Consideration of Proposed Amendments and Modifications to the Fiscal Year 2016- 2025 Metropolitan Transportation Improvement Program (MTIP) Including Surface Transportation Program – Direct Attributable (STP-DA) and Transportation Alternatives Program (TAP-DA) Funds Programming for the Winston-Salem Urban Area MPO

Presented by Fred Haith.  The NCDOT regularly updates the State Transportation Improvement Plan (STIP) to include new projects and modify existing projects.  Any STIP amendment for new statewide projects or projects within the Winston-Salem Urban Area MPO, triggers the amendment of the Metropolitan Transportation Improvement plan (MTIP).  Modifications to the STIP do not require adoption but are provided for information.  The MPO periodically imitates STIP revisions by programming Surface Transportation Program – Direct Attributable (STP-DA) and Transportation Alternatives Program (TAP- DA) funds.

5. Review of the STP-DA and TAP-DA Funded Call for Projects for the Winston Salem Urban Area MPO for Fiscal Years 2016-2017 and 2017-2018

Presented by Fred Haith.

 The Winston-Salem Urban Area MPO STP-DA and TAP-DA Call for Projects table identifies the proposed programming of the available STP-DA and TAP-DA funds.  $420,000 in STP-DA funds and $394,000 in TAP-DA funds ($814,000 Total) were added to TIP Project U-4741 Bicycle, Greenway and Sidewalk to provide funds for a variety of projects in the MPO in Fiscal Year 2016.  $700,000 in STP-DA funds and $394,000 in TAP-DA funds ($1,094,000 Total) were added to TIP Project U-4741 in Fiscal Year 2017.  A total of $600,000 in STP-DA funds was added to TIP Project U-4742, Intersection Improvement Projects in the MPO, in Fiscal Year 2016.  A total of $1,000,000 in STP-DA funds were added to TIP Project U-4742 in Fiscal Year 2017.  $1.62 million in STP-DA funds was programmed for TIP Project U-5022 (Small Roadway Projects/Streetscape Projects/Reserve) in Fiscal Year 2016.  $2.7 million in STP-DA funds was programmed for TIP Project U-5022 in Fiscal Year 2017.  $360,000 in STP-DA funds was added to TIP Project U-4951 (MPO Planning Studies) in Fiscal Year 2016.  $600,000 in STP-DA funds was added to TIP Project U-4951 in Fiscal Year 2017.  Ten percent of the STP-DA and TAP-DA funds programmed in each TIP number will serve as a contingency for the approved projects.  The TAC has the authority to grant additional STP-DA funds for projects upon request under reasonable circumstances. 3

 Altogether, $8 million in STP-DA funds and $788,000 in TAP-DA funds are proposed for Fiscal Years 2016 and 2017.  A local match of 20% is required of each project approved to receive funding.

A discussion ensued regarding the contingency fund.

6. Review of the Proposed Schedule for the Fiscal Year 2016-2017 Unified Planning Work Program (UPWP) and Self Certification of the Winston-Salem Urban Area MPO Transportation Planning Process

Presented by Greg Errett.

 From suggestions and requests, the draft Fiscal Year 2016-2017 UPWP will be developed and presented to the TCC and the TAC at the January 21, 2016 meetings and then sent to the North Carolina Department of Transportation and to federal agencies by Friday January 29, 2016 for their review and comment.  Approval of the Fiscal Year 2016-2017 UPWP will be considered at the Thursday, March 17, 2016 meetings.  Staff anticipates that the UPWP must be approved by the TAC by March 31, 2016.  Also, as part of the process in developing the annual UPWP, we are required to conduct an annual self-certification of the MPO’s transportation planning process. We will provide that to you at the January and February TCC/TAC meetings for your review and consideration.

a. NCDOT Division 9 Transportation Projects Update

Presented by Pat Ivey

 Pat distributed the What’s Going on with Business 40? newsletter and a nomination card for renaming Business 40.  The budget reforms signed by Governor McCrory added over $700 million in new funding for transportation over two years and ended the annual transfer of $216 million from the Highway Fund to the General Fund.  Over 10 years, these budget reforms are projected to provide an additional $1.6 billion for North Carolina Department of Transportation construction projects.  The accelerated project list includes all four sections of the final leg of the eastern section of the Winston-Salem Northern Beltway, which is also part of the Future Interstate 74 corridor (only segment A had been funded) and the interchange at U.S. 52. 4

 The complete list of accelerated schedules for transportation projects will be presented to the Board of Transportation for their review at their December meeting, with their approval expected in January 2016.

Action Requested: Consideration of the recommended Surface Transportation Program – Direct Attributable (STP-DA) and Transportation Alternatives Program – Direct Attributable (TAP-DA) funding allocation for the Winston-Salem Urban Area MPO’s Fiscal Year 2016 and Fiscal Year 2017 call for projects.

The United States Census defines urbanized areas with a population over 200,000 as Transportation Management Areas (TMAs). The Winston-Salem Urban Area was designated as a TMA after the 2000 U.S. Census. All TMAs may program federal STP-DA funds for high priority projects within their urban areas. As a TMA, the Winston-Salem Urban Area Metropolitan Planning Organization (MPO) has the authority to program available STP-DA funds for transportation planning, bicycle, greenway, sidewalk, street and highway, transit and other projects in the urban area.

