(A C LNG) Application for a Licence to Export Liquefied Natural Gas (LNG) and Import Natural Gas pursuant to Section 117 of the National Energy Board Act (Act) Dear Mr. Parsons and Mr. Harper: The National Energy Board (Board) has received the above-noted application dated 26 May 2015, for a licence to export LNG for a term of 25 years at the outlet of the loading arm of the natural gas liquefaction terminal, anticipated to be located in the vicinity of Middle Melford, Nova Scotia. In addition, A C LNG applied for a licence to import natural gas from the United States of America (U.S.) for a term of 25 years from the point at which the Maritimes & Northeast Pipeline crosses the Canada-U.S. border near St. Stephen, New Brunswick, or such other points as may become accessible over the term of the Import Licence. The Board will consider the export application pursuant to section 118 of the Act, which reads: “On an application for a licence to export oil or gas, the Board shall satisfy itself that the quantity of oil or gas to be exported does not exceed the surplus remaining after due allowance has been made for the reasonably foreseeable requirements for use in Canada, having regard to the trends in the discovery of oil or gas in Canada.” Section 118 of the Act specifies what the Board is legally mandated and authorized to consider in a gas export licence application. The Board cannot consider comments that are unrelated to section 118, such as those relating to potential environmental effects of the proposed exportation and any social effects that would be directly related to those environmental effects. For further information, please see the Board’s Interim Memorandum of Guidance Concerning Oil and Gas Export Applications and Gas Import Applications under Part VI of the National Energy Board Act, dated 11 July 2012. …/2 -2- The Board wishes to obtain the views of impacted persons on the merits of the application. The attached “Notice of Application and Comment Period” (Appendix 1) sets out how the Board will obtain those views. The Board directs A C LNG, by 14 October 2015, to: • publish the “Notice of Application and Comment Period” in each of the publications listed in Appendix 2; and • serve a copy of this letter and the “Notice of Application and Comment Period” on the persons listed in Appendix 3 in the official language of their choice. Additionally, A C LNG must file with the Board a complete list of publication dates immediately after all notices have been published. Export and Import Licence Application On 26 May 2015, A C LNG Inc. (A C LNG) applied to the National Energy Board (Board or NEB) pursuant to section 117 of the National Energy Board Act to export liquefied natural gas and to import natural gas. A C LNG applied for a licence to export 15.5 million tonnes of liquefied natural gas per year, a natural gas equivalent of 755.7 billion cubic feet (Bcf) including tolerance, for a term of 25 years from the outlet of the loading arm of the natural gas liquefaction terminal, anticipated to be located in the vicinity of Middle Melford, Nova Scotia. The maximum quantity of liquefied natural gas requested to be exported over the term of the applied-for licence is 329 million tonnes, a natural gas equivalent of 16 038 Bcf, including tolerance. A C LNG applied for a licence to import 839.71 Bcf of natural gas per year for a term of 25 years from the United States of America (U.S.) into Canada from the point at which the Maritimes & Northeast Pipeline crosses the Canada-U.S. border near St. Stephen, New Brunswick, or such other points as may become accessible over the term of the Import Licence. The maximum quantity of natural gas requested to be imported over the term of the applied-for licence is 17 821 Bcf 2. A C LNG’s application is available on the Board’s website at: http://www.neb-one.gc.ca/. A C LNG must deposit and keep on file, for public inspection during normal business hours, copies of the application at its office located at 1959 Upper Water Street, Suite 1301, Halifax, Nova Scotia, and provide a copy of the application to any person that requests it. A copy of the application is also available for viewing during regular business hours, by appointment, in the Board’s library (2nd Floor, 517 Tenth Avenue SW, Calgary, Alberta).
