(as amendedi, I hereby convey to the House of Representatives, my decision, on Tth June',2018 to decline to assent to the following five (5) Bills:

(a) The CFRN, 1999 (Fourth Alteration, No.8) Bill, 2017 - as Section 7 of this Bill may need to be redrafted to clearly indicate that it is Section 109 (I) (e) of the 1999 Constitution that is being amended. Also, there are existing laws that cater for legislative Service Commissions. Filially, prescribing a specific dare in the 1999 Constitution for an annual State of the Nation Address nut» create practical challenges in diarizing this event;

(b) The CFRN, 1999 (Fourth Alteration. No.IS) Bill, 2017 - as Section 5 (a) of this Bill should also amend the marginal note to Section 214 of the 1999 Constitution;

(c) The CFRN, 1999 (Fourth Alteration No. 22) Bill, 2017 - as some of thefunctions proposed to be undertaken by the Nigeria Security and Civil Defence Corps are currently the responsibility of other agencies ofgovernment, Furthermore. imbedding these functions in the 1999 Constitution may impair future efforts to change the role of the Corps to meet new and emerging challenges;

(d) The CFRN, 1999 (Fourth Alteration, No. 24) Bill, 2017 - as this Bill appears not to take full cognisance of the provisions of Section 9 (3) of the 1999 Constitution; and

(e) The CFRN, 1999 (Fourth Alteration, No. 28) Bill, 2017 - Section 2 (b) and Section 3 (b) of this Bill appear not to lake full cogisance of the provisions of Section 58 (4) of the 1999 Constitution.

7. Matter of Urgent Public Importance (Standing Order Eight, Rule 4) Call to Constitute the North East Development Commission (NED(): I Ion. Abdussamad Dasuki (Kebbe/Tall/buwal Federal Constituency) introduced the matter and prayed the Ilouse to:

Call to Constitute the North East Development Commission (NEDC):

The House:

Notes that the North East region has been ravaged by violent insurgency for almost a decade now;

Also notes that the insurgency by extremist Boko IIararn terrorists has devastated mostly Borno, Yobe and Adamawa States in the period;

Further notes that it is estimated that no fewer than 100,000 people lost their lives, with over 3 million displaced as refugees in neighbouring countries of Niger, Chad and Cameroon as Internally Displaced Persons (IDPs) in various camps across the country;

Concerned that over $20 billion dollars worth of properties have been destroyed;

Also concerned that most public institutions such as schools, hospitals, markets, prisons, police formation, military barracks and other security establishments had been totally razed down;

Further concerned that in recognition of the enormous challenges confronting the country especially the North East, the House of Representatives set in motion measures aimed at addressing these challenges early in the life of this Assembly when the Rt. Hon. Speaker, Yakubu Dogara, personally, and along with 300 other members sponsored the motion on the urgent need for the rehabilitation, reconstruction, resettlement and recovery of the North East region;

Recalls that the Speaker has also been visiting different lDP camps across the country, donating relief materials and even paid examination fees for scores of IDP children;

Also recalls that the Speaker personally sponsored the North East Development Commission establishmenf'Bill, 2015; 481 No. 10 Tuesday, 24 .July, 2018

Further recalls that the Bill was passed by both the Senate and House of Representatives on January 13, 2017. However, the Executive expressed reservations with some aspects of the Bill as a result of which it was returned to the National Assembly for further legislative input;

Aware that the Bill was further considered and all areas of concern to the Executive were adequately taken care of consequent upon which it was retransmitted back to the President in September 2017 for his assent;

Also aware that the President assented to the Bill on October 25, 2017. This finally birthed the long-awaited and highly anticipated Commission that will kick-start and pioneer the onerous task of rebuilding and rehabilitating the violence ravaged region;

Further aware that one month after the Bill was assented to, His Excellency, President Muhammadu Buhari, GCFR, presented the 2018 Appropriations Bill before the Joint Session of the National Assembly and budgeted the sum of f'it45 billion for the North East Intervention Fund;

Disturbed that the National Assembly having worked on the budget and the President signed the Appropriations Bill into law on June 20,2018 and nine months after signing into law the NEDC Act, and one month after signing the 2018 budget into law, the President is yet to constitute the Commission;

Worried that the delay in setting up the NEDC is coming at a time the scale of humanitarian crisis in the North East is increasing exponentially following renewed attacks by the insurgents; there is therefore the urgent need to set up the commission so as to kick-start the work of rebuilding the region in earnest;

Resolves to: " Urge the President of the Federal Republic of Nigeria, to as a matter of urgency , constitute the North East Development Commission (NEDC) without further delay (Hon. Abdussamad Dasuki - Kebbe/Tambuwa! Federal Constituency).