The Winston-Salem Urban Area MPO also has the authority to program available TAP-DA funds. The MAP-21 legislation established a new program to provide for a variety of alternative transportation projects, including many that were previously eligible activities under separately funded programs. The TAP replaces the funding from pre-MAP-21 programs including Transportation Enhancements, Recreational Trails, Safe Routes to School, and several other discretionary programs, wrapping them into a single funding source.

The attached table identifies the proposed programming of the available STP-DA and TAP-DA funds as follows:  $420,000 in STP-DA funds and $394,000 in TAP-DA funds ($814,000 total) were added to TIP Project U-4741 Bicycle, Greenway and Sidewalk to provide funds for a variety of projects in the MPO in Fiscal Year 2016.  $700,000 in STP-DA funds and $394,000 in TAP-DA funds ($1,094,000 total) were added to TIP Project U-4741 in Fiscal Year 2017.  $600,000 in STP-DA funds was added to TIP Project U-4742, Intersection Improvement Projects in the MPO, in Fiscal Year 2016.  $1,000,000 in STP-DA funds was added to TIP Project U-4742 in Fiscal Year 2017.  $1.62 million in STP-DA funds was programmed for TIP Project U-5022 (Small Roadway Projects/Streetscape Projects/Reserve) in Fiscal Year 2016.  $2.7 million in STP-DA funds was programmed for TIP Project U-5022 in Fiscal Year 2017.  $360,000 in STP-DA funds was added to TIP Project U-4951 (MPO Planning Studies) in Fiscal Year 2016.  $600,000 in STP-DA funds was added to TIP Project U-4951 in Fiscal Year 2017.

Item #4 RESOLUTION APPROVING THE RECOMMENDED SURFACE TRANSPORTATION PROGRAM - DIRECT ATTRIBUTABLE (STP-DA) AND TRANSPORTATION ALTERNATIVES PROGRAM - DIRECT ATTRIBUTABLE (TAP-DA) FUNDING ALLOCATION FOR THE WINSTON-SALEM URBAN AREA MPO’S FISCAL YEAR 2016 AND FISCAL YEAR 2017 CALL FOR PROJECTS

A motion was made by TAC Member ______and seconded by TAC Member ______for the adoption of the following resolution, and upon being put to a vote was duly adopted.

WHEREAS, the Winston-Salem Urban Area, an urbanized area with a population over 200,000, may program federal STP-DA and TAP-DA funds for high priority projects within the urban area.; and

WHEREAS, the TAC has considered how the MTIP will affect the elderly and disabled per the provisions of the Americans with Disabilities Act of 1990 (ADA) (Pub. L. 101-336, 104 Stat. 327, as amended) and the United States Department of Transportation (USDOT) implementing regulations; and

WHEREAS, $360,000 in STP-DA funds was added to TIP Project U-4951 (MPO Planning Studies) in Fiscal Year 2016; and $600,000 in STP-DA funds was added to TIP Project U-4951 in Fiscal Year 2017; and

WHEREAS, 10% of the STP-DA and TAP-DA funds programmed in each TIP number will serve as a contingency for the approved projects. The TAC has the authority to grant additional STP-DA funds for projects upon request under reasonable circumstances; and

WHEREAS, a local match of 20% is required of each approved project.

NOW, THEREFORE BE IT RESOLVED that the Transportation Advisory Committee of the Winston-Salem Urban Area MPO approves the recommended Surface Transportation Program – Direct Attributable (STP-DA) and Transportation Alternatives Program – Direct Attributable (TAP-DA) funding allocation for the Winston-Salem Urban Area MPO’s Fiscal Year 2016 and Fiscal Year 2017 as shown on the attached table from the call for projects.

Winston-Salem Urban Area Metropolitan Planning Organization 2016 Call for Projects ______

The Winston-Salem Metropolitan Planning Organization (WSMPO) is seeking proposals from local governments and other eligible project sponsors to implement transportation projects. The 2016 Call for Projects will commit federal funds allocated to the WSMPO to implement Bicycle and Pedestrian, Intersection Improvements, Small Roadway, Streetscape, and Transit projects. All proposals seeking funding will be evaluated, ranked, and submitted to the WSMPO Transportation Advisory Committee (TAC) for final approval.

Available Funds:

Funding is being made available to the WSMPO through the recent Transportation Bill, Moving Ahead for Progress in the 21st Century (MAP-21). The amount of federal funding available is as follows:

 Bicycle/Pedestrian - $1,717,000 in Federal Funds available with $191,000 serving as contingency  Intersection Improvements - $1,440,000 in Federal Funds available with $160,000 serving as contingency  Reserve/Small Roadway/Streetscape/Transit - $3,888,000 in Federal Funds available with $432,000 serving as contingency

The Surface Transportation Program Direct Apportionment Program (STP-DA) is a federal transportation funding program that provides flexible funding to states for highway, bridge, transit capital, intercity mass transportation, bicycle and pedestrian projects, among other project types. The program is authorized by federal transportation bills, the most recent of which was MAP-21, the Moving Ahead for Progress in the 21st Century Act. States are required to make these funds available to Transportation Management Area MPOs (Urbanized areas with a population greater than 200,000). These “direct attributable” (DA) funds are allocated by MPOs to member jurisdictions. The Winston- Salem MPO (WSMPO) undertakes this process by issuing calls for projects.

