2 Welcome to TTY Access Program With the TTY Access Program and an active subscription to Link*, hard of hearing and speech-im- paired subscribers have 24/7 access to personal calling and TTY Advisors.

Simply pair your Bluetooth phone, plug in your TTY device and begin making and receiving calls in the usual fashion**. Don’t have a Bluetooth phone? We’ll get one for you. With your active Lexus Link sub- scription you can also use your Bluetooth phone to access certain Lexus Link services such as accident assistance.

5 TTY Access Program User Instructions After the phone is paired with the vehicle and the customer’s personal TTY device is plugged into the phone, the following functions may be available: Dialing a number by using the touch pad on the navigation screen One touch dialing on the navigation screen for speed dial numbers Making a call from the phone book Making a return call from the outgoing call log or the incoming call log One touch dial to points of interest on the navigation screen

The TTY device should operate in the usual fashion. Of course, driving safely is most important. Do not use your TTY device when you are driving.

Operational instructions and limitations for using Bluetooth hands-free system can be found in the vehi- cle’s owner’s manual and on www.Lexus.com. For vehicles equipped with navigation system, instructions may be found in the Navigation System Owner’s Manual.

Services available are contingent upon the Lexus Link service plan purchased, but may include stolen vehicle location assistance, remote door lock/unlock, remote light and horns, ride assist, directions, points of interest look up, emergency services notification, roadside assistance, accident assistance, and customer care issues.

6 TTY Access Program Frequently Asked Questions Q1. What is the TTY Access Program? A1. For Lexus Link subscribers requiring TTY access to personal calling, Lexus is offering to send customers a Bluetooth enabled phone that pairs with the vehicle’s hands-free calling system and can be used with their own TTY device. The customer, using their own TTY device, may be able to access multiple features in the usual fashion. Features that may be available include: Dialing a number by using the touch pad on the navigation screen One touch dialing on the navigation screen for speed dial numbers Making a call from the phone book Making a return call from the outgoing call log or the incoming call log One touch dial to points of interest on the navigation screen Lexus will strive to find the phone with the most features compatible with the vehicle.

Q2. What determines features availability? A2. Feature availability is determined by the type of phone, the Bluetooth profile, and its compatibility with the vehicle. Because cellular companies change phone models frequently, feature availability depends on the phones available in the marketplace at any given point in time. Features may also be limited by the individual’s TTY device.

Q3. How do I participate in the program? A3. Your Lexus Dealer has the necessary form along with the terms and conditions of the program. Additional information can be found online at www.Lexus.com or by calling 1-800-25-LEXUS. TTY access to the Lexus Customer Assistance Center is available at 1-800-443-4999-TTY.

Q4. What if I have my own phone? Can I still participate? A4. So long as the phone is Bluetooth enabled and paired properly with the vehicle, you should be able to plug your TTY device into the phone and begin using in the usual fashion.

Q5. How do I know if my personal Bluetooth phone is compatible? A5. Not all Bluetooth phones are guaranteed to work with the Lexus hands-free calling system. To find a compatible mobile phone or pair an existing phone, please go to www.Lexus.com for instructions on Bluetooth phone link.

Q6. What Lexus Link features are available to TTY users? A6. Services available are contingent upon the Lexus Link service plan purchased and require an active subscription, but may include stolen vehicle location assistance, remote door lock/unlock, remote light and horns, ride assist, directions, points of interest look up, emergency services notification, roadside assistance, accident assistance, and customer care issues. Please contact our dedicated TTY toll-free line at 1-877-248-2080. While email may be your primary mode of communication, it is absolutely necessary that you contact Lexus Link via telephone in emergency situations.

Q7. Can I make and receive TTY calls while the vehicle is in motion? A7. The TTY Access Program is for use only by passengers or by the driver if the vehicle is parked. By signing the TTY Access Program agreement, you agree that you will not use the TTY Access Program while driving.

Q8. What is the per minute charge? A8. The per minute charge is determined by the Wireless Service Provider. The terms and conditions of the wireless service used in the TTY Access Program will be determined by the Wireless Service Provider and not by Lexus.

