Cory Library List of Accessions No 16 RHODES UNIVERSITY, GORY LIBRARY FOR HISTORICAL RESEARCH. LIST OP ACCESSIONS NO. 16. PERSONAL PAPIRS AND OTHER DOCUMENTS OP, OR RELATING TO THE RIGHT HON. SIR JOHN GORDON SPRIGG (1850 - 1915), PRIME MINISTER OP THE GAPE OP GOOD HOPE, 1873-81, 1886-90, 1896-98, 1900-04. GRAHAMS TOWN 1965, ACKNOWLEDGE MS N T The University Librarian wishes to record, most grateful thanks to the members of the Sprigg family for their decision to place this document collection on loan in the Cory Library for Historical Research, and in particular to Mr. J.G. Sprigg, Librarian of the Grahamstovm Library, for his most valuable assistance in assembling and listin g the documents, and for the foreword which follows. FOREWORD This "collection" is a chance survival* By far the greater part was discovered in a dilapidated and mildewed trunk in a tumble down woodshed at Cambridge., East London, a ft e r the death o f my Aunt Jessamy Sprigg. Double chance su rvival in fa c t, as I s t i l l have a vivid recollection of the fun my cousins, my sister and I had in tending the bonfire that seemed to go on fo r days in the back garden of Vredenburg, at Wynberg, Cape afte the death of my grandfather S ir Cordon Sprigg in 1915, and o f la t e r comments on the " fr ig h t fu l accumulation of papers" that had to be "cleared up and burnt." How this trunk with it s haphazard contents survived the burning w i l l always remain a mystery. To th is basic m aterial I have added . photographs, letters, press cuttings etc. which have come to me variou sly from my la te fa th er and Aunt Jessamy and from my Aunt Lucilla who lives at Betty’ s Bay. Like most of these "salvage" collections, the present one tells l i t t l e about the person concerned, but I have included what personal letters I could find, as wall as the notes made by the Rev. Ernest Baker in the early 1950*s with a view to compiling a biography of Sir Gordon.' Unfortunately Mr. Baker died before he had advanced far with the project. The Charles M ills letters (which were in the trunk) begin to build up a behind-the-scenes p ictu re of a ffa ir s between the governmeits in Cape Town and London. I t is a p ity that so many o f these le t t e r s perished in the bonfire, and sad to think that my childish hands played their part in this. It has always seemed to me to be a little odd that a man who, in the heyday o f the Cape Colony, from the granting o f responsible government in 1872 to the time o f Union 1910, was ca lled to the the position of premier no less than four times, should never theless have been so studiously ignored by the historians and biographers. Perhaps Sir Gordon really was a rather unimaginative plodder as is sometimes claimed, and he certainly was eclipsed by the glamour o f the contemporary names o f Rhodes, Jameson, Kruger, Barnato and oth ers, but why, in that case, put him at the head o f the state not once but four tim es, one of these times falling within the critical period of the South African War? oontd. /### conta. I would lik e to thank Dr. van der Riot o f holes U n iversity for his invaluable advice and. help in putting the collection together in the f i r s t p lace, and to thank both Dr. van der R iet and the staff of the Cory Library for thoroughly revising my rough preliminary work to bring it into line with the rest of the Cory Library material, and for bringing out this "List of Accessions No. 16", devoted to the c o lle c tio n . I have much pleasure, on behalf of the family, in handing th is c o lle c tio n to Rhodes U n iversity on permanent loan to the Cory Library, to be preserved 3°or the future, and to be made available tc those who bona fide arc seeking information. I hope that the material h re presented w ill be of some assistance to historical research in the general sense, but I cherish also the hope that, meagre as it is, this collection may stimulate someone more competent than I to go to wider sources, and to undertake the rather formidable task of making an assessment of a somewhat neglected character who was prominent in the later stages of the life of the old Cape Colo^/. We decided to begin with a map – a map that hopefully presents a broad picture of how far we’ve already come in Africa towards the goal of achieving a “digital information commons”, as well as providing some sense of how to grow it further. We have tried to chart the international, regional and national policies, players and movements that to some extent dictate the scope of the commons in Africa, and at the same time to outline some of the creative responses from people on the ground working towards the expansion of the commons in some way.

