EXECUTIVE SUMMARY 624 Stanyan Street San Francisco, California

The site was initially developed with the existing building in the 1910s and has been occupied by various commercial businesses, all apparently involved in some type of automotive related activity. The property is currently occupied by a full service auto repair business. There are no auto body painting operations done at the site.

There have been various automotive repair businesses identified at the site which have historically used, generated, stored or disposed of hazardous materials. There were five underground storage tanks (USTs) associated with the property. Four of the tanks were removed under proper permitting and San Francisco Department of Public Health closed the UST case with No Further Action required. There was no evidence seen physically or in any current documentation by the responsible agencies of the fifth UST. Many original small tanks when replaced in the 1930s, were mainly removed without documentation, and the new USTs installed. If the fifth UST was present, any negative impact from it would have been detected and remediated during the 10 years of LUST investigations and remedial operations carried out at the site to achieve LUST closure.

There currently is use, storage, generation and regulated disposal of automotive related materials at the property. All of the materials are correctly handled and there was no evidence of uncontrolled discharges, leaks, spills, ponding or standing liquids seen.

There are several hydraulic lifts in the building. The operation and removal of such lifts are not regulated. If there is a decision made to remove the lifts, there would be no guidelines, regulations or agency oversight required at this time. If there is significant leakage from the lifts, it could be noted in future investigations of other concerns in the area. The lifts are not regulated because the normal hydraulic fluid used is non-toxic and is not mobile in the soil or groundwater.

The drains, floors, walls and various surfaces seen in the building were clean and there with no accumulations of liquids. There were no indications seen in the building, the sidewalks or on the exterior walls of the building that there are any remaining underground tanks at the site. There is also no evidence that there are or has been any pits, lagoons, wells of any type or septic tanks at the site.

Normal refuse removal is provided by the city regulated waste hauling company. Water and sewer services are provided by municipal utilities. Energy (natural gas and electricity) are provided by the PG&E company.

On-site drainage from the building is into the municipal sewer system via drains, slopes and roof systems. There is no drainage or runoff from any adjacent properties. The site is protected from street runoff by curbs and gutters.

The site as all commercial properties may be subject to the regulations of the Maher Ordinance if there is a change of use as directed by the planning department or the building department. The Maher Ordinance was originated to address situations of environmental concern of sites being converted to more sensitive uses.

The site is located within the Stanyan Street corridor on the boundary of . The areas to the south along Stanyan Street may have had various businesses, such other automotive repair facilities, dry cleaning activities and retail/wholesale outlets which may be environmental concerns to the site as well as to any property in the nearby area. Many such businesses may use, store, generate and dispose of hazardous materials. No Recognized Environmental Concerns were identified in the nearby areas.

This Phase I Environmental Site Assessment report is compliant with ASTM Designation E1527-05, “Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process”; U.S. EPA’s “Standards and Practices For all Appropriate Inquiries” (40 CFR Part 321); and the Federal Small Business Liability Relief and Brownfields Revitalization Act (January 11, 2002). LW declares that all- appropriate inquiries in conformance with the standards and practices have been developed and performed during the preparation of this report.

There are no conditions associated with the property that would require the involvement of any regulatory agency.

Based on all appropriate inquiries carried out during the preparation of this report, it is our opinion that there were Recognized Environmental Concerns (RECs) associated with this property, however all have been addressed and that the RECs have been resolved.

RECOMMENDATIONS There is no evidence that any additional environmental investigation at this site is warranted at this time.

PHASE I ENVIRONMENTAL SITE ASSESSMENT 624 Stanyan Street San Francisco, California

1.0 INTRODUCTION

As authorized, LW Construction Services Inc. (LW) conducted a Phase I Environmental Site Assessment of the property which is known as 624 Stanyan Street in San Francisco, California. The property is a single parcel and is identified as Lot 020 of Block 1227 as shown on the City Assessors web site.

1.1 Purpose The Phase I Environmental Site Assessment is being conducted at this time to provide the existing owners with environmental information and may be used in future planning and financial activities.

