New Developments in Competition Law

Recent developments have wrought changes in this important area of commercial law. Hear the latest in Commerce Act matters from an expert panel who will discuss:

• Competition law trends; • practice; • New law on the vertical effects of mergers and supply agreements; • Potential amendment of the Commerce Act’s ban on the misuse of market power; • Recent merger cases; and • Pending law reform like the criminalisation of cartel conduct and the Commission’s new market study powers.

ABOUT THE SPEAKERS Sir Terence Arnold KNZM QC, Acting Judge, The Supreme Court, taught at law schools in New Zealand and Canada before joining Chapman Tripp, where he was a litigation partner from 1985 to 1994. He went to the Bar in 1994 and took silk. Sir Terence became Solicitor-General in 2000 and was appointed to the Court of Appeal in 2006. In 2013, he was appointed to the Supreme Court. In practice, he was heavily involved in competition and regulatory issues arising from deregulation and privatisation of Crown entities, particularly in relation to telecommunications and electricity.

Dr Mark Berry, Chairman, New Zealand Commerce Commission, has held his current post since April 2009. Mark is also an associate member of the Australian Competition and Consumer Commission. Mark is a former partner, Chapman Tripp consultant and barrister sole. He has a doctorate from Columbia University, New York.

James Mellsop, Managing Director, NERA Economic Consulting, specialises in the application of economic analysis to competition law matters. James has provided expert evidence before the Australian Competition Tribunal, the New Zealand High Court, and the New Zealand Commerce Commission. He has worked on projects around the region, and has been engaged by both the Australian Competition & Consumer Commission and the Commerce Commission

Matt Sumpter, Partner, Chapman Tripp, is a litigation partner who co-leads Chapman Tripp’s competition practice. Matt authored the antitrust text book, New Zealand Competition Law and Policy. He writes the New Zealand Law Review of Competition Law and taught competition law for many years at the University of .
