Constitutional Confusion on the Left: The NDP’s Position in Canada’s Constitutional Debates Murray Cooke [email protected] First Draft: Please do not cite without permission. Comments welcome. Paper prepared for the Annual Meetings of the Canadian Political Science Association, June 2004, Winnipeg The federal New Democratic Party experienced a dramatic electoral decline in the 1990s from which it has not yet recovered. Along with difficulties managing provincial economies, the NDP was wounded by Canada’s constitutional debates. The NDP has historically struggled to present a distinctive social democratic approach to Canada’s constitution. Like its forerunner, the Co-operative Commonwealth Federation (CCF), the NDP has supported a liberal, (English-Canadian) nation-building approach that fits comfortably within the mainstream of Canadian political thought. At the same time, the party has prioritized economic and social polices rather than seriously addressing issues such as the deepening of democracy or the recognition of national or regional identities. Travelling without a roadmap, the constitutional debates of the 80s and 90s proved to be a veritable minefield for the NDP. Through three rounds of mega- constitutional debate (1980-82, 1987-1990, 1991-1992), the federal party leadership supported the constitutional priorities of the federal government of the day, only to be torn by disagreements from within. This paper will argue that the NDP’s division, lack of direction and confusion over constitution issues can be traced back to longstanding weaknesses in the party’s social democratic theory and strategy. First of all, the CCF- NDP embraced rather than challenged the parameters and institutions of liberal democracy. -

FLAG OF DEFIANCE – THE INTERNATIONAL USE OF THE RHODESIAN FLAG FOLLOWING UDI BRUCE BERRY University of Pretoria ([email protected] ; +27 82 909 5829) Abstract The international response to Rhodesia’s Unilateral Declaration of Independence (UDI) was to proclaim the colony to be in a state of rebellion, the government in Salisbury to be illegal, and to request the United Nations to apply sanctions against the ‘rebel regime’. The ensuing political impasse resulted in the need to promote a more distinctive national identity and the symbols to reflect this newfound independence. The first, and most obvious, change came with the adoption of a new national flag on the third anniversary of UDI on 11 November 1968. As the most visible symbol of post-UDI Rhodesia, the international use and display of the new flag became the subject of demonstration and controversy. This paper shows how the green and white Rhodesian flag came to highlight Rhodesia’s contested statehood when flown outside the country during the UDI period. Rhodesia’s new flag became a symbol of the country’s defiance, and the emotion it evoked, and continues to evoke, causes controversy even to this day. Keywords: Rhodesia, symbols, flags 1 1. INTRODUCTION After years of fruitless negotiations on the issue of independence, at 11 a.m. on 11 November 1965 (the 11th hour of the 11th day of the 11th month) Rhodesian Prime Minister Ian Smith and his Cabinet signed a Proclamation of Independence from the British Parliament, whilst retaining loyalty to the person of the Monarch as the Queen of Rhodesia.1 The immediate response by the British Government to this Unilateral Declaration of Independence (UDI) was to proclaim Rhodesia to be in a state of rebellion, the Government in Salisbury to be illegal and to request the United Nations to apply sanctions against the ‘rebel regime’. -

Brady On the morning of 15 February 1965—a day designated by Her Majesty the Queen of Canada in her proclamation—a crowd of roughly ten thousand Canadians gathered in front of a specially constructed flagpole erected before the Centre Block of the Parliament Buildings on Ottawa’s Parliament Hill.1 The Canadian Red Ensign flew from the flagpole on this chilly, snow-covered day—but not for long; the crowd was assembled to see the flag’s retirement and the raising of its successor.2 That morning, the Montreal Gazette called for understanding the viewpoint of those who will feel a pang in the heart at the coming down of the Red Ensign . they feel this regret not simply because it stood for old ties of kith and kin. For them it has had the broader meanings of the legacy: it was the symbol of freedom, of the rule of law, of the heritage of parliamentary democracy, of the standards of good sense and moderation, of the spirit of courage and service. All these are values not narrow and divisive, but the rich inheritance for the human spirit, the values to be clung to, as long ago proved and always needed.3 Inside, some 600 dignitaries gathered for a “simple and solemn” ceremony designed to bury the passions enflamed during the flag debate of the preceding year that ended with Parliament adopting the Maple Leaf Flag to replace the Red Ensign as the flag of Canada.4 The battle over the new flag pitted two titans of twentieth-century Canadian politics against each other: Lester Pearson, the Liberal prime minister and proponent of a new flag, against John Diefenbaker, Raven, Vol. -

In the first place, they were different racially. • The people in Ireland, Wales and highland Scotland belonged to the Celtic race; • Those in England and lowland Scotland were mainly of Germanic origin. • This difference was reflected in the languages they spoke. People in the Celtic areas spoke Celtic languages: Irish Gaelic, Scottish Gaelic and Welsh. • People in the Germanic areas spoke Germanic dialects (including the one which has developed into modern English). • Today these differences have become blurred. • Although there is only one government for the whole of Britain, and people have the same passport regardless of where in Britain they live, some aspects of government are organized separately (and sometimes differently) in the four parts of the United Kingdom. Moreover, Welsh, Scottish and Irish people feel their identity very strongly. • The nationality of people from UK is the British.
