I. INTRODUCTION

A. Background

1. Government of Madhya Pradesh (GOMP) with a sector project loan funding from Asian Development Bank (ADB) has proposed to implement Madhya Pradesh Urban Services Improvement Project (MPUSIP), herein after referred as ‘Project’. Madhya Pradesh Urban Development Company Limited (MPUDC) shall be the Implementing Agency and the State Urban Development and Housing Department (UDHD) shall be the Executing Agency for the Project. A project management unit (PMU) created under MPUDC is implementing MPUSIP.

2. The Resettlement Framework for MPUSIP outlines the objectives, policy principles and procedures for land acquisition, if any, compensation and other assistance measures for Displaced Persons / Affected Persons,1 if any. This framework reflects the borrower’s law on the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013, state government policies, ADB’s Safeguard Policy Statement (SPS), 2009 and other social safeguard guidelines. A detailed description of compensation measures and assistance is provided in the entitlement matrix.

3. An entitlement matrix, consistent with the existing norms and guidelines of the country and the state government, and ADB’s Safeguard Policy Statement has been prepared to cover losses identified in this Project. The matrix recognizes that the lack of title/customary rights recognized under law will not be a bar to entitlement and has special provisions for non-titled persons. The eligibility for compensation will be determined through a cut-off date. People moving into the sub-project area after the cut-off date will not be entitled to compensation or other assistance.

4. Madhya Pradesh Urban Services Improvement Program (MPUSIP) proposed to be funded by Asian Development Bank (ADB) envisages provision of sustainable water services to 128 towns in the State out of which provision of sewerage and storm water management services is proposed in 10 towns. The State Urban Development and Housing Department is the Executing Agency while the Madhya Pradesh Urban Development Company (MPUDC) Limited is the implementing agency for the Program.

B. Project Description

5. As per revised procurement plan, MPUSIP’s physical components include (a) improvements to water supply scheme in 69 subproject towns, and (b) sewage collection and treatment services proposed in four (4) identified towns namely Saikheda, Sanawad, Anjad and Badwaha under Phase I while in Phase II – water supply scheme in 59 subproject towns and sewage collection and treatment services proposed in eight towns namely Sanchi, Dhamnod, Mandsaur, Nagda, (part-II), , & Rajnagar. The objective of the proposed improvements in subproject towns is to achieve safe and sustainable water services both in terms of services to customers, cost recovery and conservation of precious water resources. The project proposals envisage providing 100% coverage of population with continuous, pressurized and safe drinking water services and achieving

2 progressively increasing cost recovery by expanding the coverage and increasing operating efficiency. The main objectives of the Project are as follows:

(i) Supplying pure drinking water. (ii) Promote sustainable measures to increase potable water supply to the population. (iii) Water supply through future sustainable source developments. (iv) Water supply through improvements of safe yield of existing water sources. (v) Water supply through improvements to water treatment works. (vi) Drinking water supply contributes towards a sustainable regional development. (vii) To improve the current state of the water cycle of subproject through improvements in the separate components of the water supply system in investment program.

C. Scope of this Report

6. This draft land acquisition and involuntary resettlement due diligence report is prepared for the proposed group water supply scheme for Satai and Bijawar Nagar Parishads located in and Khargapur and Jatara Nagar Parishads located in . Proposed subproject components involving new construction or civil work include: (i) Anicut of 362 m length and 4.5 m height and intake well of 8 m dia and 6 m height proposed on Dhasan river, (ii) Raw water rising main of 258 m length and 300 mm dia DI K-9 pipe, (iii) water treatment plant with 6.71 MLD capacity, (iii) clear water feeder mains of about 104475 m; length, (iv) Seven Over Head Tanks (OHTs) are proposed for scheme - one for town Satai with 50 KL capacity, three numbers for town Bijawar with 250 KL, 250 KL and 150 KL capacities, one for town Khargapur with 100 KL capacity and two numbers for town Jatara OHT with 500 KL and 300 KL capacities are proposed (v) distribution network pipe laying (114,733 m); and (vi) house service connections in each subproject towns. All municipal wards of the subproject towns will be covered under the project. Total population of town Satai, Bijawar, Khargapur and Jatara, as per census 2011, is 10592, 20513, 14813 and 17499 respectively and estimated on which it is designed for the year 2048 will be 17818, 31315, 24500 and 27320 respectively.