MAP-21, the Moving Ahead for Progress in the 21st Century Act (P.L. 112-141), was signed into law by President Obama on July 6, 2012. Funding transportation programs at over $105 billion for fiscal years (FY) 2013 and 2014, MAP-21 is the first long-term highway authorization enacted since 2005. MAP-21 creates a streamlined and performance-based surface transportation program and builds on many of the highway, transit, bike, and pedestrian programs and policies established in 1991.

MAP-21 establishes a new program to provide for a variety of alternative transportation projects, including many that were previously eligible activities under separately funded programs. The Transportation Alternatives Program (TAP) replaces the funding from pre- MAP-21 programs including Transportation Enhancements, Recreational Trails, Safe Routes to School, and several other discretionary programs, wrapping them into a single funding source.

As a Transportation Management Area MPO, the WSMPO receives a direct sub- allocation of STP-DA funds each year and an allocation of TAP funds each year. The primary requirement for utilizing these funds in our MPO area is: STP-DA and TAP funds must be obligated to eligible projects through a competitive process, in consultation with the State from proposed projects submitted by eligible entities.

Programming STP-DA and TAP Projects 1. The MPO Staff contacts NCDOT’s Program Development Branch (PDB) to determine available STP-DA and TAP funds. 2. MPO staff meets to develop a Draft Fiscal Year Program. MPO staff develops the parameters for the biannual Call for Projects (Minimum and Maximum project costs, Project Submittal Method, Eligibility, Monthly Project Updates sent to: MPO and NCDOT, etc…) 3. MPO staff will hold a biannual Federal Funding Workshop. The workshop will address the call for projects parameters, required documentation, timelines, budget issues, project delivery expectations, etc. 4. TAC approval of the call for projects parameters, required documentation, timelines, budget, project delivery expectations, etc. 5. MPO staff initiates the biennial Call for Projects. 6. Project selection committees are formed to review and rank projects based on a specified set of criteria. 7. The MPO’s TAC takes formal action to program projects with available STP-DA and TAP funding. The TAC must approve the project(s) and its action must state the funding committed based upon the applicable estimated cost of preliminary engineering (PE), right of way (ROW), and construction phase of the project as well as a schedule to accomplish each phase of the project. The MPO shall also document that the scope of work meets the eligibility requirements. 8. The PDB of NCDOT programs the project(s) based upon the information submitted with Board of Transportation concurrence. With concurrence, the PDB of NCDOT assigns a STIP Project Number. 9. The MPO identifies the Local Governmental Entity (LGE) that will administer the project in accordance with the STP-DA Independent Project Guidelines. 10. The Local Programs Management Office (LPMO) will assign a NCDOT Project Manager (NCDOT PM) to coordinate the project for NCDOT. The NCDOT PM works with the LGE to execute an agreement to define funding and project responsibilities.

Implementing STP-DA and TAP Projects 11. The LGE will request an agreement through NCDOT’s Project Management Tool. 12. NCDOT’s Local Projects Management Office (LPMO) will develop a Project Agreement based on the PID for all phases: Design (if applicable), Right-of-Way (ROW), Construction, etc. The agreement must be executed, and any required planning documents approved prior to NCDOT authorizing project specific phases: Design, ROW, Construction, etc. The agreement will define the project’s location and whether the proposal is on a state or locally owned facility. The agreement will also specify the maintenance and liability responsibilities for the completed project. 13. The LGE will oversee project implementation once a project agreement is executed. The LGE ensures the terms of the agreement are adhered to for reimbursement. 14. NCDOT Authorizes Preliminary Engineering.

15. The LGE will complete the preliminary engineering for the project. For projects requiring a document more comprehensive than a Type I Categorical Exclusion, a file copy of the approved planning environmental document should be forwarded to the NCDOT PM prior to, or with the request for ROW authorization for all projects. (Note: The LGE is responsible for evaluating the need for the facility (i.e., generators, safety, continuity, integration, existing or projected traffic) and public involvement. The LGE is responsible for certification to the Department that local governing standards and generally accepted engineering practices have been adhered to and a professional engineer has sealed the plans.) (Note: The LGE may use a Professional Engineering Firm (PEF) or in-house planning efforts. If a PEF is used, the LGE shall select a consultant in accordance with federal and State guidelines for procurement. The consultant selected to perform engineering services on a state maintained roadway must be pre- approved by the Department.) 16. The LGE submits invoices to the NCDOT PM for engineering costs incurred as specified in the agreement. The invoice should note the project number and whether the invoice is a partial or final invoice. Proof of payment and supporting documentation is not necessary if the governmental entity is reporting under the Single Audit Act. (Note: The STP-DA and TAP programs are cost reimbursement programs with reimbursement on a quarterly basis. As per the North Carolina Board of Transportation’s (NCBOT) Policy on Federally Funded Projects Selected by Entities Other than the NCBOT, the LGE is responsible for providing at least the 20% project matching funds to the STP-DA funds authorized and all costs greater than the authorized STP-DA funding. Additional funding can be authorized with the use of a supplemental agreement pending TAC approval.) 17. If the project is on the state maintained roadway system, preliminary designs will be submitted by the LGE for review and approval by NCDOT PM. Preliminary design plans are to show design, profiles, typical section, construction limits, drainage, and proposed ROW and /or easements. The project shall be designed in accordance with federal and State regulations as well as AASHTO standards. A plan showing utility conflicts shall also be included with the final plans. 18. NCDOT PM and PDEA approves the planning document. 19. The LGE obtains any required permits for the project and verifies to the NCDOT PM that all such required permits have been obtained and have not expired prior to project construction.