AR5502/19 In the matter between: SITHEMBISO SYDWELL KHUMALO APPELLANT and THE STATE RESPONDENT This judgment was handed down electronically by circulation to the parties’ representatives by email, and released to SAFLII. The date and time for hand down is deemed to be 10h00 on 5 November 2020. __________________________________________________________________ ORDER __________________________________________________________________ The following order shall issue: 1. The appellant’s appeal against his convictions and sentence is upheld. 2. The convictions and sentence are set aside. 3. The immediate release of the appellant is hereby ordered. __________________________________________________________________ JUDGMENT __________________________________________________________________ Steyn J (Jappie JP concurring): [1] This appeal was originally set down to be heard on 3 June 2020. The record was however incomplete and the matter was referred back to the court a quo for the 2 record to be reconstructed in accordance with the guidelines as laid down in S v Leslie1 and S v Zondi.2 [2] The matter returned to the high court on 19 August 2020 for hearing, however, the record was in a shoddy state and to make the matter worse, the order of Madondo DJP issued on 3 June 2020 was simply ignored. After a search through the papers attached to the record, an email was discovered purporting to be from the presiding regional magistrate. It states the following: ‘Please tell the parties that after perusing the court record I found that Appellant’s evidence is complete (sic) from pages 123-131 and not page 73. On page 73 no evidence is missing as the whole record starts at line 5.

  • ABSTRACT Title of Dissertation: ROYAL SUBJECTS
ABSTRACT Title of dissertation: ROYAL SUBJECTS, IMPERIAL CITIZENS: THE MAKING OF BRITISH IMPERIAL CULTURE, 1860- 1901 Charles Vincent Reed, Doctor of Philosophy, 2010 Dissertation directed by: Professor Richard Price Department of History ABSTRACT: The dissertation explores the development of global identities in the nineteenth-century British Empire through one particular device of colonial rule – the royal tour. Colonial officials and administrators sought to encourage loyalty and obedience on part of Queen Victoria’s subjects around the world through imperial spectacle and personal interaction with the queen’s children and grandchildren. The royal tour, I argue, created cultural spaces that both settlers of European descent and colonial people of color used to claim the rights and responsibilities of imperial citizenship. The dissertation, then, examines how the royal tours were imagined and used by different historical actors in Britain, southern Africa, New Zealand, and South Asia. My work builds on a growing historical literature about “imperial networks” and the cultures of empire. In particular, it aims to understand the British world as a complex field of cultural encounters, exchanges, and borrowings rather than a collection of unitary paths between Great Britain and its colonies. • R V MALAN (1901): POLITICS, JUSTICE and the SOUTH AFRICAN WAR, 1899-1902 1 Introduction1 2 FS Malan, Ons Land and the British Em
_______________________________________________________________ R v MALAN (1901): POLITICS, JUSTICE AND THE SOUTH AFRICAN WAR, 1899-1902 FA Mouton* 1 Introduction1 On 18 April 1901, in the midst of the South African War, Francois Stephanus Malan (1871-1941), a member of the Cape parliament and editor of Ons Land newspaper, was convicted in the Cape Supreme Court of the criminal libel of General John French and imprisoned for twelve months. The prosecutor, James Rose Innes (1855-1942), was a fellow member of parliament and the Attorney-General in the cabinet of Premier Sir Gordon Sprigg. He was one of the Cape Colony’s most respected politicians and would become one of South Africa’s greatest judges. That the trial left a lasting wound on Malan is clear from his published memoirs,2 and the authorised biography written by Bettie Cloete, his daughter.3 Both these publications argue that his treatment in court was unfair and the prison sentence unreasonable. Together father and daughter created a perception that Rose Innes was a pawn in a politically motivated abuse of the Colony’s legal system and that he was used to silence a troublesome critic of British imperial policy in South Africa and the methods used by the British army. By analysing the reasons for Malan’s prosecution, as well as by examining the court proceedings, this article will argue that Malan’s enduring anger and hurt, combined with the passage of time, distorted his memory of events, and that Rose Innes was unfairly accused of being part of a political trial to neutralise a critic of the British Empire.