7. A due diligence process was conducted to examine the land acquisition and resettlement issues in detail, in line with ADB SPS 2009. This report describes the findings and provides copies of relevant documents, resolutions, minutes of meetings and photographs. This land acquisition and resettlement due diligence report needs to be read along with the Resettlement Framework prepared for MPUSIP.

8. Involuntary resettlement impacts will be reconfirmed again after completion of detailed design and detailed measurement surveys (DMS) which will be conducted by Design Build and Operate (DBO) Contractor, PIU and project consultants before initiation of civil works during implementation.2 Executing Agency will be responsible for submission of the updated social safeguard document to ADB for No Objection. The final involuntary resettlement report will be reviewed and disclosed on website of urban local body (ULB), implementing agency and ADB. The implementing agency is responsible to hand over the project land/site to the contractor which should be free from all encumbrances.

Report (involuntary resettlement DDR / RP for different sites/stretches will be prepared and submitted to ADB for approval; prior payment of compensation to permanent and/or temporarily impacted persons is mandatory before start of civil work at each site/alignment stretch.

II. POLICY FRAMEWORK, AND ENTITLEMENTS

9. The Resettlement Framework prepared for MPUSIP sets out the objectives, principles, eligibility criteria and entitlements for APs, based on ADB SPS, 2009 and LARR 2013 as well as national and state laws for protection of street vendors. Until recently, all activities related to rehabilitation and resettlement in the State of MP had been based on the Madhya Pradesh Resettlement and Rehabilitation Policy, 2002 (MPRR) and National Rehabilitation and Resettlement Policy, 2007 (NRRP-2007). GOMP adopted LARR 2013 on 3 October 2014 with some specifications for operationalizing its implementation in the state.3 Details of policies are in the Resettlement Framework for MPUSIP.

III. SUBPROJECT DESCRIPTION

A. Description about Subproject Towns

10. As mentioned earlier, group WSS for four towns Satai, Bijawar, Khargapur and Jatara is framed with common water source and WTP. Description about each subproject town is as follows:

11. Subproject town Satai: Satai Nagar Parishad is an ancient town which is about 28 kms away from Chhatarpur, district head quarter town. As per census data of 2011, the total population of the town is 10592. This town is divided into 15 wards and has population of 10592 of which 5,509 are males while 5,083 are females as per Census India 2011. Population of children with age of 0-6 is 1678 which is 15.84% of total population of Satai town. In Satai town, female sex ratio is of 923 against state average of 931. Child sex ratio in town is around 842 compared to Madhya Pradesh state average of 918. Literacy rate of Satai town is 63.01% lower than state average of 69.32%. In Satai town, male literacy is around 73.42% while female literacy rate is 51.92%. The area of the town is spread over 23.49 Sq. kms. and is situated between 24043’17’’N 79037’56’’E in the plateau. This region is surrounded by small hills forming ridges and valleys. It is about 170 km from Sagar, the divisional head quarter. Nearest market centre is Chhatarpur which is about 28 kms and nearest railway station is Khajuraho (43 Kms). The region is rich in mineral deposits. The main agriculture crops of this area are soyabean, wheat, arbi and ground nut.

12. Subproject town Bijawar: Bijawar is a Nagar Parishad in Chhatarpur district in the state Madhya Pradesh, India. The Nagar Parishad is spread over 25.74 Sq.km. This town is divided into 15 wards and has population of 20513 of which 10838 are males while 9675 are females as per Census India 2011. Population of children with age of 0-6 is 2942 which is 14.34% of total population of Bijawar town. In Bijawar town, female sex ratio is of 893 against state average of 931. Moreover, child sex ratio in town is around 909 compared to Madhya Pradesh state average of 918. Literacy rate of Bijawar town is 74.32% lower than state average of 69.32%. In Bijawar town, male literacy is around 82.23% while female literacy rate is 65.43%. This town is located between Latitude 24.630N and Longitude 79.50E. 13. Social safeguards document for the package will be updated by PMC in coordination with DBO contractor.