20. NCDOT authorizes ROW funding upon completion of the environmental document and receipt of a request for ROW funding in the listed dollar amount per the attached preliminary plans. The LGE is responsible for the acquisition of ROW or easements and such acquisition must be certified in accordance with the Federal Aid Policy Guide, Part 710. Certification of existing municipally owned ROW shall be in accordance with procedures governing the acquisition of ROW. ROW costs or utility relocation costs incurred prior to NCDOT authorization of ROW funding will not be reimbursed. (Note: It is recommended that the LGE contact the Division ROW Agent prior to initiating any ROW acquisition to review the preliminary ROW plans and the required negotiation and relocation processes that must be followed and to determine if an encroachment agreement is necessary.) 21. The LGE shall accomplish or cause to be accomplished the relocation and/or adjustment of any and all publicly or privately owned utilities in conflict with the project. 22. Prior to the LGE advertising for construction bids, the LGE shall submit final plans, specifications, and contractor’s estimates (PS&E package) for construction funding federal authorization. For projects on the state maintained roadway system, the PS&E package should include 3 sets of final plans/2 copies of contract proposals for NCDOT for review and approval prior to advertisement of the construction project. 23. The LGE shall advertise the project as per the FHWA regulations as contained in the Federal-Aid Policy Guide. 24. The LGE shall submit a bid tabulation with DBE goals stated (along with 2 copies of the construction contract for projects on the state maintained system) to the NCDOT PM prior to award of the construction contract by the LGE. The NCDOT PM will notify the LGE of FHWA and Departmental concurrence, thereby authorizing the LGE to proceed with the awarding of the construction contract. 25. The LGE will oversee and inspect the project construction. The Local DOT Division Office should also be consulted and will be responsible for performing the final project inspection. The LGE submits all construction invoices to the NCDOT PM for review and reimbursement subject to all conditions as contained within the project Agreement. The LGE must adhere to cost principles as contained in OMB Circular A-87, Administrative Requirements as contained in 49 CFR 18, and shall arrange for an independent audit in compliance with NCGS 159-34 and in accordance with OMB Circular A-128..

WSMPO Policies 1. A Project Screening Form must be COMPLETED and submitted along with other supporting documentation in order for a project to be evaluated (Attached). (Note: The screening form will assist in identifying potential pitfalls such as utility and ROW conflicts.)

2. Programming STP-DA funds that have yet to be allocated to the MPO is prohibited. (Note: Estimates of capital cost, ranging from detailed engineer’s estimates to planning-level cost estimates, should be as refined as appropriate for the project’s stage in the project development process. Cost estimates used to program or setting aside future funds will more than likely need to be revised in the future, resulting in the need for additional funds.)

3. Only Safety and STIP projects partially funded by the NCDOT may be brought to the attention of the TAC and considered for funding outside of the scheduled Call for Projects. (Note: There is a limited amount of funds available for each Call for Projects. Consideration of any project that was not approved by the TAC during the Call for Projects reduces the contingency funds for the approved projects.)

4. During each call for projects 10% of the available STP-DA funds will serve as a contingency for the cumulative total of project costs approved. The TAC has the authority to grant additional STP-DA funds for projects upon request under reasonable circumstances. (Note: Adhering to the budget established for a given Call for Projects ensures that subsequent Calls occur without delay. From 2009 to 2014 the average cost increase approved by the TAC was 73% above the original cost estimate.)

5. An executed Locally Administered Project Agreement with the State must be in place no later than nine (9) months after Programming in the STIP by the NC Board of Transportation. If a project fails to secure an executed agreement funding is revoked and the project must be resubmitted during the next call for projects. (Note: Prompt project delivery has significant benefits: Reduces risk of funds subject to lapse; demonstrates that the MPO can spend its yearly allocation of funds; reduces the impact on the MPO subject to federal rescission.)

6. If an approved project is canceled, the associated STP-DA funds remaining revert back to the MPO’s unobligated balance. If a Municipality decides to cancel a Project without the concurrence of the NCDOT, the Municipality shall reimburse the NCDOT one hundred percent (100%) of all costs expended by the NCDOT associated with the Project.

7. Once a project is approved for funding, scope changes that result in a category shift are prohibited. For example, a sidewalk project’s scope can’t be modified to include a lane widening. (Note: Project categories are identified prior to each Call for Projects. Typical categories: Intersection Improvements, Small Roadway Improvements, and Bicycle and Pedestrian Improvements. Projects are ranked per category and funding is awarded to select projects in each category. Scope modification often result in the need for additional STP-DA funds.)