1.2 Involved Parties John Carver was the principal research engineer, preparer and reviewer of this Phase I Environmental Site Assessment. A copy of the John Carver resume is attached as part of Appendix B. John Carver is an Environmental Professional (EP) as described in ASTM Designation E1527-00 and U.S. EPA's 40 CFR Part 312. The current property owner is the 624 Stanyan Street LLC, Mr. Larry Nasey, Managing Partner. Currently the property is unoccupied.

The "User" of the Phase I is the 624 Stanyan Street LLC, the current owner of the property.

The User and their agents, may rely upon the contents, conclusions and recommendations of this Phase I Environmental Site Assessment Report in arriving at decisions regarding the property at the time of publication. The data in this report may be time sensitive and should only be relied on for limited time periods. If the information in this report is to be used in any manner after six months of publication, the appropriateness of the Phase I report should be evaluated by LW or a qualified Environmental Professional.

No other parties, other than those designated by the User, may rely on the information herein for any purpose.

A third party vendor, Environmental Data Resources (EDR) compiled addresses and businesses appearing on various regulatory agency lists which could have an adverse environmental effect on the subject property. EDR also provided proprietary copies of Sanborn Insurance Maps of the property, aerial photographs and an abstract of business directory addresses and names.

1.3 Scope of Work The major objectives of the Phase I Environmental Site Assessment are to identify possible environmental concerns related to on-site or nearby chemical use, storage, handling, spillage, and/or on-site disposal, with particular focus on potential degradation of soil or groundwater quality. This assessment also addresses past and present land usage and operating practices at and near the site, and the potential for migration of chemicals, contaminants and toxics onto the site from reported chemical releases on properties in the vicinity of the site or from observed chemical storage on adjacent properties.

The field services portion of this Assessment consisted of a site visit to the property along with a walk through of the nearby area streets. The objectives of the site visit were to inspect the property, observe the present usage of the site from an environmental standpoint, and interview persons knowledgeable about the site.

An historical review of the subject site's prior usage and operations was carried out to identify potential sources and practices which could involve toxic or hazardous materials or conditions. This review included obtaining and reviewing selected aerial photographs interviews of personnel familiar with the site, and review of public historic records. As part of the interview process, an Environmental Questionnaire was completed by the owner and has been attached in Appendix B.

LW obtained and reviewed database contents from Environmental Data Resources of addresses and businesses appearing on various regulatory agency lists which could have an adverse environmental effect on the subject property.

The scope of work for this Assessment did not include sampling or analysis of soil at the property, testing the property for the possible presence of asbestos-containing materials, lead, PCB-containing equipment, natural hazards such as radon and methane gases, or potential damage from earthquake or floods.

Financial information was not collected and reviewed as part of this Assessment as LW Construction Services, Inc. is not qualified for evaluation of such.

It is our opinion that the scope of work carried out during the preparation of this report is in accordance with ASTM E1527-05 standard. A copy of the John Carver Resume and current credentials are attached in Appendix B.

1.4 Data Gaps According to § 3.3.20 of ASTM Standard E 1527-05 a data gap is a lack of or inability to obtain information required by the ASTM Standard despite good faith efforts to gather same. Data gaps may result from incompleteness in any of the activities required by the ASTM Standard. The following data gaps occurred in connection with this report:

2.0 SITE DESCRIPTION

2.1 Physical Conditions The subject site is a rectangular shaped property of about 10,000 square feet located along the east side of Stanyan Street between Oak Street and Page Street in San Francisco, California. The general location of the site is shown on the Vicinity Map, Figure 1 of Appendix A. The site boundaries are shown on Figure 2 of Appendix A.

A plan showing the site with respect to the surrounding properties and streets is shown on the Site Plan, Figure 2 of Appendix A.

The site is occupied with a single building with the address of 624 Stanyan Street. The building occupies 100% of the property.

There is no basement associated with the property. There is a paved sidewalk/access area along the Stanyan Street right of way. Photographs of the site and surrounding area are shown on Figure 3 of Appendix A.

The site is at an elevation of about 256 feet above Mean Sea Level (MSL) as shown on USGS data. In many areas, near-surface groundwater flow direction coincides with topography. Because of the topography of the area the general groundwater gradient of

the area is inferred to be toward the east. A copy of the site area of the USGS data is attached in Appendix A as Figure 4.

