The program and academic catalog “Queens of King Manor” is set to open in September and will examine the way material objects reflect women’s movements and society from the colo- nial era through the 20th century. The museum will feature a physical collection and illustrated catalogue, as well as an online component ex- ploring citizenship, voting rights and the reality that many women’s rights movements did not actually include all women. Celebrating women’s contributions is an ap- propriate choice for King Manor, which would not be around today without a group of women committed to the preservation of history. The King Manor Association of Long Island worked to save the historic home, owned by Rufus King, a member of the Continental Congress and a sig- natory to the Constitution. On Mar. 23, 2016, Nossov filed a complaint in Kings County Supreme Court, Civil Term against Hunter Mountain and Hunter Mountain Resort, LLC, in an effort to recover damages for his injuries. After the defendants failed to appear or answer the complaint, a default judgment was entered against them on April 18, 2018. By notice of motion dated Sept. 15, 2018, Nossov moved for leave to amend the summons, complaint and caption to name Hunter Mountain Ski Bowl, Inc. (HMSB), doing business as Hunter Mountain, as a defendant instead of the named defendant Hunter Mountain. The Supreme Court granted that branch of Nossov’s motion. Upon an appeal by HMSB, the justices of the Appellate Division, Second Department reversed the order of the Supreme Court. In their decision, the justices explained that Nossov was not entitled to relief for leave to amend the summons, complaint and caption to name HMSB as a defendant instead of Hunter Mountain because it may be granted only where there is evidence that the correct defendant was served and would not be prejudiced by the granting of the amendment. The justices noted that although relief may be used to cure a misnomer in the description of a party defendant, it could not be used after the expiration of the statute of limitations as a device to add or substitute an entirely new defendant who was not properly served. They concluded that there was no evidence that HMSB and Hunter Mountain are one and the same entity. In addition, the justices determined that Nossov failed to establish that he properly served HMSB or that the Supreme Court obtained jurisdiction over it. Last, the justices found that Nossov was not entitled to relief since he did not provide a copy of his proposed amended summons and complaint and the proposed amendments were palpably insufficient or patently devoid of merit as the statute of limitations barred any claim against HMSB, a new defendant in the complaint. Accordingly, the justices reversed the order of the Supreme Court and denied Nossov’s motion for leave to amend the complaint. —Nossov v. Hunter Mtn., 2018‐14886, July 22, 2020 STATUTE OF LIMITATIONS BARS PERSONAL INJURY SUIT AGAINST ESTATE Appellate Division, Second Department On July 22, 2013, Anthony Aurilia allegedly sustained injuries when he tripped and fell on the sidewalk abutting a property located on 14th Avenue in Brooklyn. In 2014, Aurilia filed a complaint in Kings County Supreme Court, Civil term against the alleged owners of the abutting property, John Imbriale and Margaret Imbriale, but that complaint was dismissed after Aurilia learned, in June of 2014, that the Imbriales had died years before the filing of the complaint. In an order and judgment dated Nov. 26, 2018, Hon. Lawrence Knipel of the Supreme Court granted Carbonara’s motion and dismissed the complaint. Upon an appeal by Aurilia, the justices of the Appellate Division, Second Department, affirmed the judgment of the Supreme Court. In their decision, the justices first noted in a motion for dismissal of a complaint as time­ barred, the moving defendant must establish that the time in which to commence the complaint had expired. The justices also noted that complaints seeking to recover damages for personal injuries are subject to a three­year statute of limitations. The justices concluded that Carbonara demonstrated that the statute of limitations began to run on July 22, 2013, when the alleged accident occurred, and that the complaint was filed on Nov. 8, 2017, more than three years later. The justices determined that, in opposition, Aurilia failed to raise a question of fact that would warrant denial of the motion. They noted that Aurilia was aware of the Imbriales’ deaths nearly two years before the statute of limitations expired, yet he failed to seek the remedy for a plaintiff under such circumstances, which is to petition the Surrogate’s Court for the appointment of the Public Administrator as the personal representative of the estate.