8. Once a project is approved for funding, scope changes that deviate from the location of the approved project are prohibited. For example, an intersection improvement project at location A cannot become an intersection improvement project at location B. (Note: Each project is evaluated based on the parameters submitted during the Call for Projects. Changing a project’s location introduces new variables that must be evaluated before an award of funding.)

Projects Approved Prior to the January, 2016 Biennial Call for Projects (Pre-Existing) The Projects listed on the attached table must adhere to the policies and procedures stated in this document excluding MPO policy #4 and #5. In lieu of MPO policy #5, each project must obtain an executed Locally Administered Project Agreement with the State by August 01, 2015. If an agreement is not secured then the funding associated with said project will revert back to the MPO’s overall available funding balance. The local jurisdiction will have to resubmit the project during the January, 2016 Biennial Call for Projects, if it is still viable. In lieu of MPO policy #4, additional STP-DA funding requests can only be made during the January, 2016 biennial call for projects due to the lack of available funds.

SUMMARY OF INFORMATION: Attachments: Yes X No ______Each year the Winston-Salem Urban Area Metropolitan Planning Organization (MPO) is required to develop and approve a Unified Planning Work Program (UPWP) for transportation planning. The UPWP identifies what transportation planning projects and work tasks will be completed during the fiscal year and the estimated amount of federal and State highway and transit planning funds that will be used to complete the work, plus the required local matches.

Attached is the draft UPWP for Fiscal Year 2016-2017. The UPWP consists of three (3) major parts: Table 1, a Funding Sources Table; Table 2, a Narrative Task Table; and Table 6 a Five Year Planning Calendar for the MPO.

Tables 3, 4 and 5 that contain supplemental funding information as required by the North Carolina Department of Transportation (NCDOT) Public Transportation Division (PTD) for the use of Federal Transit Administration (FTA) Section 5303 transit planning funds. Table 6 is the MPO’s required Five Year Planning Calendar.

The UPWP’s most important projects will be to assist NCDOT with the design/build process for the Business 40 Streetscape Design Plan and betterments package; making final adjustments to the proposed routes and schedules for the new Winston-Salem Transit Authority’s (WSTA) regular route transit system and identify/plan bus stop locations and needed improvements; implement the recommendations for upgrading WSTA’s bus stops and transit shelters along current routes 10 and 13 (primarily along Patterson Avenue and Peters Creek Parkway (NC 150)); assist various public and private agencies with the use of available JARC and Section 5310 transit funds; and, prepare for the federal certification review of the MPO’s transportation planning process.

Please note that the Winston-Salem Urban Area MPO is proposing to program the same basic amounts of transportation planning funds (PL funds), Section 5303 transit planning funds, and to re-establish the use of Surface Transportation Program – Direct Attributable (STP-DA) funds for major studies and projects within the MPO.

The draft UPWP will be submitted to NCDOT through their Partner Connect and Connect NCDOT websites by January 31st. Additional reviews will take place at the February 18, 2016 TCC/TAC meetings and adoption of the UPWP will take place at the March 17, 2016 TCC/TAC meetings with final electronic submissions to NCDOT by March 31, 2016.

RESOLUTION TO APPROVE THE FISCAL YEAR 2016-2017 UNIFIED PLANNING WORK PROGRAM (UPWP) AND FIVE YEAR PLANNING CALENDAR FOR THE WINSTON-SALEM URBAN AREA METROPOLITAN PLANNING ORGANIZATION

A motion was made by TAC member ______and seconded by TAC member ______for the adoption of the following resolution, and upon being put to a vote was duly adopted.

WHEREAS, all Metropolitan Planning Organizations (MPOs) that have been designated as Transportation Management Areas (TMAs) with an urbanized population of over 200,000 are required to develop an annual Unified Planning Work Program (UPWP) in coordination with the Federal Transit Administration (FTA); and

WHEREAS, the annual UPWP identifies what transportation planning projects and work tasks will be completed during the fiscal year, the proposed funding sources, and the amounts of federal, State and local highway and transit planning funds that will be allocated by work task to complete the work; and

WHEREAS, the transportation planning projects and work tasks in the annual UPWP are based on the task descriptions in the recently updated Prospectus for Transportation Planning; and

WHEREAS, a comprehensive and continuing transportation planning program must be carried out cooperatively in order to ensure that funds for the transportation projects are effectively allocated to the Winston-Salem Urban Area; and

WHEREAS, the City of Winston-Salem Department of Transportation (WSDOT) has been designated as the recipient of FTA Section 5303 Metropolitan Planning Program funds; and

WHEREAS, members of the Winston-Salem Urban Area Transportation Advisory Committee agree that the Fiscal Year 2016-2017 UPWP and the Five Year Planning Calendar will effectively advance transportation planning for the urban area.

NOW, THEREFORE, BE IT RESOLVED that the Transportation Advisory Committee of the Winston-Salem Urban Area Metropolitan Transportation Organization approves the Fiscal Year 2016-2017 UPWP and Five Year Planning Calendar for the Winston- Salem Urban Area Metropolitan Planning Organization.