The site is located in a Dune Sand deposit, (Qd) which is a naturally occurring sand deposit. Groundwater in the area is thought to be about 50 feet below ground surface.

2.2 Administrative Conditions The property is owned by the 624 Stanyan Street LLC. Currently the property is occupied by the "Ted and Al's Service Center" and is an active auto repair facility.

There are no records of Environmental Liens against the subject street address. The NPL Recovery Database (US EPA) and the Deed Database (Deed Restriction Database maintained by the California DTSC) were reviewed to determine the presence of any environmental associated liens. None were found.

There were no Federal or State environmental "activity or use limitation" (AULs) in place for this property. The negative AUL statement is based on the review of more than 100 databases particularly the U.S. EPA's Engineering Controls and the Institutional Controls. Any State AULs would be included in the DTSC database entitled ENIVROSTOR. There are no Tribal databases in California concerning AULs.

The Maher Ordinance is not a limitation but is a local ordinance which provides environmental guidelines to be used when there is significant soil disturbance at a property or if there is a change of use.

3.0 SITE HISTORY

3.1 General History The site is in an urban mixed/residential area along the partially commercial Stanyan Street corridor of San Francisco. The Stanyan Street corridor is the boundary of the historic and very large Golden Gate Park to the west. The site was developed by 1899 with some type of school complex. By 1913, the exiting structure was on site and was shown to be a garage. The site has remained an automobile use property developed since at least 1913 The most significant uses have been automotive related businesses. There were a total of 5 underground storage tanks (USTs) installed at the property. Four of the USTs have been removed. There was no physical or current evidence of the 5th UST (300 gallons or less, installed in 1911, and replaced by the 4 larger USTs). The 4 USTS had evidence of Leaks and a Leaking UST (LUST) case was opened and after 10 years of action, was closed by the appropriate agencies with No Further Action (NFA) required.

With the exception of the USTs, there is no historical evidence or indication that there have been any discharges, releases or inappropriate activities of any hazardous materials, chemicals or regulated substances at the property.

3.2 Aerial Photograph Review This review involved obtaining and reviewing selected aerial photographs showing the site for the years 1938, 1946, 1956, 1968, 1974, 1982, 1993, 1998, 2005 and 2012. The scale and resolution vary making detail observations of individual properties difficult to impossible. Copies of selected aerial photographs are attached as Appendix C.

The subject site appears and surrounding areas all appear to have been established in their essentially current condition in the 1938 photograph.

3.3 Sanborn Map Review Sanborn Maps have been prepared for the Insurance Industry on a regular basis for parts of the San Francisco area since 1866. They identify the location of infrastructure, major structures and their uses, and other related geographic information. Sanborn Maps covering the time span of 1889 to 1999 for the site were available and were reviewed. The findings of this review are summarized below. Copies of selected Sanborn Maps are included as Appendix D.

3.4 City Directory Review An abstract of various city directories was complied by EDR Inc by scanning old directories. The scans are often unclear and presents data that is open to interpretation. The entries from the EDR research were reviewed and the following found and reproduced without modification. A copy of the City Directory is attached in Appendix E.

Since at least 1940, the site appears to have always been occupied by some type of automotive related business.

3.5 Other Sources Environmental Reports There were no environmental site assessment related reports available for the subject property.

San Francisco Fire Department (SFFD). The SFFD was contacted and visited on January 13, 2014. Both computer files and paper files were requested for the address of 624 Stanyan Street. There were various permits, applications and receipts for the various businesses which have occupied the property since the 1910s. The oldest and most significant item found at the SFFD was a permit application dated January 13, 1911 to install not more than one 600 gallon tank for gasoline. The permit had a notation on it which was dated 10-7-31 indicating that 2-550 gallon and 2 280 gallon USTs were installed. Copies of the permit and notations are included in Appendix B.

San Francisco Department of Public Health The Local Oversight Program (LOP) division of the Department of Public Health (DPH) was contacted. The LOP maintains files relating to storage tanks, hazardous material spills and releases. In January, 2014 Mr. Russell Jin of the DPH contacted LW and indicated that there were files addressing 624 Stanyan Street

John Carver visited the LOP and reviewed the files presented on a CD. There were various documents regarding the removal of four underground storage tanks (USTs) at the site. Because of several holes and high levels of gasoline in the soil, a Leaking Underground Storage tank (LUST) case was opened. There were many documents regarding the various work that was carried out including the installation of three groundwater monitoring wells. After 10 years and two five year reviews by the Regional Water Quality Control Board (The Board), the LUST case was closed by the SF DPH with no further work required. Copies of the 2nd five year review and the DPH closure are included in Appendix B.