4 of Madhya Pradesh. Town Khargapur is geographically located at 79.150C East Longitude and 24.82 0C North Latitude at a height of 337m above Mean Sea Level (MSL). The Nagar Parishad is spread over 0.43 Sq.kms. This town is divided into 15 wards and has population of 14813 of which 7915 are males while 6898 are females as per Census India 2011. Population of children with age of 0-6 is 2225 which is 15.02% of total population of Khargapur town. In Khargapur town, female sex ratio is of 872 against state average of 931. Moreover, child sex ratio in town is around 807 compared to Madhya Pradesh state average of 918. Literacy rate of Khargapur town is 70.01% lower than state average of 69.32%. In Khargapur town, male literacy is around 77.54% while female literacy rate is 61.48%.

14. Subproject town Jatara: Jatara is a Nagar Parishad town in Tikamgarh district of Madhya Pradesh and 42 kms away from Tikamgarh town. The Nagar Parishad is spread over 21.25 Sq.kms. Jatara is located at 25.020 N 79.050 E. It has an average elevation of 246m (807 feet). It is situated near Khajuraho and . This town is divided into 15 wards and has population of 17499 of which 9075 are males while 8424 are females as per Census India 2011. Population of children with age of 0-6 is 2542 which is 14.53% of total population of Jatara town. In Jatara town, female sex ratio is of 928 against state average of 931. Moreover, child sex ratio in town is around 893 compared to Madhya Pradesh state average of 918. Literacy rate of Jatara town is 73.18% lower than state average of 69.32%. In Jatara town, male literacy is around 80.25% while female literacy rate is 65.61 %.

B. Existing Water Supply

15. Subproject town Satai: Presently the main source of water supply in the town are tube wells located in various parts of the town. There are 7 tube wells out of which 5 nos. tube wells are running throughout the year.

16. The water is being supplied to the town after preliminary treatment of chlorination. There is one overhead tank of capacity 480 KL in Satai. The condition of overhead tank is structurally good. Water is stored in overhead tank through pumping from tube wells. There are total 15 Wards in Satai Nagar Parishad. Satai Nagar Parishad supplies approximately 0.51 ML of water per day from all sources. There is one overhead tank of 480 KL capacity in Satai. Water from two tube wells is stored and then distributed to seven wards of the town. Remaining five wards are getting water through direct supply from tube wells. Rests of three wards are getting water from hand pumps. The duration and frequency of water supply is one hour in per day. The per 5 capita supply of water is 40 LPCD. Existing distribution network in the town with AC/CI pipes of Diameter 80 mm to 200 mm. The coverage of Distribution network is only 40% in the town.

17. Subproject town Bijawar: Presently the main source of water supply for the town is ground water extracted from tube wells located in various parts of the town. There are 14 nos. tube wells running throughout the year.

18. The water is being supplied to the town after preliminary treatment of chlorination. There are 15 Wards in Bijawar Nagar Parishad There is one overhead tank of capacity 200 KL in Bijawar. The condition of overhead Circular tank is structurally good. Water is stored in overhead tank through pumping from tube wells. Bijawar Nagar Parishad supplies approximately 0.85 ML of water per day from all sources. There is one overhead circular tank of 200 KL capacity in Bijawar. Water from two tube wells is stored and then distributed to five wards of the town. Remaining five wards are getting water through direct supply from tube wells. Rests of five wards are getting water from hand pumps. The duration and frequency of water supply is one hour per day. The per capita supply of water is 34 lpcd. Existing distribution network in the town with AC/CI pipes of Diameter 80 mm to 200 mm. The coverage of Distribution network is only 45% in the town.

19. Subproject town Khargapur: Khargapur town is facing a water shortage. The water problem becomes very acute during the year of scanty rainfall. At present, to cater the water needs of this population, 0.70 MLD per day of water is supplied through tube wells. There are 06 tube wells in the city and these tube wells run throughout the year.

20. The water is being supplied to the town, after preliminary treatment of chlorination. There are 15 wards in Khargapur Nagar Parishad. One overhead tank of total capacity 500 KL are in use. Water is stored in the OHT (500 KL) through which it is supplied to nine wards of Khargapur Nagar Parishad. In the remaining area it is distributed direct by pumping from tube wells. At present, taking into account 20 % transmission & distribution losses, 40 lpcd of water is being supplied in Khargapur. One of the major problems of water supply is the absence of treatment facility. Existing distribution network in the town with AC/CI pipes of diameter 80 mm to 200 mm. The coverage of distribution network is only 60% in the town.

