The Shaker Heights Board of Education met in regular session on Tuesday, October 19, 2004 at 8:01 p.m. at Mercer Elementary School, 23325 Wimbledon Road, Shaker Heights, Ohio 44122.

Upon the recommendation of Superintendent Mark Freeman, Ms. Levenson moved, seconded by Mrs. Ribar that the Board approve the following resolution:

WHEREAS, the Shaker Heights City Schools Board of Education has previously, on April 20, 2004, authorized the Ohio Schools Council to advertise and receive bids on behalf of said Board as per the specifications submitted for the cooperative purchase of two (2) 71- passenger conventional buses and two (2) 65-passenger conventional buses; and

WHEREAS, Myers Equipment has submitted the lowest, most responsive, most responsible bid of $234,345 for two (2) 71-passenger conventional buses and two (2) 65- passenger conventional buses; now

THEREFORE, BE IT RESOLVED, the Shaker Heights City Schools Board of Education accepts the bid by Myers Equipment of $234,345 for two (2) 71-passenger conventional buses and two (2) 65-passenger conventional buses.

At this time Superintendent Freeman indicated that Section V, Item A, was deleted from the published agenda since the collective bargaining agreement has not yet been approved by the Union membership.

DISTRICT HIGHLIGHTS

At this time, the Superintendent reported the following district highlights: • Forty Shaker Heights High School students have been honored by the National Merit and National Achievement Scholarship Programs, again placing Shaker at the top among Northeast Ohio public schools. National Merit Semifinalists are David Anderson, Hannah Corrigan, David Frisof, Daniel Kanter, Jason Plautz, Lee Reis, Julia Sivertson, Caroline Smith, Meagan Steiner, Jonathan Strassfeld, Alex Wang, and Ben Wolpaw. In addition, Alexandra Buder Shapiro, who graduated a year early last June, was honored as a Semifinalist with this year's class. She is currently studying at the University of Pennsylvania. National Merit Commended Students are Liam Brett-Eiger, Andre Dev, Marc Engel, Julia Ferguson, John Gustafson, Rebecca Heide, Michael Kowen, Eric Kramer, Emma Lawrence, Clare Malone, Adam Margolius, Kevin Margolius, Andrew McFarlane, Sean Muron, Christopher Nau, Emily Rosenberg, Andrew Schiraldi, 9 Nathan Siegel, Zachary Simon-Curry, and Thomas Wilson. Jenny Goldman, who was killed last January in an automobile accident, was posthumously named a National Merit Commended Student. Commended Students in the National Achievement Scholarship Program for the nation's top African-American seniors are Dana Benders, Asia Greene, Christopher Inniss, India James-Gaskins, Danielle Jones, and Marguerite Moore.

Nationwide, 16,000 National Merit Semifinalists have been designated from approximately 1.3 million program entrants in more than 21,000 high schools nationwide. Representing less than 1 percent of each state's high school seniors, Semifinalists are the state's highest-scoring students on the 2003 Preliminary Scholastic Assessment Test (PSAT). Since the inception of the program, Shaker has consistently been among the top schools in Ohio in producing National Merit scholars. This year’s scholars will be honored at a future Board of Education meeting.

• Public school districts in Ohio have proposed 308 school tax issues for the November 2 election, according to the Ohio Secretary of State. This will be the highest number of school issues in a November election since 1976. Including primary and special elections held earlier this year, the 2004 state total for school ballot issues is 639, the highest number since 1984.

The Ohio School Boards Association says this is indicative of the "crisis condition" of Ohio school funding.

Although most of the issues are operating levies, the total includes 63 emergency levies, 43 permanent improvement levies, and 46 bond issues. Five Cuyahoga County districts, including Bedford, Orange, and Municipal, are on the ballot for operating levies, two for emergency levies, and one for a permanent improvement levy. Shaker is the only district in the county with a bond issue on the ballot this fall.

• School superintendents from throughout the Midwest, meeting in Cleveland this month, were treated to a musical performance by eight Shaker band members: Emily Bostwick, Christopher Connors, Cecilia Culp, Aaron Fallon, Charles Inniss, Geoffrey Sanford, Sarah Sy, and Alex Wang. Tom Deep of the music department and parent Mimi Lam helped prepare the students for the performance.