The Hazardous Materials Unified Program Agency (HMUPA) was contacted on January 20, 2014. The HMUPA maintains records regarding storage, use and generation of various hazardous materials primarily for commercial properties. Normal turn around time for HMUPA response can be up to three to four weeks. If there are files, they will be reviewed when received, and if any data would affect the conclusions and recommendations of this Phase I, notification will be published immediately.

The review of the various city regulatory files did reveal the one time presence and the subsequent closure of four USTs at the site. The analytical data was reviewed and was found to have been in accordance with regulatory requirements at the time of closure.

3.6 Underground Storage Tank History At some time about 1911, there was one UST installed at the site. Fire Department records from the 1930s then seem to indicate that four tanks were installed at the site. It was typical during that period when there were tanks added to a site, any original and smaller USTs were removed as a matter of course with no documentation. It appears that this was the situation at 624 Stanyan Street.

In 2001 four USTs were removed and found to have leaked. A program of over excavation was carried out, the but there was remaining contamination. As part of the lust program, there was additional profiling of the contamination including the installation of three groundwater monitoring wells. Monitoring continued for about 10 years with apparent reductions in contaminant levels. The case was reviewed by the Regional Water Board and the SF DPH closed LUST case in 2012. Closure documentation is include in Appendix B.

4.0 SURROUNDING LAND USE The property is in a mixed-use neighborhood with the large Golden Gate municipal park across Stanyan Street to the west. Historically much of the area was residential buildings with the site itself being the only auto related business. The area remains mainly residential.

5.0 SITE RECONNAISSANCE INSPECTIONS

5.1 General Site Description The property was observed in order to identify any environmentally hazardous material or conditions. A detailed inspection for asbestos containing materials was not a part of this investigation. A reconnaissance of surrounding properties was made at the same time to determine the presence of underground storage tanks in proximity to the site, and other environmental concerns that may impact the subject site. Photographs of the site and surrounding areas are included in Appendix A as Figure 3.

On January 13, 2014, Mr. John Carver conducted a field inspection of the property in the company of Mr. Buzz Nasey.

The site is occupied with a single building built in the 1910s. The building covers 100% of the property. Concrete sidewalks and driveways into the building are located along the Stanyan Street right of way. There is no basement below the property.

The ground floor is totally occupied by the Ted and Al's Service Center, an auto repair facility. The main activity of the business appears to be engine repairs, engine tune ups and routine maintenance. There was no body work or auto painting seen.

Because of the nature of the business, there are various materials and supplies used which may be or are considered hazardous and regulated. Used motor oil which is a hazardous waste was collected, stored and removed from the site by regulated subcontractors. The storage of the used motor oil was within drums within secondary containment. Used oil filters were contained in a drum for periodic removal as hazardous waste.

The business owner indicated that the solvents currently used are "non toxic" and are used within a protocol that is maintained by an outside contractor which collects used solvents, and provides new solvent on an as-needed basis.

Copies of disposal documentation maintained by the business are presented in Appendix B.

There were several "in ground" hydraulic lifts seen in the business. The owner explained that the lifts were regularly serviced and that any leaks were immediately cleaned up. He did not have any specifics as to the operation or hydraulic oil use of the lifts.

There are no auto painting activities associated with this business.

The floors were in fair condition with no serious cracking, spalling or other deterioration which exposed the underlying soil.

The sidewalk and paved areas along the street frontage of the address, as well as the visible exterior building walls were observed. The interior was also observed for evidence of storage tank presence. There was no evidence, such as fill caps, dispenser systems or signage, of the presence of any existing underground storage tanks (USTs) seen at the property.

Drainage of the building is directed to the municipal drainage system. There is no runoff onto the site from adjacent properties. The site is protected from street runoff by curbs and gutters.