Each year the Winston-Salem Urban Area Metropolitan Planning Organization (MPO) is required to develop and approve a Unified Planning Work Program (UPWP). The UPWP identifies what transportation planning projects and work tasks will be completed during the fiscal year and the amount of federal and State highway and transit planning funds that will be used to complete the work, plus the required State and local matches. Depending on the specific funding source, tasks funded through the UPWP are eligible for reimbursement of 80-90% of their cost from the Federal Highway Administration (FHWA) and the Federal Transit Administration (FTA) through the North Carolina Department of Transportation (NCDOT).

The Winston-Salem Urban Area UPWP identifies three (3) separate federal funding sources for conducting transportation planning and they are shown in Table 1. They include:

 FHWA Section 104 (f) Funds (PL Funds) – These funds are the primary funding source dedicated to the MPO to perform transportation planning as required by various State and Federal laws and regulations. These funds require a 20% local match.  FTA Section 5303 Funds – These funds are used for transit planning in the urban area. The FTA provides 80% of these funds with a 10% match from NCDOT and a local match of 10% from the Winston-Salem Urban Area MPO.  Federal Surface Transportation Program – Direct Attributable (STP-DA) supplemental planning funds are included in this year’s UPWP for the MPO and requires a 20% local match.

The local match requirements will be shared by all members of the Winston-Salem Urban Area MPO as defined in the Memorandum of Understanding (MOU).

Happy New Year!

It’s time to complete your 2016 Ethics forms, the Statement of Economic Interest (SEI) and the Real Estate Disclosure (RED) form, as required under North Carolina Law. For members/alternates who submitted ethics forms in 2015, the deadline for submission of 2016 forms is April 15, 2016. New members/alternates must complete their SEI and RED prior to assuming their position on the TAC.

Please read the notes on the reverse side of this memo—the completion/submission process will be much easier for you if you do. I’ve also attached information sheets provided by the NC Ethics Commission with tips for complying with the SEI and RED requirements. Please read these information sheets before working on your SEI and RED.

The submission requirements are the same as last year, as are the fines. The Ethics Commission is required to impose a fine of $250 for late filing and/or failure to file for each form. Please file on time!

As a TAC member, you have two forms to complete—the Statement of Economic Interest (SEI) and the Real Estate Disclosure (RED). (Legislators and other State board/commission members only have to complete the SEI.)

Ethics 2016 Compliance Notes from Margaret:  File early. Please do not wait until April to complete and submit your forms. If you encounter problems, you may not meet the April 15 deadline.  File on-line. While you can file manual, there are many advantages to on-line filing: the SEI and RED forms are combined, so you don’t miss a form; you also can’t miss any questions since you can’t submit without completing every question; you an immediate confirmation that you have filed your forms; and filing will be easier next year (you may even be  Call me or the Ethics Commission staff if you have questions or problems. The Ethics Commission staff and I will work with you to meet your compliance requirements.

On-line Filing (highly recommended): Login: If you’ve filed on-line before, you will need your Login and Password. There are ways to recover your Login and Password, if you don’t remember them. If you haven’t filed on-line, you will need to create an NCID#. When you figure out or create your login/password, please write them down for future years. Reason for Filing: In the “Reason for Filing” section, Check Board/Commission and then the very last option on the drop down menu, “Winston-Salem Urban Area MPO (TAC)” Keep a copy: Print out a copy of your SEI/RED and the page with the submission confirmation number. Write your login/password on these documents and file in a safe place.

Manual Filing (not recommended): Submit Both Forms: You must complete and submit both the State-ment of Economic Interest (SEI) and the Real Estate Disclosure (RED). Your filing will not be complete unless the Commission receives both forms completed in full. If you do not submit both forms completed in full and signed, your filing will be considered incomplete. You may miss the filing deadline and could be fined. Submit Original Forms: You must mail in (or deliver) original, signed forms. You cannot fax or email the forms. Complete all blanks: Do not skip any questions. Indicate NA or Not applicable for anything that doesn’t apply. Please have someone else review the forms to make sure you have completed all the questions. If you do not complete all questions, it will be considered incomplete, they will return the form to you and you could miss the filing deadline and could be fined. Reason for Filing: In the “Reason for Filing” section, check Board/Commission and list “Winston-Salem Urban Area MPO (TAC)” This is very important. Putting down the wrong reason, such as listing your local government, could mean that your form will be incorrectly filed and you will not get credit for the submittal. Keep a copy of the Forms: Print out a copy for your records, but also in case your forms gets lost in the mail and you have to resubmit them. Send via Certified Mail: Send your forms via certified mail to the Ethics Commission so you have documentation the forms have been received by the Ethics Commission. READ EACH QUESTION CAREFULLY AS THE TIME PERIODS FOR REPORTING VARY PER THE NC STATE GOVERNMENT ETHICS ACT (N.C.G.S 138A)

1. PUBLIC RECORDS. The State Ethics Commission (Commission) is required to collect and maintain disclosures from certain persons covered by the State Government Ethics Act (Ethics Act). By law, the information requested is public record and available to the public upon request. As public records, 2016 Statements of Economic Interest (SEI) are available on the Commission’s website. Personal contact information, however, is not.