• Six distinguished Shaker graduates were inducted into the Alumni Association Hall of Fame on October 11. The new inductees are: Don Blumenthal, '70, Director of the Internet Lab for the Bureau of Consumer Protection at the Federal Trade Commission. The lab investigates Internet fraud, deception, and unsolicited commercial e-mail (“spam”). In his spare time, Blumenthal is also a scout for the Oakland Raiders of the National Football League. A graduate of Oberlin College, Blumenthal holds a J.D. from the University of Pennsylvania and a certificate in systems and project management from the American University. 10 Charan Devereaux, '87, a senior researcher at the Harvard Law School and producer of music to benefit social causes. Her music projects include two compilation CDs to benefit organizations working to end domestic abuse. Devereaux collaborated with such artists as Dolly Parton, Sarah McLachlan, Joan Baez, Indigo Girls and Odetta, generating more than $200,000 for the beneficiaries. Dorothy Hart, '40, scholar, actress and United Nations activist. Ms. Hart discovered her acting talent as a volunteer at the Cleveland Play House and went on to act in films and television with the likes of and Ronald Reagan. Her real passion was the UN, which she served as a speakers committee member and, in 1959, as an observer at the World Federation meeting in Geneva. Ms. Hart died on July 11.

Jerry Silver, '65, Professor of Neurosciences at the Case Reserve University School of Medicine. Silver has recently received two top research awards for his work on spinal cord regeneration, the Ameritec Prize for work toward a cure for paralysis and the Reeve-Irvine Research Medal, given by the University of California's Reeve-Irvine Research Center, which is named for the late actor Christopher Reeve. David Wain, '87, writer, director and performer for television and film. His credits include Bamboozled, Keeping the Faith, Wet Hot American Summer, Mad TV, Cosby, Sheep in the Big City, Strangers With Candy, and The Daily Show. A co-founder of the comedy troupe The State, Wain is currently writing and performing as a member of STELLA, a comedy trio with Michael Ian Black and Michael Showalter. Kym Whitley, '80, actress, director, writer, and stand-up comedienne. Whitley has guest-starred on television series including Married with Children, The Parent 'Hood, and Martin. Her feature film credits include Street Wars and 25 Lighthouse. She toured in the play Beauty Shop and is completing work on Never Give Up Unless You Really Can't Act, a book on making it in show business.

• On Monday evening, interested Shaker residents gathered at the Middle School for the Shaker Heights PTO’s Fall Forum, a free event entitled Science Matters: Preparing Our Students, Involving the Community, and Promoting Scientific Literacy. The program featured guest speakers, Shaker faculty representatives, and a science exposition. During the first half of the program, Linda Abraham-Silver, new director of the Great Lakes Science Center, spoke about her plans for the Center, the importance of science literacy, and her decision to move her family to Shaker Heights. Matthew Warman, M.D., associate professor of genetics at Case Western Reserve University and a Shaker parent, discussed the skills students need to succeed in a science career. Several members of the Shaker faculty then highlighted what students are learning in science classes and co-curricular activities. A Mini Science Expo provided those in attendance the opportunity to tour Shaker's traveling space lab and to learn more about the High School’s planetarium, the Nature Center at Shaker Lakes, and PTO science activities. The K-12 science teachers were also on hand to discuss science instruction in the District. PTO volunteers Carolyn Steiner and Charniece Holmes organized the event. 11 • On Tuesday morning, the Superintendent welcomed community leaders for the first of two breakfast briefings this fall. Comments centered on student achievement; school finance; facilities; and faculty recruitment, training and retention. Another briefing will be held on November 16. • Shaker Heights High School has hosted two international exchange groups this fall. Fourteen students and two teachers from Goslar, Germany, will conclude their three- week visit tomorrow. The exchange with the Ratsgymnasium in Goslar is, at 26 years old, Shaker’s longest-standing international program. Earlier in the fall, 15 students and two teachers from the Shanghai Foreign Language School in China – Shaker’s newest partner school. The District encourages travel and exchange programs to deepen understanding of various cultures, history, and current events.