Refuse removal is provided by city controlled contractors Water and sewer services are provided by municipal utilities. Energy (natural gas and electricity) are provided by the PG&E company. No wells of any type, pits, lagoons or septic tanks were seen at the site.

5.2 Nearby Site Reconnaissance The site is located in a residential and retail oriented neighborhood in the western part of San Francisco. The area is dominated by Golden Gate Park just to the west across Stanyan Street.

To the north and adjacent to the site is a 30 unit apartment building. There are also residential buildings to the northeast. Further north is the Golden Gate Park Panhandle and then the Fell Street right of way and more residential properties.

To the east and behind the building is the extension of the Girls and Boys Club complex which fronts on Page Street to the southeast.

Directly south and extending along most of the east side of Stanyan Street are various commercial businesses, such as a cyclery, and restaurants mixed with residential properties. The blocks south of Page Street are residential for about a block and then there are more commercial businesses including a grocery store.

The areas to the west of the site are the open lands of Golden Gate Park.

No active gasoline stations or other businesses which have active underground tanks or fuel distribution systems were seen in the nearby areas. However some of the nearby buildings have been involved with hazardous materials, and may have used underground storage tanks in the past.

Some of the nearby businesses to the to the south as well as residential buildings, may have in the past, currently or may in the future use, store and dispose of various materials, many of which are considered hazardous, including underground tanks for heating oil. However there was no evidence seen of any inappropriate or illegal activities involving such materials.

Figure 2 of Appendix A shows the nearby neighborhood and associated uses of the buildings in the area.

5.3 Suspected Asbestos Containing Material As previously stated, no detailed investigation for Asbestos Containing Material (ACM) was conducted. Asbestos inspections require the services of a "Certified Asbestos Consultant".

Owners or operators of commercial buildings are not required by state or federal law to remove asbestos containing materials from their buildings. However, in the cases of demolition or renovation, a number of laws and regulations pertaining to ACBM must be considered. In addition, owners or operators of commercial buildings are required to comply with laws regulating worker/tenant notification of the presence of ACBM. The following is a summary of pertinent regulations applying to commercial buildings:

National Emission Standard for Hazardous Air Pollutants (NESHAP), Environmental Protection Agency, 40 CFR Part 61 Subpart (M)-regulation pertaining to emissions of asbestos fibers from demolition and renovation projects.

Connelly Law (California Assembly Bill 3713) and Assembly Bill 1563 (Amendment) require that owners of certain public and commercial buildings constructed before 1979 and known to contain asbestos must disclose the presence of asbestos to employees and tenants.

California Proposition 65 and the Safe Drinking Water and Toxic Enforcement Act of 1986 may require warning of the risks of exposure to asbestos in buildings if the suspected ACBM is analyzed and found to contain asbestos.

California Occupational Safety and Health Administration (Cal-OSHA) Regulations specify work practices for employee safety and require registration of contractors involved in asbestos related work.

California State Department of Health Services (DHS) regulates asbestos handling, transport and disposal by treating ACBM as hazardous waste.

California Regional Water Quality Control Board (CRWQCB) regulates disposal by imposing waste discharge requirements on disposal sites.

California Contractor's State License Board registers and certifies contractors engaging in asbestos-related work.

5.4 Electrical Transformers No potential PCB-containing items were observed to exist on the subject property. This was verified by a PG&E representative.

5.5 Hazardous Material As an automobile related building and location, there is, was and will use, storage and disposal of various hazardous materials at the site. The regulations required for hazardous materials appear to have been followed such as secondary containment for used motor oil and containment of solvent materials.

There were four underground storage tanks at the site, but all were removed under proper permitting procedures. There were indications of leaks and the LUST case was closed by the Department of Public Health with no further action required after 10 years of remediation and groundwater monitoring.

5.6 Radon Gas LW did not perform sampling of suspect radon contamination. Radon is a naturally occurring radioactive gas. It is colorless and odorless. Because it is a gas, it is quite mobile. It can move through small spaces in soil and rock on which buildings are

constructed. Radon can seep into offices or homes through cracks, sumps, floor drains, joints or pores in hollow block walls. Radon can also be present in well water.

