Ignorance is not &«ffi£«&£~ bliss to any side The Ohio Liquor Control Department uses the word "equitable." We'll use the word "backwards." The liquor control department thinks it is a privilege. We think it is a problem. Ralph DiBenedetto, co-owner of Sub-Me-Quick, is guilty of breaking one of the state liquor codes, according to the department and is subject to a suspension or revocation of his liquor license. The liquor control department is subject to blame. The whole issue revolves around a small point in the liquor codes. While it is legal to deliver beer, it is not legal to collect on delivery. The two statements seem to be illogical when put side by side. What is the purpose of delivery if one cannot collect at the point of delivery? That is the question DiBenedetto, along with a number of other establishments across the state which deliver beer, had never really bothered to ask. It seemed, and was, a dumb question. A better question is why the liquor control department, when issuing a permit allowing delivery, did not inform them of this technicality. "Permit holders are responsible for getting and knowing the liquor laws," Sue Hoffman of the state office said, in trying to answer. "It is part of the privilege and responsibility of holding a liquor license." That responsibility is almost impossible to fulfill. When we called lawyers to interpret this particular code, the answers were varied. While the ignorance of the law is never an excuse, it can be explained, v in this case, by the ignorance of the liquor control department.
