THEIR UNIVERSITIES: How POPULAR DIscoNTENT Is RESHAPING HIGHER EDUCATION LAW Ben Trachtenberg, ABSTRACT Surveys taken since 2015 reveal that Americans exhibit starkpartisan divisions in their opinions about colleges and universities, with recent shifts in attitudes driving changes to higher education law. In recent years, Democrats have become slightly more positive about higher education. Concurrently, Republicans have become extremely more negative, and a majority of Republicans now tells pollsters that colleges and universities have an overall negative effect on the country. Particularlyin legislative chambers controlledby Republicans,public and elite dissatisfaction with higher education has led to legal interventions into the governance of universities, with new laws related to faculty tenure, the treatment of undocumented immigrant students, the use of state funds for disfavoredprograms, the composition of university governing boards, and campus speech, among other topics. At the federal level, during the Obama Administration advocatespersuaded the Department of Education to demand sweeping changes to how institutions adjudicate allegations of sexual harassment and sexual assault. At the behest of different advocates and critics, Trump Administration officials have rescinded the prior guidance and are in the process of enacting new regulations on the same campus processes. Higher education has real problems-such as skyrocketing tuition-which inspire real anger. Right-wing media outlets amplify this discontent, andpoliticians respond to voter outrage with hearings and legislation, deepening the lack of confidence. These phenomena are likely to endure and even to increase in intensity. Accordingly, higher education law has entered a new era in which college and university leaders must anticipategrowing legislative intervention into day-to-day campus operations.Remaining true to institutionalvalues in a newly difficult legal environment will challenge highereducation administratorsacross the country, both at private and atpublic institutions.In particular,leaders ofpublic institutions will face increasingly daunting tasks in states with conservative electorates. TH3EIR UNTVERSITIES "When we see an issue that's split 2 by political party, any kind of issue, it usually never recovers." - Brandon Busteed,polling expert,formerly at Gallup "[W]e are at the beginning of a new state-legislative era, and that beginning is auspicious."3 - Stanley Kurtz, conservative commentator and education reform advocate INTRODUCTION The law of higher education has entered a period of rapid change, driven in part by recent souring of public opinion about colleges and universities. Americans overall report increasing dissatisfaction with higher education, and Republicans in particular tell pollsters that colleges and universities have an overall negative effect on the country. Growing distrust of university administrators and trustees has inspired legislatures to intervene in university governance, with new state and federal laws affecting issues from sexual assault hearings to affirmative action to faculty tenure to campus speech to the composition of governing boards. As public perception of higher education diverges further from the self-perception within institutions, further legal intervention appears inevitable. An example from Michigan illustrates what can happen when university leaders adopt a high-profile policy position at odds with the wishes of the electorate. In June 2003, the University of Michigan Law School won a victory in the Supreme Court, which held that the law school's affirmnative action policies did not violate the Equal Protection Clause of the Fourteenth Amendment.4 The University's president, Mary Sue Coleman, cheered the result as "a tremendous victory for the University of Michigan, for all of higher education, and for the hundreds of groups and individuals 5 who supported us." She added, "[t]his is a resounding affirmation that will be heard across the land-from our college classrooms to our corporate boardrooms." Three years later, Michigan voters sent a resounding message of their own.     Chapter 4 The right-wing media enablers of anti-Islam propaganda Spreading anti-Muslim hate in America depends on a well-developed right-wing media echo chamber to amplify a few marginal voices. The think tank misinforma- tion experts and grassroots and religious-right organizations profiled in this report boast a symbiotic relationship with a loosely aligned, ideologically-akin group of right-wing blogs, magazines, radio stations, newspapers, and television news shows to spread their anti-Islam messages and myths. The media outlets, in turn, give members of this network the exposure needed to amplify their message, reach larger audiences, drive fundraising numbers, and grow their membership base. Some well-established conservative media outlets are a key part of this echo cham- ber, mixing coverage of alarmist threats posed by the mere existence of Muslims in America with other news stories. Chief among the media partners are the Fox News empire,1 the influential conservative magazine National Review and its website,2 a host of right-wing radio hosts, The Washington Times newspaper and website,3 and the Christian Broadcasting Network and website.4 They tout Frank Gaffney, David Yerushalmi, Daniel Pipes, Robert Spencer, Steven Emerson, and others as experts, and invite supposedly moderate Muslim and Arabs to endorse bigoted views. In so doing, these media organizations amplify harm- ful, anti-Muslim views to wide audiences. (See box on page 86) In this chapter we profile some of the right-wing media enablers, beginning with the websites, then hate radio, then the television outlets.     CHAPTER EIGHT: McCORKLE PLACE McCorkle Place is said to be the most densely memorialized piece of real estate in North Carolina.501 On the University’s symbolic front lawn, there are almost a dozen monuments and memorials fundamental to the University’s lore and traditions, but only two monuments within the space have determined the role of McCorkle Place as a space for racial justice movements.502 The Unsung Founders Memorial and the University’s Confederate Monument were erected on the oldest quad of the campus almost a century apart for dramatically different memorial purposes. The former honors the enslaved and freed Black persons who “helped build” the University, while the latter commemorated, until its toppling in August 2018, “the sons of the University who entered the war of 1861-65.”503 Separated by only a few dozen yards, the physical distinctions between the two monuments were, before the Confederate Monument was toppled, quite striking.     'Cancel culture' doesn't stifle debate, but it does challenge the old order Billy Bragg Speech is only free when everyone has a voice – that’s why young people are angry Outside Broadcasting House in London, the BBC has erected a statue to one of its former employees, George Orwell. The author leans forward, hand on hip, as if to make a telling point. Carved into the wall beside him is a quote from the preface of Animal Farm: “If liberty means anything at all, it means the right to tell people what they do not want to hear.” It’s a snappy slogan that fits neatly into a tweet, but whenever I walk past this effigy of the English writer that I most admire, it makes me cringe. Surely the author of Nineteen Eighty-Four would understand that people don’t want to hear that 2+2=5? For Orwell’s quote is not a defence of liberty; it’s a demand for licence, and has become a foundational slogan for those who wilfully misconstrue one for the other. Over the past decade, the right to make inflammatory statements has become a hot button issue for the reactionary right, who have constructed tropes such as political correctness and virtue signalling to enable them to police the limits of social change while portraying themselves as victims of an organised assault on liberty itself. The latest creation in their war against accountability is “cancel culture”, an ill-defined notion that takes in corporate moves to recognise structural racism, the toppling of statues, social media bullying, public shaming and other diverse attempts to challenge the status quo.

Nancy Gertner U.S. District Judge, District of Massachusetts FOR MOST OF the early part of the 20th century, the Lower East Side of Manhattan, located in the southeastern part of New York City, was a major immigrant hub where waves of hardworking peo- ple from all over the world came to begin their own versions of the American dream. Among the most notable of the immigrant groups to settle in this community were Eastern Europeans of the Jewish faith, who made the four miles of small, crammed buildings their first homes in the United States. When they arrived at Ellis Island, they had no money and no family roots, and they spoke little to no English. As the new generation of Jewish Ameri- cans started businesses and became more and more successful, the neighborhood flourished, creating the most recognized and vibrant Jewish neighborhood in the United States.