2 CONTACT INFORMATION PAGE. The Contact Information page, which includes your personal contact information, will not be available on the Commission’s website.

3. CHILDREN’S INITIALS. Only list minor children’s INITIALS on the SEI. List each child’s full legal name on the Confidential Form at the end of the SEI. The Confidential Form is not a public record, and the Commission will not make it available to the public.

4. ANSWER EACH QUESTION. It is important to answer each question, including all applicable sub-parts. Even if your answer is "no" or "not applicable," make certain you answer each question. Many of the questions have "yes" and "no" boxes to check for your convenience. Incomplete SEIs may cause delays and negatively impact your public service on a covered board or as an employee.

5. WHY ARE YOU FILING. You must list the complete name of the state board or state agency employer for which you are filing the SEI. Without this information, your SEI may be delayed and negatively impact your public service on a covered board or as an employee.

6. HOW TO FILE. The Commission strongly recommends on-line filing as it is secure, allows easy information updates, and gives you access to your electronic SEIs previously filed. Filing your SEI on-line is easy, quick, convenient, and reduces the chance of reporting errors. Getting started is easy. Follow the simple steps to create your own NCID account and get access today: http://www.ethicscommission.nc.gov/library

To file a paper version of the SEI, you must provide the Commission with a signed, original SEI form. Each SEI includes an "affirmation" and is a legally binding document. Please sign your paper SEI in blue ink.

FAXED OR EMAILED COPIES OF YOUR SEI CANNOT BE ACCEPTED

7. INCOME. List each source of income as requested on the SEI. The actual dollar amount is not required. Be sure to list your employer as a source of income in Question # 6 of the SEI.

8. READ CAREFULLY. Read each question carefully, as the Ethics Act requires that you disclose your financial holdings and obligations, personal property, and real property and may also include your knowledge of the holdings of both your immediate family and your extended family. “Immediate family” and “extended family” are defined terms in the Ethics Act, and those definitions are included with this document.

PAY CLOSE ATTENTION TO TIME PERIODS IN EACH QUESTION

9. REFLECT. Think carefully about WHY you are filing, and whether it has any relationship to your position. Does your board or commission license or regulate you? For many of the boards, a subject matter expert like a licensee is needed. Answering “yes” does not prohibit your service on the board, and your perspective is valued.

10. MAKE A COPY. Make a copy of the SEI for your own records, and make a note in your calendar when you submit it, whether on-line or by mail or hand delivery. When you successfully submit your SEI electronically on-line, the final screen will provide a confirmation number and will be definitive proof that you have satisfied your filing obligation. Please print the confirmation screen for your records.

11. ETHICS LIAISON. Contact your Ethics Liaison to assist you in your obligations under the Ethics Act. Your Ethics Liaison is good source of information about how to fill out your SEI.

12. ON-LINE HELP. The Ethics Commission has on-line resources to answer questions you may have about your SEI. For more information, please visit the State Ethics Commission website which has education offerings.

HELPFUL DEFINITIONS

The definitions below may be helpful to you in completing your SEI. A complete list of all definitions used in the State Government Ethics Act, N.C.G.S. § 138A-3, is available on the Commission’s website.

Board. Any State board, commission, council, committee, task force, authority, or similar public body, however denominated, created by statute or executive order, as determined and designated by the Commission, except for those public bodies that have only advisory authority.

Business. Any of the following organized for profit: association, business trust, corporation, enterprise, joint venture, organization, partnership, proprietorship, vested trust, and every other business interest, including ownership or use of land for income.

Business with which associated. A business in which the covered person or filing person or any member of that covered person's or filing person's immediate family does any of the following: is an employee, holds a position as a director, officer, partner, proprietor, or member or manager of a limited liability company, irrespective of the amount of compensation received or the amount of the interest owned, owns a legal, equitable or beneficial interest of ten thousand dollars ($10,000) or more in the business or five percent (5%) of the business, whichever is less, other than as a trustee on a deed of trust, or is a lobbyist registered under Chapter 120C of the General Statutes.

For the purposes of this definition, the term “business” shall not include a widely held investment fund, regulated investment company, or pension or deferred compensation plan, if all of the following apply: the covered person, filing person, or a member of the covered person’s or filing person’s immediate family neither exercises nor has the ability to exercise control over the financial interests held by the fund, and the fund is publicly traded or the fund’s assets are widely diversified.

Emancipation. A minor child, under the age of 18 years, is emancipated by the following acts: marriage, enlistment in the United States armed forces, or court action for emancipation.

Extended family. Spouse, lineal descendant, lineal ascendant, sibling, spouse's lineal descendant, spouse's lineal ascendant, spouse's sibling, and the spouse of any of these individuals.

Honoraria. Payments for services for which fees are not legally or traditionally required.

Immediate family. An unemancipated child of the covered person residing in the household and the covered person's spouse, if not legally separated. A member of a covered person's extended family shall also be considered a member of the immediate family if actually residing in the covered person's household.

Judicial officer. Justice or judge of the General Court of Justice, district attorney, clerk of court, or any individual elected or appointed to any of these positions prior to taking office.