Q9. Is an active Lexus Link subscription required for participation? A9. Yes, an active Lexus Link subscription is required for all Lexus Link services and if Lexus provides a Bluetooth enabled phone for personal calling.

Terms and Conditions of the Lexus TTY Access Program Effective as of December 15, 2006 As a customer requiring TTY-compatible personal calling that integrates with features in your car, you will be enrolled in the TTY Access Program. These terms and conditions are the agreement between you and Lexus. These terms and conditions apply in addition to the terms and conditions of your Lexus Link service. PLEASE READ THIS AGREEMENT BEFORE PARTICIPATING IN THE TTY Program. KEEP A COPY OF IT IN A SAFE PLACE. 1. YOUR TTY Program SERVICE AND EQUIPMENT. You are responsible for obtaining your own TTY device that is appropriate for use with mobile phones. We cannot provide any assurances that your TTY device will function properly. You have the option of using your own TTY-compatible mobile phone to make and receive telephone calls. You will not be able to access certain personal calling features available in your car unless your mobile phone is equipped with Bluetooth® technology. For example, a Bluetooth®-equipped mobile phone is required to: (a) dial a telephone number by using the touch pad on the navigation screen, (b) use one-touch dialing for numbers stored in your contacts or speed-dial list, (c) use one-touch dialing to points of interest on the navigation screen, and (d) make a return call from the outgoing call log or incoming call log. Lexus Link services available are contingent upon the service plan purchased and require an active subscription, but may include stolen vehicle location assistance, remote door lock/unlock, remote light and horns, ride assist, directions, points of interest look up, emergency services notification, roadside assistance, accident assistance, and customer care issues. Available Lexus Link services are accessible for TTY users by calling OEM Telematics Services at 1-877-248-2080. If you do not have a mobile phone that is TTY-compatible and Bluetooth®-equipped, we will provide one to you at no charge. You will be able to connect this mobile phone to your TTY device to make and receive telephone calls, either by using the keypad on the phone or through the personal calling features listed above. We will select a pre-paid wireless service plan from a Wireless Service Provider of our choosing, and we will provide, on a complimentary basis, a pre-paid amount that will enable you to use a minimum of 30 minutes of air- time (for domestic calls) over your first 60 days as a participant in the TTY Program. If you wish to continue participating in the TTY Program after the free air time has been used up, you are responsible for buying additional minutes of air time in advance from the Wireless Service Provider. The terms and conditions of the wireless service used in the TTY Program will be determined by the Wireless Service Provider, and not by us. 2. STARTING YOUR TTY Program SERVICE. You can participate in the TTY Access Program service only by signing this agreement. If you sign this agreement, you are bound by it and any later changes or amendments to it. 3. ENDING YOUR TTY Program SERVICE. If you are using your own mobile phone to participate in the TTY Access Program, you must contact your wireless service provider to cancel your service. You do not need to notify us. If you are using a mobile phone provided by us, you can cancel your TTY Access Program service at any time, as long as you comply with the terms and conditions set by the Wireless Service Provider. Generally, you can cancel your service by notifying the Wireless Service