This is an action seeking a refund of the estate tax levied on a married same-sex couple, which would not have applied to a married straight couple, and which consequently violates the United States Constitution. 2. The plaintiff in this action, Edith Schlain Windsor ("Edie"), met her late spouse, Thea Clara Spyer ("Thea"), nearly a half-century ago at a restaurant in New York City. Edie and Thea went on to spend the rest of Thea's life living together in a loving and committed relationship in New York. 3. After a wedding engagement that lasted more than forty years, and a life together that would be the envy of any couple, Thea and Edie were finally legally married in Toronto, Canada in 2007. Having spent virtually their entire lives caring for each other in sickness—including Thea's long, brave battle with multiple sclerosis—and in health, Thea and Edie were able to spend the last two years of Thea's life together as married. 4. New York State legally recognizes Edie and Thea's marriage and provided them with the same status, responsibilities, and protections as other married people. However, Edie and Thea were not considered "married" under federal law because of the operation of the statute known (ironically) as the Defense of Marriage Act ("DOMA"), 1 U.S.C. § 7. 5. This clearly unequal treatment of Edie and Thea's marriage both demeans their remarkable commitment to one another and has great practical significance for Edie, the sole beneficiary of Thea's estate. -

September 20, 2019 Program Design Branch, Program Development Division, Food and Nutrition Service United States Department of Agriculture 3101 Park Center Dr., Alexandria, VA 22302 Re: Notice of Proposed Rule Making -- Revision of Categorical Eligibility in the Supplemental Nutrition Assistance Program (SNAP) RIN 0584-AE62 Dear Program Design Branch: The undersigned lesbian, gay, bisexual, transgender, and queer (LGBTQ) and allied organizations urge the USDA to withdraw its proposed rule, Revision of Categorical Eligibility in the Supplemental Nutrition Assistance Program (SNAP). If implemented, the proposed rule would harm millions of low-income Americans, with particularly negative implications for the LGBTQ community. Since 1996, over forty jurisdictions have implemented a process known as “broad-based categorical eligibility” (BBCE), for households receiving some in-kind services funded through the Temporary Assistance for Needy Families (TANF) Program. While federal requirements restrict SNAP assistance to households with net incomes under 100% of the federal poverty level (FPL), gross incomes under 130% of the FPL, and in many cases liquid assets below $2,250, the BBCE option gives states flexibility to adjust these thresholds.i Most states have opted to eliminate the asset test and increase the gross income limit (up to 200% of the FPL) for SNAP. In this manner, states can: 1) extend SNAP eligibility to families with gross incomes working their way up the economic ladder but still struggling with high costs for basics, and 2) incentivize families to save by loosening restrictions on assets. Congress has consistently upheld BBCE since its inception, most recently during the 2018 Farm Bill.ii The proposed rule would greatly undercut the scope of BBCE, effectively sidestepping Congress’ bipartisan efforts to maintain the option. -

Ho ABSTRACT This Article interprets the Supreme Court’s 2018 decision, Masterpiece Cakeshop, Ltd. v. Colorado Civil Rights Commission, as a critical extension of Derrick Bell’s interest convergence thesis into the LGBTQ movement. Chiefly, Masterpiece reveals how the Court has been more willing to accommodate gay individuals who appear more assimilated and respectable—such as those who participated in the marriage equality decisions—than LGBTQ individuals who are less “mainstream” and whose exhibited queerness appear threatening to the heteronormative status quo. When assimilated same-sex couples sought marriage in Obergefell v. Hodges, their respectable personas facilitated the alignment between their interests to marry and the Court’s interest in affirming the primacy of marriage. -

In many of the ‘comfortability’ questions central to GLAAD’s Accelerating Acceptance survey, non-LGBT Americans report significantly less discomfort than was reported in 2014. -

On the surface, this may seem a relatively simple question, but my work takes a broad perspective, approaching this single question from a multitude of perspectives. To do so I carried out a combination of experiments, interpreting the results through the Attention Weighted Schema Abstraction model that I developed. Following the introduction Chapter 2 lays out the AWSA model in the context of previous literature on stereotype conception and speech and sexuality. Chapter 3 presents the production experiment, which recorded speakers reading a series of single words and sentences and interviews discussing stereotypes of sexuality. Phonetic analysis showed that though speech did not vary categorically by sexual orientation, familiarity with Queer culture played a significant role in variation of speech rate and mean pitch. This pattern was only seen for straight and bisexual speakers, suggesting that lesbian stereotypes are used to present an affinity with Queer culture, which was further supported by the decrease or loss of their significance in interview speech. -

LGBT History
LGBT History Just like any other marginalized group that has had to fight for acceptance and equal rights, the LGBT community has a history of events that have impacted the community. This is a collection of some of the major happenings in the LGBT community during the 20th century through today. It is broken up into three sections: Pre-Stonewall, Stonewall, and Post-Stonewall. This is because the move toward equality shifted dramatically after the Stonewall Riots. Please note this is not a comprehensive list. Pre-Stonewall 1913 Alfred Redl, head of Austrian Intelligence, committed suicide after being identified as a Russian double agent and a homosexual. His widely-published arrest gave birth to the notion that homosexuals are security risks. 1919 Magnus Hirschfeld founded the Institute for Sexology in Berlin. One of the primary focuses of this institute was civil rights for women and gay people. 1933 On January 30, Adolf Hitler banned the gay press in Germany. In that same year, Magnus Herschfeld’s Institute for Sexology was raided and over 12,000 books, periodicals, works of art and other materials were burned. Many of these items were completely irreplaceable. 1934 Gay people were beginning to be rounded up from German-occupied countries and sent to concentration camps. Just as Jews were made to wear the Star of David on the prison uniforms, gay people were required to wear a pink triangle. WWII Becomes a time of “great awakening” for queer people in the United States. The homosocial environments created by the military and number of women working outside the home provide greater opportunity for people to explore their sexuality. -

From Criminal to Citizen: How The Evolution of Public Opinion Won Gay Marriage In The Courtroom Sabrina Singer Senior Thesis Department of History Barnard College, Columbia University Advisor: Robert McCaughey Singer 1 Prologue A warm tropical breeze brushed my face as I stood in the Miami Beach Botanical Gardens waiting for the mayor to begin. The crowd murmured with excitement, looking around at each other with anticipation as the sun set behind the palm trees. I glanced over at the couple I had met earlier in the evening. They were dressed in matching tuxedos, holding hands, waiting. The drag queen next to me shifted her weight back and forth, impatient. Then, finally, the speeches were over and the ceremonies could begin. The judge had only lifted the stay on gay marriage in the early hours of the morning, yet hundreds of gay couples lined-up to walk down the makeshift aisle to the hastily constructed altar to be married by the mayor. Dressed in suits, biking clothes, jean shorts, and bathing suits, couple after couple affirmed their love and commitment. Same-sex marriage had come to Florida. I had witnessed similar jubilation in front of the U.S. Supreme Court building two summers prior when the Court issued its momentous ruling in United States vs. Windsor, overturning the Defense of Marriage Act that had prevented the federal government from recognizing same-sex marriage. Beholding the relief and joy on the faces of the people swarming the steps of the Supreme Court building, I knew that I had chosen the right issue to believe in.
