REQUIREMENT LEGAL PROVISION Owing to the sensitivities peculiar to Peshawar Cantt, the President Section 42 of the Cantt Board Peshawar directed that Board meetings of Cantonment Cantonments Act, 1924 Board Peshawar may not be made open to public.

Before conducting with the business of Board meeting agenda, oath of office to the following nominated member(s) administered as required under section 18(1) of the Cantonments Act, 1924 (II of 1924), which is reproduced hereunder :-

“18. Oath of affirmation: (1) Every elected member, and every person who is by virtue of his office, or who is nominated to be a member of a Board shall, before taking his seat, make at a meeting of the Board an oath or affirmation of his allegiance in the following form, namely: -

ANNUAL ACCOUNTS

Requirement: To note Annual Accounts of Cantonment Board, Peshawar for the year 2018 – 19 as required under Rule – 41 of the Cantonment Accounts Code, 1955, which states that

“A copy of the annual account shall be laid before the Board for information and a copy thereof shall be posted on the Notice Board of the Cantonment Board”.

ITEM 3

ANNUAL ADMINISTRATION REPORT

Requirement To read and note the Annual Administration Report for the year 2018 – 2019 of Cantonment Board Peshawar.

Legal Provision Section 45-A of the Cantonments Act, 1924

Report on administration.- Every board shall, as soon as may be after the close of the year and not later than the date fixed in this behalf by the [Federal Government], submit to the [Federal Government] through the [Competent Authority], a report on the administration of the Cantonment during the preceding financial year, in such form and containing such details as the [Federal Government] may direct. The comments, if any, of the [Competent Authority], on such report shall be communicated by him to the Board which shall be allowed a reasonable time to furnish a reply thereto, and the comments together with the reply, if any, shall be forwarded to the [Federal Government] alongwith the report.]

RESOLUTION: The Board read & noted. The Annual Administration Report for the year 2018 – 2019 of Cantonment Board Peshawar be forwarded to the Competent Authority through proper channel.

ITEM 4

RE-IMBURSEMENT OF MEDICAL BILLS

Requirement To consider applications submitted by the following employees of CB Psc and report of Accountant, Cantt Board Peshawar regarding payment of on account of medical re-imbursement against their treatment on emergency basis duly recommended by the MS CGH, Psc.

Legal Provision In the light of the ML&C Deptt: letter No. 92/30/ADG(Est)/ML&C/81, dated 21-04-2011 the Board recommended the case and ML&C Deptt: will approve the re-imbursement of medical bills.

Budget Provision The Budget provision exists under Head F-1 (b) of the sanctioned Budget Estimates 2019-20.

RESOLUTION: The Board considered and approved the re-imbursement of medical bills as mentioned on agenda side. Sanction of the Competent Authority be obtained.

SANITATION BRANCH

ITEM 5

SANITARY REPORT

Requirement To read and note the monthly sanitary report for the month of August 2019.

Legal Provision: Section 129 of the Cantonments Act, 1924.

(1) The Health Officer shall exercise a general sanitary supervision over the whole cantonment, and shall submit monthly to the [Board] a report as to the sanitary condition of the cantonment, together with such recommendation in connection therewith as he thinks fit.

(2) The Assistant Health Officer shall perform such duties in connection with the sanitation of the cantonment as are, subject to the control of the 1 [Board], allotted to him by the Health Officer.

RESOLUTION: The Board read and noted. The Board resolved that the instructions/observations as contained in the Sanitary Report furnished by the Health Officer be complied with and steps should be taken for improvement of sanitary position of Cantt area.

The Board further resolved that in the wake of outbreak of dengue, fumigation be done twice a day.

ITEM 6

PAYMENT TO MEDICAL CONSULTANCY FIRM TO HELP OUT IN PROCUREMENT OF MEDICAL EQUIPMENT’S FOR CANTT GENERAL HOSPITAL, PESHAWAR.

Reference: CBR No.11 dated 31-1-2019 and CBR No. 19 dated 28-6-2019.

Requirement To consider approval for payment of Rs. 1.950 (m) to M/s Global Consultants for preparation of the feasibility report in two phases (i.e. Phase-I CGH @ Rs. 0.950 million, and Phase-II Medical College @ Rs. 1.00 million).