WELCOME – MR. J. LINDSAY FLORENCE, MERCER ELEMENTARY SCHOOL PRINCIPAL

Superintendent Mark Freeman introduced Mr. J. Lindsay Florence, Principal of Mercer Elementary School. Mr. Florence extended a warm welcome to the Board and community. Mr. Florence also introduced Jody Podl, a member of the Mercer Elementary School PTO.

At this time an overview of the District’s web site, www.shaker.org, was presented by Peggy Caldwell, Director of Communications, and Kathy Fredrick, Director of Library Media and Instructional Technology. The site has undergone a comprehensive redesign and re-engineering in the past year. The presentation was followed by a question and answer discussion with the members of the Board.

At this time Superintendent Mark Freeman commented on District safety and security and the work done in conjunction with the safety officials of the City of Shaker Heights. President Kaufman emphasized the importance of school security and the understanding of such issues by the parents and the community. Superintendent Freeman also provided an update about the District’s safety and security plans for Election Day.

• Property taxes are up due to 2nd half of new levy collections; • Investment rates are increasing; expect another increase one week after the election; • Other State sources include semi-annual public utility reimbursement payment of $388,000 both this year and the prior year; • The fiscal year end financial audit conducted by the Auditor of State is in progress; 12

• Fannie Mae Update – A settlement agreement with its regulator, the Office of Federal Housing Enterprise Oversight (OFHEO), addresses improper accounting practices and inadequate control procedures. The settlement includes restating its financial statements, and a requirement to boost its capital surplus to 30% over the next 9 months. This is expected to increase its credit quality, and therefore it is not likely to loose the AAA rating of its debt instruments. We remain confident in the safety of the District’s portfolio and will continue to monitor such investments; and • The bus notes in the amount of $720,000 were awarded to the Fifth Third Bank at a rate of 1.99% for a one year maturity. Such issuance combined the financing of multiple bus purchases. In total we received seven bids from six issuers with rates ranging from 1.99% to 2.34%.

Mr. Christman also commented on the following legislative matters:

• State tax collections and lottery profits are both above estimates after the first quarter with taxes up $72.2 million or 1.7% and lottery profits up $8.2 million or 5.4%; • E-Rate halted payments until a rewrite of spending rules can be concluded. Such action was taken in response to alleged instances of vendors taking advantage of unsuspecting school districts. Since 1998 Ohio schools have been the beneficiaries of $420 million in discounted telecommunication services; • SERS Health Care Changes: As a result of an OAPSE lawsuit, a Franklin County Magistrate has recommended to the Court of Common Pleas that an injunction be issued to halt SERS from implementing its health care changes for 2004. SERS, who claims it will run out of health care money in 2006 absent the changes, paid $87 million in 1993 and $200 million in 2003 for health care benefits; • STRS investment return for calendar 2003 of 24.1% added $500 million to their Fund; • November School Ballot Issues – There are over 300 issues from 278 school districts on the November 2nd ballot which is the most since 1976 (28 years). This increase is on top of the record in August in which only about 25% passed; • Governor appointed new Board members to SERS and STRS as a result of the recently effective Ohio Pension Reform Legislation. Dan Wilson, former Shaker Heights City School District Treasurer and current Mentor Treasurer, was appointed to the investment expert seat on the Board; and • State Board of Education adopted Fiscal 2006 and Fiscal 2007 budget recommendations which call for a total funding increase as follows: Fiscal 2006 – 9.6% and Fiscal 2007 – 9.4%.

BE IT RESOLVED, by the Board of Education of the Shaker Heights City School District, County of Cuyahoga, State of Ohio;

Section 1. That the Auditor of Cuyahoga County be and is hereby requested to issue an order to the Treasurer of Cuyahoga County to pay to the Treasurer of this Board of Education such funds as may be available for distribution by said County Treasurer.

Section 2. That the Treasurer be and hereby is authorized to sign the appropriate documents to secure such advances, as well as the secondary documents to secure the semi- annual settlement with the County Treasurer during the calendar year 2005.

Section 3. That such authorization shall extend to all advances requested during the calendar year 2005.

Section 4. That the Treasurer of the Board, be and hereby is authorized and directed to certify a copy of this resolution to the County Treasurer and make such other certifications and reports to the County Auditor or Treasurer as may be necessary to make this resolution effective.