Provider or allowing your pre-paid minutes to expire. If you cancel your wireless service, any refunds for amounts already paid will be determined by the Wireless Service Provider. If you cancel service or if you do not buy minutes for a certain period of time, the Wireless Service Provider may charge a fee to reactivate service. You may end your participation in the TTY Access Program without canceling your Lexus Link service. But if you cancel your Lexus Link service, this agreement will automatically terminate. We reserve the right to reclaim the mobile phone provided under the TTY Access Program if you cancel your Lexus Link service, and we are not responsible for reimbursing you for any amounts paid to the Wireless Service Provider. 4. YOU WILL HAVE A SEPARATE AGREEMENT WITH THE Wireless Service Provider. If you choose to use your own mobile phone to access the personal calling features available in your car, you are responsible for obtaining wireless service and complying with the terms and conditions set by your wireless service provider. If you use the mobile phone that we provide under the TTY Access Program, you must comply with the terms and conditions set by the Wireless Service Provider we select, including the rates charged for any air time beyond the initial minutes we provide on a complimentary basis. You will purchase air time for use in the TTY Access Program directly from the Wireless Service Provider. You can get information about rates for pre-paid minutes of air time and other service plans from the Wireless Service Provider. We have no relationship with the Wireless Service Provider in connection with this service to you. Whether you use your own mobile phone or one that we provide to you, we have no control over the wireless service provided using the mobile phone. This means that we have no control over, among other things: the amounts you are charged for air time or additional charges, fees, and taxes, the wireless service coverage area, service interruptions, technology changes, equipment warranties, equipment malfunctions, assignment of a wireless phone number, or the privacy of information provided to the wireless provider or sent over the wireless network. 5. YOUR RESPONSIBILITY FOR CONTACTING THE Wireless Service Provider. If you experience any problems with your mobile phone or your wireless service, you are responsible for notifying the Wireless Service Provider of these problems. We will not contact the Wireless Service Provider on your behalf under the TTY Access Program. 6. YOUR RESPONSIBILITY FOR DRIVING SAFELY. The TTY Access Program is for use only by passengers or by the driver if the vehicle is parked. NEVER USE A TTY DEVICE WHEN YOU ARE DRIVING. By signing this agreement, you agree that you will not use the TTY Access Program service while driving. You are responsible for checking the laws and regulations regarding the use of wireless devices in the areas where you drive. Give your full attention to driving; driving safely is your first responsibility. You are also responsible for fol- lowing any safety guidelines provided by the mobile phone manufacturer and/or the Wireless Service Provider, and by the TTY device manufacturer. Store the mobile phone and TTY device safely before driving your vehicle. Do not place the mobile phone and/or TTY device above any airbag, or in the airbag deployment area. 7. NO WARRANTIES ON EQUIPMENT, INFORMATION OR SERVICES FROM LEXUS. Warranties are special kinds of promises. NEITHER LEXUS NOR ANY LEXUS DISTRIBUTOR OR LEXUS DEALER MAKES ANY WARRANTIES, EXPRESS OR IMPLIED, ABOUT ANY MOBILE PHONE OR OTHER EQUIPMENT USED IN CONNECTION WITH THE TTY Access Program, WHETHER PROVIDED BY US OR OBTAINED BY YOU. THE VEHICLE WARRANTY INCLUDED WITH YOUR VEHICLE DOES NOT COVER ANY TTY Access Program EQUIPMENT. NEITHER LEXUS, NOR ANY LEXUS DISTRIBUTOR OR LEXUS DEALER MAKES ANY WARRANTIES, EXPRESS OR IMPLIED, ABOUT THE TTY Access Program SERVICE OR ABOUT ANY DATA OR INFORMATION OR SERVICES PROVIDED THROUGH IT. THIS MEANS, AMONG OTHER THINGS, NO WARRANTIES OF QUALITY, ACCURACY, TIMELINESS, COMPLETENESS, MECHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. ALL SUCH WARRANTIES ARE EXPRESSLY EXCLUDED BY THIS AGREEMENT. 