Confirmation of minutes of 200th meeting of Executive Committee held on 24.09.2014 at New Delhi. It was noted that 200th meeting of Executive Committee was held on 24.09.2014 at New Delhi. The minutes of the same were sent to all the members of the Executive Committee on 27.09.2014 by email followed by speed post with the request to suggest addition/deletion if any in respect of correctness of the minutes. However, the same will also be placed before the Committee at the time of consideration of the same. Executive Committee confirmed the minutes. Agenda Item No.2. Action Taken Report of 199th meeting of EC held on 09.09.2014 at New Delhi. It was noted that the meeting of 199th Executive Committee was held on 09.09.2014 at New Delhi. Executive Committee noted the same. 201st EC Minutes | 1 Agenda Item No.3. Notice received from the Office of the Deputy Labour Commissioner (West), Labour Deptt., Govt. of Delhi, issued to CCIM for non-implementing the award passed by Labour Court, in ID No. 87/1984 dated 01.10.2013. It was noted that a Notice was received to office of CCIM vide Notice No. F.4 (24)/IMP/ALC/WD/14/4885 from the office of the Deputy Labour Commissioner (West), Labour Deptt., Govt. of Delhi at Karampura, F- Block, New Delhi, to attend the hearing on 24.09.2014 (Wednesday) at 11.00 AM. The Legal Consultant (Zahid) and Dr. PR Sharma, Secretary, CCIM have attended the said hearing in the office of Deputy Labour Commissioner with the approval of President, CCIM. The copy of Execution Petition filed in the Court of Deputy Labour Court by Awardee Satpal Khatri who was working at the post of Peon-cum-chowkidar in the office of CCIM was given to CCIM representatives. In this regard, it was noted that the council terminated Satpal Khatri (peon on adhoc basis in the CCIM) on 02.03.1982, due to his inefficiency and non-satisfactory work. Thereafter he filed a Petition in Labour Court vide ID No. 109/87 in year 1984. Labour Court in year 2001 awarded an award in his favour and directed CCIM to re-instate him with full back wages w.e.f. date of termination of services upto the date of award. Further the Council had filed a Writ Petition in Hon‟ble High Court of Delhi, W.P.( C) No- 3374/2001. Hon‟ble High Court stayed the operation of the award in its interim order passed in the favour of CCIM. The writ petition was under the pendency of Hon‟ble High Court till year 2013. On dated 01.10.2013 the Hon‟ble Court dismissed the petition of Council due to the continuous non-appearance of counsel in the said matter. Now, the Awardee, Satpal Khatri has filed an execution petition in which he sought a claim of compensation from the date of termination i.e. 02-03-1982 upto date of award with 24% interest per annum on the amount due and payable by the Council to the Awardee. He also sought all benefits associated with and incidental to the service including promotions and increase in salary from time to time with full back wages and continuity of service. It is suggested by the Legal Consultant (Zahid Rayeen) who attended the hearing, that the claim of award to Sh. Satpal Khatri must be decided by the Council within stipulated time limit granted to the Council i.e. 27.10.2014. Further, an application of restoration of Writ Petition must be moved through Legal Axis so that a relief to cease the operation of said award can be obtain in favour of Council. The process to move the application to restore the W.P. has been initiated with the approval of President, CCIM. Now the next date of hearing is fixed for 27.10.2014. Executive Committee decided to depute legal consultant of the Council to pursue the matter with the legal Axis to exhaust the legal remedy at the first instance at earliest in respect of condone of delay as well as to hear the Central Council. The matter should be taken up by the legal consultant on urgent basis. 201st EC Minutes | 2 Agenda Item No.4. Installation of card access door in office of CCIM. It was noted that as per direction of the President, CCIM, glass doors with biometric/ID card based access have been installed in the the office of CCIM (3rd and 4th floor). Further for the purchase of Door Access point, Door Access Card & fixing of toughened Glass, a Sub-Committee consisting of Dr. K. Natarajan (AR-SIddha), Shri Harban Meena and Shri Krishan Kumar was constituted to collect the quotations from market The said committee visited the market and obtained quotations from various agencies on 02.09.2014 & opened all the sealed covers received from the following agencies:- 1. However, as per requirement of the office, the rates quoted by M/s ABS Furnishing Co were found to be lowest and the work has been awarded to M/s ABS Furnishing Co., West Patel Nagar, New Delhi for the supply of the Door Access point, Door Access Card fixing of toughen Glass and to install the same in the office of CCIM with the approval of President, CCIM. Executive Committee approved the same. Agenda Item No.5. Appointment of two Technical Associates – regarding. It was noted that the two Technical Associates (Ayurved) namely Dr. Praveen (Senior Technical Associate) and Dr. Priyanka (Junior Technical Associate) have resigned. The matter was placed before President, CCIM and it was directed to engage following Technical Associate‟s:- 1. Dr. Neha Arya (Senior Technical Associate) 2. Dr. Monu Priya Verma (Junior Technical Associate) Both the Technical Associates have joined the office. Executive Committee approved the same. Agenda Item No.6. Regarding engagement of additional manpower of Computer Operators & Peons on outsource basis. It was noted that in view of work load, the need to engage the additional Computer Operators & Peons was felt in the office of the Council, Ms. Bedi & Bedi (Contractor) has been asked to provide Computer Operators & Peons as per details given below after getting prior approval of the President, CCIM. 1.