The Board vide CBR under reference approved the recommendations of the committee (constituted vide office order No.339 dated 25-02-2019 for evaluation of profiles/documents for hiring of consultancy services for establishing Medical & Dental College and Teaching Hospital in Peshawar Cantt as was earlier considered by the Board in its meeting held on 29 March 2019) regarding hiring of M/s Global Consultant as the Consultancy Firm for provision of Consultancy for enhancement of Cantonment General Hospital Peshawar & Medical & Dental College, Peshawar.

Accordingly decision of the Board was conveyed to M/s Global Consultants vide letter No.28/2/CGH/2019 dated 24-7-2019 and in response M/s Global Consultants vide letter dated 20-8-2019 requested for payment of Rs. 1.950 (m) for preparing of feasibility report of 300 pages to answer most of the questions and facilitate in the decision making. The Lahore Cantt Board has also paid Rs. 1.950 (m) for the feasibility report. Moreover, the firm also requested for additional visit charges of Rs. 30,000/- per visit to Peshawar and for preparing feasibility, the team will require between two to four Peshawar visits.

Payment of consultancy charges of Rs. 1.950 (m) for the feasibility report in two phases i.e. Phase I CGH @ Rs. 0.950 million, and Phase II Medical College @ Rs. 1.00 million; and Rs. 30,000/- per visit is recommended.

The Board vide CBR under reference approved monthly charges of the firm @ Rs. 150,000/-, however, after payment of consultancy charges, the said monthly charges will be withdrawn.

RESOLUTION: The Board considered and approved payment of consultancy charges of Rs. 1.950 (m) for the feasibility report in two phases i.e. Phase I CGH @ Rs. 0.950 million, and Phase II Medical College @ Rs. 1.00 million; and Rs. 30,000/- per visit is recommended.

REVISION OF RATES OF TRADE & PROFESSION TAX

Reference: CBR No. 32 dated 18-4-2002 and S.R.O. Notification No. 890(I)/2004 dated 12-10-2004.

Requirement To consider proposal of the Incharge Trade & Profession Tax & Revenue Superintendent, Cantonment Board Peshawar regarding revision of rates of Trade & Profession Tax levied by

the Board and duly notified vide S.R.O. Notification No. 890(I)/2004 dated 12-10-2004 under section 60 of the Cantonments Act, 1924 on all the persons in the Peshawar Cantonment, carrying on any one or more of the Trades, professions or calling specified in the schedule, at the rate specified in the corresponding entry in the third column of the schedule of the notification.

The tax levied in 2004 has not been revised / increased since then, and the trades are being charged very nominal i.e. Rs. 100/- to Rs. 500/- per annum, which requires to be revised / enhanced.

Requirements To consider the application dated 12-09-2019 submitted by the widow of Robin Darshin (Late) Ex: Dental Asstt: Cantt: General Hospital Peshawar, requesting therein for allotment of CB Flat No. 04 2nd floor CB Plaza “Number Plat” F. A Road Psc in the light of Assistance package as her children’s is studying in Peshawar.

Brief of the case It is submitted that Mr. Robin Darshin (Late) Ex: Dental Asstt: Cantt: General Hospital Peshawar died in service on 22-07-2019 (F/N) and struck off from the strength of Cantt Board Peshawar from the same date vide Office Order No .1185, dated 08-08-2019. He was allotted said Cantt Board Flat vide Office Order No.453, dated 11-05-2018, which is still in occupation of his legal heirs.

The family of the deceased requested for retention of official accommodation as per assistance package for families of Government employees who die in service as circulated vide Govt : of Pakistan , O.M No. 8/10/2013-E-2 (pt) dated 04-12-2015 received vide under RHQ letter No. 33/G/I/Rec/II/policy/DPR dated 13-01-2016 for revision of assistant package for families of Government employee who died in service “Retention of Government house or payment of rent of hired house till the age of superannuation”.

Brief of the case

 Several left over space in CB Plaza(s) including Cantt Plaza, Arbab Road was utilized by the Cantt Board and were auctioned.

 Out of which Flat No. 2 (Ground Floor) (Reserved for lift space i.e. 8 X 6) situated at CB Plaza, Arbab Road, Peshawar Cantonment was rented out to Muhammad Suleman on premium basis after getting highest bid i.e. Rs. 14,05,000/- in a auction held on 27-10-2007.

 The case was placed before the Board and the same was approved by the Board vide CBR No. 10, dated 10-11-2007. The possession of the “Lift space” was taken over by the Cantt Board in the year 2013-14 so as to construct lift at the site to the upper floor i.e. two Halls. However, the applicant is paying rent of the Lift space regularly and there are no dues outstanding against the Lift space upto 30-06-2018.

