Abstract This study is a description and evaluation of the adjudicative-disposi- tion systems in operation in five states and communities with Federally funded drinking-driver control programs called Alcohol Safety Action Projects (ASAP). The five sites selec£ed had undergone significant change in the legal or judicial system or had developed innovative approaches for handling drinking-driving cases. Case studies were conducted for Puerto Rico; Phoenix, Arizona; Los Angeles, California; Hennepin County, Minnesota; and Idaho. A final technical report con- sists of a summary and analysis of the case-study findings with final conclusions and policy recommendations. The primary objective of the Puerto Rico ASAP study was to assess the impact of (i) the statutory adoption of the National Highway Traffic Safety Administration's operational definition of a problem drinker as the legal definition for court disposition purposes and (2) a m~dated presentence investigation and drinker-type classification of al con- •victed drinking-driving offenders. The study found that the •Puerto Rico ASAP successfully created, implemented, and tested a viable system # of drinking-driver control through legislative enactment in 1973, where no such •system had previously existed. However, additional legislation in 1975, although theoretically desirable, will probably prove to be counter productive. Wards 18. The methods of research included interviews with key persons in the PuertoRican criminal justice system, observations in courts and elsewhere, and analysis of ASAP status reports prepared for the National Highway Traffic Safety AdministratiOn (NHTSA). Prior to 1973 Puerto Rico's DWI law was a criminal law, with harsh penalties for offenders. First offenders were supposed to lose their driver's licenses for 1 to 2 years; second offenders were supposed to be given manda- tory jail sentences and see their driver's licenses permanently revoked. Because of the harshness of the penalties, combined with widespread tolerance for drinking, there were few DWI prosecutions. Those who were prosecuted, moreover, usually found it easy to avoid conviction by taking advantage of loopholes in the BAC law. Although an implied consent law existed, defendants were often able to convince judges that their refusal to take a BAC test was justified. Furthermore, defendants were permitted to decide whether they would take a blood, a breath,•or a urine test. In addition, certain procedural rules--for example, the require- ment for a probable-cause hearing for defendants "without unnecessary delay" --helped defendants evade conviction. It called for Presentence investigations to determine whether offenders were problem or social drinkers/and allowed judges to issue restricted licenses • .' . .. Until offenders participated in rehabilitation programs (for problem drinkers) or education programs (for social drinkers). The BAC law's loopholes Were CloSed at the same'time'. Breath testing was established as the preferred testing method, and the right to choose the BAC testing method was shifted from the defendant to the arresting officer. = The new law did not, however, lower the presumptive level of intoxication from 0.15 percent BAC to 0.i0 percent, as requested by the ASAP. The new DWI law, combined with stronger law enforcement efforts spon- sored by the ASAP, resulted in significant increases in the number of presentence investigations and in the identification of problem and social drinkers. Where 221 problem drinkers had been identified in 1973, for example, that number increased to 1,146 in 19741 As another effect of the new law, judges gradually came to rely on presentencing investigators and probation officers for advice on how Dwi cases should be treated. Unfortunately, the new BAC and DWI laws did not deal with certain problems that had existed in the criminal justice system prior to 1973, and they added a few new ones. The new DWI law, for example, required a pre- sentencing investigation that wasan investigacion minuciosa, words that were taken to mean an excessively thorough investigation of the entire life of defendants. The new BAC law, in giving the breath test preferred status, resulte d indismissals of cases when experts were unavailable to testify on the accuracy of breath testing equipment. Furthermore, judgescontinued to be lenient with defendants who refused to take a BACtest. iv Puerto Rico In 1975 the island's legislature again revised the BAC and Dwi laws. The presumptive level of intoxication was set at 0.i0 percent BAC, and DWI cases were assigned to District Courts, thus relieving thecongestion that such cases had caused in the Superior Courts. At thesame time, however, the new legislation returned to defendants the right to choose a BAC testing % method and required completion of theDriver Improvement School course by offenders within 30 days, thus creating severe administrative problems.

As a result, this thesis is mainly concerned with the capacity of words, iterated within the archive of social media, to haunt us— both culturally and informatically. Through hauntology, this study hopes to understand a modern discourse community that is bound by an epideictic framework that specializes in the deconstruction of the individual’s ethos via the constant demonization and incitement of past, current, and possible social media expressions. The primary goal of this study is to understand how these practices function within a capitalistic framework and mirror the performativity of capital by reducing affective human interactions to that of a transaction.

