REVIEW OF PARLIAMENTARY POLLING DISTRICTS AND POLLING PLACES

1. PURPOSE

To advise Members of the results of the consultations carried out in connection with the review of the Parliamentary Polling Districts and Polling Places within and to request the Committee to agree the content of the revised Parliamentary Polling Districts and Polling Places Order. 2. RECOMMENDATIONS (a) That the results of the consultation process be noted; (b) That the Parliamentary Polling Districts and Polling Places Order as set out in Appendix C to this report be approved for the reasons set out in the report, subject to any changes necessary in respect of Broadwell/ and/or the Central Ward; (c) That as required by the provisions of Section 18(C) of the Representation of the People Act 1983, all correspondence received in respect of the review; the minutes of relevant meetings of the Committee and a copy of the order be published; (d) That the comments included in Appendix B be noted, together with the additional comment included in this report; (e) That, for the reasons set out in section 4 of the report, no changes be made in respect of polling district JD2 in the Witney Central Ward at this stage, but that the Head of Democratic Services be requested to carry out further investigations and consultations with a view to a further report to this Committee after the elections in May 2015; and (f) That in the event of a polling place becoming unavailable for a particular election the Head of Democratic Services be authorised to designate a new polling place, subject if practicable to prior consultation with the Chairman of the Audit and General Purposes Committee and the local member(s). 3. BACKGROUND 3.1. At its meeting on 26 June 2014, the Committee resolved that the statutorily required review of the Parliamentary Polling Districts and Polling Places within West Oxfordshire be carried out. As required by the legislation, the Acting Returning Officer (ARO) for the Parliamentary Constituency of Witney was requested to submit his representations, and these were subsequently published on 30 June 2014. These representations were supplied to all who were consulted on the review, including all members of this Council and, for ease of reference, a copy is included at Appendix A, (pages 4 to 15). 3.2. Representations were invited from political parties within the constituency, District Councillors, Town and Parish Councils and Parish Meetings and from persons and groups

Item No. 5, Page 1 of 25 having particular expertise in relation to access to premises or facilities for persons with varying disabilities. 3.3. Details of the representations received during the consultation period together with the ARO’s comments on these responses are set out in Appendix B (pages 16 to 19). Despite representations having been sought from individuals and groups representing disabled persons no responses have been received in respect of the review. 3.4. For the reasons set out in Appendix A, a change to the polling station at is proposed. This reflects the desirability of (i) using the new facility in the village; and (ii) not using school premises where there is a suitable alternative. 3.5. It is also worth drawing the Committee’s attention to the facts that (i) in , and in respect of both the Burford and Fulbrook polling districts, the inclusion of both St John the Baptist Church and the Warwick Hall reflects the fact that the latter is not expected to be available for use at the elections scheduled for May 2015 and May 2016; and (ii) both the Corn Exchange and Langdale Hall have been included in respect of Polling District Witney South No. 2 because of the uncertainty as to which will be available/used in May 2015. 3.6. It should be noted that the draft Parliamentary Polling Districts and Polling Places Order set out in Appendix C (pages 20 to 25) has been produced in line with the recommendations of the Electoral Commission by designating specific buildings or areas as the polling place. 3.7. It is important to point out that in the Order the term “Polling Place” refers to the building or area within which electors would vote and does not refer to the specific Polling Station which is a separate although related issue. 3.8. The Electoral Register to be published on 1 December 2014 will reflect any necessary changes that may be required to the Register resulting from the review. 4. SPECIFIC ISSUES FOR CONSIDERATION 4.1. The following require the Committee’s specific consideration. Polling Place for Broadwell and Kencot 4.2. As explained in Appendix B, the meeting will be updated with any view from the Broadwell Parish Meeting in respect of the possible use of The Carter Institute at Kencot rather than The Old School at Broadwell. It is worth mentioning that Broadwell has the larger electorate but that the two buildings are only around half a mile apart, meaning that the inconvenience of any change would hopefully be minimal. Polling District/Polling Place in Witney Central Ward 4.3. The attention of the Committee is drawn to the comments relating to Witney Central Ward which are set out in Appendix B. My immediate view was not to support the suggestion of an additional polling place in the Ward because (i) the polling provision is adequate; (ii) it will always be the case that some electors are closer to their allotted polling station than others; (iii) the distance from the Marriotts flats to Tower Hill School is actually less than to the Langdale Hall; (iv) an additional polling place would add to our costs; and (v) at no time have any other representations been made. 4.4. In response, Councillor Coles has made the perfectly reasonable points that (i) his aim is to make voting as easy as possible for residents; and that (ii) turnout in parts of the area more distant from the existing polling station has been very low. 4.5. My final conclusion is reflected in recommendation 2(e) above. Whilst it would potentially

