Nair Editor, The Free Press Journal and Former Sheriff of Bombay I venture to share with thousands of readers of the Journal some unique experiences my esteemed friend and I, Sri. S. Ramakrishnan, Editor of the Bhavan’s Journal, Bombay, had at Madras in October last. Some time back Sri Ramakrishnan received a letter from Sri-La-Sri Pandrimalai Swamighal stating that he had been directed in a dream by Lord Sri Guruvayurappan to show him and his family a vision of Mother Goddess Parashakthi and that he should meet Swamiji on Friday, October 9, 1970, at Madras. divine exPeriences As at that time Kulapati Munshiji was in Sri Harkisondas Hospital, Bombay, undergoing treatment for acute bronchial pneumonia, Sri Ramakrishnan implored Swamiji to excuse him and give him another opportunity. INTRODUCTION That religion is a money-spinner is a truism repeated frequently enough. But the commercializing potential of intellectual property rights in religion appears to have been discovered only recently in India. This throws up some fascinating conundrums for anyone observing the Indian IP system, which in any case is grappling with preserving the old and broaching the new. This tussle has had no better advertisement in the recent past than in the grant of a geographical indication (henceforth, “GI”) to the Tirupati Laddu. This note tries to enquire into some of the controversial issues raised in the aftermath of the grant, in light of the policy objectives of the law governing geographical indications in India, as well as recent decisions of the administrative authorities. The note concludes with a speculative discussion on the rationale for applying for a GI on the Laddu, and whether those objectives have been met. II. THE BACK-STORY: FROM LADDU TO GI A GI is a name or sign attached to goods that signifies the geographical location of origin or manufacture of the goods. The GI may also by extension indicate an inherent quality, reputation or other characteristic associated with the goods. India has embraced GI’s as part of its system of protecting intellectual property rights with enthusiasm by designing a statute, i.e., the Geographical Indications of Goods (Registration and Protection) Act, 1999 [henceforth, “the Act”], to favour agricultural, natural and manufactured goods, including handicraft products and foodstuffs.

Meghna Banerjee & Susanah Nausahd* Geographical Indications (GI) are signs which identify goods as originating in a specific geographic location. Being a collective right, it seeks to protect the economic interests of an entire community of producers from a particular region who specialize in the making or manufacturing of a native product. Although many products of Indian origin such as Basmati are not adequately protected under TRIPS, at the domestic level India ensures that GI protection is uniformly available to all types of products. While such protection has the potential to bring about economic prosperity of marginalized sections of society, the conferment of GI status to products like Tirupati Laddu have raised concerns regarding the standards followed by the authorities while registering a GI. Critics point out that the grant of GI tag to the Laddu dilutes the very essence of GI protection and facilitates the commercialization of faith symbols by a religious shrine. This paper examines the controversial issues surrounding the conferment of GI designation to Tirupati Laddu. I. INTRODUCTION Geographical indications (GIs) are a class of intellectual property which is used primarily to identify products as originating from a particular geographical area.     FSSAI IN NEWS Dated: 20.09.2017 (Wednesday) E-Paper Finally, Tirupati Laddu gets FSSAI clearance, TTD gets food safety licence The Tirumala Tirupati Devasthanam (TTD), the governing body of the Sri Venkateswara temple atop Tirumala, has at last obtained a license from the Food Safety and Standards Authority of India (FSSAI). According to reports, the FSSAI license has been obtained for its famous laddu prasadam, and the food that it distributes under the Annaprasadam scheme. The FSSAI had also asked the Central Licensing Authority in Chennai to inspect the 'pottu' used in preparing the temple's famous laddus. This order came after an RTI application by a Bengaluru-based RTI activist in December last year. This would mean that the TTD will now follow regulations of the Food Safety Standards Act. FSSAI IN NEWS In his compliant, the RTI activist reportedly wrote, “The cooks who are in preparation of these laddus in large quantity are found wearing no proper dress. They are working in half naked dress and found sweating due to heavy heat at the kitchen. These cooks are not wearing any hand glove, apron and other safety norms.” The laddu is a major source of the TTD's revenue and adds several crore rupees to its annual budget. It is made with flour, sugar, ghee, oil, cardamom and dry fruits.

    Journal of Intellectual Property Rights Vol 17, January 2012, pp 55-63 Intellectual Property Rights and the Handloom Sector: Challenges in Implementation of Geographical Indications Act Soumya Vinayan† Council for Social Development, Southern Regional Centre, Hyderabad 500 030, India Received 19 July 2011, revised 15 September 2011 Actors at the local, national and global level, through their policies, institutional structure and processes, influence livelihood decisions irrespective of geographical setting. The introduction of intellectual property rights (IPR) under the WTO regime demonstrates how decisions taken at an international level affect millions of livelihoods across the globe. This has necessitated national governments to introduce new laws and legislation such as the enactment of Geographical Indications Act of India in 1999. The inclusion of Geographical Indications (GIs) under the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement of WTO has been acclaimed by developing countries for its potential to boost rural development, create wealth and protect traditional knowledge. The premium consumers are willing to pay for the GI registered product is inextricably linked to the quality of the product. This calls for a thorough re-organization of the supply chain to adhere to not only quality but also to ensure that the revenue arising out of GI is distributed equally along the supply chain. This necessitates strengthening of linkages between stakeholders at all levels to foster trust and facilitate access to market. In this context, the paper examines the key challenges involved in the implementation of GIs, a key component of IPR, in the traditional livelihood sector such as handloom weaving in India, drawing on the success stories of GIs from around the world.
