As a result, hydro projects have become the focus of intense public protests and legal disputes. NUNCA MÁS MEETS #NIUNAMENOS— ACCOUNTABILITY FOR PINOCHET-ERA SEXUAL VIOLENCE IN CHILE Caroline Davidson* ABSTRACT Chile has been held up as a transitional justice success story. Emerging from a repressive dictatorship to democracy, it has made meaningful progress in grappling with brutal human rights violations through truth commissions and, more recently, criminal trials. Yet, the Chilean human rights prosecutions have a glaring hole. Courts have convicted scores of state agents for enforced disappearance, execution, and torture (or their equivalents in Chilean law at the time), but have failed to meaningfully address sexual violence crimes, even though almost all women detained by the regime were victims of some form of sexual violence, and many were raped. Recent, however, the issue seems to be gaining more judicial attention. This Article explores the question why it has taken so long for Chilean courts to reach the issue of dictatorship-era sexual violence. The reasons include the “pacted” Chilean transition, deficiencies in Chilean criminal law and procedures on sexual violence, lack of resources for sexual violence prosecutions, normalization of violence against women, and the reluctance of survivors to come forward when the likelihood of success was exceedingly low. The Article also examines the confluence of cultural and legal forces—perhaps most importantly, feminist mobilization and greater judicial openness to * Associate Professor, Willamette University, College of Law. 1130 UNSW Law Journal Volume 40(3) 9 BEYOND RECOGNITION: LESSONS FROM CHILE FOR ALLOCATING INDIGENOUS WATER RIGHTS IN AUSTRALIA ELIZABETH MACPHERSON I INTRODUCTION Australian water law frameworks, which authorise water use, have historically excluded indigenous people. Indigenous land now exceeds 30 per cent of the total land in Australia.1 Yet indigenous water use rights are estimated at less than 0.01 per cent of total Australian water allocations.2 In the limited situations where water law frameworks have engaged with indigenous interests, they typically conceive of such interests as falling outside of the consumptive pool’3 of water applicable to commercial uses associated with activities on land such as irrigation, agriculture, industry or tourism.4 The idea that states must recognise’ indigenous groups, and their ongoing rights to land and resources, has become the central claim of the international indigenous rights movement. 5 Claims for recognition of indigenous land and resource rights are the logical outcome of demands for indigenous rights based on ideas of reparative’ justice.6 The colonisers failed to recognise indigenous rights to land and resources at the acquisition of sovereignty, the argument goes, and the remedy is to recognise those rights now. San Carlos de Apoquindo 2.200 Teléfono 22 618 1245 – [email protected] 1 ANÁLISIS DE LA REPUTACIÓN DE CHILE EN LA PRENSA EXTRANJERA 2 ANÁLISIS DE LA REPUTACIÓN DE CHILE EN LA PRENSA EXTRANJERA Resumen Ejecutivo Un análisis cuantitativo y cualitativo de 1.744 artículos publicados sobre Chile en 10 diarios y 1 semanario de relevancia mundial durante 2015, muestra que los conflictos y escándalos políticos y empresariales—como el de la colusión del papel higiénico—y los litigios limítrofes con Perú y Bolivia, dañaron la reputación de Chile en el extranjero durante 2015. La buena actuación de Chile en la Copa América, en cambio, sirvió para paliar el gran número de noticias negativas que se escribieron sobre nuestro país el año pasado. Fue precisamente la Copa América el tema que resultó más interesante para la prensa extranjera durante 2015, seguido de los desastres naturales y accidentes, como las erupciones de volcanes como el Calbuco, y las inundaciones en el norte durante el primer trimestre, entre otros. Los triunfos de la Selección chilena de Fútbol se tradujeron en un volumen considerable de noticias positivas para Chile, las que fueron parcialmente contrarrestadas por la detención de Arturo Vidal tras su accidente en estado de ebriedad, y el comportamiento antideportivo de Gonzalo Jara. En 2015, el 39% de las noticias publicadas en 10 diarios y 1 semanario de referencia mundial fueron negativas para nuestro país, comparadas con el 33% que fueron positivas y el 28% que fueron neutras / mixtas. -

