Report No. 22/17 National Park Authority REPORT OF THE HEAD OF PARK DIRECTION SUBJECT: THE PREFERRED STRATEGY (PRE-DEPOSIT LOCAL DEVELOPMENT PLAN REPLACEMENT), DRAFT SUSTAINABILITY APPRAISAL, DRAFT EQUALITIES IMPACT ASSESSMENT, CANDIDATE SITES REGISTER Purpose of the Report 1. This item asks Members to approve the attached draft preferred strategy for the Pre-Deposit Local Development Plan (replacement) for consultation (Appendix 1). 2. Also requested for approval for consultation are: . the Sustainability Appraisal link provided on the Committee Papers website and in the footnote below1. A non-technical summary is attached as Appendix 2. and the Equalities Impact Assessment link provided on the Committee Papers website and in the footnote below. A summary is attached as Appendix 3. the Candidate Site Register link provided on the Committee Papers website and in the footnote below. A summary sheet is provided as Appendix 4. 3. A Report of Consultations to date can be viewed – link provided on the Committee Papers website. 4. It is anticipated that the consultation will be during June and July 2017. Town & Community Councils have been notified that these papers are available to view on our website. 5. The Preferred Strategy sets out: . Where we are now: What key issues need to be addressed? . Where we want to be: An overall vision for the future . How we get there: A land use strategy for the Park identifying the scale of overall development proposed, where it will be located and what other strategic policies are needed to help implement the strategy. A Key Diagram: showing the areas of the Park affected by the proposed strategy. Please see Appendix 1. 6. The Sustainability Appraisal sets out: 1 Preferred Strategy Webpage http://www.pembrokeshirecoast.org.uk/default.asp?PID=795 Pembrokeshire Coast National Park Authority Page 5 Extraordinary National Park Authority – 17th May 2017 . how the appraisal was carried out; . any difficulties encountered in undertaking the appraisal; . the rationale for the options considered and the reasons for selection of the preferred option and for the rejection of alternatives (noting that this will include wider, non SA considerations); . the story behind the plan's preparation, including the role of the SA in developing, refining and choosing between options; . the anticipated effects of the plan; . any proposed mitigation or enhancement measures (and information as to how these have been reflected in the plan); and . proposals for monitoring (i.e. potential indicators for monitoring the significant effects identified through the SA). 7. Appendix 2 provides a non-technical summary. Equalities Impact Assessment 8. The Public Equality Duty requires the Authority to have due regard to the need to eliminate discrimination, promote equality of opportunity and foster good relations between different communities. This means that, in the formative stages of our policies, procedure, practice or guidelines, the Authority needs to take into account what impact its decisions will have on people who are protected under the Equality Act 2010 (people who share a protected characteristic of age, sex, race, disability, sexual orientation, gender reassignment, pregnancy and maternity, and religion or belief). 9. The Replacement Local Development Plan Preferred Strategy has been subject to an Equality Impact Assessment in line with the Equality Act 2010. Appendix 3 provides a summary. Candidate Sites Register 1. In anticipation of preparing the Plan the Authority has invited anyone with an interest in land to submit sites for consideration for inclusion in the local development plan. In addition the Authority has considered if there are any other sites which may be suitable for development. 2. A provisional view on what sites are considered to be in accordance with the Preferred Strategy is set out in Appendix 4. The full Candidate Site Register can be found using links on the Committee Papers website. 3. Land allocations are not set out in the Preferred Strategy but will be set out in a future ‘Deposit Plan.’ 4. Sites not proposed at this stage by the local planning authority could be introduced later in the plan making or examination processes if the need arises. This is to ensure that the development plan is based on real evidence so that the plan will be deemed to be 'sound'. 6. They include plans and proposals by other organisations. 7. These Background Papers will be updated and added to throughout the preparation of the Plan. Officers are continuing to update in advance of the Preferred Strategy consultation. Risk considerations 8. Revising the Plan is a statutory requirement. The risks associated with preparing this Local Development Plan are set out in the Authority’s Delivery Agreement. Financial considerations 9. Local Development Plan revision is budgeted for by the Authority. Welsh Language considerations 10. The publication and consultation exercises are carried out in accordance with the Welsh Language (Wales) Measure 2011 and the Welsh Language Standards Regulations (No.1) 2015. The impacts on the Welsh language also forms part of the appraisal process. Human Rights considerations 11. The planning system seeks to progress legitimate aims by managing the development and use of land in the public interest to contribute to achieving sustainable development. It reconciles the needs of development and conservation, securing economy, efficiency and amenity in the use of land, and protecting natural resources and the historic environment. Human rights under Articles 1 (right to peaceful enjoyment to property), 8 (right to respect for the home, private and family life) and 14 (right to equality), are the most relevant ones. Proportionality means that the measure which interferes with the right must strike a fair balance between the aim and the right which it interferes with. 12. The process for Local Development Plan preparation and its rigorous assessment procedures will support this approach. Subject to Member approval the formal Preferred Strategy consultation will be undertaken the results of which will be first discussed through the Local Development Plan Member workshops. 14. Responses received will be considered by the Authority in due course and a general description of how these comments have affected the policies and proposals of the Local Development Plan will be fed back to respondents as soon as reasonably practicable. A schedule of individual site related comments or suggestions for new site allocations will also be published. Recommendations: (a) Approve the draft Preferred Strategy and Key Diagram for the Pembrokeshire Coast National Park for consultation. (b) Approve the draft Sustainability Appraisal for the draft Preferred Strategy for consultation. (c) Approve the draft Equalities Impact Assessment for the draft Preferred strategy for consultation. (d) Approve the Candidate Site Register for consultation.
