capitalistic propaganda. Thus, they call their theory the “propaganda model” referring to the capitalist media structure and its underlying political function. Herman and Chomsky’s analysis has been centered upon the US media, however, they also believed that the model is also true in other parts of the world as the media conglomeration is also found all around the globe. In the Philippines, media conglomeration is not an alien concept especially in the presence of a giant media outlet, such as, ABS-CBN. Despite the pervasiveness of celebrity culture in the country and the increasing number of unauthorised celebrity advertisements in such platforms, the right of publicity does not explicitly exist in Philippine law. This paper explains that the lack of an explicit statute-based right of publicity does not mean that it does not exist in common law or other statutory law. Centred on the minimalist path of law reform, the paper argues that the existing right to privacy in Philippine law can justify a right to publicity, anchored on the right to protect unwarranted publicity about oneself regardless of one’s status in the public eye, as well as on the right to autonomous self-definition. The illustrative cases in this paper evidence the hurt feelings celebrities suffer from unwanted publicity. A publicity right also exists as a property right under local intellectual property laws on unfair competition. I. At the start of last December, there were 38 percent satisfied and 33 dissatisfied with his performance, or a net satisfaction rating of +5. SWS refers to +5 as “neutral” since single-digit net ratings are indistinguishable from zero, and zero means exact balance between satisfaction and dissatisfaction. Based on the SWS archives, which show that Mr. Enrile had net scores of +21 in September 2008 and +30 in December 2007, his new score of +5 is definitely a comedown. Strictly speaking, however, it’s more appropriate to compare it with ratings of earlier senate presidents than with ratings of plain senators, including JPE himself before he headed the senate. The previous senate head, Manny Villar, had scores from +39 to +59, which are “good” to “very good’ in SWS terminology, ending at +43 in September 2008. Except for Franklin Drilon’s +2 (February 2005) and +8 (March 2005), all other senate presidents, since 1990, had scores of +22 and up (“moderate” starts at net +10, “good” at +30, and “very good” at +50). Why did public satisfaction with Mr. Enrile drop so much, compared to when he was a plain senator? I think the only thing that could have made a big impression on the public was the sudden realignment in the senate, which led to his takeover from the very popular Mr.

ABSTRACT USING FORCE TO GAIN VOICE: THE PROSPECTS AND LIMITS OF USING COERCIVE MECHANISMS TO SECURE DELIBERATIVE INCLUSION This thesis analyses the impact of marginalised groups using coercive mechanisms as a strategy for deliberative inclusion. It engages the literature on deliberative democratic theory that makes a case for using non-linguistic mechanisms to gain entry to exclusionary deliberative forums. This research explores its limits through a linguistic-based microanalysis of an ―extreme‖ case where marginalised political agents employed threats of force – the apparent antithesis of deliberation – in an attempt to secure inclusion. The case is that of a military mutiny in the Philippines in 2003, where a group of junior officers took over the central business district to publicly air their demands for reform to the military.