8. LIMITATIONS OF LIABILITY. You are waiving important rights. IN ADDITION TO THE LIMITATIONS OF LIABILITY TO WHICH YOU AGREE IN THE Lexis Link Agreement, UNLESS FORBIDDEN BY LAW IN A PARTICULAR INSTANCE, YOU AGREE AS FOLLOWS: Continued on next page. First, LEXUS IS NOT LIABLE FOR THE ACTIONS OR INACTIONS OF THE Wireless Service Provider OR THE ACTIONS OR INACTIONS OF THE MANUFACTURER OF ANY EQUIPMENT USED IN CONNECTION WITH THE TTY Access Program. Second, LEXUS IS NOT LIABLE FOR ANY INJURIES TO PERSONS OR PROPERTY ARISING OUT OF OR RELATING TO YOUR USE ANY MOBILE PHONE OR TTY DEVICE IN CONNECTION WITH THE TTY Access Program. Third, IF ANY DISPUTE ARISES BETWEEN US, NEITHER YOU NOR WE CAN RECOVER (1) PUNITIVE DAMAGES, (2) TREBLE, CONSEQUENTIAL, INDIRECT, OR SPECIAL DAMAGES, OR (3) ATTORNEY’S FEES. YOU AND WE AGREE NOT TO MAKE, AND TO WAIVE TO THE FULLEST EXTENT ALLOWED BY LAW, ANY CLAIM FOR DAMAGES OTHER THAN DIRECT, COMPENSATORY DAMAGES AS LIMITED IN THIS AGREEMENT. Fourth, NOTWITHSTANDING ANYTHING ELSE IN THIS AGREEMENT, YOU AGREE TO EXCUSE ANY NON-PERFORMANCE BY LEXUS, ANY LEXUS DISTRIBUTOR, OR LEXUS DEALER CAUSED IN WHOLE OR IN PART BY AN ACT OR OMISSION OF A THIRD PARTY, OR BY ANY EQUIPMENT FAILURE, ACT OF GOD, NATURAL DISASTER, STRIKE, EQUIPMENT OR FACILITY SHORTAGE, OR OTHER CAUSES BEYOND THE CONTROL OF US OR OUR SERVICE PROVIDERS. Fifth, if any wireless service provider or equipment manufacturer is involved in any problem, you also agree to any limitations of liability that it imposes on its customers. Finally, you agree that the limitations of liability in this agreement will survive even after the agreement has ended. These limitations of liability apply not only to you, but to anyone using the TTY Access Program service equipment, to anyone making a claim on your behalf, and to any claims made by your family, employees, customers, or others arising out of or relating to your TTY Access Program service. 9. YOUR RESPONSIBILITY FOR INSURANCE. The TTY Access Program that Lexus offers is intended as a convenience. The payments you make for that service aren’t related to the value of your Car or any property in it, or the cost of any injury to or damages suffered by you. We aren’t an insurance company. You promise you’ll obtain and maintain appropriate insurance covering personal injury, loss of property, and other risks. FOR YOURSELF AND FOR ANYONE ELSE CLAIMING UNDER YOU, YOU HEREBY RELEASE AND DISCHARGE LEXUS, ANY LEXUS DISTRIBUTOR OR LEXUS DEALER, AND EACH OF THEIR RESPECTIVE PARENTS, AFFILIATES, AND SUBSIDIARIES, AND THE RESPECTIVE OFFICERS, DIRECTORS, AND EMPLOYEES OF ANY OF THEM FROM AND AGAINST ALL HAZARDS COVERED BY YOUR INSURANCE. NO INSURANCE COMPANY OR INSURER WILL HAVE ANY RIGHT OF SUBROGATION AGAINST LEXUS OR ANY LEXUS DISTRIBUTOR OR LEXUS DEALER. 