21. Subproject town Jatara: Jatara town is facing water shortage. Water problem becomes very acute during the year of scanty rainfall. At present, to cater the water needs of this population, 0.78 MLD per day of water is supplied through 06 tube wells. There are 06 tube wells in working that run throughout the year.

22. Water is supplied one hour on alternate day at the rate of 45 LPCD, taking into account 20% transmission and distribution losses. Town has two OHTs and one GSR for storage facilities. Ground water is the source of water supply. Water is extracted and is supplied through 7 km, AC/CI pipes of diameter 80 mm to 200 mm distribution network. Presently there is no water treatment plant in the town.

C. Proposed Water Supply

23. The proposed Group Water Supply Improvement Project aims to bridge the gap in urban demand, set right the inadequacies in the existing system and provide a safe, reliable, sustainable and increased access to improved water supply service for the city’s residents. The primary objective of the proposed service improvements is to achieve (i) safe and sustainable water services both in terms of services to residents and cost recovery, and (ii) conservation of precious water resources. The project envisages 100 percent coverage of population with continuous, pressurized and safe drinking water services and achieving progressively increasing cost recovery by expanding coverage and increasing operating efficiency.

24. The proposed subproject components of towns Satai, Bijawar and Khargapur and Jatara group water supply scheme includes:

(i) Source: There is only one surface source i.e. Dhasan River which can be taken as reliable source for Satai, Bijawar, Khargapur and Jatara towns. Dhasan River is about 37 km from Satai, 21 km from Bijawar, 22 km from Khargapur and 59 km from Jatara. (ii) Anicut: An Anicut 362m long and 4.5m height at Dhasan River near village Badkhera is proposed for getting 2.74 MCM of raw water for the 8 months requirement of these towns. (iii) Intake well cum pump house: On the bank of Dhasan River near village Badkhera, R.C.C. intake well of 8m diameter and 6 m height is proposed to collect and lift water up to treatment works. (iv) Raw Water Rising Main (RWRM): The proposed RWRM is 258m long 350mm dia. DI K9 from proposed from Intake well to WTP. (v) Raw Water Pump: Two nos. vertical turbine type pump with 100% as standby is proposed at Intake well. The rating of each pump is 11 KW. (vi) Water Treatment Plant (WTP): There is no WTP in any one of the subproject towns. A common WTP for subproject towns having capacity of 7.16 MLD considering 22hrs. of pumping has been proposed for the ultimate year of 2048 near village Badkhera. Source, Anicut, Intake well, RWRM and WTP is common for subproject towns. (vii) Clear Water Feeder Main (CWFM): Total Clear water feeder mains of 104475 m long and 100 to 250 mm DI K-9 pipe. Where 5051 m long 100 mm DI K-9 pipe, 21967 m long 150 mm DI K-9 pipe, 30431 m long 200 mm DI K-9 pipe and 47026 m long 250mm DI K-9 pipe

(viii) Overhead Tank (OHT): For town Satai, one OHT of 50 KL capacity is proposed; for town Bijawar, three OHTs with 250 KL, 250 KL and 150 KL capacities are proposed; for town Khargapur one OHT of 100 KL capacity is proposed and for Jatara town two OHTs with 500 KL and 300 KL capacities are proposed. (ix) Zoning and Distribution Line: These four subproject towns Satai, Bijawar, Khargapur and Jatara has been divided into zones like 2 nos., 4 nos., 2 nos. and 2 nos. of water supply zones respectively. Total length of the proposed network is around 118691m of diameter 110 mm to 280 mm. Details are as follows:

IV. FIELD WORK AND PUBLIC CONSULTATION

26. This involuntary resettlement document is prepared in consultation with stakeholders including local residents, beneficiaries/consumer, and Urban Local Body (ULB) officials/representatives. Informal consultations and focus group discussions (FGDs) were conducted to seek feedback from local people and other important stakeholders on the proposed development interventions, perceived impacts and mitigation measures and their participation.

A. Outline of Fieldwork

27. During the visit, a field inspection of proposed subproject facility locations and pipeline alignments that had been identified was undertaken in each of the subproject town. These included field visit to the identified sites and alignments and stakeholder consultations. The entire land requirement for the proposed subproject component will be fulfilled by government lands. The details of selected lands for subproject components are given in the Appendix-1 and Appendix 5.

