● This ordinance is to amend the definitions relative to “Farm Animal” so as to delete the regulation of chickens from the regulations applicable to farm animals; adding a cross reference to the location of regulations applicable to chickens in the Manatee Code of Ordinances.

● The Board has directed staff to draft a separate ordinance pertaining to the regulation of chickens in urban areas. This is a separate item that will be brought before the Board of County Commissioners at a future date.

AN ORDINANCE OF MANATEE COUNTY, FLORIDA, REGARDING LAND DEVELOPMENT; AMENDING SECTION 201, LAND DEVELOPMENT CODE, TO AMEND THE DEFINITIONS RELATED TO “FARM ANIMAL” SO AS TO DELETE THE REGULATION OF CHICKENS FROM THE REGULATIONS APPLICABLE TO FARM ANIMALS; ADDING A CROSS REFERENCE TO THE LOCATION OF REGULATIONS APPLICABLE TO CHICKENS IN THE MANATEE COUNTY CODE OF ORDINANCES; PROVIDING FOR A PURPOSE AND INTENT; AMENDING OTHER SECTIONS OF THE LAND DEVELOPMENT CODE FOR INTERNAL CONSISTENCY; REPEALING ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE.

BE IT ORDAINED by the Board of County Commissioners of Manatee County, Florida:

Section 1. Purpose and Intent. This ordinance is enacted to carry out the purpose and intent of and exercise the authority set out in the Local Government Comprehensive Planning and Land Development Regulation Act, Part II of Chapter 163, Florida Statutes, as amended and retitled the Community Planning Act in House Bill 7207 and Chapter 125, Florida Statutes, as amended.

Section 2. Findings. The Board of County Commissioners relies upon the following findings in the adoption of this ordinance:

1. Section 704, of the Manatee County Land Development Code (the “Land Development Code” or “the Code”), and Definitions, in Section 201 of the Code, along with other code provisions, establish regulations regarding farm animals, including chickens, within the unincorporated area of Manatee County.

2. Chapter 24 of the Manatee County Code of Ordinances (the “County Code”) establishes regulations regarding animals in the unincorporated area of Manatee County.

3. It is in the interest of the public health, safety and welfare of the citizens of the County to amend Section 201, Definitions of the Land

1 Development Code so as to delete regulations regarding chickens to the extent they are more appropriately regulated in the County Code. 4. The Manatee County Planning Commission held a duly noticed and advertised public hearing on April 11, 2013, received public comment, the staff report, and has reviewed the amendments set forth in this ordinance and has found these amendments to the Land Development Code to be consistent with the Manatee County Comprehensive Plan and recommended their adoption to the Board.

5. The Board of County Commissioners held two duly noticed advertised public hearings on May 2, 2013, and ______, 2013, received public comments, the staff recommendation and report of the Planning Commission and has found this ordinance would serve to streamline regulations within the County and thus serve a valid public purpose.

Section 3. Amendment of Chapter 2, Definitions and Rules of Construction, Land Development Code.

Chapter 2 of the Code is hereby amended in Section 201, Definitions, to amend the definitions related to “farm animals.” Said definitions are amended and restated in their entirety, a copy which is attached hereto, labeled Exhibit A to this ordinance, and made a part hereof by reference.

Section 4. Severability.

If any section, sentence, clause or other provision of this Ordinance shall be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not be construed as to render invalid or unconstitutional the remaining sections, sentences, clauses or provisions of this Ordinance.

Section 5. Codification.

The publisher of the County’s Land Development Code, the Municipal Code Corporation, is directed to codify the amendments in Section 3 of this ordinance into the Land Development Code, but shall not codify the remaining Sections.

Section 6. Applicability.

The amendments set forth in this ordinance shall apply to all applications, decisions or controversies pending before the County upon the effective date hereof or filed or initiated thereafter.

2 Section 7. Repealing Ordinances in Conflict.

Ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 8. Effective Date.

This ordinance shall become effective upon the immediate filing of this ordinance with the Secretary of State.

Farm Animal shall mean those animals commonly raised, bred or used for agricultural or livestock purposes, including, but not limited to: cattle, sheep, poultry, swine (including miniature potbellied pigs), horses, emus, rheas, goats and other livestock. Farm animals shall not be deemed to include common household pets, potbelly pigs, maintained in compliance with Section 704.2.2 hereof or chickens maintained in compliance with Chapter 24 of the Manatee County Code.