Item No. 5, Page 2 of 25 be possible to make a change (if such were decided) ahead of the May 2015 elections, it would not be possible ahead of the register publication date of 1 December 2014, and would therefore necessitate the re-publishing of the entire electoral register in February or March, which has significant implications, including for political parties and candidates. The recommendation will enable in depth consideration and consultation, and it will be possible if desired to make amendments to that polling district only, ahead of the next full review of polling districts and places, which has to be undertaken in the sixteen month period beginning with October 2018. 5. ALTERNATIVES/OPTIONS 4.6. The review and the subsequent publication of the Parliamentary Polling Districts and Polling Places Order is statutorily required. 4.7. The Committee could choose to amend the order as it saw fit, subject to publication being within the overall necessary timescales. 6. FINANCIAL IMPLICATIONS 5.1. There are no direct financial implications in relation to the review itself. The costs incurred in carrying it out were mandatory, were within the figure reported to the Committee at the meeting held on 26 June 2014, and have been accommodated within existing budgets. 5.2. Should any decision be taken in the future to hire portable buildings for use as polling stations in parishes where there is currently no provision within the parish, this would have budgetary implications of which could be up to £2,000 per venue. 7. RISKS Failure to complete the review and publish the revised Parliamentary Polling Districts and Polling Places Order would be a breach of the Council’s statutory duties. 8. REASONS To comply with the statutory requirement to conduct a review of polling districts and polling places.

West Oxfordshire District Council Representation of the People Act 1983 – Section 18(C) – Review of Polling Districts and Polling Places 2014 Representations of the Acting Returning Officer for the Parliamentary Constituency of Witney NOTES: 1. A Polling District is a geographical sub-division of an electoral area, i.e. a UK Parliamentary Constituency, a European Parliamentary electoral region, a ward of an electoral division. In England each parish is to be a separate polling district. Where a Town/Parish council is split into Wards, Polling Districts are situated within the Ward. The District Council is responsible for designating Polling Districts. 2. A Polling Place is the building or area in which polling stations will be located. The Polling Place for a Polling District must be in an area of that district except where special circumstances make it desirable to designate an area outside that district. The Polling Place must constitute a small enough area so that electors will not have difficulty finding the polling station. Although there is no legal definition of what a polling place is and the Act states that where no polling place is designated the polling district becomes the polling place, the Electoral Commission recommends that Polling Places always be defined and for that reason it is recommended that the previous policy of designating the polling district as the polling place is changed and the polling places have therefore been designated in the table below in line with the Electoral Commission recommendation. The District Council is responsible for designating Polling Places. 3. A Polling Station is the actual area where the process of voting takes place, and must be located within the Polling Place designated for the particular Polling District. It should be noted that in unforeseen circumstances it may be necessary to change the location of a polling station and the polling place. The Returning Officer is responsible for designating Polling Stations. Electoral Commission guidance states that no polling station should have more than 2,500 electors allocated to it. In West Oxfordshire many of the polling stations have less than 1,000 electors and no polling station has more than 1,900 electors. 4. The representations set out in the following table give details of the existing Polling Districts and Polling Places together with the proposed designated Polling Places together with details of existing polling stations together with any alternatives that have been identified and other comments. Polling Station Owners have been asked for confirmation of availability for the foreseeable future & possible problems have been highlighted in the table.