13. Need to Develop the Olumirin Waterfall in Erin-Ijesha, Oriade Local Government Area, Osun State into a World Class Tpurist Destination and a Hydro Power Generation Site Motion made and Question proposed:

The House:

Notes that some of the numerous tourist attractions in Nigeria are the Water-falls across the various Geopolitical Zones of the Country;

Also notes that one of the most amazing and breathtaking waterfall in Nigeria IS the Olumirin Waterfall, located in Erin-Ijesha, Oriade Local Government Area, Osun State;

Funher notes that according to Yoruba history, Akinla, a granddaughter of Oduduwa who founded Erin-Ijesha town, discovered the waterfall in 114 A.D; -, Aware that the water flows from the top of the mountain and have seven falls, each providing a different perspective and forms a large pool of water ofl the ground, surrounded by vegetation;

Also aware that due to its breathtaking nature, Olumirin Waterfall attracts over 50,000 visitors annually, especially during the celebration of the Osun Osogbo festival and has the potential of attracting 1,000,000 local and foreign tourists annually;

Cognizant that the water current from the Olumirin Waterfall, if harnessed, is capable of generating 1500 megawatts of electricity for the National Grid for the benefit of Nigerians;

Observes that this magnificent and highly profitable Waterfall has not been properly harnessed and developed into a befitting world class tourist site;

Aware that the water flows from the top of the mountain and have seven falls, each providing a different perspective and forms a large pool of water on the ground, surrounded by vegetation;

Also aware that due to its breathtaking nature, Olumirin Waterfall attracts over 50,000 visitors annually, especially during the celebration of the Osun Osogbo festival and has the potential of attracting 1,000,000 local and foreign tourists annually;

Cognizant that the water current from the Olumirin Waterfall, if harnessed, is capable of generating 1500 megawatts of electricity for the National Grid for the benefit of Nigerians;

Observed that this magnificent and highly profitable Waterfall has not been properly harnessed and developed into a befitting world class tourist site;

Concerned that rather than abating, these challenges are expanding and spreading to more States across the nation;

Also concerned that the consequence of the continuous cont1icts is the acquisition of, and crude manufacture of arms by Communities which feel threatened,

Disturbed that the void being created in the rural areas or expanding "ungoverned spaces" may be taken over by bandits, terrorists and rogue elements;

Also disturbed that the "ungoverned spaces" like the notorious Samhisa forest usually provide room for training, planning and execution of violence by Non-State Actors;

Cognizant that the consequence of unplanned urbanisation include pressure on infrastructures and increased violent crimes;

Worried that currently IDP camps around the country are developing into unregulated and unplanned permanent settlements;

A BILL FOR AN ACT TO PROVIDE FOR THE SMOOTH AND ORDERLY TRANSFER OF POWER FROM ONE GOVERNMENT TO ANOTHER AND OTHER RELATED MATTERS THERETO (I-IBs 102 & 1(9)

Clause 1: General Purpose of the Bill. (1) When at any general election for the Office of the President of the Federal Republic of Nigeria, the incumbent President is not re-elected, the President shall within 2 weeks of the declaration of the President elect as the winner of'the election provide space for not more than 10 persons designated by the President elect to begin a review and analysis of budgeted expenditures during the tenor of the current President, review all other necessary documents as may be requested by the President-elect's transition team and to acquire a working knowledge of the various offices, departments, commissions, boards and other agencies of the executive arm of the Federal Government with a view to promote the orderly transition of the executive power in connection with the expiration of the term of office of a President and the inauguration of a new President.

(2) The President shall also constitute his transition team who must cooperate with the President elect and the staff he so designated and provide any assistance that may be reasonably requested.

(3) The provisions of this section shall apply at all times after each general elections whether or not the power change is within the sallie party or from one party to another.

(4) For the purpose of this Bill, the President shall include the vice President and the President-elect shall include the vice President-elect (Hall. Femi Gbajabiamila - House Leader).