5.7 Lead Paint Lead based paint is defined as any paint, varnish stain or other applied coating that have 1 mg/cm or 5 mg/kg (0.5%) more of lead by dry weight. Housing and Urban Development regulations define a lead-based paint hazard as any condition that causes exposure to contaminated dust, soil or paint that is present. Normally lead paint on walls which are in good condition is not a hazard. However during remodeling, some precautions may be necessary.

6.0 REGULATORY REVIEW

6.1 List of Databases Searched The following databases were searched for sources of potential environmental liability at or in the vicinity of the subject site by EDR Inc. The databases and distances reviewed are those in accordance with ASTM standards. The Non-Standard Databases were reviewed to determine if any were of environmental concern. The EDR Executive summary and entries within 500 feet are presented. in Appendix F. The balance of the full report, more than 500 pages has been archived and is available upon request.

6.3 Significant Addresses The site was found on the following databases with various name styles:

The listings all reflect the use of the property as an auto repair related business, and the fact that there were USTs removed from the site which did leak. The leaks were addressed under the LUST protocols and the LUST case was closed with no further work required. None of the listings indicated any violations, un-addressed discharges or inappropriate activities at the site Some of the listings such as the inclusion on the UST and LUST databases are a Recognized Environmental Concern (REC). However all the required activities associated with these RECs have been addressed with the appropriate regulatory agency and no further action documentation has been provided to resolve the RECs.

There are other sites listed near the site, and based on the gradient position, the nature of the databases and general site profiles of the entries, there are no conditions related to the other sites on the database review that are considered to be Recognized Environmental Concerns.

7.0 SUMMARY OF FINDINGS

7.1 History The site was initially developed with the existing building in the 1910s as a commercial building in the automotive trade. It has been occupied by various commercial businesses since construction. These appear to all have been automotive repair businesses of one type or another. The current occupant is Ted and Al's Service Center which is a full service auto repair station. The business is certified and AAA approved and is a well organized, professionally operated business complying with all local and state permits and regulatory guidelines.

San Francisco Fire Department records indicated that 5 USTs were installed at the site in at least two different episodes. It was common practice during the early 1900s, that when a smaller UST was replaced with larger, and more USTs the original UST was removed with no documentation. Such activities were normal and are not an environmental concern. In this situation since the replacement 4 USTs were removed and as part of a

leak situation, there were several extensive soil and groundwater investigations and the whole area was subject to regulatory oversight, any impact from the original UST was addressed.

There were records found from the appropriate agencies (SF DPH) that four USTs were removed from the site. There was evidence of a discharge and a Leaking Underground Storage Tank (LUST) case was opened. There was a program of remediation, observations and monitoring which occurred over a period of about 10 years. After the second 5 year review by The Board, the SF DPH closed the LUST case with No Further Action (NFA) required. There did remain some soil and groundwater contamination but under the regulations, nor further action was required and any further action would not have been appropriate or within any regulatory guidelines.

Some if not most of the identified historic businesses at the address have been involved in activities which have involved hazardous materials. There have been various auto repair businesses which have used various hazardous materials including solvents.

With the exception of the removed USTs, there was no physical or documentary evidence found during this investigation of any spills, leaks or inappropriate use storage, generation or disposal of chemicals, hazardous materials, reportable substances or hazardous waste.

7.2 Physical Conditions of the Property The property is a 10,000 square foot rectangular lot which is occupied by a single building with no basement. The building covers 100% of the land.

The building is currently occupied with an automobile repair business. There are automobile and pedestrian entrances along the Stanyan Street frontage.

As an automotive repair business, there are various hazardous materials currently associated with the property. The hazardous materials appear to be properly stored, used and disposed of. There are program in place to properly handle waste oil, oil filters and solvents. There are minor spills of fluids, but all seen were minor and are cleaned frequently. There was no long term residues, ponding or staining seen at the site.

There are several hydraulic lifts in the building. There are no federal or state or local regulations regarding the removal of hydraulic lifts. Therefore the lifts can currently be operated with little regulation. If there is a decision made to remove the lifts, there would be no guidelines, regulations or agency oversight required at this time. If there is significant leakage from the lifts, it could be noted in future investigations of other concerns in the area. The lifts are not regulated because the normal hydraulic fluid used in non-toxic and is not mobile in the soil. therefor No evidence was seen such as signage, fill caps, or vent pipes which would indicate the presence of any remaining USTs.

