Agency Real Property Reports Required by Rsa 4 STATE OF NEW HAMPSHIRE AGENCY REAL PROPERTY REPORTS REQUIRED BY RSA 4:39-e FOR THE FISCAL YEAR ENDED JUNE 30, 2013 Revised through December 31, 2013 4:39-e Real Property Owned or Leased by State Agencies; Reporting Requirement. I. On or before July 1, 2013, and biennially thereafter, each state agency, as defined in RSA 21-G:5, III, shall make a report identifying all real property owned or leased by the agency. For each parcel owned by the agency, the report shall include any reversion provisions, conservation or other easements, lease arrangements with third parties, and any other agreement that may affect the future sale of the property. For each parcel leased by the agency, the report shall include the lease term. II. Each state agency shall file the report with the governor, the senate president, the speaker of the house of representatives, the chairperson of the senate capital budget committee, the chairperson of the house public works and highways committee, the chairperson of the long range capital planning and utilization committee established in RSA 17-M:1, and the commissioner of the department of administrative services. III. The commissioner of the department of administrative services shall develop a standard format for agencies to use in submitting the report required under this section. The form of the report shall not be considered a rule subject to the provisions of RSA 541-A. (Source. 2012, 254:1, eff. June 18, 2012.) Introduction and Notes In developing a standard format for all agencies to use in submitting the report required by RSA 4:39-e Administrative Services (DAS) staff have designed and constructed a central statewide database to receive, store, and maintain information on all real property assets owned or leased by the State of New Hampshire, and from which all agency reports will be generated. Time constraints and scarce resources over the past fiscal year have limited the capabilities of the database and the range of real property data that it can accommodate for this first set of reports, but with the sustained efforts of the DAS team and an enhanced commitment to data collection, compilation, quality, and updates from each and every agency the long term vision of a comprehensive statewide real property management database will eventually take shape. The result would be a powerful and valuable tool for more consolidated and effective real property asset reporting and management, long-term planning, and interagency coordination to be used by the legislature, the executive administration, and agencies alike. Notes on certain limitations of the 2013 reports: 1. The statute requires each agency to identify “all real property owned or leased by the agency” in its report. Time constraints, scarce resources, and a need for simplicity to maximize agency participation and compliance have conspired to limit this first set of reports to land and building assets only. 2. All data is presented as provided by the agency and has not been checked by DAS for accuracy, completeness, or consistency. However, DAS has been advised by several agencies that their lists of reported assets are incomplete, often due to technical issues presented by the disparate data storage media or formats that they employ. For example, the Department of Transportation has specifically indicated that its data excludes: sand/gravel pits, sand/salt sheds, storage sheds, railroad corridor land, and “Infrastructure properties used as the right of way for Roads, Bridges, Railroads, Rest Areas, Park and Ride or Turnpike Toll Operations that are either fully constructed or in Project Development.” Some agencies have provided incomplete information on their reported assets for similar technical reasons. 3. The statute requires each agency to report information on the status of title and all encumbrances for every single parcel of land owned by the agency. Presently most agencies neither track such information nor employ any staff who are fully qualified to research and/or interpret it. 4. Most agencies have not allocated sufficient personnel or other resources to achieve full compliance with the statute. The reasons for this appear to vary from a simple shortage of available personnel and resources to an endemic lack of understanding within the agency of the scope and complexity of the information required by the statute. 5. Some assets have been reported in whole or in part by more than one agency, signaling a need for better interagency coordination in real property asset management and reporting. 6. Despite two all-agency memoranda regarding RSA 4:39-e compliance that were distributed by DAS during the first half of the fiscal year and later direct efforts to encouraging individual agency participation, a few agencies failed to submit any data for inclusion in the database and are therefore omitted from the following reports.