 The applicant now vide his application under references is requesting therein to allot an alternate shop (space) as per site plan / map attached with application i.e. site adjacent to applicant’s shop. The request of the tenant was referred to field technical staff i.e. SD’Man for site verification/demarcation so that further action regarding allotment of alternate space in lieu of shop acquired by this office as per site suggested by the applicant vide site plan attached with application under reference. The site was visited by the field staff alongwith officials concerned and it was revealed that an open space lying vacant since long in the said plaza area measuring 212 Sft (12.83 x 16.50) and suitable for construction of shop.

The detail of premium as calculated in the light of Department letter No. 40/8/F&B/ML&C/2003 dated 09-08-2019 is as under:-

AMENDMENT OF ARV UNDER SECTION 71(c) OF CANTT ACT 1924 IN RESPECT OF PROPERTY NO.26-A, SADDAR ROAD PESHAWAR CANTONMENT

Requirements To consider the application dated 07-08-2019 submitted by Memona Yousaf, 26-A Saddar Road Peshawar Cantonment, regarding revision of assessment of subject property in the light of Section 71(c) of the Cantonments Act, 1924.

The assessment of the subject property was proposed @ Rs. 13,19,556/- P.A as per CBR No.11 dated 10-3-2017 for the triennial period 2016-19.

Subsequently the Board vide CBR No.17 dated 30-5-2019 grant remission of house tax of Rs. 1,50,000/- to the said property.

Later on the applicant produced rent agreement (renewed) of the said property and requested for revision of assessment as required under section 71(c) of the Cantonments Act, 1924. As per rent agreement the ARV of the property for the period under consideration comes to Rs.669,240/- P.A instead of Rs. 13,19,556/- P.A. likewise the amount to be remitted comes to Rs. 164,246/- out of which Rs. 150,000/- has already been remitted.

RESOLUTION The Board considered the case. The Board resolved to grant remission of Rs. 323,841/- in payment of house tax for the period 1-7-2017 to 19-2-2019. However, the Board rejected the case of revision of assessment of the said period.

CLARIFICATION REGARDING BAN OF PREMIUM AUCTION VIDE TOUR/VISIT NOTES OF DG ML& C VISIT OF CIMLA ON 28TH NOV, 2018.

Requirements: To consider ML& C Deptt: letter No. 40/8/F&B/ML&C/2003 dated 09-08-2019 regarding clarification for calculation of premium for auction of Cantt Fund units and their respective monthly rent. The formulae as per letter cited above is as under: -

i) The existing system of disposal of commercial buildings including shops and flats i.e. auction of Premium with fixed amount of rent is upheld for all sort of normal / routine cases. However, formula for calculation of minimum premium may be calculated as elaborated in the following table: -

The HQ ML&C letter ibid also contain formula for calculation of premium, however perusal of the same revealed that rent of such properties be fixed at 50% or more of the market rates.

In the light of above directions, list of un-auction units alongwith market rates is place before the Board for imposition of monthly rent.

Reference: Station Headquarters, Psc letter No. 89/5/Gen/CB-9YHPDX, dated 31-07- 2019.

Requirement To consider the estimate amounting to Rs. 21.50 (M) for construction of Class-IV Quarters / Flats at Chhoti Lalkurti, Peshawar Cantonment.

History of the case  Existing Class-IV quarters are in very dangerous & dilapidated condition and required to be demolished.

 After site visit by the PCB/ Sta Com, the Station HQ Psc letter No. 89/5/Gen/CB- 9YHPDX, dated 31-07-2019 has directed to re-construct the said quarters on urgent basis.

 Accordingly estimate for re-construction of 1 x quarter was placed before the Board for consideration. The Board vide CBR No. 32, dated 29-08-2019 resolved that ground + 3 flats be constructed instead of single storey class IV quarter.

 Therefore an estimate amounting to Rs. 21.50 (M) for construction of Class-IV Flats (G+1) as Phase – I at Chhoti Lalkurti, Peshawar Cantonment has been proposed.

 The expenditure will be met out of Closing Balance of the Budget Estimates for the year 2019-20.

History of the case: The lessees vide application dated 23-05-2019 submitted regularization building plan in respect of property comprising Survey No. 454-Part & 455, Dabgari Garden, Peshawar Cantt.

Regularization building plan in respect of above property was placed before the Board for consideration. The Board vide CBR No. 22(1), dated 31-8-2018 approved the regularization building plan on payment of composition fee amounting to Rs. 15,60,543/-.

