REPORT TO: ENVIRONMENTAL SERVICES COMMITTEE ON 3 AUGUST 2005

SUBJECT: TRAFFIC REGULATION ORDER - A942 AT STRATHLENE - 40 MPH SPEED LIMIT

1. Reason for Report

1.1 To invite the Committee to approve the following Traffic Regulation Order: –

"The Council (A942 to to Road at Strathlene – 40 mph Speed Limit) Order, 2005".

1.2 This report is submitted to Committee in terms of Section D (16) of the Council’s Administrative Scheme relating to Orders for the regulation of traffic.

2. Background

2.1 Members will recall that following consideration of the Environmental Services Committee on 23 March 2005 (paragraph 15 of the Minute refers) it was agreed to approve a proposal to revoke “The County Council of Banffshire (40 mph Speed Limit) Order 1974 in so far as it related to “Buckie – Findochty – Portknockie Road (A942) at Strathlene and introduce restrictions as detailed in Appendices A and B to that report.

2.2 Authority was granted to the Director of Environmental Services and the Chief Legal Officer to carry out the statutory process to promote the proposed Order.

2.3 The proposal was advertised in the Banffshire Advertiser on 31 May 2005 and no objections have been received in response to the statutory consultation.

3. The Proposals

3.1 The Committee are invited to approve "The Moray Council (A942 Buckie to Findochty to Portknockie Road at Strathlene - 40 mph Speed Limit) Order, 2005.

4. Financial Implications

4.1 The cost of implementing the Order will be met from the Road Safety Capital Plan 2005/2006.

5. Staffing Implications

5.1 There are no staffing implications arising from this report.

6. Environmental Implications

6.1 The speed restrictions to be introduced are designed to alert drivers to the change in the road environment and provide a safer environment for pedestrian and turning traffic.

7. Corporate Plan

7.1 The report encompasses the main aims of the economic development programme by maintaining suitable transport facilities and infrastructure for residents, visitors, business and workers

8. Sustainable Development Implications

8.1 Where feasible, the work will incorporate materials from a sustainable source and reuse or recycle existing materials. Special measures are taken to mitigate against the pollution and preserves in the natural environment as far as possible. Close liaison is maintained with outside agencies to promote good working and eco friendly policies of the Council. The work are usually carried out by local contractors, which supports local economy.

9. Consultations

9.1 The proposals were advertised and no objections were received.

9.2 The Local Member, Grampian Police, the Head of Financial Services and Principal Solicitor (Commercial and Conveyancing) have been consulted throughout this process and are in agreement with the proposals. ITEM: 12(d)

10. Recommendations

10.1 The Committee are invited to approve the undernoted Traffic Regulation Order and authorise the Chief Legal Officer to make the Order:-

"The Moray Council (A942 Buckie to Findochty to Portknockie Road at Strathlene – 40 mph Speed Limit) Order, 2005"