B. Field work Report

28. Meetings were held with the concerned ULB Officials, Public Representatives, Stakeholder and prominent resident of subproject town to collect data / information for proposed subproject during various discussions/meetings (refer to Appendix 2 and 3).

(i) During the meeting and discussion, information on the present situation of water supply in the town and the requirement of the stakeholders, were gathered. Based on present water supply arrangements and gaps arrives are well documented. (ii) With the ULB authorities, all the possible water supply sources and identified locations for all other the components of water supply scheme, were visited. (iii) All the options of possible water supply source, its dependability, quality assurance of source available and the distance from the town, were studied. (iv) Water from the selected source was collected and tested from the Laboratory of Bhopal Municipal Corporation Laboratory, Bhopal. Also test report is obtained for designing purpose. (v) Water security is ensured in consultation with the concerned department like WRD etc. such that best-chosen water source is made available to ULB for the purpose of water supply scheme. (vi) Revenue authorities were contacted to ensure the land acquisition, secured in the ownership of ULB or Revenue Department Govt. of Madhya Pradesh for WTP and Service Reservoirs.

C. Public Consultation

29. Extensive consultations were undertaken with key stakeholders in line with ADB's requirements pertaining to environment and social considerations. Focus group discussion (FGD) conducted at nearby of proposed locations of Intake Well, WTP and OHT etc. The outcome of focused group discussion with stakeholders in the town and the line departments (persons involved in Infrastructure like water, waste water and allied services - Engineers and

12 workers of Local Body, water resource department (WRD), public works department (PWD), national highways, district administration and others. Thus, representatively various problems ahead may encounter to public during pre and post execution of work considers and after discussion with concern authorities' necessary mitigation measures are well considered (refer to Appendix 2). Tools used for consultation were stakeholder meetings. The following were the outcomes of consultations:

(i) The consultations helped to identify the felt needs /concerns and apprehensions of the communities related to the project and priorities of concerned stakeholders. (ii) Consultations revealed that people are aware of the problems of the existing water supply system in the town and are willing to cooperate in the proposed project. (iii) Consultations with the key stakeholders revealed that existing water supply system is in a pathetic condition, so improvement is required and local inhabitant will definitely and fully accept the project.

30. The major stakeholders targeted during consultations are:

(i) The municipalities, its elected members and staff who will be required to oversee the construction of the distribution networks and WTP as well as be directly responsible for the maintenance of the installations. (ii) Local residents who will take initiative to connect their houses with the water distribution line. (iii) Local business people and traders. (iv) The opinion makers are intimately acquainted with and well regarded by the community. They need to be enlisted in spreading environmental awareness within the community as well as in conveying the benefits of the project.

V. LAND AVAILABILITY AND INVOLUNTARY RESETTLEMENT IMPACTS

31. No land acquisition or involuntary resettlement impacts are anticipated for any of the identified sites for proposed civil works under group WSS for towns Satai, Bijawar, Khargapur and Jatara. Land identified for subproject components is government land which is reported vacant, unused, without any settlement / squatter / cultivation or other use.

32. Dhasan River is the only surface source of water which can be considered as a dependable source to fulfil the present and future demand of the subproject towns. As there is no other reliable source in the vicinity of the subproject towns, hence a group water supply scheme from Dhasan River has been planned for these towns. An anicut of 362 m long and 4.5 m in height is proposed on Dhasan river.

33. Raw water abstraction for all the four towns is proposed from Dhasan River. Dhasan River has sufficient flow upto month of November. Hence a storage reservoir is required for almost 8 months of the year. The water is then proposed to be treated and supplied to the town. Intake well is proposed to draw raw water from Dhasan River at upstream of proposed Anicut for the ultimate year (Year 2048) with suitable pumping arrangements. The land is vacant and without cultivation, the permission for abstraction of water and construction of anicut and Intake well on Dhasan river is to be taken from water resource department (WRD). There is no downstream impact on Dhasan River as our requirement is only 8.43 MLD. Hence, sufficient water will also be available for downstream users. No fishing and any other activity is reports; upstream or 13 downstream. There is proposed R.C.C. intake well of 8 m diameter and 6 m height to collect and lift water up to treatment works. The land required for proposed Anicut and intake well is owned by WRD, process to obtain NOC from WRD is in progress. No involuntary resettlement impacts are anticipated as a result of this proposal.