The lessees were intimated vide letter dated 20-12-2018 to deposit the composition fee alongwith other charges within 7 days.

In response hereof the lessees submitted application dated 24-12-2018 for payment of composition fee in easy monthly installments @ Rs. 1,00,000/- which was regretted vide CBP letter dated 27-06-2019 and directed them to deposit the composition fee within 3 days followed by reminder vide CBP letter dated 09-08-2019.

Now the lessees vide application dated 20-8-2019 again requested to allow them for payment of composition fee alongwith other charges in easy monthly installments.

Audit Objection: During the course of audit for the year 2018-19, the Audit Authorities vide OL No. 37 has objected non-recovery of composition fee amounting to Rs. 15,60,543/-.

Points to be considered: Whether to allow the lessees to deposit the composition fee & other charges amounting to Rs.16,58,322/- in easy installments or otherwise?

Since the status of land is not Class “C” but “B-4” under the management of MEO Peshawar Circle Peshawar, the case is to be forwarded to MEO Peshawar for re-classification of land.

MILITARY DAIRY FARM, COMPRISING SURVEY NO. 640, BARA ROAD, PESHAWAR CANTONMENT

Reference: Para 2(iv) of DD(HQ) ML&C Department letter No.35/72/Lands/ML&C/84 dated 05-3-1985 addressed to MEO Peshawar and copy endorsed to Qtg Dte, GHQ Rawalpindi.

Requirement To consider Para 2(iv) of DD(HQ) ML&C Department letter No.35/72/Lands/ML&C/84 dated 05-3-1985 addressed to MEO Peshawar and copy endorsed to Qtg Dte, GHQ Rawalpindi: -

(iv) The construction will be restricted to 3 stories only including ground floor. On the ground floor maximum two shops will be allowed to be constructed by the Cantt Board and on the 1st and 2nd floors offices-cum-shops and flats can be constructed.

Brief History a) Military Diary Farm land comprising Survey No. 640, Peshawar Cantt was disposed off in 1985. The terms and conditions regarding the above said disposal of land were decided in a meeting held in the office of QMG on 03-03-1985 wherein the Head of ML&C Deptt: was also present.

b) Subsequently, ML&C Deptt; vide letter dated 05-03-1985 conveyed the above said terms and condition regarding disposal of land comprising Survey No. 640, Peshawar Cantt to MEO Peshawar. As per para-2(iv) of the above said letter it was decided that:

“The construction will be restricted to 3 stories only including ground floor. On the ground floor maximum two shop will be allowed to be constructed and on the 1st and 2nd floors offices-cum-shops and flats can be constructed”

c) The restriction on construction beyond 03 stories was neither incorporated in public notice nor in Govt sanction letter dated 18-06-1985. Furthermore, no such condition was incorporated in any of the lease agreement. Therefore, the lessees of these plots constructed multi storied commercial building beyond three stories, which stand un-authorized in the light of restrictions imposed by the QMG.

CB Building Bye Laws It is pertinent to mention here that the CB Building Bye-laws duly notified, however, permit Basement + Ground Floor + 4 stories building in the vicinity.

Audit Objections a) The Audit authorities while conducting the audit of Cantt Board Peshawar raised the objections in different years which have converted into Draft Para and mostly led to Audit Paras out of which the audit have observed in DP-204 of 2009-10, that the lessees of some plots situated at Military Dairy Farm Scheme, Peshawar Cantt have constructed 03 & 05 floors un-authorizedly which needs to be compounded. The non-compounding is causing loss to Cantt Fund of Rs. 1,60,89,060/- (M) (calculated by the audit) which is due to non-finalization of composition fee.

b) The DAC in its meeting held on 27th and 28th Jan 2010 in Draft Para No. 204 of 2009-10, directed to take up the case with Ministry of Defence to consider relaxation for construction beyond 3rd Story. In the light of the DAC directives, the RHQ Peshawar has already forwarded the case to HQ ML&C Rwp, incorporating therein all details regarding subject matter, vide letter No. 33/G/518/Audit/DPR, dated 23-02-2010.

Factual Position a) Since the restriction on construction to 03 x storey was not included in the auction notice of subject land. Therefore, the lessee/auction purchasers of plot located in the subject Survey No. 640 Peshawar Cantt are not at fault

b) Had the lessees know that the commercial plot contain some conditions/restrictions for making only three stories then they might have reacted in the different way by offering lower bid or might not even had participated in the auction.

