Casey Duncan* INTRODUCTION In 1998 U.S. Major League Baseball (MLB) entered into an agreement with Japan's Nippon Professional Baseball (NPB) league governing the transaction of non-free agent players be- tween the two leagues. This United States-Japanese Player Contract Agreement, also known as "The Posting System Agreement" (Posting System) is designed to regulate such inter- national player transactions and to protect the interests of both leagues. While the Posting System has had some initial success, recent developments make its long-term success as a solution suspect. It is the purpose of this note to examine critically the Posting System in light of these developments, and to suggest possible changes to better effectuate its goals and protect the in- terests of both leagues and their players.

Broshuis* Abstract Collective bargaining has significantly altered the landscape of labor relations in organized baseball. While its impact on the life of the major league player has garnered much discussion, its impact on the majority of professional baseball players—those toiling in the minor leagues—has re- ceived scant attention. Yet an examination of every collective bargaining agreement between players and owners since the original 1968 Basic Agree- ment reveals that collective bargaining has greatly impacted minor league players, even though the Major League Baseball Players Association does not represent them. While a few of the effects of collective bargaining on the minor league player have been positive, the last two agreements have estab- lished a dangerous trend in which the Players Association consciously con- cedes an issue with negative implications for minor leaguers in order to receive something positive for major leaguers. DANA BRAND (1954-2011) rofessor Dana Brand, former chair of the Hofstra University Department of English and a lifelong Mets fan, was a scholar and critic of American literature and late P19th- and early 20th-century culture. He joined the Hofstra faculty in 1989, and throughout his career at Hofstra, he produced not only academic books and articles on topics in literature, philosophy, and film, but also personal essays. Some of these essays became the basis for his book Mets Fan, which was released in 2007. His second book about baseball fandom, The Last Days of Shea, was published in 2009, and his efforts in the blogosphere earned him the nickname “The Proust of Mets Bloggers” in The New York Times. From Professor Brand’s essay “Baseball and the Life of the Mind” (relating a conversation he had while a graduate student at Yale with Bart Giamatti, J. Hillis Miller, and Jacques Derrida): “We were just, for that moment, some people talking about things we loved deeply. We knew that we didn’t understand our love of sports any more than anyone else. But we were happy to stand out in the cold and share the fact that we loved it.” And we loved him. Weisberg For Larry Lucchino, watching his Red Sox play a ballgame in Fenway Park is like a full day—work, recreation, socializing, meals—compressed into three hours and punctuated by the crack of the bat and the passions of the fans. His luxury box, hanging thirty feet above the field, is a mix of board room, living room, and dining room—all with a view of the action. On September 17, the Sox are playing the Cleveland Indians in a night game. Lucchino confers with the principle owner of the team, John Henry, and the team’s chairman, Thomas Werner, at the table, and they all keep track of the game by glancing at the version projected on the TV—or by glancing out the window. Then Lucchino gets up and walks to the balcony, which suspends three rows of seats out almost directly over the grass, just on the third base side of home plate. If there’s a best seat in the house, it’s in this patch of real estate. But Lucchino kneels in the aisle to chat with his wife, keeping one eye on the game. At the moment, the Red Sox have men on first and second. Benny Agbayani pulls a line drive just fair over third base. “Yes!
