Respondent/Complainant This petition is coming on this day for final hearing before this Court in the presence of learned Advocate Mr. C. Subramanian,B.A.,B.L., Advocate for the petitioner / Accused learned Assistant Public Prosecutor, represented for State, upon perusing the petition submitted, having stood over for consideration till this Court, this Court delivers the following : ORDER The Bail application is filed u/s 437 of Cr.P.C to enlarge the accused on bail. 2. Petition is filed u/s 437 of Cr.P.C to enlarge the accused on bail. Respondent side gived reply and opposed bail application. 3. Records are perused. Heard both sides. Petitioner/Accused is charged for an offence punishable u/s 147,148,294(b),323,324,506(2) of IPC and he is in Judicial Custody from 25.10.2020 for past 11 days. On perusal of reply would reveal that complainant was discharged from hospital and he is not hopitalised at present. 4. On considering facts and circumstance of the case and Judicial custody of accused for past 11 days, petitioner is enlarged on bail subject to following conditions that: (i) Petitioner shall execute bond for Rs.10,000/- each with two sureties. (ii) Petitioners shall sign before Saibaba Colony police station, concern at 10.00 am daily for 30 days. Respondent/ Complainant ORDER Bail Application Filed U/s. 437 OF Cr.P.C on behalf of the petitioner by Advocate Thiru Shanthi and this application has been received through E-mail. Police submitted reply on 04.11.2020. After considering bail application, FIR and submission of counsel through email this court passed the following order. 2. From the materials available submitted through email it is seen that Accused is charged for the offences under Sections 381 IPC and he was arrested by the respondent/police and he was remanded to judicial custody on 03.01.2020. 3. The counsel for the petitioners submitted that the petitioner/Accused is on innocent and she has not committed any offence as alleged in the FIR. The Petitioner/Accused permanent residence of Coimbatore city in ondipudur. The petitioner/accused is will not tampering the prosecution witness and will not abscond the accused. If he released on bail. The petitioner/accused is ready to abide by any condition which imposed by this honourable court on him. The petitioner/accused is ready to produce the sureties to the satisfaction of this honourable judicial magistrate No.I of coimbatore. The petitioner/accused was an judicial custody for the past 10 months. Lodged in the central prison at Coimbatore. The petitioner/accused has not filed any type of bail application honourable high court of chennai. Thus he prayed for release on bail. 4. Notice was sent through email to police. In the reply submitted by police on 4th November, police and prosecution has raised strong objection in releasing the accused on bail stating that the prosecution submitted that if the petitioner is released on bail he will tamper the witnesses and hamper the investigation, he may continue to the same kind of offence, Investigation is still pending. Hence, the prosecution strongly oppose to allow this petition and may be dismissed. 5. Material submitted through email were perused. Considering the facts and circumstances of this case, Nature of the offence, objection and stage of the investigation, this court does not incline to grant bail to the petitioner. Hence, this petition is dismissed. The counsel for the petitioners submitted that the petitioner/Accused has not committed the alleged offence, and he is not guilty and he is an innocent person. Actually the defacto complainant is non other than the petitioners wife brother, due to the family problem the defacto complainant fiosted a false case against the petitioner. The petitioner is having permanent residence in the above address and he will not abscond or tamper with any of the witnesses in the event of bail. The petitioner is ready to co-operate with the investigation agency and he will appear before the investigation officer as an when he was summoned for the investigation. The petitioner is ready to furnish sufficient sureties to the satisfaction of the court and will abide any condition imposed on him. The petitioner submits that there is no bail petition is presently pending before the Hon'ble high court of Judicature, Madras in the above case. Thus he prayed for release on bail. 4. Notice was sent through email to police. In the reply submitted by police on 4th November, police and prosecution has raised strong objection in releasing the accused on bail stating that the prosecution submitted that if the petitioner is released on bail he will tamper the witnesses and hamper the investigation, he may continue to the same kind of offence, Investigation is still pending. Hence, the prosecution strongly oppose to allow this petition and may be dismissed. 5. Considering all the facts, nature of the offence and period of incarceration this court inclined to grant bail. Accordingly this petition is allowed subject to the following condition. The petitioner shall execute a bond for Rs.10000/- along with two sureties each to the like sum amount the petitioner shall appear before the respondent PS, daily at 10.00 a.m. until further orders.