Follow up of the Case 1) In view of the above decision of DAC, the ML&C Deptt: vide U.O. No. 35/72/Lands/ML&C/84 dated 19-12-2013 requested to QMG’s Branch, Otg &Land Dte, GHQ Rawalpindi, followed by subsequent reminder vide U.O. No. 35/72/Lands/ML&C/84 dated 10-03-2014 and U.O. No. 2/18/DP/IE&P Section/ML&C/01 dated 11-06-2014, for relaxation in construction beyond 3 storeys.

2) Meanwhile, the MEO vide Letter No. CP-640/V dated 24th April 2014 addressed to Station Headquarters, Psc intimated that these 101 Commercial plots auctioned on 03-04-1985 by the MEO after publication in News Papers and approved of highest bid was accorded by Govt of Pak, Ministry of Defence for grant of lease in Sch-X (Modified) of the CLA Rules, 1937. However, restriction on construction beyond 03 stories was neither incorporated in public notice nor in Govt sanction even no such condition was incorporated in the lease agreement. MEO Psc also recommended that the exercising building control authority through notified building bye-laws rests with Cantt Board i.e. Peshawar Cantt Board and it should take steps to recover amount on account of un-authorized construction.

3) The Station Headquarters Psc vide letter No. 206/Lands/Gen Corres-46HP4N dated 11th June, 2014 forwarded the letter of MEO Psc No. CP- 640/V dated 24th April 2014 for implementation.

4) This office vide letter No. 21/480/Lands/89497, dated 22-10-2018 forwarded fresh case to DGML&C, Rawalpindi requested that this office may please be advised about regularization of un-authorized construction of above 3 stories by way of composition fee in the light of restriction of QMG’s Branch conveyed by the ML&C Deptt; vide letter dated 05-03-1985.

Way Forward It would be appropriate to ignore the restriction/condition imposed by QMG /GHQ Rawalpindi, so that: -

a) Audit objections may be settled b) Enable Cantonment Board Peshawar to recover a handsome amount on account of composition fee.

RESOLUTION The Board considered and discussed the matter at length. The Board resolved that a fresh detailed case be taken up with QMG’s Branch, Otg &Land Dte, GHQ Rawalpindi, through HQ 11 Corps, Peshawar Cantonment, for relaxation in condition regarding construction beyond 3 storeys, so that regularization of un-authorized construction of above 3 stories by way of composition fee can be allowed to settled the Audit Objections as well as to enable Cantonment Board Peshawar to recover a handsome amount on account of composition fee.

ITEM 50

PERMISSION FOR LAYING OF OVERHEAD FIBER OPTICS NETWORK ON ELECTRIC POLES BY M/S NAYATEL PVT LTD

Reference: CBR No. 21, dated 27-04-2019.

Requirement To consider application dated 24-09-2019 submitted by M/s Nayatel Pvt Ltd requesting therein for provision of NOC for 2nd Phase for laying overhead fiber optics network on electric poles in residential / commercial area.

History of the case  The Board vide CBR No. 21, dated 27-04-2019 was accorded permission to M/s Nayatel Pvt Ltd to deploy fiber optics network subject to the following conditions;

a) Provisional NOC be granted to the company for execution of work in phase wise.

b) NOC for phase – 1, be granted to the area of Defence colony for 14.3 kms road only.

c) Other phases will be allowed only after successful execution / completion of Phase – 1.

d) The company shall deposit an amount of Rs. 1,000,000/- as refundable security which will be retained till successful execution of the project.

e) The company shall restore the infrastructure in its original position and to the entire satisfaction of the Board.

 The company was informed vide CP letter No. 28/2/Road Cut/85218, dated 18-05- 2018 to complete the following formalities;

(i) To execute a contract agreement on non-judicial stamped paper of appropriate value.

(ii) To deposit ROW charges amounting to Rs. 1.70 (M) for one year in advance.

(i) To deposit an amount of Rs. 1,000,000/- as refundable security.

 After completion of the above mentioned formalities, NOC was granted to the company vide CBP letter No. 28/2/Road Cut/87269, dated 27-08-2018

ROW Charges Right of Way (ROW) calculated according to the rates approved by the Board vide CBR No. 23, dated 30-11-2017 are as under;

(a) Total Length = 42 KM = 137795 Foot (b) Approved Rate = Rs. 3/- per foot per month (c) Charges for one month = 137795 x 3 = Rs. 4,13,385/- (d) Charges for one year = 413385 x 12 = Rs. 49,60,620/-
