The trees shall be planted in a prepared pit, which is 50% larger than the root ball of the tree to be planted. The sides of the planting shall be forked over to help alleviate compaction and allow the tree roots to become established. The trees shall be planted with the root collar at the same level as the surrounding soil levels and they shall be backfilled with topsoil clean of building contaminants. The trees shall be anchored with a single stake angled at 45% and attached the trunk of the tree at approx.1 metre above ground level. The stake shall be driven into the ground clear of the root ball. The trees shall be planted in the first planting season after the felling of the noted trees and between November and March no closer than 5 metres from the trunk of any existing tree.

4 If within a period of five years from the date of the planting of any tree that tree, or any tree planted in replacement for it, is removed, uprooted or destroyed or dies, or becomes, in the opinion of the local planning authority, seriously damaged or defective, another tree of the same species and size as that originally planted shall be planted at the same place, unless the local planning authority gives its written consent to any variation.

SUBMISSION OF REMEDIATION SCHEME A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. 3. 16 Before first occupation of each unit, a Validation Test of any sound mitigation measures identified in the acoustic assessment in condition 15 shall have been carried out and the results submitted to and approved by the Local Planning Authority. Such Validation Test shall: Be carried out by a competent person in accordance with an approved method statement Demonstrate that the sound level criteria specified with the above identified report have been achieved.

If these levels have not been achieved, irrespective of the sound mitigation measures already approved, a further scheme will be required incorporating the recommendations of an acoustic consultant to achieve the specified noise levels. The scheme of works shall be submitted to and approved in writing by the Local Planning Authority. Any approved scheme shall be fully implemented and completed prior to occupation of the unit and thereafter retained.

17 Before use of the development is commenced, the applicant shall submit a Service Yard Management Plan for the written approval of the LPA detailing how noise from the servicing activity and odours from the bin storage areas will be minimised. Thereafter the Service Yard Management Plan shall be implemented in accordance with the approved details for the life of the development.

18 There shall be no collection of waste bottles outside the hours 06:30 to 09:00 and 17:00 to 22:00.

19 The opening hours of the premises used for purposes within Class A3 and A4 of the Town and Country Planning Use Classes (Order) 1987 (as amended), including unit J, shall be restricted to 07:00 to 2400 hours.

20 No noise, generated by activities within the premises, shall be audible above background noise at the façade of the closest residential premises outside the hours of 08:00 and 24:00 Monday to Sunday.

21 Details of any external lighting to the development shall be submitted for the written approval of the LPA prior to their erection/installation and thereafter the development shall be carried out and retained in accordance with the approved details.

22 Unless otherwise agreed in writing by the Local Planning Authority, development other than demolition and that required to be carried out as part of an approved scheme of remediation must not commence until sections 1 to 4 have been complied with. If unexpected contamination is found after development has begun, development must be halted on that part of the site affected by the unexpected contamination to the extent specified by the Local Planning Authority in writing until section 4 has been complied with in relation to that contamination.

1. SITE CHARACTERISATION An investigation and risk assessment, in addition to any assessment provided with the planning application, must be completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to the approval in writing of the Local Planning Authority. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The written report is subject to the approval in writing of the Local Planning Authority. The report of the findings must include:

(i) a survey of the extent, scale and nature contamination;

(ii) an assessment of the potential risks to:

* human health, * property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes, * adjoining land, * groundwaters and surface waters * ecological systems * archaeological sites and ancient monuments;

(iii) an appraisal of remedial options, and proposal of the preferred option(s).

This must be conducted in accordance with DEFRA and the Environment Agency's 'Model Procedures for the Management of Land Contamination, CLR 11'.

2. SUBMISSION OF REMEDIATION SCHEME A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation.

3. IMPLEMENTATION OF APPROVED REMEDIATION SCHEME The approved remediation scheme must be carried out in accordance with its terms prior to the commencement of development other than demolition and that required to carry out remediation, unless otherwise approved in writing by the Local Planning Authority. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works. Following completion of measures identified in the approved remediation scheme, a verification report (referred to in PPS23 as a validation report) that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority.

4. REPORTING OF UNEXPECTED CONTAMINATION In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with the requirement of section 1, and where remediation is necessary a remediation scheme must be prepared in accordance with the requirements of section 2, which is subject to the approval in writing of the Local Planning Authority.

Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority in accordance with section 3.

23 No part of the development to which this permission relates shall be brought into use until the carriageway and any footway/footpath from which it gains access has been constructed to basecourse macadam level and/or block paved and kerbed and connected to the existing highway network with street lighting installed and in operation. The completion of all road works, including any phasing, shall be in accordance with a programme approved in writing with the Local Planning Authority in consultation with the Highway Authority before any part of the development is brought into use.

24 Notwithstanding the provision of any Town and Country Planning General Permitted or Special Development Order for the time being in force, the parking spaces on Raglan Street and Albert Street , turning areas and access shall be kept available for their intended purposes at all times, unless otherwise agreed with the Local Highway Authority.

16 Within one month of the date of this permission details of the proposed means of disposal of foul and surface water drainage, including details of any balancing works and off site works, shall be submitted to and approved in writing by the Local Planning Authority. Development shall take place in accordance with the agreed details.

17 Unless otherwise approved in writing by the Local Planning Authority, there shall be no piped discharge of surface water from the development prior to the completion of the approved surface water drainage works and no buildings shall be occupied or brought into use prior to completion of the approved surface drainage works.

18 The development hereby approved shall incorporate the mitigation measures recommended in the submitted ground stability report unless the Local Planning Authority gives written consent to any variation.

19 The site shall be developed with separate systems of drainage for foul and surface water on and off site.

20 The surface water strategy for this development must be in accordance with the FRA dated February 2010, prepared by Jeremy Benn on behalf of JBA consulting. The maximum rate of surface water discharge will be 4.6l/s and outfall to the 525mm diameter public combined sewer recorded in Water Skellgate as agreed by Yorkshire Water in their letter dated 15th December 2013 (P017211).

21 Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no extensions, garages, outbuildings, windows, rooflights or dormer windows other than any expressly authorised by this permission shall be erected without the grant of further specific planning permission from the Local Planning Authority.
