BUSINESS Overview Nu Skin Enterprises is a leading, global direct selling company with operations in 45 countries throughout Asia, the Americas and Europe. We develop and distribute premium quality, innovative personal care products and nutritional supplements sold worldwide under the Nu Skin and Pharmanex brands. We also market technology-related products and services under the Big Planet brand. We operate using a direct selling model in all of our markets with the exception of Mainland China (hereinafter “China”). In China, we implemented a retail business model with employed sales representatives because of regulatory restrictions on direct selling. However, we are in the process of integrating direct selling into our business model in this market pursuant to recently enacted direct selling regulations. We are a leading direct selling company posting 2006 revenue of $1.12 billion. As of December 31, 2006, we had a global network of approximately 761,000 active independent distributors, sales representatives, and preferred customers, approximately 30,000 of whom were executive level distributors or full-time sales representatives. Our executive level distributors and full-time sales representatives play an important leadership role in our distribution network and are critical to the growth and profitability of our business. We recognized approximately 87% of our revenue in markets outside the United States in 2006. Our Japanese operations accounted for approximately 43% of our 2006 total revenue. This market’s contribution to our overall revenue, as a percentage of revenue, is lower when compared to prior years because of growth in other markets and general business softness in Japan the past few years. Due to the size of our foreign operations, our results can be, and often are, impacted positively or negatively by foreign currency fluctuations, particularly in Japan and other Asian markets, as well as economic, political and business conditions around the world. -1- We develop and market branded consumer products that we believe are well suited for direct selling. Our distributors market and sell our products by educating consumers about the benefits and distinguishing characteristics of our products and by offering personalized customer service. Through dedicated research and development, we continually develop and introduce new products that enhance our existing line of products to provide our distributors with a differentiated product portfolio. We believe that we are able to attract and motivate high-caliber independent distributors because of our focus on product innovation, our attractive global compensation plan and our advanced technological distributor support. Our business is subject to various laws and regulations throughout the world, in particular with respect to network marketing activities and nutritional supplements. This creates certain risks for our business, including regulation regarding improper activities by our distributors or any inability to obtain necessary product registrations. Key to our future success is revenue growth within our markets, particularly those that are new and developing. During the past year, we expanded operations into three new markets including Russia, Romania and Costa Rica. Kansas has a law on the books that needs to be updated and strengthened. SB 2231 will also draw a clear line of distinction between legitimate direct selling opportunities in Kansas and illegal pyramid schemes. Too often, pyramid schemes succeed because of the lack of clear laws defining them. Pyramid schemes continue to appear and re-invent themselves around the country despite the best efforts of the law enforcement community. SB 2231 will more clearly define illegal pyramid promotional schemes and help protect Kansans from becoming victims. The new law will also protect legitimate direct selling opportunities, such as those offered by Amway, Mary Kay, Avon, Nu Skin, Pampered Chef, Shaklee, Southwestern Advantage, Thirty-One Gifts, Tupperware and many other well-respected companies. Thousands of Kansans are independent distributors of these income-earning opportunities, supplementing their family incomes by selling quality products to family, friends, and neighbors, while interesting others to do the same. Amway alone has over 2,000 independent Kansas distributors, working to help their families. The line of distinction separating out their legal small businesses from illegal pyramid schemes must be clear and strong. What Pyramid Schemes Are: Pyramid schemes are illegal get-rich-quick schemes in which the main source of money comes from paying large recruiting fees – not from the sales of real product to real consumers.

Founded in Provo, Utah, in the United States, the company is based upon a multilevel marketing direct-selling model that employs independent contractors to sell personal care products and dietary supplements. The firm has gone on to become the seventh largest direct seller in the world, with 2013 revenue of over $4 billion. It has paid out more than $10 billion in commissions and sales incentives. Nu Skin has been recognized throughout the years for its innovative products and social responsibility initiatives, but it h as also faced some ethical and legal challenges. Today Nu Skin has a widespread global reach, operating in 53 international markets on five continents. In particular, China has become a lucrative market for Nu Skin’s direct-selling operations. Nu Skin’s Chinese sales force consists of more than 400,000 sales representatives and sales in China account for approximately 30 percent of Nu Skin’s revenue. Nu Skin has performed so well in China and other countries that CEO M. Truman Hunt has announced the company’s intention to increase its revenues to $10 billion by 2020. China is a critical market for reaching this goal. Despite Nu Skin’s rapid growth and success, allegations arose in China that could prove challenging to the company’s sales objectives in that country.