Nonprofit corporation or organization with which associated. Any not for profit corporation, organization, or association, incorporated or otherwise, that is organized or operating in the State primarily for religious, charitable, scientific, literary, public health and safety, or educational purposes and of which the covered person, 3 | P a g e

filing person, or any member of the covered person's or filing person's immediate family is a director, officer, governing board member, employee, lobbyist registered under Chapter 120C of the General Statutes, or independent contractor. Nonprofit corporation or organization with which associated shall not include any board, entity, or other organization created by this State or by any political subdivision of this State.

Person. Any individual, firm, partnership, committee, association, corporation, business, or any other organization or group of persons acting together. The term "person" does not include the State, a political subdivision of the State, a board, or any other entity or organization created by the State or a political subdivision of the State.

Person with which the legislator is associated. Any of the following: a member of the legislator's extended family, a client of the legislator, a business with which the legislator or a member of the legislator's immediate family is associated, a nonprofit corporation or association with which the legislator or a member of the legislator's immediate family is associated, the State, a political subdivision of the State, a board, or any other entity or organization created by the State or a political subdivision of the State that employs the legislator or a member of the legislator's immediate family.

Person with which the public servant is associated. Any of the following: a member of the public servant's extended family, a client of the public servant, a business with which the public servant or a member of the public servant's immediate family is associated, a nonprofit corporation or association with which the public servant or a member of the public servant's immediate family is associated, and the State, a political subdivision of the State, a board, or any other entity or organization created by the State or a political subdivision of the State that employs the public servant or a member of the public servant's immediate family.

Scholarship. A grant-in-aid to attend a conference, meeting, or other similar event, which includes all event- related expenses, like food, beverages, registration, travel and lodging.

Trusts: Blind Trust. A trust established by or for the benefit of a covered person or a member of the covered person’s immediate family for divestiture of all control and knowledge of assets. A trust qualifies as a blind trust under this subdivision if the covered person or a member of the covered person’s immediate family has no knowledge of the holdings and sources of income of the trust, the trustee of the trust is independent of and not associated with or employed by the covered person or a member of the covered person’s immediate family and is not a member of the covered person’s extended family, and the trustee has sole discretion as to the management of the trust assets.

Toolkit for Electric Vehicle (EV) Infrastructure Corridor Development o Oregon Department of Transportation initiated a pooled-fund study to assist state and local transportation agencies interested in promoting the use of alternative vehicle and fuel technologies o The Deployment of Alternative Vehicle and Fuel Technologies initiative utilizes a series of workshops around the country to develop a web-based “toolkit” for state and local transportation agencies. o It provides resources and information to support plug-in electric vehicle (EV) adoption through EV charging infrastructure development along travel corridors. o The toolkit is comprised of two components: Resource Library and Workshop Materials. Winston-Salem MPO Call for Projects The Winston-Salem Urban Area MPO will accept bicycle and pedestrian transportation projects through its call for projects through Monday, January 25th. There is approximately $1,717,000 in federal funding available for bicycle and pedestrian projects through the call, which includes Transportation Alternative Program (TAP) Funding as well as Surface Transportation Program (STP) funds. Typical projects include design and construction of sidewalks, greenways, bicycle lanes, bicycle parking, and pedestrian crossing improvements, though other bicycle and pedestrian facilities are also eligible. In addition to infrastructure improvements, TAP funds may be used for programmatic expenses related to education, encouragement, enforcement, and evaluation activities, so communities are encouraged to submit those types of projects as well. Infrastructure projects submitted through the call for projects must be at least $200,000 and no more than $1,500,000, and the municipality is responsible for managing the project and providing the 20% local match regardless of project size. Additional evaluation forms are now required to ensure that selected projects have been vetted and evaluated sufficiently to ensure successful project implementation. Once the projects have been submitted, MPO staff will convene a bicycle and pedestrian project selection committee to recommend a set of projects to the TAC for funding.

North Carolina House Bill 232 NCDOT has released a draft report of recommendations for the H232 Bicycle Safety Law Study (http://www.bikewalknc.org/wp-content/uploads/2015/12/H-232-report.pdf). Last year, the North Carolina Legislature asked NCDOT to examine current bicycle laws and make a series of recommendations to update and improve those laws for cyclist and motorist safety. NCDOT formed a stakeholder working group to discuss the following issues:  How faster-moving vehicles may safely overtake bicycles on roadways where sight distance may be inhibited.  Whether bicyclists on a roadway should be required to ride single file or allowed to ride two or more abreast.  Whether bicyclists should be required to carry a form of identification.  Visibility (clothing or other reflective gear) and lighting requirements  Options for hand signals for turning  2-foot or other passing distance requirements  Operating position in roadway  Informal group rides on rural roadways  Aggressive driving, harassment, and distracted driving laws  Vulnerable road user protection  Formal group event permitting and regulations.

Bike Month Activities Winston-Salem MPO communities are making preparations for National Bike Month in May with a series of events. Communities planning to host an event are encouraged to share the information for inclusion in the MPO’s Bike Month Calendar. In addition to the events listed below, the MPO will organize a series of bike rides, safety events, and social events to foster a bicycle friendly community.