10. YOUR RESPONSIBIILTY FOR PAYMENT IN SOME CIRCUMSTANCES. In order to participate in the TTY Access Program, YOU AGREE THAT YOU’LL BE RESPONSIBLE FOR ANY AMOUNT ANYONE ELSE CLAIMS FROM LEXUS, LEXUS DISTRIBU- TORS OR LEXUS DEALERS (OR ANY OF OUR OFFICERS, EMPLOYEES, AFFILIATES AND AGENTS) PLUS ANY EXPENSES, RESULTING FROM ANY CLAIM, DEMAND OR ACTION, REGARDLESS OF THE NATURE OF THE CAUSE OF THE CLAIM, DEMAND, OR ACTION ALLEGING LOSS, COSTS, EXPENSES, DAMAGES, OR INJURIES (INCLUDING INJURIES RESULTING IN DEATH) ARISING OUT OF OR IN CONNECTION WITH (1) THE ACTIVITIES CONTEMPLATED BY THIS AGREEMENT, WHETHER BROUGHT BY YOU, YOUR EMPLOYEES, OR THIRD PARTIES, EVEN IF DUE TO THE SOLE NEGLIGENCE OF LEXUS OR ANY OF THE LEXUS DISTRIBUTORS OR LEXUS DEALERS; (2) CLAIMS FOR LIBEL, SLANDER, OR ANY PROPERTY DAMAGE, PERSONAL INJURY OR DEATH, ARISING OUT OF OR RELATED IN ANY WAY DIRECTLY OR INDIRECTLY TO THIS AGREEMENT; or (3) THE USE, FAILURE TO USE, OR INABILITY TO USE THE SERVICES PROVIDED IN THE TTY Access Program EXCEPT WHERE THE CLAIMS RESULT FROM THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF LEXUS, ANY LEXUS DISTRIBUTORS OR LEXUS DEALERS. 11. HOW WE’LL RESOLVE DISPUTES BETWEEN US. If you and we have a disagreement related to the TTY Access Program, we’ll try to resolve it by talking with each other. If we can’t resolve it that way, WE BOTH AGREE, TO THE FULLEST EXTENT PERMITTED BY LAW, TO USE ARBITRATION, NOT LAWSUITS (except for small claims court cases) TO RESOLVE THE DISPUTE. Of course, either of us can always contact a government agency or regulatory authority for help, too. Here’s how private arbitration will work: THE FEDERAL ARBITRATION ACT WILL APPLY. EXCEPT FOR QUALIFYING SMALL CLAIMS COURT CASES, ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT, OR ANY PRIOR AGREEMENT FOR SERVICE WITH US OR ANY OF OUR AFFILIATES, PREDECESSORS IN INTEREST, OR ANY PRODUCT OR SERVICE PROVIDED UNDER OR IN CONNECTION WITH THIS AGREEMENT OR SUCH A PRIOR AGREEMENT, OR ANY ADVERTISING FOR SUCH PRODUCTS OR SERVICES, WILL BE SETTLED BY ONE OR MORE NEUTRAL ARBITRATORS BEFORE THE AMERICAN ARBITRATION ASSOCIATION ("AAA") OR BETTER BUSINESS BUREAU ("BBB"). FOR CLAIMS OVER $10,000, THE AAA’s WIRELESS INDUSTRY ARBITRATION ("WIA") RULES APPLY. IN LARGE/COMPLEX CASES UNDER THE WIA RULES, THE ARBITRATORS MUST APPLY THE FEDERAL RULES OF EVIDENCE AND THE LOSER MAY HAVE THE AWARD REVIEWED BY A PANEL OF 3 NEW ARBITRATORS. FOR CLAIMS OF $10,000 OR LESS, WHOEVER STARTS THE ARBITRATION CAN CHOOSE EITHER THE AAA’s SUPPLEMENTARY PROCEDURES FOR CONSUMER-RELATED DISPUTES, AN INDIVIDUAL ACTION IN SMALL CLAIMS COURT, OR THE BBB’s RULES FOR BINDING ARBITRATION. EACH OF US MAY HAVE TO EXCHANGE RELEVANT EVIDENCE IN ADVANCE. YOU CAN GET RULES AND FEE INFORMATION FROM THE AAA (WWW.ADR.ORG) OR THE BBB (WWW.BBB.ORG). THIS AGREEMENT DOESN’T PERMIT CLASS ARBITRATIONS EVEN IF AAA OR BBB PROCEDURES OR RULES WOULD. IN EXCHANGE FOR THIS, WE’LL PAY (IF YOU ASK US IN ADVANCE) FOR ANY FILING FEE CHARGED YOU BY THE AAA OR BBB FOR ONE ARBITRATION OF ANY DISPUTES BETWEEN US, SO LONG AS YOU TRIED IN GOOD FAITH TO RESOLVE THE DISPUTES WITH US BEFORE FILING FOR ARBITRATION. IF THE ARBITRATION PROCEEDS PAST THE FILING, WE’LL ALSO PAY (IF YOU ASK US AT THE TIME) ANY FURTHER ADMINISTRATIVE AND ARBITRATOR FEES THAT YOU ARE LATER CHARGED. AN ARBITRATOR CAN DECIDE LATER WHETHER TO ALLOCATE THE FEES DIFFERENTLY IF THERE’S AN AWARD. THERE’S NO JUDGE OR JURY IN ARBITRATION, AND REVIEW IS LIMITED, BUT AN ARBITRATOR CAN AWARD THE SAME DAMAGES AND RELIEF, AND MUST HONOR THE SAME LIMITATIONS IN THIS AGREEMENT AS A COURT WOULD. IF AN APPLICABLE STATUTE REQUIRES AN AWARD OF ATTORNEY’S FEES, AN ARBITRATOR CAN AWARD THEM, TOO. ANY ARBITRATION AWARD MADE AFTER COMPLETION OF AN ARBITRATION IS FINAL AND BINDING AND MAY BE CONFIRMED IN ANY COURT OF COMPETENT JURISDICTION. AN AWARD AND ANY JUDGMENT CONFIRMING IT ONLY APPLIES TO THE ARBITRATION IN WHICH IT WAS AWARDED AND CAN’T BE USED IN ANY OTHER CASE EXCEPT TO ENFORCE THE AWARD ITSELF. IF FOR SOME REASON THESE ARBITRATION REQUIREMENTS DON’T APPLY, OR A CLAIM PROCEEDS IN SMALL CLAIMS COURT, WE EACH WAIVE ANY TRIAL BY JURY. 12. THE LAW THAT GOVERNS OUR RELATIONSHIP. To the fullest extent permitted by law, and except as explicitly provided otherwise, this agreement and any disputes arising out of or relating to it will be governed by the laws of the state of Michigan without regard to its conflict of law principles, and by any applicable tariffs, wherever filed. 