On-site drainage is into the municipal sewer system via slopes, eaves and drains. There is no drainage or runoff from any adjacent properties. The site is protected from street runoff by curbs and gutters.

The one time categorization of the site as a LUST case is a Recognized Environmental Concerns (REC). The LUST case had been properly addressed and the LUST case closed by the appropriate agencies with No Further Action required. (NFA) Because the soil and groundwater has residual contaminants, there remains a REC. However, there is no meaningful or required activity which could be performed to remove the conditions responsible for such a REC.

There are no other physical or documentary conditions of the property itself which are Recognized Environmental Concerns.

7.3 Environmental Situation There are no records of Environmental Liens against the property. The NPL Recovery Database (US EPA), EPA Liens Database, the DTSC Liens Database and the DTSC Deed Database were reviewed to determine the presence of any environmental associated liens. None were found. During the interview and on the questionnaire, the current owner indicated that there were no environmental liens associated with the property.

There were no Federal or State environmental "activity or use limitation" (AULs) in place for this property. The negative AUL statement is based on the review of the databases particularly the U.S. EPA's Engineering Controls and the Institutional Controls and the California ENVIROSTOR.

There are minor data gaps regarding the use of the property from the 1890s. However none are considered to be significant and are not likely to alter any conclusions or recommendations of this report.

7.4 Current Conditions of the Nearby Area The site is located within a mixed-use residential urban area in San Francisco which is adjacent to the very large Golden Gate Park to the west. The adjacent and nearby areas to the south, north and east are all mainly residential properties. There are a scattering of commercial activities along the Stanyan Street right of way to the south.

Some of the nearby businesses may have or may in the future use, store, generate and dispose of materials that may be hazardous, but these materials are common in typical modern urban commercial/retail settings.

Some of the nearby sites have had leaking underground storage tanks which have leaked. These sites have been monitored by the San Francisco Department of Public Health and all those up gradient sites within one half mile have been closed.

There may be other businesses in the nearby area to the south or scattered within the residential areas, which have, presently do and will in the future use, store and dispose of

However there were no indications that any business inappropriately used, generated, stored or disposed of any hazardous materials. Any impact from such sources are the responsibility of the generating facility.

There was no visual evidence of registered or unregistered USTs seen in the nearby area during the site reconnaissance. However some of the properties including older residential apartment buildings, may have unregistered and unknown tanks. There are no gasoline services stations or fuel distribution systems seen in the nearby areas.

There were no Recognized Environmental Concerns seen in the nearby area.

7.5 Regulatory Databases and Review The site was found on 8 of the different databases reviewed. The entries reflected the site's use as an auto repair business and the fact the four USTs were removed, leaked and then successfully closed by the appropriate regulatory agency with No Further Action required. There were no data indicating that there have been any major violations discharges or illegal activities at the site. None of the entries were identified as Recognized Environmental Concerns. There were various properties identified in the general site area, but based on the locations, gradient position, the nature of the database and general site profiles, there were no entries which are considered to be Recognized Environmental Concerns

8.0 CONCLUSIONS & DISCUSSION The site was initially developed with the existing building in the 1910s and has been occupied by various commercial businesses, all apparently involved in some type of automotive related activity. The property is currently occupied by a full service auto repair business. There are no auto body painting operations done at the site.

There have been various automotive repair businesses identified at the site which have historically used, generated, stored or disposed of hazardous materials. There were five underground storage tanks (USTs) associated with the property. Four of the tanks were removed under proper permitting and San Francisco Department of Public Health closed the UST case with No Further Action required. There was no evidence seen physically or in any current documentation by the responsible agencies of the fifth UST. Many original small tanks when replaced in the 1930s, were mainly removed without documentation, and the new USTs installed. If the fifth UST was present, any negative impact from it would have been detected and remediated during the 10 years of LUST investigations and remedial operations carried out at the site to achieve LUST closure.

There currently is use, storage, generation and regulated disposal of automotive related materials at the property. All of the materials are correctly handled and there was no evidence of uncontrolled discharges, leaks, spills, ponding or standing liquids seen.

