180031 AGREEMENT This Agreement Is Made and Entered AGREEMENT This Agreement is made and entered into this 13th day of June, 2018, by and between the Savannah-Chatham County Public School System as part of the GEAR UP Georgia Grant (hereinafter referred to as “SCCPSS”) and Board of Regents of the University System of Georgia by and on behalf of Georgia Southern University Research and Service Foundation, Inc. (hereinafter referred to as "the University"). W I T N E S S E T H WHEREAS, SCCPSS seeks to make the Near-Peer College and Career Adviser Program available to GEAR UP Georgia students (Class of 2022 freshman) at select SCCPSS schools, namely Windsor Forest High School, Savannah High School, Jenkins High School, Beach High School, Groves High School and Johnson High School, (hereinafter referred to collectively as the "High Schools"), and WHEREAS, the University is the Savannah Graduates consortium, the other participating institutions being Savannah State University and Savannah Technical College, and WHEREAS, Savannah Graduates will offer the Near-Peer College and Career Adviser Program, and WHEREAS, Near-Peer College and Career Advisers will work in collaboration with school counselors, teachers, school administrators, GEAR UP Georgia Designated Local Program Coordinator, GEAR UP Georgia Designated Onsite School Level Coordinators, other GEAR UP Georgia partners, mentors and tutors to increase the number of students who develop and carry out a plan for life beyond high school, and to increase student awareness of post-high school options available to them such as college, vocational school, trade programs, and the military, and NOW, THEREFORE, in consideration of the promises and conditions set forth herein, the receipt and sufficiency of which is acknowledged by each of them, the parties hereby agree as follows: I. During the term of this Agreement, the University, through the Savannah Graduates program, will - 1. Identify, recruit, hire and employ six (6) Near-Peer Advisers (herein after referred to as the "Advisers") to serve the six (6) High Schools for an average of 40 hours per week during the term of this Agreement. Advisers will provide High School students and their families one­ on- one and group sessions to help identify careers and post secondary options that will serve them well. 2. Provide necessary and ongoing training, support, and professional development that will allow the Advisers to fulfill their responsibilities to the High Schools, GEAR UP Georgia and SCCPSS students. 3. Employ a Program Manager who will - 180031 (a) supervise the Advisers, (b) meet with the Advisers regularly to discuss job performance and develop strategies for improvement, (c) work closely with the on-site coordinator to ensure that the relationships between the Advisers and the High School remain strong and that the Advisers are effectively serving students and advancing the primary objectives of Gear Up Georgia and the Near-Peer College and Career Adviser Program, (d) engage in frequent dialogue with the High Schools around strategic collaboration and to assess prog ress towards the goals, (e) reevaluate the work plan and make adjustments as needed, (f) serve as the main liaison between the principals of the High Schools and the Near-Peer College and Career Adviser Program, meeting at least twice a year to review the Agreement and ensure that its goals are being met, (g) work with the onsite supervisor to establish a mutually agreeable work schedule for the Advisers, (h) visit each school at least three times per academic year. 4. Share relevant data and research with the High Schools. 5. Pay the full salary of the Advisers and the Program Manager and manage the administration of benefits as well as provide housing for Advisers. 6. Provide funding to defray reasonable expenses associated with the Near- Peer College and Career Adviser Program and Adviser travel to and from training and required activities. 7. Work in good faith to develop funding that will sustain the Near-Peer College and Career Program beyond the current term. 180031 8. Keep any and all student level data provided by SCCPSS or the High Schools strictly confidential in accordance with the Family Educational Rights and Privacy Act of 1974 (FERPA) and SCCPSS policies. 9. All Near Peer College and Career Advisors and Program Managers who access SCCPSS student educational records will be subject to the direct control of SCCPSS with respect to the use and maintenance of such education records. II. During the term of this Agreement, SCCPSS and the High Schools will - 1. Welcome the Advisers and work actively to facilitate cooperation between the Near-Peer College and Career Adviser Program and any other college access advising already present at the school. 2. Supply reasonable access to student level data which is deemed to serve legitimate educational purpose (including, but not limited to each student's name, date of birth, year of graduation, class schedule, transcript, and test score) before Adviser installation for the purpose of advising, reporting and program evaluation. 