How to Interpret
In these terms & conditions, ‘Event’ refers to the event being booked for and ‘the client’ refers to the individual, firm or company booking the event, ‘Room’ refers to any room within The Deepdale Stadium.
Use of rooms
Use of any room is by permission of Heathcote & Co Deepdale who reserve the right to refuse any booking or admission at their discretion.
The nature of the event shall be notified by ‘The Client’ at time of enquiry and booking, Heathcote & Co Deepdale reserve the right to refuse any bookings from organisations that support or undertake activity that is deemed by Heathcote & Co Deepdale illegal or unethical.
The use of Heathcote & Co Deedpale logo is not permitted unless agreed in writing by Heathcote & Co Deepdale.
‘The Client’ shall not sub let the hired rooms or any part thereof without written approval from Heathcote & Co. Deepdale.
Hours of use
The hire charges quoted relate to times of the booking, events that continue beyond these stated and agreed times are subject to additional hire charges as deemed appropriate by Heathcote & Co Deepdale.
Football
In the event of a football match being rescheduled or as a result of an additional home fixture being made Heathcote & Co Deepdale reserve the right to offer an alternative date, where possible, or to cancel a booking, without any liability on our part.
We need a deposit
A deposit of 40% of the anticipated cost calculated in accordance with these Terms and Conditions will be required on the signing of these terms unless otherwise agreed in writing by Heathcote & Co. Deepdale All deposits are non-refundable. Until payment of the deposit is received, no contract will be deemed to be entered into between Heathcote & Co Deepdale and the Client.
How many are we catering for?
Quoted prices are based upon the estimated number of guests attending the function that has been supplied by the client. The final, guaranteed number of guests must be communicated to Heathcote & Co Deepdale not less than fourteen working days (excluding Saturdays, Sundays and Bank Holidays) prior to the date of the Event.
The Client will be charged on the basis of the guaranteed number of guests (or the number of persons for which the event is originally booked if no guaranteed number is provided), or the total number of guests attending, whichever is the greater.
If you change something
Heathcote & Co Deepdale reserve the right to charge for the provision of special terms in addition to any costs agreed between Heathcote & Co Deepdale and the Client.
Talking about food
All details of food and beverage to be served shall be set out on a separate menu, which will be agreed in writing in due course. Heathcote & Co Deepdale reserve the right to substitute items on the menu with alternative food or drink of a similar quality if the original items shown on the menu cannot be conveniently obtained. Any such changes will where practical be discussed with the Client.
Heathcote & Co Deepdale cannot guarantee that our menu dishes are free from seed and/or nut traces. Heathcote & Co Deepdale admit no liability for any illness caused by an allergy or specific dietary requirement that Heathcote & Co Deepdale were not made aware of. The Client must advise Heathcote & Co Deepdale in writing if you or any of your guests suffer from an allergy, intolerance or has a specific dietary requirement at least seven working days prior to the Event.
Heathcote & Co Deepdale are as passionate about the environment as they are about their food. Wherever possible ingredients will be sourced from our local producers and suppliers. However it should be noted that this is subject to seasonal availability and market forces.
Neither of us want you to cancel, but…
In the event of the cancellation of the Event, the advance deposit paid by the Client will not be refunded by Heathcote & Co. Deepdale.
In addition, a cancellation charge will be imposed and payable on demand in the event of the cancellation of all or any part of the Event after acceptance. The amounts are due as liquidated damages and not as a penalty and will be calculated in accordance with the following schedule:

NOTICE OF CANCELLATION RECEIVED PROPORTION OF ANTICIPATED CHARGE Within 21 days of the Event 50% Within 7 days of the Event 100%
Additionally, any charges payable to any sub-contractors or any other costs, charges and expenses incurred on behalf of the Client will be charged.
How and when you need to pay
Payment must be made within seven days prior to the date of the Event. Payment is calculated on the anticipated cost for the guaranteed number of attendants. If no guaranteed number is provided, it is calculated on the number of persons for whom the Event was originally booked.
In the event of non-payment of the calculated amount by the due date, Heathcote & Co Deepdale reserves the right to treat such non-payment as repudiation of this contract.
Payment of additional sums due from the Client is to be made within seven days of presentation of the final account.
Heathcote & Co Deepdale reserve the right to charge interest on unpaid accounts at 4% above Nat West Bank plc base rate from time to time.
The VAT Man
Value Added Tax at the current rate payable in addition to all charges is applicable.
If there is any damage or anything breaks a. The Client shall take all reasonable precautions to ensure that no damage occurs to the property of Heathcote & Co Deepdale who reserve the right to render The Client liable for the replacement or repair of any or all property damaged. b. Any expenses incurred for damages caused by any guest of the Client or of any outside contractor hired by the Client, shall be the responsibility of the Client who agrees to indemnify and hold harmless Heathcote & Co Deepdale from all claims and actions against them arising as a result thereof. c. In the event that any member of Heathcote & Co Deepdale staff being injured by The Client or anyone attending the event, The Client will be liable for any claims rising.

The Client shall ensure that nothing is fixed to the floors, walls, ceilings, or any other interior or exterior of the buildings by any means including but not limited to nails, staples, blue tac, without the written permission of Heathcote & Co Deepdale. e. Heathcote & Co Deepdale are not liable or responsible for any items lost, mislaid or damaged within the Rooms. f. All items and equipment stored are at The Clients risk. g. The Client shall ensure that the event is conducted in an appropriate and orderly manner without causing nuisance or disturbance and in compliance with the instructions and guidance of Heathcote & Co Deepdale. h. Heathcote & Co Deepdale reserve the right to eject as is reasonable any persons who from the event, room and stadium that they feel are behaving in an inappropriate or dangerous manner. i. Heathcote & Co Deepdale will not be responsible for any damages caused to the premises at which the Event takes place due to the neglect of default of the owner of the premises or his employees or agents of sub-contractors or any neglect of default of the Client or his guest.
Force Majeure
If for any reason beyond its control, including but not limited to strike, labour dispute, accident, act of war, act of God, fire, flood or any other emergency condition, Heathcote & Co Deepdale is unable to perform its obligations under this Agreement, such non-performance is excused and Heathcote & Co may terminate this Agreement without further liability of any nature upon return of the deposit paid.
In no event shall Heathcote & Co Deepdale be liable for consequential damages of any nature or any reason whatsoever.
Data Protection
In order to perform our obligations under these Terms and Conditions, Heathcote & Co. Deepdale may require you to disclose Personal Data (as defined by current data protection legislation commonly referred to as GDPR). Heathcote & Co. Deepdale (or sub-contractors of Heathcote & Co.
