This petition is coming before me on 02­06­2020 for hearing in the presence of Sri P. Sugunakar Rao, Advocate for the petitioner/accused and the learned Addl. P.P for the State, having heard and stood over for consideration to this day, the Court made the following:

This is a petition filed under Section 438 Cr.P.C for grant of anticipatory bail to the petitioner/accused.

Notice given to the APP. Counter filed.

Heard both sides. Perused the record.

As per complaint dt. 13.03.2020 the petitioner/accused and her deceased husband entered into an agreement with the complainant to purchase a portion in House No.3­1­47, Main road, Jammikunta for consideration of Rs. 84,00,116/­, and they agreed to get registration on or before 01­11­2017 and they also paid Rs. 1,00,000/­ towards advance, they also paid Rs. 10,00,000/­ on 29­06­2017, Rs. 4,00,000/­ on 05­07­2017, Rs. 10,00,000/­ on 08­08­2017 and on the same day Rs. 10,50,000/­ through on line, paid Rs. 18,00,000/­ on 03­10­2017 by way of cheque, Rs. 9,35,000/­ on 12­10­2017, Rs, 15,000/­ on 12­10­2017 thus totally paid Rs. 63,00,116/­ as on 12­10­2017. But the petitioner and her husband failed to register the house and also did not return the amount. Therefore the complainant approached the elders who convened a panchayat on 29­09­2019 on which date the petitioner and her husband executed an agreement on Rs.100/­ non judicial stamp paper agreeing to return the above amount with excess Rs. 7,00,000/­ on or before 29­12­2019 for their failure to register the property. But they failed to return the amount and did not register the property. On 30­12­2019 the husband of petitioner by name Gampa Mahender dead due to ill health. The complainant wait for some time with humanity and he is residing in the ground floor of the house since the date of agreement i.e., 22­06­2017 and running a Kirana shop while the accused is residing in the 1st floor. During road widening process, the out side steps of the house were demolished by the municipal authorities due to which accused is using steps situated inside of the house in the portion of the complainant who never obstructed her. But the petitioner used to irritate the complainant and abused him and his family members in filthy language with an intention to get vacate them from the portion at any cost. While so on 01­03­2020 at 7.30 hours the petitioner quarreled with the wife of complainant by name Archana in his absence and beat her with hands and also threatened them to kill if they did not vacate the house. Basing on the above complaint dt. 13­03­2020, case was registered for offences under section. 420, 406, 323, 506 IPC. The counsel for petitioner has submitted arguments through phone that the entire case facts are civil in nature and the complainant never showed his readiness to pay remaining balance amount as such sec. 420 or 406 IPC are not made out and petitioner is under the apprehension in the hands of the police as such she seeks anticipatory bail. On the other hand, the learned P.P. argued that there is possibility of mortgaging the same property to another influencing the witnesses and tamper the evidence. As Seen from the record, the charges leveled against the petitioner are 420, 406, 323, 506 IPC. The Petitioner and her husband received almost Rs. 63,00,000/­ from the complaint but failed to register the property nor return the amount inspite of agreement dt. 29­09­2019. There are specific serious and grave allegations against petitioner/accused. The investigation in this case is in progress and some more witnesses to be examined. If at this stage, the petitioner/accused is granted anticipatory bail, she may abscond and there is every likely hood of destroying the evidence and may threaten the complainant and his family members who are residing in the same house. Considering the nature of offences and in view of the facts and circumstances of the case, and in view of the submissions made by learned APP, I find that it is not a fit case to grant anticipatory bail to the petitioner/accused.

In the result, the petition is dismissed.