3. As to each participating High School, designate a High School employee to serve as the on-site GEAR UP Georgia coordinator who will - (a) serve as the Adviser's primary resource and advocate within the High School, facilitate the Adviser's integration into the life of the High School, and provide appropriate advice and counsel. (b) work closely with Savannah Graduates program staff to ensure that the relationship between the Adviser and the High School remains strong and that the Adviser is effectively serving students and advancing the goals of GEAR UP Georgia and the Near-Peer College and Career Adviser Program (c) work with the Savannah Graduates program staff to establish a mutually agreeable work schedule for the Adviser. (d) engage in frequent dialogue with Savannah Graduates program staff around strategic collaboration and to assess progress towards the goal, reevaluate the work plan, and make adjustments as needed by at least on an annual basis. (e) serve as the main liaison between the principal of the school and Savannah Graduates meeting at least once per year to review partnership and ensure that goals are being met. 180031 4. Communicate clearly both to the Advisers and to Savannah Graduates staff any policies and procedures with which the Advisers are expected to comply. 5. Contribute to and participate in training, as appropriate. 6. Provide Advisers with access to SCCPSS student transcripts and schedules, electronically or in hard copy which is deemed to serve a legitimate educational purpose of effectively advising students. 7. Provide dedicated and appropriate working/meeting space for each Adviser, including a computer with Internet access, and ready access to phone and voicemail, fax, photocopier, and printer. 8. Provide each Adviser with a comprehensive orientation to the High School to which the Adviser is assigned, with introductions to key administrators, teachers, and staff, as well as an overview of the mission and culture of the High School. 9. Maintain the existing staffing level of the High School guidance or counseling department and not make any staffing modifications suggesting the replacement of a counselor or counseling position with a Near-Peer College and Career Advisor. 10. SCCPSS shall pay to the University the sum of Ninety Nine Thousand, Seven Hundred and Fifty Dollars ($99,750.00) on or before August 31, 2018 to fund three (3) of the six (6) Near Peer Advisers. III. During the term of this Agreement, both parties will - 1. Work collaboratively to develop and implement programs and services that foster access to career and post-secondary education options and include all students identified by the High Schools and who are willing to participate. 2. Work collaboratively to outline current school-based efforts to foster access to career and post-secondary education options, review programs and services to ensure they complement and do not duplicate existing effort, and establish clear and mutually agreeable timelines for the implementation of the Near-Peer College and Career Adviser program. 3. See the Advisers as professional, well-trained resources for High School's students regarding college and career access. 180031 IV. General Terms. 1. Program Evaluation. Savannah Graduates, the University, Savannah State University, SCCPSS and other external funders provide funding for the Near-Peer College and Career Adviser Program. The Near-Peer College and Career Adviser Program will be evaluated on an ongoing basis. Data will be collected and managed through Savannah. SCCPSS agrees to provide data needed for this evaluation. Data will be used for program evaluation purposes only. All results of data analysis will be reported in aggregate and no individual student will be identified. Data to be collected may include, but not be limited to -- a. information on enrolled students during program implementation; and information on services provided to students. At the school level, the adviser will collect data to help target and track services and evaluate the program success. 2. Term: Renewals and Extensions: Early Termination. The term of this Agreement shall begin on June 13, 2018 and shall end on the last day of the SCCPSS 2018-2019 academic year. The parties may extend the term of the Agreement for one or more renewal terms on the same terms and conditions as stated herein by mutual written consent to be signed by officers of the respective parties who are authorized to execute contracts on their behalf. Notwithstanding the foregoing, either party may terminate this Agreement prior to the expiration of its term by notifying the other party in writing of its intention to end the relationship at least 30 days prior to the intended early termination date. I n the event of an early termination, the University will refund to SCCPSS any funds not used du ring the winding-u p period. 3. This Agreement may be amended by mutual written consent of the parties, to be signed by officers of the respective parties who are authorized to execute contracts on their behalf.