Clause 2: (I) The President shall provide for the President-elect in connection with the preparation for his assumption of office as the President of the Federal Republic of Nigeria the following facilities:

(a) Office space well-furnished and equipped with all relevant machines and electronics within the Presidential Villa to enhance smooth working relationship with the President's team; such equipment shall include but not limited to computers/laptops, printers, binding machines, papers, communication services to aid the transition team in achieving the objectives of this Bill.

(b) Payment of allowances for members of the President-elect's team at such rate as may be determined by the Revenue Mobilsation Allocation and Fiscal Commission to cater for the team, and such rate must not exceed what is obtainable in the civil service.

PROVIDED that any employee of any agency or department of government may be drafted to be part of the transition team of either of the President or President-elect and he shall continue to be entitled to such compensation provided by law for his regular employment and shall be entitled to the rights and privileges, associated with his regular employment without any interruption.

AND PROVIDED that in appointing the Transition Team, the President-elect shall consider key areas requiring professional/expert input to the extent that extra funds shall not be provided by the state to hire the services of Professionals outside the Transition team.

(b) ensure that all assets and properties of government are maintained and are in good condition.

(f) immediately after the new President is sworn in initiate/commence the prosecution of any person who breaches any provision of this Bill.

F17, LAWS OF THE FEDERATION OF NIGERIA. 2004), TO REVIEW THE RETIREMENT AGE OF STAFF OF FEDERAL POLYTECHNICS, HARMONIZE THE TENURE OF THE OFFICE OF THE RECTOR AND OTHER PRINCIPAL OFFICERS OF THE FEDERAL POLYTECHNICS IN NIGERIA AND FOR OTHER RELATED MATTERS (liB. 1488)

Clause 1: Amendment of the Federal Polytechnics Act, Cap. F17, Laws of the Federation of Nigeria, 2014. The Federal Polytechnics Act, Cap. F 17, Laws of the Federation of Nigeria, 2004 (in this Bill referred to as "the Principal Act") is amended as set out in this Bill (Hon. Femi Gbajabiantila - House Leader).

Clause 3: Amendment of section 3. Section 3 of the Principal Act is amended by substituting for the existing section a new section 3 as follows:

"3. (1) There shall be established for each polytechnic a Governing Council (hereafter in this Bill referred to as "the Council ") which shall be a body corporate with perpetual succession and a common seal and may sue and be sued in its corporate name.

(2) The Council shall consist of a Chairman and the following other members:

(a) four persons representing a variety of interests and broadly representative of the whole federation, at least one of whom shall be a woman;

(b) one person to representing the alumni association;

(c) a representative of the community where the polytechnic is situated:

(d) the Rector;

(e) the Deputy Rector(s);

(j) one person representing the Federal Ministry of Education or regulatory agency;

(g) two persons not below the rank of Chief Lecturer elected by the Academic Board from among its members;

(h) three persons not below the rank of Senior Lecturer or its equivalent elected by the Congregation from among its members in which one shall be non-teaching staff.

(3) (i) The Chairman and members of the Council other than ex-officio members shall be appointed by the President and Commander-in-Chief of the Armed Forces. 524 Tuesday, 24 July, 2018 No. 10

(ii) Persons to be appointed to the Council shall be persons of proven integrity, knowledgeable and acquainted with the working and tradition of the Technical and Vocational education.

(4) Any member of the Council other than an ex-officio member shall hold office for a period of three years at the first instance and may be eligible for re-appointment for another period of three years and no more.

(5) The governance structure of each polytechnic shall be composed of:

(a) Governing Council;

(b) Academic Board;

(c) Management Committee;

(d) School Board; and

(e) Departmental Board.

(6) The provisions set out in the Second Schedule to this Bill, shall apply in relation to the Council, governance structure and other matters therein specified" (Han. Femi Gbajabiamila - House Leader).

"8. (1) There shall be a Rector of each polytechnic (lithe Rector") who shall be appointed by the President, Commander-in-Chief of the Armed Forces in accordance with the provision of this section. (2) Where a vacancy occurs in the post of the Rector, the Council shall:

(a) advertise the vacancy not later than six (6) months to the expiration of the term of [he seating Rector in not less than two national newspapers in Nigeria, specifying:

(i) the qualifications of the persons who may apply for the post, which shall be a Chief Lecturer in the Polytechnics sector with at least five. years of experience on that position among 'other criteria; and

(ii) the terms and conditions of service applicable to the post, and thereafter, draw up a short list of suitable candidates for consideration.