34. The proposed raw water rising main (RWRM) is 258 m long 350 mm dia. DI K9 from proposed Intake well to proposed WTP. Proposed alignment of RWRM will be laid within the right of way (ROW) of existing road, which belongs to revenue department and reported earthen road. The pipes will not cross any private land throughout the alignment.

35. A common water treatment plant (WTP) of capacity 7.16 MLD is proposed to be constructed near village Badkhera. The land required for WTP comes under village Badkhera and is owned by the revenue department Government of Madhya Pradesh. Land transfer is required from the revenue department.

36. Total Clear water feeder mains of 104475 m long and 100 to 250 mm DI K-9 pipe. Where 5051 m long of dia 100 mm, 21967 m long of dia 150 mm, 30431 m long of dia 200 mm and 47026 m long of dia 250mm DI K-9 pipe is proposed, will be laid within right of way of existing roads. Proposed alignment of CWFM will be laid within the ROW of earthen road of revenue department, Pradhan Mantri Gramin Sadak Yojna (PMGSY), Public Works Department (PWD), State Highways, Madhya Pradesh Road Development Corporation (MPRDC), National Highways Road. No objection certificate is to be obtained from these departments. Enroute villages namely Gulganj, Amron Tiraha and Kasra reported on Satai road, while on Bijawar road, villages namely Gulganj, Rajpura, Maukhera and Bhatpura are reported as enroute villages. On Khargapur road, Maukarwaha, Danpura, Malgaoun, Gargauli and Manpatar villages are reported and on Jatara road, Band Tigdadha and Baldevpur etc. are reported as enroute villages. Proposed alignment will cross any private land throughout the alignment.

37. One OHT of 50 KL capacity is proposed for town Satai water supply, for town Bijawar, three OHTs with 250 KL, 250 KL and 150 KL capacities are proposed; for town Khargapur one OHT of 100 KL capacity is proposed and for Jatara town two OHTs with 500 KL and 300 KL capacities are proposed. Identified land for proposed OHTs belong to revenue department, Government of Madhya Pradesh. One OHT of 100 KL is proposed for Khargapur, the land belongs to Revenue Department, Government of Madhya Pradesh.

(i) OHT-50 KL is proposed in ward number 10 at town Satai. Proposed site belongs to revenue department with Khasra number 1024/1. (ii) Three OHTs with 250 KL, 250 KL and 150 KL capacities are proposed at Bijawar. All proposed sites belong to revenue department with Khasra number 2484, 1937 and 1347 under ward number 12, 7 and 1 respectively. (iii) OHT-100 KL is proposed in ward number 15 at town Khargapur. Proposed site belongs to revenue department with Khasra number 279. (iv) Two OHTs with 500 KL and 300 KL capacities are proposed at Jatara. All proposed sites belong to revenue department with Khasra number 2710/1164/2 and 203 under ward number 15 and 3 respectively. OHT (500 KL) will be constructed at Kund Pahadi, Narsingh under ward no. 15 while another OHT (300 KL) will be constructed at Gadaryana Muhalla Indra Ward No. 03.

38. It is pertinent to mention that all proposed site/land is without any settlement/ squatter /cultivation or others. Therefore, no involuntary resettlement impact is anticipated.

39. The proposed distribution network 118691 m of new pipelines) in all these subproject towns will be laid. The proposed distribution pipelines will be laid within the road ROWs of respective nagar parishads and is not anticipated to cross private land anywhere in the town. Details of land ownership for each of the proposed water supply components to be constructed are given in Appendix 1. Pipe laying activity on roads in the most congested market areas and densely built-up areas has been carefully planned to avoid involuntary resettlement impacts including temporary economic impacts to hawkers, shops and businesses. Mobile hawkers and vendors have been witnessed along the road side for a significant part of the distribution network alignment.

40. Civil works in the project include linear excavation for laying pipes along the roads, placing pipes in the trench and refilling with the excavated soil. The trenches will be 0.4 m – 0.7 m wide and 0.8 to 1 m depth. Subsequent to completion of works, road reinstatement will be undertaken by the contractor as part of the civil works. No necessity for full closure of roads is identified.

