    Second Hemispheric Report on the Implementation of the Belém do Pará Convention Follow-up Mechanism to the Belém do Pará Convention (MESECVI) April 2012 The Organization of American States (OAS) brings together the nations of the Western hemisphere to promote democracy, strengthen human rights, foster peace, security and cooperation and advance common interests. The origins of the Organization date back to 1890 when nations of the region formed the Pan American Union to forge closer hemispheric relations. Carter University of Virginia Over the last twenty years there has been a proliferation of audiovisual works representing urban poverty, violence, and race in Brazil. During the same period, critics have devoted a significant amount of time to discussing the types of violence portrayed and the aesthetic constructions used for their varied representations, while also taking into account some of their political consequences. For example, while scholars such as Ivana Bentes (2005), Beatriz Jaguaribe (2005), Tânia Pellegrini (2005), Lúcia Nagib (2003), Emanuelle Oliveira (2009), and Sophia A. McClennen (2011) have dealt with questions of aesthetics, others, like Esther Hamburger (2007), have directed their attention to matters of production and the broader dispute for the control and appropriation of the mechanisms of production—that is, who controls and produces these representations and how they do it. Taking on both the complex matter of individuals representing themselves and the aesthetics of contemporary representations of violence, João Cezar de Castro Rocha (2005) proposed the “dialectic of marginality.” In contrast with Antonio Candido’s “dialectic of malandroism” (dialética da malandragem), which outlines a process wherein the marginalized individual is brought into the legal and ordered public sphere, the “dialectic of marginality” does not reconcile differences, but rather Carter 80 points them out and refuses “to accept the improbable promise of compromise between the tiny circle of the powerful and the expanding universe of the excluded” (Castro Rocha 31).

The Definition of Death Sentence Death sentence or capital punishment is an execution of an offender sentenced to death after conviction by a court of law of a criminal offense. Capital punishment should be distinguished from extrajudicial executions carried out without due process of law.20 Thirty six countries actively practice capital punishment, 103 countries have completely abolished it de jure for all crimes, 6 have abolished it for ordinary crimes only (while maintaining it for special circumstances such as war crimes), and 50 have abolished it de facto (have not used it for at least ten years and/or are under moratorium). The United Nations General Assembly has adopted, in 2007, 2008, 2010, 2012 and 201421 non-binding resolutions aiming for a global moratorium on executions, with a view to absolute abolition.     Global Anti-Bribery Year-in-Review: 2020 Developments and Predictions for 2021 January 28, 2021 2020 ENFORCEMENT TRENDS AND KEY DEVELOPMENTS A. Introduction As was true in many areas of the law, Foreign Corrupt Practices Act (FCPA) enforcement in 2020— and anti-corruption enforcement more generally—was affected by the COVID-19 pandemic, but perhaps not as much as was initially expected. Although the number of Department of Justice (DOJ) and Securities and Exchange Commission (SEC) enforcement actions was down in 2020 compared to recent years, the DOJ and SEC both remained active in enforcing the FCPA, bringing major cases that set new records and issuing new updates to longstanding FCPA guidance. Below are four key developments from 2020: 1. Two New Cases Top the Penalty Charts: The year started with the Airbus case, which set a new record at the time for FCPA penalties. The resolution involved coordination by the United States with French and UK authorities, and resulted in $2.1 billion in penalties.1 In October 2020, however, the Airbus settlement was eclipsed by another record settlement, this time with The Goldman Sachs Group, Inc., which agreed to $3.3 billion in penalties imposed by the DOJ and SEC, becoming the largest combined FCPA penalty on record. This case also involved cooperation by US authorities with a number of foreign law enforcement agencies.2 2.
