Bandari Laxmaiah s/o.Balaiah, 57 yrs, occ: Agriculture r/o.H.No.1-2/5, Katnepalli village of Choppadandi mandal r revenue of Karimnagar district. 2. Bandari Anjaiah, s/o.Laxmaiah, 33 yrs, r/o.H.No.1-2/5, Katnepalli village of Choppadandi mandal revenue of Karimnagar district. ….Petitioners/ Accused No.2 & 8 and The State through Station House Officer, Choppadandi P.S. ….Respondent/Complainant. Offences under Section 307, 379, 427 r/w 149 IPC PETITION FILED UNDER SECTION 438 OF CR.P.C. This petition coming before me on today for hearing in the presence of Sri E.Kondal Reddy, Advocate for the petitioner/accused and the learned Addl. Public Prosecutor for the state, having been heard and stood over for consideration to this day, the Court made the following: :: O R D E R:: 1. The bail application is filed under Section 438 Cr.P.C., praying the Court to enlarge the petitioners/accused No.2 & 8 on anticipatory bail. 2. Notice given to Public Prosecutor, who filed counter and stated that investigation is completed. 3. Heard both sides. 4. Now the point for consideration is:- Whether the petitioners/ accused can be enlarged on bail ? 5. POINT: The learned counsel for the petitioners/ accused No.2 & 8 submitted that the defacto-complainant lodged report stating that on 7-6-2020 at Gumlapur 2 the petitioners herein A2 and A8 and other accused were assembled unlawfully and attacked the complainant and his villager K.Thirupathi Reddy with sticks, iron rods and knives and tried to kill them due to land disputes, as a result of which his wrist was broken and K.Thirupathi Reddy also received bleeding injuries on his head and committed theft of 20 grams gold chain, smart phone and damaged motor cycle. Therefore, requested for necessary action. Basing on the above report the police Choppadandi registered a case in Cr.no.60/2020 against A2 & A8 and other accused for the offences u/secs.307, 379, 427 r/w 149 IPC. 6. On the other hand, the Public Prosecutor submitted that the investigation is completed. 7. Perused the record. It is seen that the present crime was set in motion on 7-6-2020. C.D. Part I discloses that the alleged offences are u/secs.307, 379, 427 r/w 149 IPC. The counter filed by the police through Public Prosecutor shows that the entire investigation is completed. Public Prosecutor also submitted that the investigation is completed. However, A2 and A8 are directed to surrender before the Court Prl.Junior Civil Judge, Karimnagar on or before 28-11-2020 without fail as they were shown as absconding. In the result, the petition is allowed. A2 and A8 are directed to surrender before the learned Prl.Junior Civil Judge-cum- J.M.F.C., Karimnagar on or before 28-11-2020 without fail.
