    1 Executive summary The competitive landscape of the personal transport industry has been and is continuing to experience unprecedented change and disruption from regulatory reform, new entrants and new, vertically integrated business models. Since the 5% cap on surcharges was introduced in Victoria in 2014, the illegal entry of Uber in 2012 and subsequent legalisation of ridesharing in 2016, competition in all facets of the industry has substantially increased and is now more intense than ever. Ridesharing service providers have grown the market for personal transport and are now an entrenched part of the competitive landscape. Their services are perfectly substitutable for booked Taxi services and they have taken market share from unbooked Taxi services. Ridesharing service providers’ share of the market is increasing year on year. Concurrently, deregulation of the Taxi licencing system in Victoria in October 2017 has almost doubled the number of Taxis in Victoria. Since Cabcharge Payments provides in-Taxi hardware to facilitate non-cash payments, the number of terminals it deploys has increased directly in line with the increase in the number of Taxis. The ESC should change the maximum surcharge from 5% to to satisfy its statutory obligation to ensure persons facilitating the making of non-cash payment transactions are able to recover the reasonable cost of accepting and processing such transactions.1 In setting the maximum surcharge, the ESC must allocate proper weight to each of its statutory objectives. The ESC’s overarching statutory objective is to promote the long term interests of Victorian consumers with regard to the price, quality and reliability of essential services.

Driving change: The Taxi Services Commission Along with the weather and football, taxis were a much discussed topic in Melbourne and the talk was frequently far from complimentary. In 2011, the Victorian Government launched an inquiry into the taxi and hire car industry as a response to growing concerns about the safety, quality and accessibility of services offered. Acknowledging that the industry suffered from some serious systemic issues, the Government approved a suite of reforms recommended by the inquiry, including significant changes to the licencing process. The Taxi Services Commission (TSC) was established as a statutory authority in July 2013 to implement these reforms and replace the Victorian Taxi Directorate (VTD) which had been responsible for licensing, accreditation and other regulatory matters. Taking on this sizeable challenge was former Australian Competition and Consumer Commission chief Graeme Samuel. As TSC Chairman he faced an industry, so far, notoriously resistant to change. Flagging satisfaction Although taxis and hire cars1 are privately owned and operated, they are considered an important part of Victoria’s public transport network, offering convenient and flexible point-to-point travel for a diverse range of users. They are also particularly important in Melbourne; a large city with a widespread population and many outer suburbs inadequately served by public transport. Connections between public transport services are frequently unreliable or non-existent; even short cross-town trips in urban areas can be complex and time-consuming.     Victoria Government Gazette No. S 185 Friday 13 June 2014 By Authority of Victorian Government Printer Subordinate Legislation Act 1994 PROPOSED NOTICE SPECIFYING CONDITIONS THAT ARE TO BE IMPLIED IN EVERY DRIVER AGREEMENT Notice of Decision I, Graeme Samuel AC, Chair of the Taxi Services Commission (TSC), give notice under section 12J of the Subordinate Legislation Act 1994 that the TSC has decided to proceed, with amendments, with the making of a notice under section 162L(1) of the Transport (Compliance and Miscellaneous) Act 1983 specifying conditions that are to be implied in every driver agreement (Notice). The proposed Notice was subject to a Regulatory Impact Statement (RIS) seeking public comment. Sixteen submissions were received. Following consideration of these submissions, it is proposed that the following changes be made to the draft Notice proposed in the RIS: Insurance (proposed condition 3) In all circumstances, the Operator must pay any applicable excess on a third party insurance policy for a taxi-cab driven by the Driver and also indemnify the Driver for any vehicle damage arising out of the Driver’s use of the taxi-cab. The exemptions providing for the Driver to contribute to the excess in certain circumstances, and exemptions to the requirement for the Operator to indemnify the Driver, will be removed. It will be clarified that the Operator must hold the third party property insurance policy in the Operator’s individual name only. The Operator must provide a copy of the insurance policy to the Driver on request, rather than being required to keep a copy in the taxi-cab at all times.

    CPV - Submission 312 Introduction 13cabs appreciates the opportunity to contribute this confidential submission to the Economy and Infrastructure Standing Committee’s Inquiry into the reforms to the Commercial Passenger Vehicle Industry that were introduced in 2017. 13cabs is the largest taxi network in Australia, with our head office and origins based in Melbourne. We are the subsidiary of the Australian ASX Listed company A2B Australia Limited, which provides infrastructure to the Victorian Government for the MPTP service. 13cabs wholly supports this Inquiry and provides this contribution on a well-informed basis from its many years within personal transport within Victoria and elsewhere. The taxi industry in Victoria has faced continuous uncertainty and disruption over the last decade. Emerging competitors, regulatory change and shifts in consumer expectations have all factored in change to the Commercial Passenger Vehicle Industry landscape. There are two key areas of focus resulting from the 2017 legislative reform process: 1. The first relates to those incumbent members of the taxi industry in 2017 and how the changes impacted on their businesses and lives. We have no doubt that the upheaval faced by many individuals, particularly holders of perpetual taxi licences will be a central area of focus for the Inquiry. We will not speak at length on the impacts of the 2017 reforms on these people and their businesses, as we believe there are others better placed to do so. However, we would like to reiterate our firm view that this important cohort of hard-working Victorians did not receive the compensation to which they were entitled, effectively stripping them of assets they worked so hard to attain.

I have been appointed Chair of the Inquiry, with Dr David Cousins AM appointed as Assistant Commissioner. The Terms of Reference for the Inquiry are very broad, with the overall aim being to instigate major and enduring improvements to service, safety and competition in Victoria's commercial passenger vehicle industry. Relevantly, the Terms of Reference require the Inquiry to ensure its recommendations cover: • the appropriateness of the structure of the taxi industry including accountabilities of the range of industry participants with a particular focus on commercial incentives to participants; • competition in the sector, in particular focusing on vertical integration, anti-competitive practices and incentives for innovation; and • the effects of regulation, particularly relating to (amongst other things) price controls and taxi fare setting arrangements, and how these impact on customer service and innovation.
