It aims to understand the implementation of the Convention, its added value, arguments against the ratification of the Convention, and the impact of the COVID-19 pandemic on violence against women (VAW) and domestic violence (DV). The 27 EU Member States are included in the study, together with Turkey, which offers a comparator of the impact of the ratification of the Convention by a non-EU country. This document was requested by the European Parliament's Committee on Women’s Rights and Gender Equality (FEMM).     EMPOWERING WOMEN IN TURKEY: A PRIORITY IN THE PRE-ACCESSION PROCESS Empowering women must be a priority in the pre-accession process and all stakeholders must be mobilized to ensure effective progress and implementation on the ground of the new rights. This means strengthening the administrative capacity of relevant bodies and appropriate structures to monitor women’s situation. Member States have a lot to share with Turkey and exchanges of best practices in different fields will enable the various actors to face the challenges brought by the need to adapt the welfare system. Vladimír Špidlax x Mr Vladimír Špidla is member of the European Commission in charge of Employment, Social Affairs and Equal Opportunities since November 2004. Prior to his functions at EU level, he was Prime Minister of the Czech Republic. he European Union is not only a gathering of States, it is above all a Union of people where both women and men enjoy rights, have an active role to play and benefit from policies. A COMPARATIVE ANALYSIS OF THE HEADSCARF IN FRANCE, TURKEY, AND THE UNITED STATES BY HERA HASHMI* INTRODUCTION In July 2009, a man stabbed and killed a pregnant woman wearing a headscarf in a German courtroom during an appellate trial for his Islamophobic remarks against her.1 Her death led to outrage around the world, and she became known as the "martyr of the veil," a woman killed for her religious belief.2 Yet it was just a simple piece of cloth that evoked this violent reaction. Such Islamaphobic sentiments seem to be spreading throughout various parts of the world. In 2004, France banned headscarves and all conspicuous religious symbols from public classrooms.3 In 2005, the European Court of Human Rights (ECtHR)4 upheld Turkey's headscarf ban barring thousands of headscarf-wearing women from attending schools, universities, and entering government buildings in a country where a majority of the population is Muslim.

Definition and scope of criminal law provisions 1. Please provide information on criminal law provision/s on rape (or analogous forms of serious sexual violence for those jurisdictions that do not have a rape classification) by providing full translated transcripts of the relevant Sections of the Criminal Code and the Criminal procedure code. Article 216 of the Danish Criminal Code states (unofficial translation): “A penalty of imprisonment for a term not exceeding eight years for rape is imposed on any person who (i) uses violence or threats of violence to have sexual intercourse; or (ii) engages in sexual intercourse by duress as defined in section 260 or with a person who is in a state or situation in which the person is incapable of resisting the act.”1 The flaws in Danish law on sexual violence are not confined to the definition of rape and its consequences. Articles 218-220 of the Criminal Code criminalize sexual intercourse in situations where a person exploits another person’s mental disability or their dependency, for instance in situations of deprivation of liberty, in institutions such as youth institutions or psychiatric wards.2 Article 221 of the Criminal Code criminalizes obtaining sexual intercourse through deception.3 The Criminal Code does not specify explicitly that these offences constitute rape and they carry lesser penalties than those defined as such in it.

Under the coordination of Purple Roof Women’s Shelters Association, we first started to come together to share tasks and agree on the time plan in order to prepare the report till the end of May, which was the deadline for the submission of the state report. However, as we found out later, Turkey delayed the submission till July without informing the CSOs, thus we had to decide to proceed to draft the NGO report without seeing the state’s report.

Ares(2017)6350095 - 22/12/2017 Summary conclusions of the joint Annual Review Meeting on progress of implementation of the Partnership Agreement 2014-2020 in Cyprus Nicosia, 13 December 2017 On 13 December 2017 took place in Nicosia the joint Annual Review Meeting in accordance to Article 51 (2) of the CPR, covering all programmes and ESI Funds in Cyprus and taking account of the progress report on implementation of the Partnership Agreement as at 31 December 2016, following Article 52 of the CPR. The meeting was co-chaired by DG REGIO Director Mr Rudolf Niessler and DG EPCD Director Mr Costas Iacovou. Representatives of DG EMPL, DG MARE and DG REGIO also participated in the meeting. Cyprus presented the state of play of implementation of the Partnership Agreement by 31 December 2016. The initial pace of implementation was very slow at the end of 2016 for all ESI Funds (for ERDF in particular, no payment claim had been submitted to the Commission and only EUR 2.6 million had been declared for the Cohesion Fund). Around 60 calls of proposals had been launched by the end of 2016 whilst the activation of all programmes was only 32%. According to Cyprus, this was mostly due to the new regulations and guidelines for the management and implementation of ESI Funds in the programming period 2014-2020, which implied many changes at administrative level (modification of the Management and Control System, including the designation of authorities/agreements with the intermediate bodies, reformulation of the IT system for the management of the ESIFs, training to all bodies involved in the management and implementation of the Funds etc.).

  • The Istanbul Convention and the CEDAW Framework
    The Istanbul Convention and the CEDAW framework: A comparison1 of measures to prevent and combat violence against women Opened for signature in Istanbul in May 2011, the Council of Europe Convention on preventing and combating violence against women and domestic violence (Istanbul Convention) is the first legally-binding instrument in Europe in this field, and in terms of scope, the most far reaching international treaty to tackle this serious violation of human rights. It aims at zero tolerance for such violence and is a major step forward in making Europe and beyond a safer place. By accepting the Istanbul Convention, governments are obliged to change their laws, introduce practical measures and allocate resources to effectively prevent and combat violence against women and domestic violence. The Istanbul Convention codifies established standards, jurisprudence and developments at international level, as well as best practice at national level, thereby lending them more weight and ensuring their wider application. Drawing in particular on the framework of measures of the Convention on the Elimination of All forms of Discrimination against Women (CEDAW) and case law developed by the CEDAW Committee, it is firmly based on the premise that violence against women cannot be eradicated without investing in gender equality and that in turn, only real gender equality and a change in attitudes can truly prevent such violence. The following tables describe the manner in which the Istanbul Convention builds on the three sources that constitute the CEDAW framework: the Convention, General Recommendations and case law. The tables also show how the Istanbul Convention complements these instruments by establishing a more detailed catalogue of legally-binding obligations to prevent and respond to violence against women.
