Ceux-ci, en général, sont accusés sur-le-champ d’avoir commis l’acte criminel le plus grave dans les circonstances en attendant la conclusion de l’enquête. Par contre, avant que des accusations ne soient portées dans les cas où la police a tiré sur un civil, une enquête complète est menée, et les accusations semblent souvent moins graves que les faits pourraient le justifier.1 Au Canada, la loi est censée être la même pour tout le monde. Elle n’est toutefois pas appliquée de la même façon entre citoyens et policiers. Dans les faits, rares sont les policiers qui sont traduits devant les tribunaux pour des gestes de violence qui, s’ils avaient été posé par de simples citoyens, auraient valu à ceux-ci des accusations criminelles passibles de longues peines d’emprisonnement. En 1990, le gouvernement de l’Ontario a voulu contredire la sagesse populaire voulant que les policiers soient au-dessus des lois en mettant sur pied l’Unité des enquêtes spéciales – Special Investigations Unit ou S.I.U. en anglais – un organisme ayant pour mandat d’enquêter sur de possibles actes criminels commis par des policiers et de porter des accusations criminelles le cas échéant. Les enquêtes de l’UES portent sur des incidents où des citoyens ont été tués ou ont subi des blessures graves, que ce soit par des balles tirées par des policiers, lors de la détention dans un poste de police ou durant un accident de la route impliquant un véhicule conduit par un policier, ainsi que sur des allégations d’agression sexuelle visant des policiers. Au Québec, chaque fois qu’il a été question de mettre sur pied un organisme civil indépendant pour mener des enquêtes impartiales sur des incidents graves impliquant des policiers, les associations de policiers ont déchiré leur chemise sur la place publique. Or, en Ontario, les associations de policiers n’ont pas du tout réagi de la même façon à la création de l’UES, qui est passée pour ainsi dire comme une lettre à la poste. Cette absence d’opposition des milieux policiers peut notamment s’expliquer par le fait que la mise sur pied de l’UES n’était alors qu’une des nombreuses réformes qui avaient été incluses dans un vaste projet de loi comptant pas moins de 87 pages. Si la nouvelle obligation de recruter davantage de membres de minorités racisées dans les rangs de la police avait fait sourciller certains dirigeants de corps policiers et d’associations de policiers,2 les associations de policiers se sont montrées carrément hostiles aux déclarations du Solliciteur général de l’époque à l’effet qu’il souhaitait voir des restrictions à l’utilisation de la force mortelle par les policiers.3 1 Rapport de la Commission sur le racisme systémique dans le système de justice pénale en Ontario, p. 435. 2 The Toronto Star, “Police chief sees racial balance in 4 years”, November 17 1989, p. A1. 3 Comme nous le verrons, les associations de policiers vont vite déchanter à l’égard de l’UES, certains de leurs porte-paroles allant même jusqu’à prôner son abolition pure et simple durant les années subséquentes. Mais il n’en demeure pas moins qu’au moment où le gouvernement libéral de David Peterson a annoncé la création de l’UES, les dirigeants policiers semblaient avoir compris qu’il était dans l’intérêt de la paix sociale qu’un organisme civil fasse enquête sur les incidents graves impliquant la police dans un contexte où le mécontentement populaire grandissant, particulièrement au sein de la communauté noire de Toronto, face à des interventions policières controversées laissait craindre l’éclatement d’émeutes similaires à celles qui ont ébranlé la plupart des grandes villes des États-Unis durant le XXe siècle. « Les démocraties ont toujours adopté des "soupapes de sécurité sociale" pour libérer les pressions qui s’accumulent, dans une tentative d’éviter la désapprobation. L’UES est l’une de ces "soupape de sécurité sociale" », écrivait d’ailleurs James Cornish, directeur de l’UES, de 2004 à 2008.4 Ironiquement, ce n’est qu’après la mise sur pied de l’UES que les rues du centre-ville de Toronto ont été le théâtre d’une importante émeute quelques jours après la mort d’un jeune homme noir tombé sous les balles de la police. L’émeute de Yonge Street, en mai 1992, symbolisait à elle seule le terrible fiasco que représentait l’UES. Ce n’est pas là la seule ironie qui a marqué l’histoire de l’UES. L’UES a fait ses premiers pas sous un gouvernement néo-démocrate dirigé par un certain Bob Rae, lequel avait maintes fois prit fait et cause en faveur d’enquêtes civiles indépendantes sur les décès aux mains de la police du temps où il était chef de l’opposition à Queen’s Park, l’Assemblée législative de l'Ontario. Or, contre toute attente, ce fut le gouvernement suivant, dirigé par les conservateurs de Mike Harris, réputés proches des milieux policiers, qui a posé de véritables gestes concrets pour que l’UES reçoive certains des moyens financiers et légaux qui lui faisaient cruellement défaut depuis sa création. Bien entendu, il a fallu qu’un certain nombre rapports produits à la suite de différentes consultations publiques déplorent le quasi-dénuement de l’UES avant que le gouvernement provincial accepte, voire se résigne, à doter l’Unité de certaines des ressources dont elle avait besoin pour fonctionner dans un minimum de dignité. Ainsi, bien que certains responsables du gouvernement Harris cachaient difficilement leur manque d’affection envers l’UES, les conservateurs ontariens semblaient avoir réalisé ce que la plupart des dirigeants d’associations de policiers québécois n’ont 4 James L.