CERTIORARI TO THE SUPREME COURT OF PUERTO RICO No. 15–108. Argued January 13, 2016—Decided June 9, 2016 Respondents Luis Sánchez Valle and Jaime Gómez Vázquez each sold a gun to an undercover police officer. Puerto Rican prosecutors indict­ ed them for illegally selling firearms in violation of the Puerto Rico Arms Act of 2000. While those charges were pending, federal grand juries also indicted them, based on the same transactions, for viola­ tions of analogous U. S. gun trafficking statutes. Both defendants pleaded guilty to the federal charges and moved to dismiss the pend­ ing Commonwealth charges on double jeopardy grounds. The trial court in each case dismissed the charges, rejecting prosecutors’ ar­ guments that Puerto Rico and the United States are separate sover­ eigns for double jeopardy purposes and so could bring successive prosecutions against each defendant. The Puerto Rico Court of Ap­ peals consolidated the cases and reversed. The Supreme Court of Puerto Rico granted review and held, in line with the trial court, that Puerto Rico’s gun sale prosecutions violated the Double Jeopardy Clause.

Clark Honors College in partial fulfillment of the requirements for the degree of Bachelor of Arts An Abstract of the Thesis of Momo Wilms-Crowe for the degree of Bachelor of Arts in the Department of Political Science to be taken June 2020 Title: “Desde Abajo, Como Semilla: Puerto Rican Food Sovereignty as Embodied Decolonial Resistance Approved: _______Dan Tichenor, Ph.D______________ Primary Thesis Advisor This thesis explores the power, possibility, and agency embedded in food in the contemporary Puerto Rican context. Building from participatory ethnographic fieldwork with activists, chefs, and farmers engaged in food sovereignty work, I examine the concepts of political agency and subjectivity as they relate to embodied experiences of politics and highlight the generative potential of work occurring in unconventional locations for political participation. This approach is made possible with the understanding that the food we consume directly connects our individual lived experiences to broader structures of power in intimate and material ways. Through food, I offer a grounded critique of US colonial violence, inherently linked to ecological destruction, cisheteropatriarchy, and disaster capitalism. I also document dynamics of radical prefigurative politics as visible in people’s generative reimagining of relationships with their bodies, each other, and the land. This analysis is supported theoretically by Indigenous, anarchist, and queer/feminist perspectives which similarly connect the personal to the political and offer examples of political action that extend beyond state-centric formal politics.

    American Society of Civil Engineers Puerto Rico Section INFRASTRUCTUREREPORTCARD.ORG/PUERTO-RICO INFRASTRUCTUREREPORTCARD.ORG/PUERTO-RICO | 1 INTRODUCTION Infrastructure is central to quality of life and economic development. Households receive a wide range of goods and services thanks to infrastructure, including fresh fruit and vegetables, water, electronics, and textile goods. Meanwhile, infrastructure can reduce fixed costs of production for businesses, especially costs associated with transportation, which tend to be a determinant of business location. Simply put, infrastructure matters to people and businesses all around. Puerto Rico is no exception. The quality of infrastructure is essential in the daily lives of the people of Puerto Rico, and this was all too evident when Hurricanes Maria and Irma devastated the island in 2017. Two years removed from the storms, rebuilding our infrastructure remains a work in progress. Unfortunately, constant failures in the energy system, prevalent poor conditions in the road network, and notable deferred maintenance across public buildings impact daily functions, mobility and productivity. They serve as vivid reminders of the need to increase investment in infrastructure, employ better maintenance practices, and develop smarter policy. The American Society of Civil Engineers (ASCE), founded in 1852, is the oldest national professional engineering society in the United States. ASCE represents more than 150,000 members of the civil engineering profession in 177 countries. The Puerto Rico Section is commemorating its 90th anniversary with the release of the first Report Card for Puerto Rico’s Infrastructure. The ASCE Puerto Rico Section has devoted significant personal time in the development of the Infrastructure Report Card, in hopes of encouraging smart rebuilding efforts, influencing sound infrastructure policy, keeping the island competitive, and improving Puerto Ricans quality of life.