41. Laying of gravity mains and distribution network pipelines in the project area has been carefully planned to minimize disturbance to pedestrians and traffic and avoid income loss to businesses. Measures will be taken to minimize excavation, disturbance to pedestrians and traffic and avoid income loss to businesses through provision of planks for access, while minimizing road reconstruction costs. Temporary impacts to traffic/access to shops and residences due to digging of pits for trenchless pipe laying are possible during construction; however, these will be mitigated by ensuring access to properties through provision of pedestrian planks, provision of adequate signage, and careful traffic management. Mobile hawkers will be assisted to move to places nearby, to ensure their earnings are not affected. The proposed distribution network will pass through a mandi (weekly vegetable/fruit market) in old town. The weekly market day will be avoided for construction. Only mobile vendors will be shifted to nearby locations during the period of construction and assistance to shift from and back to their original location will be provided by the contactor, as required. No income loss is anticipated.

42. Mitigation: The sites or locations for the subproject components have been selected carefully to avoid and minimize involuntary resettlement impacts. The following mitigation measures are proposed to avoid and/or reduce the impacts during linear pipe works:

(i) Provide prior advanced notice (minimum one week) to community along the construction stretch. Distribute information on project and grievance redress mechanism, (ii) Maintain access to avoid disturbance to residents and businesses by providing planks and leaving spaces for businesses and residents to maintain access, (iii) Manage traffic flows as per traffic management plan prepared by the contractor in coordination with local authorities and communities, (iv) Limit the amount of time of open trenches, and complete works quickly where business activities are located, (v) Avoid full street closure to extent possible, (vi) Contractors shall provide employment opportunity to the local residents and particularly woman where possible, and (vii) Contractors shall assist vendors and hawkers in shifting to alternative locations, if required.

43. This subproject does not have any involuntary resettlement impact as there will be no physical or economic displacement. The subproject will have no adverse land acquisition impacts as the subproject components are proposed at public land which is revenue land and does not belong to tribal community. Transmission and distribution pipeline carry raw and clear water will traverse only through right of way (ROW) of the government roads. Keeping in view, no involuntary resettlement impacts will likely to be envisaged, an involuntary resettlement screening checklist is prepared and attached as Appendix 4. Accordingly, the subproject is classified under ‘Category C’ for involuntary resettlement under ADB’s SPS-2009.

VI. BUDGET

44. A provisional budget for consultation, communication, grievance redress, awareness generation, and mitigation measures such as tanker supply to existing consumers if supply is affected during construction is included in the DDR and overall subproject costs for both the towns separately.

VII. CONCLUSIONS

A. Summary and Conclusions

45. No negative involuntary resettlement impacts are assessed at identified sites for sub- project components, as adequate vacant land is available for the proposed facilities, within the compounds of government lands. Anicut and Intake well is proposed on Dhasan River and NOC for that is under approval. The site proposed for WTP near village Badkhera belongs to Revenue Department, Government of Madhya Pradesh. The site for all the seven new OHTs is in possession of revenue department Government of Madhya Pradesh Linear components (pipe laying) are proposed within government road ROWs. Temporary disruption to road users, pedestrians and community members will be avoided in the most congested zones of both the towns with proper traffic management, with the help of local police and officials. Safety measures shall be taken during construction to avoid injuries. Inconvenience to the public shall be mitigated during construction by the contractor through simple measures such as provision of planks for pedestrian access to shops, coupled with effective traffic management. A budgetary provision is made for costs likely to be incurred for updating and implementation of this DDR.

B. Compliance with Involuntary Resettlement DDR Requirements

46. The DDR needs to be updated with the following information:

(i) NOCs from WRD Department for abstraction of water from Dhasan river and construction of proposed Anicut and Intake well on river Dhasan near Badkhera village, (ii) NOC to be obtained from National Highways, MPRDC, State Highways, PWD, PMGSY and revenue department to lay the transmission pipeline within the ROW of existing roads (iii) Transfer of the identified government land for proposed components in the name of concerned Nagar Parishads, (iv) Land Status Certificate issued by office of the Chief Municipality Officer concerned of each Nagar Parishad (v) Consultations to be conducted with enroute villages reported under proposed alignment of CWFM (vi) In addition to the above, in order to improve the quality of consultations, local community organizers will be appointed for Project under package; record of consultations held with local communities and other stakeholders to be included in updated/final DDR. (vii) Layout plans for proposed facilities shall be provided in the updated DDR, (viii) This is draft DDR, to be updated during detailed design.