Pinellas to hold workshop on raising chickens in backyard Last Updated: Tuesday, April16, 2013

The Pinellas County Extension Service wants to teach you how to raise chickens in your backyard.

It has been legal for more than a year in Pinellas County to raise chickens, and the extension service is holding a workshop on how to do it right Saturday from 8:30 a.m. to noon at the Weedon Island Preserve Education Center. The cost $10 per family.

The workshop will address the fundamentals of raising chickens in Pinellas County. Dr. Robert Kluson, extension agent with Agriculture and Natural Resources at Sarasota County Extension, and other experts will discuss local regulations, housing, health issues and nutrition of backyard chickens. Pinellas regulations allow four chickens per resident in unincorporated areas. Coops cannot be visible from adjoining properties or streets.

Dear Mr Bustle

I have been following the developments concerning the zoning changes to allow chickens in the unincorporated areas of the county. I am all for it for many reasons. Fresh eggs taste better and are free of god knows what is in commercial eggs. In this economy folks are having difficulty feeding their families. It would be a good option. It would also ,in my opinion, teach our children an additional way they can provide for themselves and teach them responsibility. We are allowed to have reptiles, insects, pit bulls among other dangerous and not so appealing things as pets. I fail to see the reason behind banning egg producing chickens. They are beneficial to menacing insects, make good pets and an excellent food source. Many surrounding counties, and more affluent areas have come to see that this is not a way to open doors for suburban farms or a way to make a path for back yard swine or bovine raising. It is simply an additional way to help ourselves in these challenging times.

After reading the agenda for the Land Use meeting on Thursday, May 2, 2013, I am compelled to contact you regarding this matter.

On behalf of the residents and 69 homeowners in the community of Oak Trace, please be advised that we DO NOT approve of the proposed change in the definition of Farm Animal so as to allow chickens to be raised in Unincorporated Manatee County.

We did not build our homes in Unincorporated Manatee County because we wanted to live ttie farm life. Our community of Oak Trace IS NOT located in a farming area. We DO NOT have viable, operating farmsteads in our immediate neighborhood. We ARE NOT a farming community. We DO NOT want chickens 'being raised in our back yards or the back yards of. our neighbors. The noise, the smell, the rodents, the birds, things associated with the raising of chickens are offensive. Chickens do not belong here.

Please offer your support to our residents, and vote AGAINST any amendment that would allow chickens to be raised in Unincorporated Manatee County. Thanking you in advance.

Hybrid Farm Animals

There are many breeds in one species, for example, there are over 800 breeds of cattle. All are used for same purpose but there are some genetic differences in their breed which differentiates them from one another. This change may be due to the environmental factors or s ome other factors. Similarly all the farm animals have many different types of breed. Pure breed of farm animals are no doubt beneficial but there are many hybrids available of animals which perform better than the pure bree.ds. Genetically isolated breeds are crossed to get a hybrid which is expecte d to perform better than the original breeds. This is the basic idea behind the hybrid animals. Two n ormal breeds can form an extraordinary breed. These types of experiments are always done in th e laboratory and maximum times, the product shows greater performance as it gets the genetic qu alities of both the breeds. There are numerous hybrids which perform better than the original once. Not only in farm animals but you can get hybrid animals in almost all the species. In the story of how the dog came in from the cold and onto our sofas, we tend to give ourselves a little too much credit. The most common assumption is that some bunter-gatherer with a soft spot for cuteness found some wolf puppies and adopted them. Over time, these tamed wolves would have shown their prowess at hunting, so humans kept them around the campfire until they evolved into dogs. (See "How to Build a Dog.")

But when we look back at our relationship with wolves throughout history, this doesn't really make sense. For one thing, the wolf was domesticated at a time when modem humans were not very tolerant of carnivorous competitors. In fact, after modem humans arrived in Europe around 43,000 years ago, they pretty much wiped out every large carnivore that existed, including saber-toothed cats and giant hyenas. The fossil record doesn't reveal whether these large carnivores starved to death because modem humans took most of the meat or whether humans picked them off on purpose. A new program called "Pet Food Stamps" aims to provide free monthly home delivery of pet food and other necessary pet supplies to owners receiving food stamps or who are below the poverty line.

A firefighter rescued a golden retriever that fell into a Connecticut pond Wednesday morning, authorities said. The dog appears to be in good condition.

Westport Fire Department received a call that the 9-year-old pup, Huckleberry, fell through the ice at the end ofHales Road, authorities said Rescuers were able to respond immediately.