There are several hydraulic lifts in the building. The operation and removal of such lifts are not regulated. If there is a decision made to remove the lifts, there would be no guidelines, regulations or agency oversight required at this time. If there is significant

leakage from the lifts, it could be noted in future investigations of other concerns in the area. The lifts are not regulated because the normal hydraulic fluid used is non-toxic and is not mobile in the soil or groundwater.

The drains, floors, walls and various surfaces seen in the building were clean and there with no accumulations of liquids. There were no indications seen in the building, the sidewalks or on the exterior walls of the building that there are any remaining underground tanks at the site. There is also no evidence that there are or has been any pits, lagoons, wells of any type or septic tanks at the site.

Normal refuse removal is provided by the city regulated waste hauling company. Water and sewer services are provided by municipal utilities. Energy (natural gas and electricity) are provided by the PG&E company.

On-site drainage from the building is into the municipal sewer system via drains, slopes and roof systems. There is no drainage or runoff from any adjacent properties. The site is protected from street runoff by curbs and gutters.

The site as all commercial properties may be subject to the regulations of the Maher Ordinance if there is a change of use as directed by the planning department or the building department. The Maher Ordinance was originated to address situations of environmental concern of sites being converted to more sensitive uses.

The site is located within the Stanyan Street corridor on the boundary of Golden Gate Park. The areas to the south along Stanyan Street may have had various businesses, such other automotive repair facilities, dry cleaning activities and retail/wholesale outlets which may be environmental concerns to the site as well as to any property in the nearby area. Many such businesses may use, store, generate and dispose of hazardous materials. No Recognized Environmental Concerns were identified in the nearby areas.

This Phase I Environmental Site Assessment report is compliant with ASTM Designation E1527-05, “Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process”; U.S. EPA’s “Standards and Practices For all Appropriate Inquiries” (40 CFR Part 321); and the Federal Small Business Liability Relief and Brownfields Revitalization Act (January 11, 2002). LW declares that all- appropriate inquiries in conformance with the standards and practices have been developed and performed during the preparation of this report.

There are no conditions associated with the property that would require the involvement of any regulatory agency.

Based on all appropriate inquiries carried out during the preparation of this report, it is our opinion that there were Recognized Environmental Concerns (RECs) associated with this property, however all have been addressed and that the RECs have been resolved.

9.0 RECOMMENDATIONS There is no evidence that any additional environmental investigation at this site is warranted at this time.

10.0 LIMITATIONS

The observation and conclusions presented in this report are professional opinions based on the scope of activities and information obtained through the Phase I Environmental Site Assessment described above.

LW has performed this assessment in a professional manner using that degree of skill and care exercised for similar conditions by reputable and competent environmental consultants. Nonetheless, there are several major qualifications that are inherent in the conduct of this, or any other environmental due diligence examination.

• It is difficult to predict which if any of the identified potential problems will become actual problems in the future. Federal and State regulations continually change, as do the enforcement priorities of the applicable government agencies.

• The distinct possibility always exists that major sources of future environmental liability have yet to manifest themselves to the point where they are reasonably identifiable through an external investigation.

• The results of this investigation represent the application of a variety of engineering, technical and professional disciplines to materials, facts and conditions associated with the subject property. Many of these facts and conditions are subject to change with time. Accordingly, the conclusions and recommendations of this report must be considered in this context.

• LW shall not be responsible for conditions, facts or the consequences arising from any relevant data that were concealed, withheld or not fully disclosed at the time of the preparation of this report.

Opinions presented herein apply to site conditions existing at the time of our study, and cannot apply to site conditions or changes of which we are not aware or have not had the opportunity to evaluate. Environmental Data Resources, Inc.’s (EDR) City Directory Abstract is a screening tool designed to assist environmental professionals in evaluating potential liability on a target property resulting from past activities. EDR’s City Directory Abstract includes a search and abstract of available city directory data. For each address, the directory lists the name of the corresponding occupant at five year intervals.

Business directories including city, cross reference and telephone directories were reviewed, if available, at approximately five year intervals for the years spanning 1910 through 2013. This report compiles information gathered in this review by geocoding the latitude and longitude of properties identified and gathering information about properties within 332 feet of the target property.