Upon the recommendation of Mr. Bryan Christman, Treasurer, Mrs. Ribar moved, seconded by Ms. Levenson that the Board of Education approve the H.B. No. 412 Five- Year Financial Forecast (Exhibit T-4) and further that the Treasurer be directed to file a copy of such forecast with the Ohio Department of Education.

17 Mr. Christman commented on the H.B. 412 Five-Year Forecast as follows:

• Required two times per year, last one approved in May 2004; • Reflects final actual Fiscal 2004 numbers including 3 years historical, and 5 years of projected data; • Fiscal 2005 revenues reflect overall increase in property taxes due to 2nd half of new levy proceeds; • State Foundation growth is slightly improved in future years predicated on higher than originally projected Fiscal 2004 State Foundation revenues; • Personal property taxes are now expected to decline at a faster pace due to phase outs and reduced collections on existing tax base; • On the expenditure side this forecast reflects the Fiscal 2005 adopted budget of $76.8 million, and anticipates moderate/aggressive overall spending growth rate of about 4.7% per year. It assumes future levies, the next one as previously projected to be in 2006; and • The forecast can be amended at any time.

Ms. Levenson suggested that the average percentage change for future years be added to the next five-year forecast.

Upon the recommendation of Mr. Bryan Christman, Treasurer, Ms. Levenson moved, seconded by Mrs. Ribar that the Board of Education approve the following resolution:

Mr. Christman made the following comments about the Section 125 Plan:

• The plan name refers to the particular authorizing Internal Revenue Service Code Section 125, which allows for the shared premiums to be payroll deducted on a pre-tax basis, thereby saving the employee an estimated average of 32% (broken down as: federal income tax 25%, state income tax 3.5%, city income tax 1.75%, and medicare tax 1.45%) of the shared premium amount; • The plan is in accordance with terms of the District’s three collective bargaining agreements; • The implementation will have a minor tax benefit to the District by saving the employer match of the medicare tax (1.45%) on the shared premium amount, with minimal to no additional administrative cost; and • The plan will be effective January 1, 2005.

WHEREAS, the Board of Education of the Shaker Heights City School District (the “Board”) provides medical, dental, prescription drug and group term life insurance plans for certain eligible employees (“Benefit Plans”); and

WHEREAS, in accordance with the terms of the Benefit Plans, employees may be required to contribute toward the cost of their coverage; and

18 WHEREAS, Internal Revenue Code Section 125 permits the Board to adopt a “cafeteria plan” that will provide that employee contributions for Benefit Plan coverage will be made on a pre-tax basis; and

WHEREAS, the Board has agreed to adopt such a plan pursuant to the terms of certain collective bargaining agreements;

NOW, THEREFORE, BE IT RESOLVED by the Board of Education of the Shaker Heights City School District, Cuyahoga County, Ohio, that:

Section 1. The attached document (Exhibit T-5) is hereby adopted as the Shaker Heights City School District Section 125 Plan, effective as of January 1, 2005.

Section 2. The Treasurer of the School District is hereby appointed as the Administrator of the Section 125 Plan and is hereby authorized to carry out any and all actions that are required under the Section 125 Plan of either the Administrator or the Employer.

Section 3. This Board finds and determines that all formal actions of this Board and of any of its committees concerning and relating to the adoption of this resolution were taken, and that all deliberations of this Board and of any committees that resulted in those formal actions were held, in meetings open to the public in compliance with the law.

Section 4. This Resolution shall be in full force and effect from and immediately upon its adoption.

At this time President Kaufman asked for committee reports. Ms. Levenson’s legislative report included an update on the Blue Ribbon Task Force and the Ohio Supreme Court candidates on the November ballot. Mrs. Johnson reported on the City Neighborhood Revitalization Committee activities. President Kaufman reported that the last City Recreation and Leisure Committee meeting is scheduled to occur soon. Mrs. Johnson also reported on the progress of the bond levy campaign and the significant increased percentage of absentee ballots.

President Kaufman asked for comments or questions from the public audience. Mrs. Annette Sutherland of the League of Women Voters commented on the positive aspects of having community members in the building on Election Day in that school activities would be observed by non-users of the school system. Mrs. Sutherland asked if the Board would need parent volunteers to help with safety and security. Superintendent Freeman responded that no parent volunteers are needed at this time.