Cançado Trindade, Judge Cecilia Medina Quiroga, Judge Manuel E. The Commission submitted the application for the Court to declare that the State was responsible for the violation of the rights embodied in Articles 13 (Freedom of Thought and Expression) and 25 (Right to Judicial Protection) of the American Convention, in relation to the obligations established in Articles 1(1) (Obligation to Respect Rights) and 2 (Domestic Legal Effects) thereof, to the detriment of Marcel Claude Reyes, Sebastián Cox Urrejola and Arturo Longton Guerrero. -

Formaciones Discursivas de la Corte Suprema de Chile sobre Derechos Humanos en Dictadura y Democracia, 1974-2009*. Cristian A. Venegas Ahumada** Resumen. El objetivo es establecer si existen cambios cualitativos en la formación discursiva de la Corte Suprema de Chile sobre Derechos Humanos en Dictadura y Democracia (1974-2009). Es un corpus de 35 Discursos de Inauguración de Años Judiciales y dos Comunicados. El análisis de discurso evidencia diferencias: I. No Existió / existió una independencia limitada del Poder Judicial respecto del Poder Político. II. De la irregularidad a la regularidad en los procesos judiciales. III. Del parcial respeto a la ley y la justicia a su fortalecimiento y transparencia. IV. De la pérdida de legitimidad del Gobierno de Allende a la búsqueda de justicia y paz. Las conclusiones son: Frente al trauma social dictatorial, el “re-comienzo” es olvido en la memoria histórica. Palabras claves: Trauma social, formación discursiva, olvido, memoria histórica. The objective is to establish if there exist qualitative changes in the discursive formation of Supreme Court of Chile about Human Rights in Dictatorship and Democracy (1974-2009). The corpus consists of 35 opening speeches of Judicial Years and two announcements. The discourse analysis shows differences: I. It did not exist/ it existed a limited independence of Judicial Power regarding Political Power. II. Of irregularity to regularity of judicial processes. III. Of partial respect for the law and justice and its strengthening and transparence. IV. Of legitimacy loss of the Allende Government and the search of justice and peace. -

Los hechos ocurrieron a las ocho de la mañana del 2 de julio de 1986, Rodrigo Rojas De Negri caminaba junto a un grupo de jóvenes por una calle de la comuna. Verónica De Negri en 1976 fue trasladada al campo de concentración de Tres Alamos. Allí permaneció más de un año, sufriendo las más hasta que fue expulsada del país y logró refugiarse en Estados Unidos, donde se reunió con sus dos hijos. En medio de planes, postergados una y otra vez por la negativa chilena para que su madre retornara al país, Rodrigo nunca se insertó plenamente en la sociedad norteamericana. Y tampoco tenía madurez para comprender lo que ocurría en su tierra de origen. Vivió un tránsito indefinido, igual que tantos otros, entre una realidad que sentía ajena y otra que, sabiéndola suya, sólo percibía por señales lejanas. Desarrolló un sentimiento casi obsesivo ante esa realidad que escapaba de sus manos. Buscaba ansioso la literatura latinoamericana, tocaba charango en un grupo de música andina, participaba en actividades de solidaridad, todo en los días en que jóvenes de todo el mundo tenían en el rabillo del ojo las victorias sandinistas en Nicaragua, las hazañas del Frente Farabundo Martí en El Salvador y la lucha del pueblo chileno contra la dictadura. -

INTRODUCTION ¶1 Chile’s misuse of the label of terrorism should not shield the government from accountability for human rights violations against the indigenous Mapuche. Despite significant progress in its transition to democracy, the prosecution of Mapuche under the Prevention of Terrorism Act (“Terrorism Act”), for acts not internationally considered to be terrorism, has caused significant erosion of rule of law principles in Chile. Rule of law principles continue to emerge as important barometers for national compliance with international human rights. -

This chapter covers developments related to truth, justice, reparations and guarantees of non-repetition in Chile, with a particular focus on measuring progress or backsliding with regard to Chile’s international human rights commitments. The detailed tracking and comparative statistical analysis in the report covers the twelve months from July 2018 to June 2019, inclusive. -