13. HOW WE CAN COMMUNICATE WITH EACH OTHER. Any written notice from you required by this agreement will be considered given when we receive it at our address on the front of this agreement. Any written notice from us required by this agreement will be considered given two days after we mail it to you at the billing address we have on file for you at the time. Any oral notices will be considered given when we call you or when you call us at 1-800-443-4999 and ask for assistance with the TTY Access Program. 14. WHO ELSE THIS AGREEMENT COVERS. Lexus, Lexus’s affiliates, distributors and authorized dealers and any of the wireless service providers and other companies who help us provide Lexus Link service, including our affiliates, suppliers, authorized dealers, or who provide you services in the TTY Access Program, are intended beneficiaries of this agreement. You agree that you’ll make any of your passengers or guests or drivers of your Car aware of our rights and subject to the limitations of this agreement. 15. OUR RELATIONSHIP WITH YOU. No matter what else it says, this agreement doesn’t create any fiduciary relationships between you and us, or between you and any of the wireless service providers or other companies who help us provide the TTY Access Program services, including our affiliates, suppliers, distributors and our authorized dealers and others who provide you services in the TTY Access Program. It doesn’t create any relationship of principal and agent, partnership, or employer and employee, either. 16. WE CAN ASSIGN THIS AGREEMENT. We can assign this agreement or your obligations to pay under it in whole or in part to anyone we choose. You can’t assign this agreement or your obligations to anyone else without our prior consent. 17. ELIGIBILITY FOR TTY Access Program. By entering into this agreement with us, you are representing that you are deaf or hearing/speech impaired, and require a TTY device to make phone calls. We reserve the right to revoke this agreement and reclaim any equip- ment provided to you under the TTY Access Program if we determine that enrollment in the TTY Access Program was based on fraud or abuse of the program by any person. 18. THIS IS THE ENTIRE AGREEMENT. This agreement is the entire agreement between you and us relating to the TTY Access Program. It supersedes all other agreements or representations, oral or written, between us, past or present. If any part of this agreement is considered invalid by a court or arbitrator, the rest of it will remain enforceable. Even after this agreement has ended, its provisions will govern any disputes arising out of or relating to it (unless it’s been replaced by a new agreement between us). It will also be binding on your heirs and successors and on our successors. No waiver of any part of this agreement, or of any breach of it, in any one instance will require us to waive any other instance or breach. IN SOME CIRCUMSTANCES WE MIGHT DECIDE TO PROVIDE YOU SERVICE VOLUNTARILY EVEN IF YOU WOULDN’T OTHERWISE QUALIFY. THIS WON’T BE A WAIVER OR REQUIRE US TO DO SO AGAIN. YOU AGREE WE WON’T BE LIABLE FOR ANYTHING RESULTING FROM OUR PROVISION OF SUCH SERVICE. By signing this agreement, you acknowledge that you have reviewed the Terms and Conditions of the Lexus TTY Access Program and understand that by signing it, you are entering into a binding contract.