(b) constitute a Search Team consisting of:

(i) a member of the Council, not being a member of the Academic Board, as Chairman;

(ii) two members of the Academic Board, not below the rank of Chief Lecturer;

(iii) two members of Academic Staff not below the rank of Chief Lecturers to be elected from among its members.

(3) A Joint Council, Academic Board and Congregation Selection Board consisting of:

(a) the Chairman of the Council;

(b) two members of the Council not being members of the Academic Board;

(c) two members of the Academic Board not below the rank of Chief Lecturer, who were not members of the Search Team elected among its members; and

(d) two members of the Congregation not below the rank of Chief Lecturer who were not members of the Search Team elected among its members, shall consider the candidates on the short list drawn up under subsection (2) of this section through an examination of their curriculum vitae and interaction with them and recommend in order of performance ranking through the Council, to the President and Commander-in-Chief of the Armed Forces, three candidates for his consideration.

(4) The President shall appoint, as Rector, one of the candidates recommended to him under the provisions of subsection (3) of this section. 526 Tuesday, 24 July, 2018 No. 10

(5) Subject to this Bill and the general control of the Council, the Rector shall be the Chief Executive of the Polytechnic and shall be charged with general responsibility for matters relating to the day-to-day management operations of the polytechnic.

(6) The Rector shall:

(a) hold office for a single term of five years beginning with the effective date of his appointment and on such terms and conditions as may be specified in his letter of appointment:

(i) where a Rector was appointed on four-year tenure on the commencement of this Bill, his tenure shall be extended for a period of one year to complete the single-tenure of five years in line with subsection (6) (a) above;

(ii) where a Rector is serving second tenure of four years on the commencement of this Bill, he shall be deemed to have been serving his final term of office.

(b) have power to exercise general authority over staff and be responsible for discipline in the polytechnic; and

(1) Substituting for the existing subsections (1)-(3) new subsections (1)-(4) as follows:

"( I) There shall be for each polytechnic such number of Deputy Rectors as the Council may, from time to time, deem necessary for the proper administration of the Polytechnic.

(2) Where a vacancy occurs in the post of Deputy Rector, the Rector shall forward to the Academic Board a list of two candidates for each post of Deputy Rector that is vacant.

(3) The Academic Board shall elect for each vacant post one candidate from each list forwarded to it under subsection (2) of this section and forward his name to the Council for confirmation.

(4) Where-

(a) the Academic Board rejects the two candidates forwarded to it by the Rector under subsection (2) of this section. the Rector shall submit another list; No. 10 Tuesday, 24 .July, 2018 527

(b) the Council rejects the name sent to it under subsection (3) of this section, the Academic Board shall send the name of the other candidate on the list forwarded to it by the Rector under subsection (2) of this section. " '

(c) the polytechnic Librarian, who shall all be appointed by the Council on the recommendation of the Selection Board constituted under section 12 of this Bill.

"' (2) The Bursar shall be the Chief Financial Officer of the polytechnic and be responsible to the Rector for the day-to-day administration and control of the financial affairs of the polytechnic.

(3) The polytechnic Librarian shall be responsible to the Rector for the administration of the polytechnic library and the co-ordination of the library services in the teaching units of the polytechnic.

(4) The Bursar or Librarian -

(a) shall hold office for a single tenure of five years beginning from the effective date of his appointment and on such terms and conditions as may be specified in his letter of appointment;

(b) where a Bursar or Librarian has held office for five years or less on the commencement of this Bill, he shall be deemed to have served his final term of office" (11011. Femi Gbajabiamila - House Leader).

(ii) one member of the Council;

(iii) Dean of Students Affairs;

(iv) two members of the academic staff not below the rank of Senior Lecturer; and

(v) two representatives of the Students Union of the Polytechnic; and a committee on students -affairs shall be charged with the duty of:

(i) considering any matter which relates to the welfare of students;

(ii) any other matter referred to it by either the Councilor management of the polytechnic;

(iii) any matter which the students wish to refer to the Council shall be referred to the management in the first instance which may in turn refer the mattet to the Committee on Students' Affairs,

(3) No decision of a committee of the council shall have effect unless it is confirmed by the Council."

"4. (I) The Council shall meet for the conduct of business once in a quarter except for emergency. "

(d) The Second Schedule to the Principal Act is further amended by inserting new paragraph 9 and 10 as follows :

"9. Composition and Functions of Management Committee, School and Departmental Boards. (a) (i) There shall be a Management Committee made up of all the Principal Officers of the Polytechnic, all Deans and Directors in the Polytechnic;

(ii) the Rector shall be the Chairman of the Management Committee; and

(iii) the Management Committee shall meet at least once in a month to discuss and take decisions on matters of general interest to the Polytechnic.

(b) (i) There shall be a School Board for each school in the Polytechnic made up of all the Academic Staff in that School;

(ii) the School Board deals with academic matters and any other matter of interest to the School or any matter assigned to it by the Council, the Rector or the Academic Board;

(iii) the Dean shall be the chairman of the Sc~ool Board; and

(iv) the Dean shall be elected from among the Academic Staff not below the rank of Chief Lecturer in that School for a tenure of three years not renewable immediately.

(c) (i) There shall be a Departmental Board for each Department in the Polytechnic made up of all the Academic Staff in that department;

(ii) the Departmental Board shall deal with academic matters and any other matter of interest to the Department;

(iv) the Head of Department shall be elected from among the Academic staff not below the rank of Senior Lecturer in that department for a tenure of three years and not immediately renewable.

(d) Where there is no qualified candidate for the position of Dean or Head of Department, the Rector shall appoint an Acting Dean not below the rank of Senior Lecturer or Acting Ilead of Department not below the rank of Lecturer Ifor a period of one year in the first instance and renewable once only.

(e) Nothing in this Bill shall prevent the management Committee and Boards from making supplementary rules to guide their proceedings provided such rules are not inconsistent with the provisions of this Bill.

10. Establishment of the Congregation. There shall be for the polytechnic, a Congregation made of both Academic and Senior Non-Teaching staff, who hold at least a first degree or its equivalent:

(a) the Rector shall be the Chairman of the Congregation; and

Clause 1: Amendment of Section 9. Section 9 of the Principal Act is amended by inserting after subsection (1) a new subsection "(I A) -

The Commission shall keep the Register of Voters as the National Register of Voters in its National Headquarters and other locations as the Commission may determine; Provided that the Commission shall keep the Register of Voters in -

(a) electronic format in its central database, and (b) manual, printed, paper-based record or hard copy format"; and

(b) substituting for subsection (5), a new subsection "(5)" -

"(5) The registration of voters, updating and revision of the register of voters under this section shall stop not later than 30 days before any election covered by this Bill".

(3) Polling Agents who arc in attendance at a polling unit are entitled, before the commencement of the election, to inspect electoral materials, including ballot papers result sheets, account and verification documents, and other electoral forms to be used by the Officials of the Commission and this process may be recorded in writing, on video or by other means by Polling Agent, accredited observer or official of the Commission.

(4) Where it is determined that there has been substantial noncompl iance with this provision in respect of the polling, the elections at that polling unit shall be invalidated.

(4) Unless a political party disapproves of its identity under subsection (3), it shall not complain of unlawful exclusion from the election under this Bill in relation to its identity appearing on electoral materials used for the election.

(2) Where the Appellate Court determines that the candidate was not validly nominated, the elected candidate shall, notwithstanding the contrary decision of the Court, remain in office within the period for which an appeal may be filed and shall not be sanctioned for the benefits he derived while in office pursuant to this section; provided that where the Appellate Court in this instance is the Supreme Court, the candidate shall cease to hold that office tHon. (a) number of accredited voters slated on the collated results are correct, and consistent with the number of accredited voters recorded, and transmitted directly from polling units under section 49 (2) of this Bill; and

(b) the votes stated on the collated results are correct and consistent with the votes or results recorded and transmitted directly from polling units under section 63 (4jofthis Bill.

(5) Subject to subsection (1), a Collation Officer or Returning Officer shall use the number of accredited voters recorded and transmitted directly from polling units under section 49 (2) of this Bill and the votes or results recorded and transmitted directly from polling units under section 63 (4) of this Bill to collate and announce the result of an election if a collated result at his or a lower.

(9) A Returning Officer or Collation Officer, as the case may be, who intentionally contravenes a provision of this section that applies to him commits an offence if the results he collated or ;nnounced are false and he shall be liable, on conviction, to not less than fi;e years' imprisonment or to "a fine of not less than NIO,OOO,OOO" (Hon> Aishatu fibril Dukku - Dukku/Nafada Federal Constituency). •.
